Abstract

It is argued in this article that a study on the law reform of a country is the study which related to understanding of a scientific paradigm which made up of the basic idea of a country’s legal system. The main argument in this article is that the basic idea ofma legalmrefom on a legal system must be build upon the enforcement of the juridical principles found and developed in the system. This is derived from a postulate of the Dignified Justice teory perspective.In this view legal virtues underpinning a legal system are examined together as one system of principles and rules or a legal system. Philosophically, or it is a theoretical and a paradigm that law is believed as inseparable from the legal science itself. This philosophy has been developed to make a correction to the sociological jurisprudence perspective, which mainly argued that each occurence of social changes in a legal system cannot be answered by regulation alone. The sociological jurisprudence point of view argues that law is confined to the status quo of a society. Many has argued that this sociological indicative has occurred in many civil law systems, in particular Indonesia, to be used as its best prototype. In the Indonesian legal system, law is positioned as rules and regulations made by the legislative branch of the government. In this perspective laws has been excluded from humanity almost altogether. This article argues that Pancasila as the Indonesia Legal System is the way to solve this problem. Since Pancasila is used as the basis of the State and the source of all legal sources. For this reason, it is interesting to examine how the Pancasila actually became a basis of values in initiating the project of law reform in Indonesia.

Abstract

Democracy need law supremacy that guarantee of equality, respect for human right, justice, protection, and respect for civil and political right in the frame of unity in diversity perspective. Nation perspective intent to be a culture in democracy and law as the institution of multicultural society. Democracy refuses destructive harmonization in the perspective of nation. Monoculturalism politic, domination, hegemony, radicalism, stereotype, discrimination, majority and minority dichotomy with support by law of sectarian are an anomaly of democracy in multiculturalization condition. The respect of dignity human being in law only can be built as long as no relation sectarianism in group ideology with politic af?iliation, and politics of recognition of multiculturalism according Pancasila as the source of source of law. In the frame of nation perspective, democracy will be characterized of law which agree with peace building. Revitalization of nation perspective can be done through dissemination of peace education in order to reach solidarity and tolerancy as the public awareness. Abstract

Problematika hukum dan sosial merupakan persoalan interaksi hukum dalam masyarakat.  Secara normatif, hukum ditetapkan sebagai ukuran dalam penyelesaian persoalan. Namun secara sosial, hukum mengalami persoalan dalam pemberlakukan sosiologis atau empirisnya dalam masyarakat . Sistem hukum adalah sistem sosial, oleh karenanya, persoalan represivitas hukum bisa  menuai resistensi dalam tatanan masyarakat, manakalah hukum itu dirasa tidak sesuai dengan kebutuhan masyarakat. Hukum membutuhkan nilai kesadaran hukum masyarakat sebagai salah satu modal sosial. Modal sosial perlu dibangun utnuk menjadi sinergitas dalam pemberlakuan hukum, tidak hanya secara pemberlakukan  juridis, namun juga secara pemberlakuan secara sosiologis yakni nilai kemanfaatan bagi masyarakat. Hasil penelitian teoretik ini menunjukkan bahwa penerapan kebijakan hukum pencegahan penyebaran Covid 19 melalui fungsionalisasi komponen lembaga dan pranata hukum juga harus didukung oleh komponen budaya hukum yang memuat modal sosial berupa  daya adaptasi dan pertumbuhan  kesadaran hukum masyarakat terhadap perubahan yang berlangsung. Hal ini berarti modal sosial yang dibangun adalah  membudayakan kesadaran hukum masyarakat termasuk pengembanan hukum dalam birokrasi untuk menegakkan hukum yang bukan hanya secara normatif, namun juga menginsersi secara kultural masyarakat. Harmonisasi antara hukum dan masyarakat akan menjadi modal sosial, yang mengarah pada jawaban atas problematika ketidaktaatan hukum masyarakat,  sehingga modal sosial mendukung efektivitas hukum. Modal sosial kuat akan menumbuhkan adaptasi sikap, integrasi sosial , pandangan serta common goal yang hendak dicapai masyarakat bersama yang mempengaruhi pelaksanaan hukum dalam kebijakan penghentian penyebaran Covid 19.  Modal sosial kuat akan memberikan kohesi sosial masyarakat, mutual understanding dan menumbuhkan shared value untuk pencapaian common goal untuk menjadikan implementasi kebijakan hukum pencegahan penyebaran Covid 19 lebih efektif.  Dengan demikian modal sosial yang kuat akan memasyarakatkan kebijakan hukum .

Abstract

Modern civilization dictates that the police have to adapt to a frame work of a modern police. In this research we argued that the Police should change from the traditional policing to a Dignified Justice Policing. In this perspective, based on the findings in the spirit of the people manifested throughout the existing rules and regulations relating to the community policing (CP) the police must always be able to develop the social defence system. In this scheme, the policy is obliged to serve and to protect the society; and in particular to create a concept of justice, in which human should be treated humane. In the modern concept of policing, the Police must have a close and built a strong cooperation or partnership with society. With a close and strong partnership with the society, the modern police would be able to overcome the threat of any criminalities, particularly the religious radicalism and extremism in its society. This is particularly relevant in the rescent times where religious radicalism is a concern within any societies. Efforts to find a strategy to pursue such an aim has been drawn to a new construction or legal ideas which in this work has been coined as the Dignified Justice philosophy. This paper will describe and analise the findings with the utilization of the Dignified Justice philosophy as an alternative policy to justify a close and strong cooperation between the police and society in an effort to combat or overcome criminalities in the society and simultaneously protect the society from dangerous elements in it. One of the concern that has drawn serious attention is the phenomenon of religious extremism in the community. Key words : Police, Society, Religous Radicalism.

