Abstract

Lalu lintas merupakan salah satu sarana komunikasi masyarakat yang memegang peranan vital dalam memperlancar pembangunan bangsa. Salah satu hal yang dihadapi dalam lalu lintas adalah kecelakaan. Permasalahan ini pada umumnya terjadi ketika sarana transportasi, baik dari segi jalan, kendaraan, dan sarana pendukung lainnya belum mampu mengimbangi perkembangan yang ada di masyarakat. Adapun tujuan penelitian ini adalah menganalisis sebab-sebab terjadinya kecelakaan serta kajian upaya perbaikan dalam pencegahan lalu lintas di wilayah hukum Kepolisian Daerah Jawa Timur (Polda Jatim). Metode penelitian yang digunakan yaitu dengan pendekatan yuridis empiris, dengan data primer dan sekunder, dan analisa secara kualitatif dan disajikan secara deskriptif. Penelitian dilakukan di Polda Jatim dan beberapa Polres-Polres diantaranya, Polrestabes Surabaya, Polresta Sidoarjo, Polres Gresik, KP3 Tanjung Perak, Polres Batu, Polres Malang, Polres Pasuruan, dan Polres Probolinggo. Teori yang digunakan dalam penelitian ini adalah Teori Interaksionis dan Teori Kepatuhan Hukum. Hasil dalam penelitian ini, bahwa ada 5 (lima) faktor penyebab kecelakaan lalu lintas Khususnya di wilayah hukum Polda Jatim adalah: Adanya Faktor Kesalahan Manusia, Faktor Pengemudi, Faktor Jalan, Faktor Kendaraan Bermotor, dan Faktor Alam. Upaya perbaikan dalam pencegahan kecelakaan lalu lintas dengan dua cara yakni cara preemtif dan cara preventif.Traffic is one means of community communication that plays a vital role in expediting the nation’s development. One of the things faced in Traffic is an accident. This problem generally occurs when the means of transportation, both in terms of roads, vehicles, and other supporting facilities have not been able to keep up with the existing developments in the community. The purpose of this study are: to analyze the causes of accidents and study efforts to improve the prevention of traffic in the jurisdiction of POLDA East Java. The research method used is empirical juridical approach, with primary and secondary data, and qualitative analysis and presented descriptively. The research was conducted at POLDA JATIM and several POLRES-POLRES among others, Polrestabes Surabaya, Police Sidoarjo, Gresik Police, KP3 Tanjung Perak, Polres Batu, Polres Malang, Pasuruan Police, and Polres Probolinggo. The theory used in this research is Interactionist Theory and legal compliance theory. The results of this research are 5 factors causing traffic accidents Especially in jurisdiction of POLDA JATIM are: Existence of Human Error Factor, Driving Factor, Road Factor, Motor Vehicle Factor, and Natural Factor. Improvement efforts in the prevention of traffic accidents in two ways namely preemptive and preventive ways.

Abstract

Dalam KUHP tidak satu pasal pun yang menjelaskan batasan atau pengertian euthanasia. Namun demikian, pengenaan terhadap euthanasia dianalogikan dengan delik-delik yang tercantum dalam pasal 338, 340, 344 KUHP. Dengan dasar itulah maka pelaksanaan euthanasia dilarang. Larangan euthanasia pasif tidak pernah efektif karena kematian sebagai akibat ketidakmampuan ilmu dan teknologi kedokteran, dipandang sebagai kematian alamiah, sedangkan terhadap kematian alamiah tentu saja tidak ditahan-tahan atau dilarang hukum pidana maupun kode etik kedokteran. Hukum pidana dan kode etik kedokteran, tidak mewajibkan dokter untuk mengobati pasien di Iuar batas kemampuan ilmu dan teknologi kedokteran. berdasarkan penerapan karakteristik delik omisionis terbukti bahwa, larangan euthanasia pasif tidak memenuhi kriteria untuk diterapkan sebagai perbuatan pidana. Dalam hal terjadinya euthanasia pasif, walaupun dokter melakukan perbuatan positif, secara logika, kematian pasien tidak dapat dihindari. Dengan demikian sulit untuk dibuktikan adanya hubungan kausal antara akibat yang dilarang timbulnya dengan kelakuan negatif dokter.

Abstract

Pembinaan narapidana berdasarkan Undang-Undang Nomor 12 Tahun 1995 tentang Pemasyarakatan. Terdapat beberapa tujuan pelaksanaan pembinaan narapidana di Lembaga Pemasyarakatan. Pertama adalah memberikan pengalaman dan keterampilan. Kemudian mengembalikan kemampuan dan motivasi para narapidana. Agar tujuan tersebut bisa terlaksana terdapat beberapa faktor yang perlu untuk diperhatikan yakni: Narapidana, Petugas Lembaga Pemasyarakatan, dan Masyarakat.The prisoners development based on Act Number 12 Tahun 1995 pertaining correction. There are several purposes of the prisoners development in prison. First is that to provide experiences and skills. Then to return the ability of prisoners and their motivation. In order the mentioned goals can be achieved, there are some factors that to be consider are: Prisoners, The officers of Prison, and Society.

