Abstract

Program nasional konversi minyak tanah ke LPG terlahir dari pemikiran sederhana seorang H. Muhammad Yusuf Kalla yang kala itu menjabat sebagai Wakil Presiden Republik Indonesia. Beliau mencermati besarnya beban subsidi yang harus ditanggung pemerintah, dimana sumber subsidi terbesar kita adalah pada minyak tanah dan listrik. Seiring dengan merangkak naiknya harga minyak tanah dunia, besarnya tanggungan subsidi pemerintah pun semakin membengkak, selain juga kenyataan yang ditemui di lapangan bahwa minyak bersubsidi ternyata sebagian besar justru tidak dirasakan masyarakat luas, namun sebagian besar minyak bersubsidi justru banyak disalah gunakan. Sebagian besar minyak tanah bersubsidi banyak yang dijual ke industri, dioplos ke jenis premium dan solar dan bahkan diselundupkan  ke luar negeri demi besarnya keuntungan karena besarnya disparitas harga minyak tanah bersubsidi dengan harga pasaran minyak tanah internasional. Penelitian ini bertujuan untuk mengetahui (1)  bagaimana implementasi kebijakan program konversi minyak tanah menuju LPG tersebut dijalankan di Kecamatan Banjarmasin Utara Kota Banjarmasin dan (2) untuk mengetahui dampak apa saja yang telah dapat dirasakan masyarakat dengan adanya program konversi minyak tanah ke LPG. Metode dalam penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian fenomenologis. Dalam penelitian ini data dikumpulkan dengan teknis observasi, wawancara dan studi dokumentasi. Lokasi penelitian di Kecamatan Banjarmasin Utara Kota Banjarmasin yang mencakup lima kelurahan, yaitu Kelurahan Alalak Utara, Alalak Tengah, Alalak Selatan, Kuin Utara dan Kelurahan Pangeran. Hasil penelitian ini menunjukkan bahwa program konversi minyak tanah ke LPG di Kota Banjarmasin, khususnya di Kecamatan Banjarmasin Utara sudah berjalan cukup baik. Keberhasilan terletak pada komunikasi atau sosialisasi yang sudah berjalan jauh sebelum program bergulir di Kota Banjarmasin berupa informasi dari pulau Jawa yang telah terlebih dahulu melaksanakan program konversi. Kendala terletak pada berita-berita negatif yang masih tersimpan di benak warga berupa peristiwa ledakan tabung gas beberapa waktu lalu di pulau Jawa serta para konsultan yang ditunjuk langsung dari Pusat dengan hanya sedikit melibatkan orang daerah, sehingga pada akhirnya mereka kurang maksimal ketika harus terjun  ke tengah masyarakat karena kurang mengenal medan serta kultur masyarakat sekitar. Disarankan demi suksesnya program ini di Kota Banjarmasin untuk terus melakukan pendekatan dan komunikasi yang baik dengan masyarakat mengenai alasan, manfaat dan dampaknya bagi masyarakat atas penggunaan energi gas LPG untuk keperluan memasak baik di rumah tangga maupun keperluan usaha mikro warga, disertai dengan peningkatan pelayanan dan infrastuktur serta untuk program-program lainnya yang akan diterapkan di Kota Banjarmasin sebaiknya lebih banyak melibatkan elemen lokal dari daerah yang lebih banyak mengetahui mengenai kondisi dan kultur masyarakat Banjar.   Kata Kunci: Implementasi Kebijakan, Konversi, LPG

