Abstract

This article focuses on negotiating processes that are implemented by five Nadhliyyin-Muhammadiyah families in Ponorogo in seeking of solutions for traditional marriage prohibitions. The processes can be divided into three schematic phases. The first, pre-negotiation process, is based on both personal and collegial conviction between two parts, principles of willingness to seek some creative options, and principles to emphasize bridal candidate’s importances. The second, negotiation process consists some activities such as discussion and debate facing some prohibitions in Javanese marriage. The last process, post-negotiation, is the result of negotiation process that can be distinguished into two things: agreement or similar view that enable the marriage to continue and difference that divorce the spouse.

Abstract

AbstractNowadays, strengthening the capacity of nazir is very essential in gettingbenefits in terms of self-reliance and empowerment of mauquf alaih. One of its attempts israising fund as an advance of the improvement assets and waqf potential management.Therefore, this paper aims to investigate the uniqueness of waqf management in the viewpointof fundraising from three Nazir, namely, Hasyim Ashari Islamic boarding school TebuirengJombang, Foundation for Waqof Board and the Islamic University of Indonesia Yogyakarta andAl-Falah Social Fund Surabaya. This study employed multi case study from the perspective ofcomparative approach. The findings showed that there are three uniqueness of obtaining waqf,they are, tradition wisdom-based fundraising in Nazir Tebuireng Jombang, university-basedfundraising for community empowerment in Nazir UII Yogyakarta and the community-basedfundraising which focused on marginalized people in YDSF Surabaya. Referring to theexperiences of those three nazir above, there is diverse models in waqf fundraising. Thediversity is in the form of internalization fundraising, relationship fundraising, and integratedfundraising. Those three models lead to a series of holistic model of waqf fundraising in orderto keep the sustainable of waqf management, including the sustainability of nazir, assets,benefits, wakif and mauquf 'alaih. Abstrak                                                                  Saat ini, penguatan kapasitas nazir sangat penting dalam pengembangankemandirian dan pemberdayaan mauquf alaih. Salah satu upayanya adalah mengumpulkan dana sebagai uang muka dari peningkatan aset dan potensi manajemen wakaf. Oleh karena itu, makalah ini bertujuan untuk menggali keunikan manajemen wakaf dalam sudut pandang penggalangan dana dari tiga Nazir, yaitu, UniversitasHasyim Ashari TebuirengJombang, Dewan Wakafdari Universitas Islam Indonesia Yogyakarta dan Dana Sosial Al-Falah Surabaya. Penelitian ini menggunakan studi multi kasus dari perspektif pendekatan komparatif. Temuan menunjukkan bahwa ada tiga keunikan dalam memperoleh wakaf, yaitu penggalangan dana berbasis tradisi kearifan di Nazir Tebuireng Jombang, pendanaan berbasis universitas untuk pemberdayaan masyarakat di Nazir UII Yogyakarta dan pendanaan berbasis masyarakat yang berfokus pada orang-orang pinggiran di YDSF Surabaya. Mengacu pada pengalaman ketiga nazir di atas, ada beragam model dalam penggalangan dana wakaf. Keanekaragaman itu dalam bentuk internalisasi, hubungandanintegrasipenggalangan dana.  Ketiga model tersebut mengarah pada serangkaian model penggalangan dana wakafholistik dalam rangka mewujudkan keberlanjutan pengelolaan wakaf, termasuk keberlanjutan nazir, aset, manfaat, wakif dan mauquf 'alaih.

Abstract

This research is motivated by the fact that many people still do not understand the concept of buying and selling, primarily buying and selling bay' al inah. Therefore, the purpose of this study is to provide an understanding to the public about the concept of buying and selling bay' al inah, starting from the transaction procedures to the legal basis of this sale and purchase according to Imam Syafi'i in al-Umm and Imam Malik in al-Muwatta'. This writing uses descriptive qualitative research. To obtain data using a library approach (library research). Data collection techniques are carried out by collecting and reviewing research literature and other data sources relevant to the discussion. The data analysis used is a descriptive qualitative technique, describing and explaining the data of the object of research and comparative analysis, namely looking for points of similarities, differences and the specificity of the thoughts of 2 figures. From this research, it can be concluded that Imam Syafi'i in al-Umm allows this buying and selling because the pillars and conditions are fulfilled, namely, there are buyers, sellers, goods being traded and contracted or consented to. Meanwhile, according to Imam Malik in al-Muwat}t}a', this sale and purchase are declared invalid because there will be an element of Sadd al-Dhari'ah, namely that there will be a lousy purpose from the sale and purchase. This goal leads to prohibited acts, namely usury. Riba here occurs because the prices are different from the two buying and selling.