Abstract

Remisi merupakan hak narapidana untuk mendapatkan pengurangan pidana apabila selama menjalani pembinaan berkelakuan baik. Remisi yang merupakan hak narapidana dapat ditambah apabila yang bersangkutan melakukan perbuatan-perbuatan antara lain: Berbuat jasa kepada negara, dan Melakukan perbuatan yang bermanfaat bagi negara atau kemanusiaan, serta Melakukan perbuatan yang membantu kegiatan Lembaga Pemasyarakatan. Pengaturan remisi ada dalam beberapa peraturan yaitu: Keputusan Presiden No. 174 Tahun 1999 tentang Remisi; Keputusan Menteri Hukum dan Perundang-undangan RI No. M.09.HN.02.01 Tahun 1999 tentang Pelaksanaan Keputusan Presiden No. 174 Tahun 1999; Keputusan Menteri Hukum dan Perundang-Undangan No. M.10.HN.02.01 Tahun 1999 tentang Pelimpahan Wewenang Pemberian Remisi Khusus; Keputusan Presiden No. 120 Tahun 1995 tentang Ampunan Istimewa; Keputusan Menteri Kehakiman RI No. 04.HN.02.01 Tahun 1988 tentang Tambahan Remisi bagi Narapidana yang Menjadi Donor Organ Tubuh dan Donor Darah; Surat Edaran No. E.PS.01-03-15 tanggal 26 Mei 2000 tentang Perubahan Pidana Penjara Seumur Hidup Menjadi Pidana Penjara Sementara; dan Peraturan Pemerintah No. 99 Tahun 2012 tentang Perubahan Kedua atas Peraturan Pemerintah No. 32 Tahun 1999 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan. Pelaksanaan remisi terhadap narapidana diawali dari permohonan Kepala Lembaga Pemasyarakatan kepada Kepala Kantor Wilayah Kementerian Hukum dan HAM terhadap narapidana yang layak mendapatkan remisi berdasarkan hasil pembinaan terhadap narapidana. Keputusan remisi yang diberikan oleh Kepala Kanwil Hukum dan HAM didasarkan atas laporan Kepala Lembaga pemasyarakatan dan Undang-Undang No. 12 Tahun 1995 tentang Pemasyarakatan dan PP No. 99 Tahun 2012.Remission is the right of inmates to get a reduction in crime when undergoing training during good behavior. Remission is the right of prisoners could be increased if the relevant deeds among others: Doing services to the state, and doing deeds that are beneficial to the country or humanity, as well as Perform the action that helps the activities Penitentiary. Remission arrangements in some of the rules are: Presidential Decree No. 174 year1999 concerning Remission; Minister of Law and Legislation Decree No. M.09.HN.02.01 year 1999 on the Implementation of Presidential Decree No. 174 of 1999; Minister of Law and Legislation Decree Number M.10.HN.02.01 year 1999 on Delegation of Authority granting Special Remission; Presidential Decree No. 120 year 1995 concerning the Special Forgiveness; Minister of Justice Decree No. 1988 on Additional 04.HN.02.01 Remission for prisoners Become Organ Donors and Blood; Circular Number E.PS.01-03-15 May 26 year 2000 on the Amendment of Criminal Life Imprisonment While Being Criminal Prison; and Government Regulation No. 99 Year 2012 regarding the Second Amendment to Government Regulation No. 32 Year1999 on Conditions and Procedures for the Implementation of the Right prisoners. Implementation of the remission of prisoners begins on the petition the Head of Penitentiary to the Head Office of the Ministry of Justice and Human Rights of prisoners are eligible for remission based on the guidance to the inmates. Decision remissions granted by the Head of Department of Law and Human Rights based on the reports of correctional and Head of the Institute of Law No. 12 Year 1995 on Penal and PP 99 Year 2012.

Abstract

Seiring perkembangan teknologi saat ini menimbulkan dampak positif dan dampak negatif. Hukum selalu tertinggal satu langkah. Acap kali tindak pidana pencucian uang dilakukan dengan berbagai macam cara dan juga celah yang di iringi dengan kemajuan teknologi. Dalam hal ini menjadi catatan tersendiri bagi aparat penegak hukum dalam pembuktian tindak pidana korupsi tidak hanya mengandalkan alat bukti kuno, melainkan dapat meleburkan teknologi sehingga dapat diperoleh alat bukti digital. Masalah yang mendasari peran alat bukti digital dalam kasus pidana pencucian uang, antara lain: (1) Bagaimana Alat Bukti Digital di atur dalam hukum di Indonesia? (2) Bagaimana kedudukan alat bukti digital dalam hukum pembuktian tindak pidana pencucian uang? (3) Bagaimana peran dari alat bukti digital dalam kasus tindak pidana pencucian uang? Metode penelitian yang digunakan adalah deskriptif normatif. Hasil penelitian menyimpulkan bahwa: (1) Indonesia belum memiliki undang-undang yang mengatur tentang alat bukti digital. (2) Kedudukan alat bukti digital ini dianggap sah dan diatur dalam peraturan perundang-undangan kecuali pada Kitab Undang-Undang Hukum Acara Pidana. (3) Peran alat bukti digital dalam kasus tindak pidana pencucian uang sebagai petunjuk yang sah dalam pembuktian.

