Abstract

Tulisan ini menyorot fenomena good governance dikaitkan dengan munculnya ruang public (public sphere) di tengah-tengah masyarakat Indonesia. Penulis mengambil kasus gagasan Counter Legal Draft Kompilasi Hukum Islam dan berbagai corak reaksi dan respon masyarakat sebagai contoh ruang publik yang patut diapresiasi. Sebagai kesimpulan, dapat dikatakan bahwa ketersediaan ruang publik tidak lebih dari sekadar penciptaan iklim/atmosfir yang kondusif dan kokoh untuk melanjutkan agenda pembangunan good governance yang masih belum berjalan seutuhnya.

Abstract

The study of Sharia in a Muslim country, like Indonesia, has been experiencing a significant change in terms of approaches, methods, and object of study. This article deals with the continuities and changes in the study of Islamic law in Indonesia. Based on my bibliographical study, it emphasizes that the study of Sharia in Indonesia has changed in response to the changing social and political surroundings, which I categorize into three phases. First, during colonialism, the relationship between Islam and local customs has become an important subject of intense debate among scholars. Second, an upturn occurred in the mid-1950s, as the study of Sharia was no longer oriented to examine the debates on the relationship between Islam and local practices. Instead, Islam is seen as a set of interpre­tative resources and practices. This approach continued to develop until the 1970s. Third, along with the codification of Islamic family law, the study of Sharia has been given to the dynamics of Islamic law in courtrooms, examining the position of women and the role of judges, and in state policies both at provincial and district levels.

Abstract

During the last couple of years, Gen Z youths born between 1997 and 2010 have been actively involved in various social communities promoting a particular understanding of Islam, such as volunteers, frontline activists, or organizers. This article explores their socio-religious activism in Solo and their understanding of Islam. It delves into religious and social piety in their da‘wah (proselytization). We found out that the majority of this generation does not understand the meaning of moderate Islam properly. However, their perspectives and attitudes do not oppose differences. Most of them obtain their religious sources from social media and the Internet. Only a few of them, due to their lack of knowledge of Islamic teachings and limited encounters with non-Muslims, have a hateful attitude towards people of other religions. Meanwhile, they have an excessive defense of Islam. This study confirms Pattana Kitiarsa’s idea that religion has been commodified as a spiritual market where Muslims can select products symbolically associated with Islam.

Abstract

Artikel ini mengangkat bagaimana pendidikan konservasi lingkungan dilakukan oleh pesantren Al Fatah yang notabene terkenal hanya mendalami ilmu-ilmu agama saja. Pendidikan konservasi ini sangat dibutuhkan oleh para santri dalam membekali dirinya menjadi khalifatullah di muka bumi. Maka kurikulum yang harus dicanangkan oleh pesantren Al Fatah adalah kurikulum yang sifatnya integrasi sesuai dengan kebutuhan para santri yakni integrasi antara ilmu-ilmu agama Islam dengan ilmu saintifik yang mereka tidak mengetahui tentang keilmuan tersebut. Dengan menggunakan metode library research dengan cara menganalisis sumber-sumber yang ada baik dari buku, jurnal, media dan lain sebagainya, penelitian ini  melihat pola kurikulum yang dikembangkan oleh Pondok Al Fatah. Kita melihat bahwa dengan kerangka pendidikan semacam demikian ditambah bekerjasama dengan pihak ketiga pesantren Al Fatah berhasil melakukan pendidikan konservasi lingkungan dengan pola-pola integrasi. Pendidikan ini diberikan kepada santrinya untuk melihat bagaimana fenomena zaman ini harus dihadapi dengan penuh keyakinan supaya mereka dengan stigma santrinya tidak ketinggalan dibandingkan dengan lembaga pendidikan yang lainnya. Hal ini berhasil dilakukan oleh pesantren Al Fattah dengan melihat kasus yang ada program saintifik dilakukan.

Abstract

The transformation of Sharia into a legal code in different Muslim countries is not an easy process. Let alone in Indonesia, this transformation has included dialogues, conflicts and tensions between multiple groups. In the last two decades, along with the growing up of democratic life, this tension has given rise to the emergence of so-called ‘progressive’ and ‘conservative’ movements. Debates among them continue to rage even more intensely. On the other hand, as this article has argued, the development of Islamic family law in Indonesia has demonstrated the increase in the use of modern approaches to Islamic jurisprudence. Nevertheless, the State authority seems to have a decisive power to intervene the content and to determine the result of the debate. Accordingly, I would like to value all these political and legal processes as an inseparable part of the larger process of a public sphere in the Indonesian reformasi era.

