Abstract

This paper seeks to explore the model of negotiating the five families of Nahdliyyin-Muhammadiyah to the Ponorogo community over the traditional dispute over the prohibitions of Javanese marriage. The traditions of the Javanese marriage that is “weton”, “ngalon-ngulon”, “Golan-Mirah”, marriage of “lusan” and “madep-ngarep” marriage. Excavation model of the negotiation result is divided into three models. First, the model of negotiating within the frame of kalam (theology) and adat (tradition) connections the nappears to be incompatibility and inconsistency between the two. This is due to the emergence of different assumptions due to syirik (belief in more than of God) stereotype, because it is more holding the tradition than the existing of religious rules. Second, the model of negotiating within the framework of the Jurisprudence and adat connections that gave birth to the relationship of proximity and flexibility in responding to Javanese marriage customs or traditions so that it can be an alternative pattern of settlement. Third, the model negotiates within the framework of wisdom and diversity of customs/traditions. In the category of this meaning, the problem of the tradition of the prohibitions on Javanese marriage can be resolved by returning to the wisdom and diversity of tradition. Let the tradition solve itself. It seems that with this category the negotiation process goes fluently.

Abstract

Abstract:  Encountering between Islam and Javanese culture is fascinating to study. It is proved by cultural unique in Java community, such “selametan” tradition in building the house. Therefore, in this study discover two elements. First, look for the motivation in holding that tradition.  Second, the depth meaning of “selamatan sajen” towards Javanese community. This study conducted qualitative approach and this was case study. This study focused on the relation between Islam Javanese culture. The population was the civilizing of Gentan, Ngrupit, Jenangan, Ponorogo. Observation and interview were used to collect the data. It was found that the existence of selametan sajen is as same as the Islamic assent. It was proved by Prophet Adam a.s and his son also used that tradition in the past. Moreover, the intended meaning of its culture is to pray to Allah. Then the purposes are, first, safeness during the process in building house; second, hopefully neighbors blessing. Selamatan tradition invites their neighborhood and gives them various kinds of food and snacks. Those are called as sajen. In line, selametan tradition such building a house, has contribution in spiritual education. As the reason, its sajen has different depth meaning of each symbol. And it can be seen in Islamic culture. Keywords: Mbah Pujonggo, Singkretis, Nayuh, Kembang Setaman.

Abstract

Abstract: Waqf Fundraising Management Model. This article examines models of fundraising through conventional sources, waqf asset productivity at The Al-Falah Social Fund Foundation (YDSF) in Surabaya. This study shows that YDSF uses waqf fundraising management through developing a resource fundraising model such as  fundraising  method from conventional sources either directly or indirectly as well as grant fundraising model such as strengthening empowerment program on the distribution of endowments. Whereas in developing asset fundraising model and, in-kind waqf, YDSF has not yet developed such a model. Hence the YDSF uses merely the direct cluster management.Keywords: ṣadaqah jāriyah, al-ḥabs, charitable fundraising management, corporate social responsibilityAbstrak: Model Manajemen Fundraising Wakaf. Artikel ini mengkaji model fundraising wakaf melalui sumber-sumber konvensional, produktivitas aset wakaf, dan in-kind wakaf pada Yayasan Dana Sosial Al-Falah (YDSF) Surabaya. Studi ini menunjukkan bahwa Yayasan ini menggunakan manajemen fundraising wakaf dengan mengembangkan model resource fundraising seperti metode penggalangan dari sumber-sumber konvensional baik secara langsung maupun tidak langsung dan model grant fundraising seperti penguatan program pemberdayaan pada penyaluran wakaf. Sedangkan dalam pengembangan model asset fundraising, dan in-kind wakaf, YDSF belum dapat mengembangkannya sehingga YDSF termasuk nādhir wakaf yang masih dalam kluster pengelolaan wakaf langsung.Kata Kunci: ṣadaqah jāriyah, al-ḥabs, manajemen fundraising wakaf, corporate social responsibility