Abstract

AbstrakPenyelenggaraan pendidikan inklusif di Indonesia telah didukung dengan banyaknya landasan yuridis yang menjadi dasar dalam proses implementasi. Hal ini menunjukkan besarnya dukungan masyarakat terhadap kebijakan tersebut. Proses perumusan sebuah kebijakan  akan mempengaruhi berjalannya proses penerapan kebijakan tersebut. Pada implemetasinya, masih terdapat faktor penghambat yang disebabkan oleh masalah komunikasi kebijakan pendidikan inklusif. Berdasarkan hal tersebut, penelitian ini bertujuan untuk mengetahui pola komunikasi kebijakan inklusif yang diterapkan pada enam sekolah inklusif di kawasan bantaran Sungai Martapura Provinsi Kalimantan Selatan. Metode dalam penelitian ini adalah kualitatif dengan jenis deskriptif. Hasil penelitian menunjukkan bahwa pelaksana kebijakan telah memahami tujuan pendidikan inklusif dan terdapat faktor pendukung dalam pelaksanaan pendidikan inklusif. Pada sisi lain, pelaksanaan pendidikan inklusif masih diiringi dengan kurangnya penerimaan guru terhadap keberadaan ABK, masih ditemukannya faktor penghambat pendidikan inklusif seperti kurangnya sarana dan prasarana, perbedaan penliaian antar pelaksana kebijakan mengenai pendidikan inklusif yang diterapkan serta kurangnya komunikasi dan kerjasama antara kepala sekolah, guru dan GPK dalam melayani kebutuhan ABK. AbstractThe implementation of inclusive education in Indonesia has been supported by many juridical foundations that form the basis for the implementation process. This result shows a high support from the people of the policy. Process of policy formulation will affect the implementation of this policy. In its implementation, there are still inhibiting factors caused by communication problems on inclusive education policies. Based on this, this study aims to find the pattern of inclusive policy communication that is applied to six inclusive schools in the Martapura Riverbank area, South Kalimantan Province. The method in this research is qualitative with descriptive type. The results showed that policy implementors understood the goals of inclusive education and there were supporting factors in the implementation of inclusive education. On the other hand, the implementation of inclusive education is still accompanied by a lack of teacher acceptance of existing of children with special needs, the discovery of factors inhibiting inclusive education such as lack of facilities and infrastructure, differences in assessment among policy implementors of applied inclusive education, and a lack of communication and coöperation between school principals and teachers. and shadow teachers in serving the needs of children with special needs.

Abstract

This article analyzes normative issues in various laws and regulations governing the handling of freedom of peaceful assembly. The formulations of the problems analyzed in this article are: first, whether the regulation and limitation of the right to peaceful assembly in Indonesia are in line with international human rights ideals. Second, how are the arrangements and restrictions on the right of assembly from other countries, which can provide constructive input on the norms for regulating and limiting the freedom of peaceful assembly in Indonesia? This article uses normative legal research and a comparative approach to constitutional law, by looking at concepts and practices from other countries. The conclusions of this study are: first, the regulation and restriction of the freedom of peaceful assembly is still far from the ideal of international human rights. There are still ambivalent and discriminatory arrangements. Second, the conclusion from the results of the comparative study found that there are many variants of gathering activities that are not accommodated by Indonesian legislation, such as: sudden gatherings, continuous and scheduled gatherings, and reciprocal gatherings.

Abstract

Due to this continuing and wide-spreading COVID-19 pandemic, the 2020 election processes of the head of governments have been adapting, particularly the campaign processes. This study analysis the utilization of social media in campaign advertisements by candidates of the 2020 Election of the Mayor of Banjarmasin. Research type and approach is descriptive-qualitative. Key informants were mayor candidates both the incumbent and challengers. Additional informants were officers at the Local Election Commission (KPU Banjarmasin) and the Election Surveillance Agency (Bawaslu Banjarmasin). Data obtained from observation, interview and important documents. The research findings showcase that each candidateshave utilized several platform of social media. They reached their followers/voters through          Instagram, Facebook, YouTube and Twitter. Instagram was the most used platform. The candidates often shared photos and videos with caption and hastag, commented on comments and Direct Message (DM), and used IG Story and IG TV to reach out their followers. They often also searched and explored the potential persons or teams to be recruited as campaign team through social media. And also, they used social media to investigate their competitors’ activities.

Abstract

AbstractThis paper aims to scrutinize the issue relating to the relationship between state and religion which tend to be problematic. Religion is believed to be one of the most important moral-transcendental forces in society. However, in the setting of modern world, the government is also required to carry out its administrative activities in a neutral, non-discriminatory manner and free from certain religious majority biases. In other words, the government can neither privilege one religion, especially the majority one nor discriminate the minority one. This is a socio-legal research which addresses problems through inter-disciplinary approaches. Libertarian political theories will be presented to complement legal and human rights theories related to religious and state relations. The texts in the legislation are seen through their socio-political meaning and purpose by pre-text-text-context analysis. This writing offers secularity options which are inclusive models of secularism. Ideally, the state is in a neutral position in public space, where the state may not be too active in regulating the religious aspects of the majority religion, except in the ihktiar to maintain legal pluralism and affirmative action for vulnerable groups. AbstrakTulisan ini bertujuan untuk mengurai permasalahan terkait relasi agama dengan negara yang cenderung problematik. Agama dipercaya sebagai salah satu kekuatan moral-transendental penting dalam bermasyarakat, namun pemerintah juga dituntut untuk menjalankan kegiatan administratifnya secara netral, non-diskriminatif dan terbebas dari bias mayoritas keagamaan tertentu. Pendekatan penelitian yang digunakan adalah socio-legal yang mencandra permasalahan lewat pendekatan inter-disipliner; teori-teori politik libertarian akan dipaparkan untuk melengkapi teori-teori hukum dan HAM terkait relasi agama dan negara. Teks-teks dalam perundang-undangan dicari makna dan tujuan sosio-politiknya, lewat analisa pre-text – text – context.Tulisan ini menawarkan opsi sekularitas yang merupakan model inklusif dari sekularisme.Idealnya, negara berada dalam posisi netral dalam ruang publik, dimana negara tidak boleh terlalu aktif mengatur aspek-aspek keagamaan pemeluk agama mayoritas, kecuali dalam ihktiar untuk menjaga pluralisme hukum dan affirmative action bagi kalangan rentan.