Abstract

This article addresses how the legalisation of unregistered marriages works in Indonesian day-to-day practices. It understands people’s strategies to legalise their unregistered marriage and examines the state activities of granting legalisation. It seeks to answer in what ways the legal validity of a marriage is important to Muslim citizens. The data in this paper results from the observation of marriage registration documents in a marriage registration office and the examination of legal reasoning used by Islamic judges in marriage legalisation (isbat nikah) cases. This essay emphasizes that state recognition of a marriage cannot entirely substitute community-based legal norms. It also shows the importance of administrative transgression and judicial discretion played by street-level bureaucrats. By so doing, they have grounds to accord legalisation. They apply a lenient approach towards marriage rules that is key to providing state recognition of unregistered marriages.[Abstrak: Tulisan ini membahas bagaimana legalisasi perkawinan tidak tercatat diterapkan dalam praktik sehari-hari di Indonesia. Tulisan ini memahami strategi masyarakat dalam melegalisasi ‘perkawinan tanpa pencatatan’ dan menganalisis alasan negara dalam memberikan legalisasi. Ini untuk menjawab pertanyaan sejauh mana status sah dalam perkawinan penting bagi warga negara Muslim? Data dalam tulisan ini dihasilkan dari pengamatan dokumen pencatatan nikah di kantor pencatatan nikah dan pemeriksaan atas penalaran hukum dalam kasus pengesahan perkawinan (isbat nikah). Tulisan ini menekankan bahwa pengakuan negara atas perkawinan tanpa pencatatan tidak dapat menggantikan norma yang berlaku di masyarakat. Praktik di lapangan menunjukkan pentingnya pelanggaran administratif dan diskresi yudisial yang dimainkan oleh para birokrat tingkat jalanan. Dengan cara demikian, mereka memiliki alasan untuk memberikan legalisasi. Mereka menerapkan pendekatan yang lunak terhadap aturan perkawinan yang merupakan kunci untuk dapat memberikan pengakuan negara atas perkawinan tanpa pencatatan.]

Abstract

Pelaksanaan jual beli tanah di BMT Bina Insan Sejahterah masih menuai problematika dengan syariat Islam yaitu, masih ditemukannya berbagai macam ketidaksesuaian yaitu masih ditemukannya perjanjian klausul, hutang, dan ketidakjujuran nasabah terhadap BMT Bina Insan Sejahterah. Penelitian ini bertujuan untuk mengetahui pelaksanaan jual beli tanah pada akad murabahah yang ada di BMT Bina Insan Sejahterah apakah sudah sesuai dengan fatwa DSN NO: 04/DSN-MUI/IV/2000. Penelitian ini adalah penelitian lapangan, yang dilakukan melalui tanya jawab atau wawancara dan dokumentasi berupa data informasi dari manajer BMT dan staf lapangan terkait dengan pengadaan barang dan pelanggan BMT Bina Insan Sejahterah. Dari penelitian ini menunjukkan bahwa pelaksanaan jual beli tanah di BMT Bina Insan Sejahterah masih ditemukan berbagai macam ketidaksesuaian dalam akad murabahah di BMT Bina Insan Sejahterah antara nasabah dan pihak BMT Bina Insan Sejahterah, yaitu tentang penerapan nasabah berhutang terhadap BMT Bina Insan Sejahterah, hal ini dapat mempengaruhi akad diawal dan dapat menyebabkan akad murabahah menjadi rusak, Penyerahan barang pada BMT Bina Insan Sejahterah harus dilakukan pada waktu perjanjian akad maksudnya iyalah, setelah akad barang yang diinginkan oleh nasabah belum bisa dimiliki akan tetapi harus menunggu maksimal satu minggu baru bisa dimiliki.

Abstract

The adoption of Muslim children is one of the familial issues in Indonesia. At the law level, the Indonesian law authorizes two judicial institutions, namely Islamic and public courts, to handle the case. Here, conflicts of jurisdiction occur obviously and, as a consequence, the parties have the choice to decide which court to request based on their wishes. This article answers the question of why and what the consequences of conflicts of jurisdiction are in the case of the adoption of Muslim children? The study found that two judicial institutions both accepted and examined cases of the adoption of Muslim children. However, there is a difference in the legal consequences. If the adopted child is to be treated as a biological child and can inherit, the application is filed to a public court. On the contrary, if the child is to be maintained, it is an Islamic court that judges. In the case of family lineage (nasab), both the courts do not break the ties of the adopted child with his/her biological parents, including the right of guardianship.