Abstract

Based on data released by the Ministry of Women's Empowerment and Child Protection of the Republic of Indonesia (Kemenpppa), the number of cases of Domestic Violence (KDRT) that occurred in Indonesia throughout 2020 was still very high. East Java ranks second highest after Central Java as the province with the most domestic violence cases throughout 2020, with 1,588 cases. This figure is obtained from the number of cases of domestic violence reported in all cities in East Java. Efforts to reduce the incidence of domestic violence are not enough just to take repressive actions against perpetrators of domestic violence. What is more important is preventive action to prevent the occurrence of domestic violence. One of the causes of domestic violence can occur is the lack of public knowledge about what is meant by domestic violence. Because there are still many cases of domestic violence that occur during this Covid-19 Pandemic. This is where the role of universities is expected to be able to provide knowledge to the community, not only for women or children, but also for men. One of the things that universities can do in providing knowledge to the community regarding domestic violence is by conducting socialization and legal counseling. The role of legal counseling can provide increased legal knowledge to community members in order to avoid violations of the law, especially Law Number 23 of 2004 concerning the Elimination of Domestic Violence. Another benefit of legal counseling is that the community can play an active role directly with other communities to transmit or relay the relay to other members of the community such as within the family, neighbors, in the neighborhood associations and neighborhood associations in the East Java region. Abstract

The presence of a child born outside of marriage raises various issues both within families and society, particularly regarding the rights and obligations of the child. A child born out of wedlock may not solely result from an illicit relationship; it can also occur when a marriage is conducted only according to customary law without being officially registered. According to Article 80 of the Civil Code, prior to the Marriage Law, marriage must be performed in front of a Civil Registry official. Article 81 stipulates that religious ceremonies must occur after the civil registration. This research aims to analyze the implementation of birth registration regulations for children born out of wedlock based on Islamic justice, identify weaknesses in issuing birth certificates without a marriage certificate, and reconstruct these regulations in alignment with Islamic values. The research employs a constructivist paradigm, using a sociological-legal approach and various data collection methods. Findings indicate that the implementation of birth registration for children born out of wedlock lacks fairness, necessitating protection to ensure equal treatment with other children. Current regulations are insufficiently clear regarding children born out of wedlock, highlighting a need for better synergy among law enforcement. The reconstruction of these regulations is outlined in Law No. 23 of 2006 and the more recent Law No. 24 of 2013 regarding population administration.

Abstract

In the digital age, legal protections for personal data are insufficient, leaving individuals vulnerable to financial losses from data theft and criminal dissemination of personal information. This research focuses on assessing the effectiveness of existing regulations, such as Law Number 27 of 2022 Concerning Personal Data Protection. Employing an empirical juridical approach for field research and a conceptual approach for theoretical analysis. The analysis underscores that personal data, crucial for identification, is a frequent target for malevolent actors seeking financial gain, leading to profound consequences for victims. Incidents of personal data theft, often orchestrated by fraudsters, extend beyond financial losses, compromising personal information available for purchase on clandestine online platforms like the dark web. Despite existing regulations, the research identifies a significant gap in providing clear guidelines for safeguarding individuals in the digital era. The study concludes that the current legal framework, while foundational, requires a more comprehensive focus on the Personal Data Protection Law due to inherent weaknesses. This research contributes valuable insights into the evolving legal landscape surrounding personal data crimes in Indonesia, ensuring a comprehensive understanding of legal protections for victims amidst technological advancements.

Abstract

In providing legal protection to a suspect, the implementation of Law Number 8 of 1981 concerning Criminal Procedure Law is crucial, especially at the investigation stage in a criminal case. At the interrogation stage, arbitrary actions often occur on the part of investigators against suspects suspected of being involved in criminal acts. This research explores the legal protection of suspects' rights in the process of examining criminal cases, with a focus on the role of advocates in accordance with the provisions of Law Number 8 of 1981 concerning Criminal Procedure Law. The interrogation stage in an investigation often becomes the focal point, where arbitrary actions on the part of investigators can threaten the suspect's rights. This research adopts a library research method with a normative juridical approach. The approach in this research involves library materials or secondary sources, which are then collected, analyzed and researched. Field studies were also carried out to obtain direct data regarding the protection of suspects' rights in the investigation process. The role of advocates in legal assistance at the investigation level has limitations regulated by Article 115 of the Criminal Procedure Code. These restrictions are a step to maintain the smoothness of the investigation process without any interference that could harm the interests of the state. Therefore, apart from advocates having a more passive role at this stage, the principle of legal protection for suspects remains the main focus in running the criminal justice system.