Abstract

This paper seeks to explore the model of negotiating the five families of Nahdliyyin-Muhammadiyah to the Ponorogo community over the traditional dispute over the prohibitions of Javanese marriage. The traditions of the Javanese marriage that is “weton”, “ngalon-ngulon”, “Golan-Mirah”, marriage of “lusan” and “madep-ngarep” marriage. Excavation model of the negotiation result is divided into three models. First, the model of negotiating within the frame of kalam (theology) and adat (tradition) connections the nappears to be incompatibility and inconsistency between the two. This is due to the emergence of different assumptions due to syirik (belief in more than of God) stereotype, because it is more holding the tradition than the existing of religious rules. Second, the model of negotiating within the framework of the Jurisprudence and adat connections that gave birth to the relationship of proximity and flexibility in responding to Javanese marriage customs or traditions so that it can be an alternative pattern of settlement. Third, the model negotiates within the framework of wisdom and diversity of customs/traditions. In the category of this meaning, the problem of the tradition of the prohibitions on Javanese marriage can be resolved by returning to the wisdom and diversity of tradition. Let the tradition solve itself. It seems that with this category the negotiation process goes fluently.

Abstract

The funding institution at the Nur Rosyidah Foundation is a ZISWAF institution under the auspices of the Nur Rosyidah Magetan Foundation, which always innovates to continue to improve the quality of its services and fund collection by utilizing digital technology as a way to collect funds from donors. This research aims to determine the strategy for raising funds using digital technology, the advantages and disadvantages of raising funds, and the implications of using digital technology at the Nur Rosyidah Foundation—field research with a qualitative research approach. Meanwhile, the data collection techniques used are interview, observation, and documentation techniques. This research shows that the pattern applied at the Nur Rosyidah Foundation funding institution is an indirect fundraising method that focuses on five crowdfunding methods: paid advertising, unpaid advertising, videos and flyers, WhatsApp, and direct email. The implications of raising funds using digital technology at the Nur Rosyidah Foundation have a positive impact because the increase influences the number of funds and donors, which increases every early. The use of digital technology also has very good implications, both for internal and external circles, because the system makes it easier for consumers to donate.

Abstract

This research was motivated by differences of opinion between the fuqaha and Kiai Husein regarding husband-wife relations. Kiai Husein synchronized the postulates of jurisprudence in solving contemporary development problems using the theory of gender equality. This research includes research that explores data by interviewing related figures and extracting data from his works, known as library research. The findings show that kiai Husein Muhammad's gender equality does not come from gender, whether from women or men. Still, gender is the difference between men and women, which is created by themselves, not by God or the potential that each individual can create.

Abstract

The phenomenon of virtual waqf pledges carried out by the Waqf Pledge Deed Making Officer (PPAIW) of Jetis District, Ponorogo Regency, emerged amid a vacuum of formal regulations regarding virtual waqf, both in the Waqf Law, Government Regulations, and Indonesian Waqf Board policies. The urgency of this research lies in the differences in views among PPAIW regarding the validity and legality of virtual waqf pledges, which reflect the dynamics of Islamic legal thinking in the context of waqf digitalization. With a qualitative approach, this field research aims to explore the views of PPAIW in Ponorogo Regency regarding the virtual waqf pledge and analyze their thought patterns in responding to this phenomenon. Research data was obtained from informants from PPAIW Ponorogo. Data collection techniques were done through in-depth interviews, observation, and documentation. Data analysis was carried out using Mahsun Fuad's typological theory of Islamic legal thought, dividing the thought spectrum into participatory and emancipatory reasoning. The results of the research show that there are three typologies of PPAIW thinking regarding the virtual waqf pledge, namely: critical-responsive madzhabi reconstruction, emancipatory responsive-sympathetic interpretive reconstruction, and emancipatory responsive-sympathetic madzhabi reconstruction. This conclusion confirms the diversity of thought responses at the local level towards waqf practices in the digital era.

Abstract

This research is motivated by the increasing number of early-age divorce cases, which has resulted in many young women becoming underage widows—girls under 19 years old who have already experienced marriage and divorce, and most of whom already have children. This study is a field research using a case study approach. The data were collected from primary sources such as underage widows, their parents, and representatives from the Women's Empowerment and Child Protection Agency (P3A) and secondary sources, including documents, legislation, and relevant literature. The research was conducted in the Ponorogo, Madiun, and Nganjuk Regencies, with the implementation adjusted to the availability and conditions of the informants. Data collection techniques included in-depth interviews, observation, and documentation. Data analysis was carried out using the Miles and Huberman model, which involves data reduction, data presentation, and continuous drawing of conclusions throughout the research process. The findings show that some underage widows can utilize their livelihood assets to implement consolidation, active, and passive strategies, while others can only survive using basic survival strategies. Most choose to work and pursue education through the Package C program. Although these young widows can endure, they still face significant challenges, and some eventually decide to remarry as a way out of life’s pressures. Underage widows adopt survival strategies rationally, based on their conditions and available resources—by working, continuing education, or remarrying—as a way to cope with pressure and build a future.

Abstract

This paper describes the profile of productive waqf management developed in Turkey and tries to relate certain aspects in the context of waqf development in Indonesia. Waqf management in Turkey in terms of history, legal formation, and asset management, especially productive waqf assets, has grown rapidly and at least contributed to the state and the empowerment and independence of the community. The institutional, governance, and distribution of waqf proceeds have had major implications for the Turkish state. At least by positioning waqf assets to be developed productively, it has strengthened the function of waqf in the transformation of Muslims specifically. In this context, it is possible that the efforts that have been made by Turkish waqf in terms of asset productivity are taken more integratively for the development of waqf in Indonesia.