Abstract

This paper focuses on the notion of endowment and its role in the building and development of pesantren in Indonesia. It is interested particularly in investigating the economically independent nature of pesantren through the scheme of endowment. It also traces the history of pesantren to show that it has been independent all along. Its independence, the paper argues expands not only in economic terms but also in academic, theological as well as intellectual realm. Even against the onslaught of modernity, pesantren has been independent in the sense that it has not fallen prey to the negative impacts of modernity, if any. This paper discusses this as well as the strategy of pesantren in dealing with modernity particularly by referring to the experience of two great pesantrens, namely Tebuireng and Gontor. The paper keeps in mind that it is the values of the two pesantrens that kept them intact from the influence of modernity. It investigates therefore the nature and kind of these values as well the extent to which the two pesantrens are attached to them. One of the values that the paper is interested in is the notion of charity (sadaqah), the some-what equivalent word for endowment (waqf).

Abstract

This article reveals the negotiation model in inheritance dispute resolution among Mataraman society at East Java as a response to the high number of inheritance dispute which often becomes an acute family social problem. Conducting field research on seven families carrying out inheritance distribution process, this article classifies three models of Mataraman society’s negotiation in inheritance dispute resolution. They are negotiation using formulation of theology cum tradition, negotiation using fiqh cum tradition, and negotiation using indigenous wisdom and diversity. Among the three, the formulation of fiqh cum tradition comes as the mainstream solution and offer because it is a middle way to resolve inheritance disputes for the sake of assets unity and harmonious family relationship. It also becomes a role model for social based negotiation process for inheritance distribution in a multicultural society.(Artikel ini menggali model negosiasi dalam penyelesaian sengketa waris pada masyarakat Mataraman Jawa Timur sebagai respons atas tingginya angka sengketa waris yang muncul di masyarakat dan acapkali menjadi sengketa akut sosial keluarga. Dengan melakukan riset lapangan terhadap tujuh keluarga yang mengalami proses pembagian waris, artikel ini mengklasifikasi tiga model formulasi dalam proses negosiasi penyelesaian sengketa waris di masyarakat Mataraman. Ketiganya adalah negosiasi dengan formulasi teologi agama cum adat, negosiasi dengan formulasi fiqh cum adat, dan negosiasi dengan formulasi kearifan dan keragaman lokal. Dari ketiga formulasi tersebut, model fiqh cum adat menjadi tawaran sekaligus solusi mainstream karena merupakan jalan tengah penyelesaian sengketa waris di masyarakat demi keutuhan aset dan keharmonisan hubungan keluarga. Kategori tersebut sekaligus menjadi role model atas proses negosiasi dalam tradisi pembagian waris berdimensi sosial dalam masyarakat multikultur)

Abstract

This study aims to explore the model of management and development of company waqf assets in Malaysia and Singapore, and their relevance to the development of company waqf construction in accordance with Indonesian waqf law and the wisdom of traditions that have developed. By using an interpretive explorative type qualitative approach, this research resulted in the finding, that the construction of the management model and development of corporate waqf assets in Indonesia in accordance with the context of Indonesian waqf law and traditional wisdom are business entities, banks, universities, foundations, hospitals, cooperative. So as to realize the strengthening of the holistic corporate waqf model in Indonesia, it is necessary to strengthen the regulatory stakeholders as well as an integrative and holistic understanding among scholars.

Abstract

The reality of the difference in applying Islamic law in the context of marriage law legislation in modern Muslim countries is undeniable. Tunisia and Turkey, for example, have practiced Islamic law of liberal nuance. Unlike the case with Saudi Arabia and the United Arab Emirates that still use the application of Islamic law as it is in their fiqh books. In between these two currents many countries are trying to apply the law in their own countries by trying to bridge the urgent new needs and local wisdom. This is widely embraced by modern Muslim countries in general. This paper reviews typologically the heterogeneousness of family law legislation of modern Muslim countries while responding to modernization issues. Typical buildings seen from modern family law reforms can be classified into four types. The first type is progressive, pluralistic and extradoctrinal reform, such as in Turkey and Tunisia. The second type is adaptive, unified and intradoctrinal reform, as in Indonesia, Malaysia, Morocco, Algeria and Pakistan. The third type is adaptive, unified and intradoctrinal reform, represented by Iraq. While the fourth type is progressive, unifiied and extradoctrinal reform, which can be represented by Somalia and Algeria.
