Abstract

Hingga saat ini, satu-satunya pengaturan tentang pengungsi luar negeri di Indonesia, hanya diatur di dalam Peraturan Presiden Nomor 125 Tahun 2016 tentang Penanganan Pengungsi dari Luar Negeri (P2LN 2016). Oleh karena itu, para pengungsi tersebut ditampung tanpa payung hukum yang jelas/memadai. Tujuan dari penelitian ini adalah untuk menganalisis efektivitas penempatan pengungsi luar negeri dan idealnya penanganan pengungsi di Indonesia. Jenis penelitian ini tergolong ke dalam Penelitian Hukum Normatif dengan menggunakan dua jenis pendekatan, yaitu conceptual approach dan statute approach. Efektivitas penempatan pengungsi luar negeri dalam P2LN 2016 adalah tidak tercapainya tujuan dalam bentuk pemerintah daerah kabupaten/kota menentukan tempat penampungan bagi mereka. Idealnya penanganan pengungsi tersebut adalah pemerintah daerah kabupaten/kota menentukan tempat penampungan bagi pengungsi. Selain itu, dibentuk aturan dalam bentuk undang-undang. Selanjutnya, terdapat sanksi bagi pemerintahan di daerah yang melanggarnya. Realitas pada hari ini menunjukkan bahwa pemerintah daerah kabupaten/kota yang tidak menentukan tempat penampungan, tidak dikenakan sanksi apapun. Oleh karena itu, hendaknya negara membentuk kebijakan tertulis (undang-undang) yang secara khusus mengatur masalah pengungsi yang berasal dari luar negeri. Dengan demikian, para pengungsi dari luar negeri ditampung dengan dasar hukum yang jelas/memadai seperti batas waktu bagi para pengungsi tersebut berada di Indonesia.

Abstract

The decision of the Constitutional Court is final and binding, therefore it must be obeyed by anyone without exception. In the constitutional law order, especially with regard to the decisions of the Constitutional Court, it is known that the Erga Omnes principle is applied, which means that the decisions of the Constitutional Court must be obeyed by anyone, not only by litigants. The main research problem is what is the final character of the decision of the Constitutional Court according to Indonesian positive law and what is the most ideal reconceptualization of the final strength of the Constitutional Court Decision. This type of research is normative legal research. The data source comes from secondary data which is divided into 3 types of data, namely primary, secondary and tertiary legal materials. The conclusions of this study are, First, the final power of the Constitutional Court Decision in Indonesian Positive Law is expressly regulated in Article 24C Paragraph (1) of the 1945 Constitution, Article 10 of Law Number 24 of 2003 concerning the Constitutional Court Article 29 Paragraph (1) Law Number 48 of 2009 concerning Judicial Power. Second, the most ideal reconceptualization of the final strength of the Constitutional Court Decisions needs to be carried out to maintain the purity of the Constitutional Court as the Guardian of the Constitution, by: Affirming the Erga Omnes Principle in the Constitutional Court Law, Responsiveness of Executive and Legislative Institutions and Its Relation to Responsive Legal Theory , Reasons for Delaying Final Strength of Constitutional Court Decisions, Constitutional Court Decisions as Ius Constituendum in Legal Politics Perspective, Accelerating Progress on Draft Laws on Contempt of Court, Ideas for Incorporating Constitutional Court Decisions into the Hierarchy of Legislation.

Abstract

Abstract:  The dentist available at the hospital or FKTL in the city of Pekanbaru is not a dentist who specializes in dental conservation but is a general dentist. There are not several supporting examinations for patient health care needs that hospitals can provide to patients. Where should a general dentist, following the decree of the minister of health Number HK 02.02/MENKES/62/2015, not handle root canal treatment for molar teeth and following the Regulation of the Minister of Health Number 001 of 2012 that second-level referrals must be to a specialist? This type of research is sociological, legal analysis. Based on interviews and direct observation of services, referrals to patients who need a specialist or sub-specialist health services cannot be provided and are available at referral hospitals due to limited facilities, equipment, and human resources or personnel, such as not there are specialist doctors who are more competent to handle patients with cases that require specialist or sub-specialist health services. Keywords: referral, specialist dentist, minister of health regulation.  Abstrak: Dokter gigi yang tersedia di rumah sakit atau FKTL di kota Pekanbaru bukan seorang dokter gigi spesialis konservasi gigi melainkan seorang dokter gigi umum. Dimana seharusnya seorang dokter gigi umum sesuai dengan keputusan menteri kesehatan Nomor HK 02.02/MENKES/62/2015 tidak boleh menangani perawatan saluran akar pada gigi molar dan sesuai dengan Peraturan Menteri Kesehatan Nomor 001 tahun 2012 bahwa rujukan tingkat kedua harus ke dokter spesialis. Jenis penelitian ini adalah penelitian hukum sosiologis. Berdasarkan wawancara yang dilakukan dan observasi terhadap pelayanan secara langsung diketahui bahwa rujukan kepada pasien yang membutuhkan pelayanan kesehatan spesialistik atau sub-spesialistik yang tidak dapat diberikan dan tersedia di rumah sakit rujukan disebabkan alasan keterbatasan fasilitas, peralatan dan/atau sumberdaya manusia atau ketenagaan, seperti tidak adanya dokter spesialis yang lebih berkompeten untuk menangani pasien dengan kasus yang membutuhkan pelayanan kesehatan spesialistik atau sub-spesialistik serta tidak terdapat beberapa pemeriksaan penunjang kebutuhan pelayanan kesehatan pasien yang dapat diberikan oleh rumah sakit kepada pasien. Kata kunci: rujukan, dokter gigi spesialis, peraturan menteri kesehatan