Abstract

This research revealed the shift of political  law as a result  of  implementation  Act of Republic of Indonesia   No.17 of 2012 that reposition Act of Republic of Indonesia No.25of 1992. The implementation of Act of Republic of Indonesia No.17 of 2012 leaved crusial problem because of the lack of values ethic of cooperative. The crucial  problems in Act of  Republic of Indonesia No.17of 2012 related with the reduce of cooperative concept by  limited   as a legal entity. Beside that, the capital aspect   has potential to reduce the value of cooperative, the appointment of cooperative management of non members, and the power of supervisory board of cooperatice, and the distribution of  surplus operating results . The constitutional court with erga omnes character   canceled act of Republic of Indonesia No.17 of  2012 and  maked  transtitional to  re implement Act of Republic of Indonesia No 25 of 1992 as a focus in this research.

Abstract

Indonesia sebagai negara majemuk agama menghadapi tantangan untuk membangun relasi sosial yang harmonis.Politik identitas keragaman mereduksi kohesivitas aras nasional yang belum mapan sampai saat ini.Buruknya kohesi sosial pada masyarakat terbelah menjadi tanda problema konstitusional.Pertama refleksi terhadap apakah konsitusional memadai penciptaan masyarakat toleran, dan kedua apakah kultur berkonstitusi masyarakat bisa dibangun secara utuh dan luas.Kemajemukan masyarakat Indonesia dapat hidup koeksisten dalam Pancasila, konstitusi UUD RI 1945 dan amandemennya serta perundang-undangan yang ada. Point pentingnya adalah bagaimana supaya konsitusi menjadi suatu konsitusi yang hidup (the living constitution) bagi kehidupan bermasyarakat dan bernegara di Indonesia.Hukum seyogyanya juga mampu memenuhi suatu kebutuhan sosial yang dimaksud dengan tetap berperan sebagai “Human security”.

Abstract

Tata kelola koperasi yang tidak berbasis pada prinsip good cooperative governance berpotensi rmemunculkan dampak buruk bagi kesehatan koperasi dan kelangsungan pengembangan bagi koperasi yang seharusnya dipumpunkan pada upaya untuk mensejahterakan anggota. Kajian penelitian dilakukan dengan pendekatan juridis sosiologis. Hasil penelitian ini diharapkan memberikan kontribusi dalam merefleksi penatakelolaan koperasi di Kota Salatiga. Tatakelola Koperasi adalah kerangka kerja (framework) dalam bentuk peran (role), aturan (rule) dan pola keterhubungan (relationship) dari organ-organ Koperasi beserta dengan turunannya dalam mengarahkan dan mengendalikan usaha, untuk mewujudkan maksud dan tujuan Koperasi. Good coorporative governance didorong dari dua sisi, yaitu etika dan peraturan.

Abstract

Hakim dalam pelaksanaan tugasnya bukanlah semata sebagai mulut undang-undang (la bouche de la loi). Pekerjaan hakim adalah menafsirkan peristiwa hukum yang kongkrit dengan ketentuan hukum yang abtrak. Sejalan dengan pemahaman bahwa ilmu Hukum adalah sebuah eksemplar Hermeneutik in optima forma yang dipublikasikan pada aspek hukum kehidupan bermasyarakat, maka hakim dalam mengimplementasikan Ilmu Hukum untuk menyelesaikan suatu masalah hukum, melakukan kegiatan interpretasi yang tidak hanya dilakukan terhadap teks yuridis, melainkan juga terhadap kenyataan yang menimbulkan masalah hukum yang bersangkutan.Penafsiran hukum hakim yang bercita moral merupakan konsepsi dari law as interpretation/processes of interpreting, serta pada hukum sebagai nilai di mana dikonsepsikan Law as what ought to be in moral or ideal precepts. Artikel ini memberikan argumentasi bahwa membangun penafsiran hukum hakim berarti upaya melakukan pengembangan Ilmu Hukum hakim melalui pendekatan dinamis hermeneutika hukum yang mengakomodasi cita hukum dalam penafsiran hakim yang ”open mindedness”dan bermuatan humanistik dalam perspektif moral.

Abstract

This is a general policy in the form of restitution or compensation from the criminal to the victim of human trafficking crime which becomes a parameter of victim's right fulfilment. The weakness in its formulation leads to lack of firmness of its implementation. In this writing I will make a theoretical study related to restitution law structure for human trafficking victims. This research jurisdically studied about the non-clarity of the policies related to restitution. The method used in this research is law research assisted by library study & evaluation to restitution policy making in human trafficking law enforcement. This research is important because human trafficking is now becoming a trasnational crime which is well structured & sistematically arranged. Human trafficking gives great advantage to the criminal doing it. It is because the victims become a never ending commodity. Some considerations about restitution policy, have negated that human trafficking victims are vulnerable to have a secondary victimization risk. They come face to face with this risk when they deal with the operation of criminal laws, because the law has not fully accomodated the victim's right. That's why we need a legal form in having a victim based approach restitution.

Abstract

Victims of sexual violence often face numerous obstacles in accessing justice, including limited access to restitution mechanisms. Restitution is a form of compensation that victims can receive from perpetrators to recover the losses they have suffered. This paper aims to analyze how access to justice for female victims of sexual violence can be enhanced through restitution mechanisms. The method used is a literature review, examining relevant laws and regulations as well as the practice of implementing restitution in various countries. The analysis reveals that strengthening the implementation of restitution could improve access to justice for victims. This can be achieved by simplifying procedures, providing legal assistance, and enhancing coordination between related institutions, namely law enforcement and the Witness and Victim Protection Agency (LPSK). Additionally, efforts are needed to raise public awareness and increase the sensitivity of law enforcement officers to the issue of sexual violence. By doing so, victims can achieve proper recovery through both institutional and legal mechanisms that support victim protection.