Abstract

Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional (ATR/BPN) merupakan lembaga pemerintahan non Kementerian yang ditunjuk untuk melaksanakan tugas pemerintahan di bidang pertanahan di Indonesia. Praktik Kerja Lapangan (PKL) di Kantor Wilayah ATR/BPN Provinsi Kalimantan Selatan merupakan bagian dari praktik perkuliahan yang diikuti sebanyak 77 perwakilan mahasiswa Prodi Ilmu Pemerintahan FISIP ULM yang dilaksanakan pada tanggal 22 Desember 2022, dibagi dalam 3 tahapan yaitu tahap persiapan meliputi kordinasi kegiatan dengan pihak Kantor Wilayah ATR/BPN Provinsi Kalimantan Selatan. Tahapan pelaksanaan dengan dilaksanakannya sosialisasi oleh Kantor Wilayah ATR/BPN Provinsi Kalimantan Selatan dengan Lecture Method, diskusi dan tanya jawab. Materi yang disampaikan terkait peran, fungsi dan tugas ATR/BPN dalam melaksanakan tugas pemerintah di bidang pertanahan. Tahap terakhir adalah evaluasi kegiatan untuk mengukur keberhasilan kegiatan pengabdian dan mendapatkan feedback atas kegiatan. Adapun hasil yang didapatkan setelah PKL ini dilaksanakan, para mahasiswa pengambil mata kuliah Politik Hukum Agraria telah mengetahui dan memahami terkait peran, fungsi dan tugas ATR/BPN dalam menjalankan tugas pemerintahan di bidang pertanahan sesuai ketentuan peraturan perundang-undangan, sehingga dapat membantu sosialisasi kepada masyarakat dan mengurangi potensi timbulnya kesalahpahaman terhadap peran, fungsi dan tugas dari lembaga ATR/BPN sekaligus mengurangi potensi konflik pertanahan di Indonesia.The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) is a non-ministerial government agency appointed to carry out government duties in the land sector in Indonesia. Fieldwork practice at the ATR/BPN Regional Office of South Kalimantan Province is part of the lecture practice which was attended by 77 representatives of Government Science study program students of FISIP ULM, which was carried out in 3 stages, namely the preparation stage including coordination of activities with the ATR / BPN Regional Office of South Kalimantan Province. The implementation stage with the implementation of socialization by the Regional Office of ATR /BPN of South Kalimantan Province with lecture, discussion, and question-and-answer methods. The material presented is related to the role, function, and duties of ATR/BPN in carrying out government duties in the land sector. The last stage is the evaluation of activities to measure the success of service activities and get feedback on activities. As for the results obtained after this fieldwork practice was carried out, students taking Agrarian Law Politics courses already know and understand the roles, functions, and duties of ATR/BPN in carrying out government duties in the land sector in accordance with statutory provisions, so that they can help socialize to the community and reduce the potential for misunderstanding of the roles, functions, and duties of ATR/BPN institutions while reducing the potential for land conflicts in Indonesia.

Abstract

Affirmative action is a program that promotes equal and equitable representation for the involvement and inclusion of women in politics and governance, based on the recognition that women’s rights are part of broader human rights. This study's objective is to thoroughly examine the practical use of affirmative action in national and regional political spheres, with a particular emphasis on Southern Kalimantan, which exhibits both patriarchal cultural idiosyncrasies and societal openness. Moreover, the study examines whether providing focused political education to female cadres within the established political party structure can increase women’s representation. This study selects samples from five branches of the DPD/DPW of prominent political parties identified as the top five vote-getters in the 2019 elections in South Kalimantan. The use of institutional theory is encompassed within the analytical approach. Utilizing a descriptive qualitative methodology, the process of selecting study participants involves purposive sampling, which includes primary and secondary data sources. The results of this study significantly contribute to the support and validation of affirmative action policies and improve access to women's representation by emphasizing the importance of institutional aspects inside political parties. Promoting political education for women cadres directly fulfills fundamental elements of women’s political and human rights. This effort requires the courage and generosity of political parties to advocate for special political education to be included in the party’s constitution as a formal legal basis and a long-term commitment to upholding affirmative action as a social obligation of political parties.