Abstract

Abstract: The act of refusing to do CPR is known as DNR (Do Not Resucitate). This often overlaps with euthanasia. In many countries, there are still many doubts about performing CPR on patients. So we need a limit and legal certainty in conducting CPR. This study uses normative legal methods. From the results of the study, it was found that the appropriate Indonesian law regarding Termination of Cardiopulmonary Resuscitation (CPR) in the Law of the Republic of Indonesia Number 36 of 2009 concerning Health in Article 5 Junto of the Minister of Health Number 37 of 2014 Article 14 paragraph (5) In the process of discontinuing CPR there are indications things that need to be considered include if the patient has not given a stable response, the pupil is maximally dilated, there is no spontaneous response after CPR for 15 - 30 minutes, the electrocardiogram (ECG) is flat, and if the patient has a DNR order. Approval or rejection of the medical action needs to be stated in a written form. The order not to do CPR issued by this patient is irrefutable, this includes the refusal of medical action which is protected by law as one of the patient's rights.Keywords: Cardiopulmonary Resuscitation; DNR; EuthanasiaAbstrak: Tindakan menolak dilakukannya RJP dikenal dengan istilah DNR (Do Not Resucitate). Hal ini sering tumpang tindih dengan euthanasia. Di berbagai negara pun masih banyak keraguan dalam melakukan RJP pada pasien. Sehingga diperlukan suatu batasan dan kepastian hukum dalam melakukan RJP. Penelitian ini menggunakan metode hukum normatif. Dari hasil penelitian didapatkan Hukum Indonesia yang sesuai tentang hal Penghentian Resusitasi Jantung Paru (RJP) dalam Undang-undang Republik Indonesia Nomor 36 tahun 2009 Tentang Kesehatan pada Pasal 5 Junto Permenkes Nomor 37 tahun 2014 Pasal 14 ayat (5) Pada proses penghentian RJP terdapat indikasi yang perlu diperhatikan diantaranya yaitu jika penderita sudah tidak memberikan respon yang stabil, pupil mengalami dilatasi maksimal, tidak ada respon spontan setelah RJP selama 15 - 30 menit, gambaran elektro kardiografi (EKG) sudah flat, serta apabila pasien memiliki perintah DNR. Persetujuan ataupun penolakan terhadap tindakan kedokteran tersebut perlu dituangkan dalam suatu form tertulis. Perintah untuk tidak dilakukannya RJP yang dikeluarkan oleh pasien ini sifatnya tidak terbantahkan, hal ini termasuk penolakan tindakan medis yang dalam undang-undang dilindungi sebagai salah satu hak pasien.Kata Kunci: Resusitasi Jantung Paru; DNR; Euthanasia

Abstract

The disciplinary regulations for Polri members are a series of norms to foster, uphold discipline and maintain order in the life of Polri members. It is necessary to instill in every member of the Police the awareness that discipline is honor. Discipline of members of the Police is an honor as a member of the Police that shows credibility and commitment as a member of the Police. While the legal consequences if a police officer who carries out a polygamous marriage without permission is caught either by his wife or another party and reported to his superiors, the police officer will be subject to sanctions in accordance with the rules that apply to each member of the police as outlined in the police code of ethics. Abstract

Penelitian ini bertujuan untuk menganalisis Kepastian Hukum Pidana Cyber Crime Judi Online dan untuk menganalisis Pertimbangan Yuridis Hakim Dalam Memutuskan Perkara Tindak Pidana Judi Online. Jenis Penelitian ini adalah Penelitian Hukum Normatif dan Pendekatan penelitian yaitu, Pendekatan Undang-Undang, Pendekatan Konseptual dan Pendekatan Analisis. Sumber data dan bahan hukum yang diperoleh dari sumber data sekunder, bahan hukum primer dan bahan hukum tersier. Teknik Pengumpulan data yang digunakan adalah studi pustaka (Library Research) dan teknik analisis data yaitu teknik analisis kualitatif. Kesimpulan dari hasil dan pembahasan dalam penelitian ini adalah Dalam hukum pidana Cyber Crime Judi Online kepastian hukum belum terlaksana sepenuhnya. Dan dalam Putusan Pengadilan Negeri Nomor: 834/Pid.B/2020/PN.Jkt.Brt dan dalam Putusan Pengadilan Negeri Nomor: 740/ Pid.Sus/ 2020/ PN.Ptk pertimbangan yuridis hakim dalam membuat keputusan tetap berpedoman kepada peraturan perundangan-undangan.

Abstract

Article 53 paragraph 1 has not been realized yet, the entry into force of Law Number 18 of 2013, because in the author's opinion that the government is not firm in dealing with forest destruction has not been implemented properly. After the enactment of this Law, the Chief Justice of the Supreme Court of the Republic of Indonesia must nominate candidates for ad hoc judges who are appointed through a Presidential Decree to examine cases of forest destruction. As for the formulation of the problem in this research is how the implementation of the composition of judges in the settlement of forest criminal cases based on the legislation, how the legal consequences in the implementation of the composition of judges in the settlement of forest criminal cases based on the legislation. The method used is normative legal research. Data sources consist of primary legal materials, secondary legal materials, and tertiary legal materials. In this study the data were analyzed qualitatively and in drawing conclusions the authors applied the method of deductive thinking. Based on the results of the research, it is known that the implementation of the composition of judges in the settlement of forest criminal cases based on the legislation that the existence of the composition of judges based on the legislation against the perpetrators in the law is recognized in practice.
