Abstract

This study examines the diverse interpretations of Islamic jurisprudence on surrogacy, focusing on the contrasting approaches between Sunni and Shia scholars. While Sunni scholars predominantly prohibit surrogacy, citing concerns over lineage integrity, marital sanctity, and ethical risks, Shia jurisprudence, particularly in Iran, allows surrogacy under strict regulatory conditions. The study employs a qualitative legal methodology, incorporating Islamic legal texts, fatwas, national legislation, and comparative legal analysis to evaluate how different Islamic traditions approach surrogacy regulation. The findings reveal that Islamic legal thought on surrogacy remains deeply divided. Sunni-majority countries such as Saudi Arabia, Indonesia, and Pakistan uphold stringent bans on surrogacy, emphasizing the need to maintain clear parental lineage. Conversely, Iran’s legal framework permits surrogacy, integrating maqāṣid al-sharīʿa (higher objectives of Islamic law) to justify its permissibility under ethical guidelines. The study also explores bioethical concerns surrounding the commodification of childbirth and the exploitation of surrogate mothers, emphasizing the necessity of ethical oversight in surrogacy arrangements. The research underscores the importance of developing harmonized legal frameworks that balance Islamic ethical principles with contemporary reproductive needs. Greater interdisciplinary collaboration between Islamic scholars, legal practitioners, and medical experts is crucial for ensuring that surrogacy regulations in Muslim-majority countries are both ethically sound and legally coherent. Future studies should investigate cross-cultural experiences of Muslim couples engaging in surrogacy, regulatory best practices, and the impact of surrogacy laws on family dynamics in Islamic contexts.

Abstract

This article examines how contemporary Islamic family law regulates arbitrary divorce and evaluates the extent to which such regulation operationalizes maqāṣid al-sharīʿah, particularly as conceptualized by Jamāl al-Dīn ʿAṭiyyah. Arbitrary divorce is understood as unilateral marital dissolution that occurs without adequate judicial oversight, substantive justification, or fair compensation, resulting in harm to women and children. The study asks how different legal systems constrain or reproduce arbitrary divorce and which regulatory model most effectively realizes substantive justice. Employing a qualitative and comparative method, the research analyzes statutory regulations, judicial structures, and doctrinal frameworks governing divorce in Indonesia, Iran, and Algeria as material objects of study. The findings demonstrate three distinct regulatory patterns. Indonesia adopts a procedural model that formally judicializes divorce but fails to prevent substantive injustice due to weak enforcement and partial protection of women’s financial and custodial rights. Iran reflects an administrative–doctrinal model that retains significant male prerogatives while introducing limited compensatory mechanisms. In contrast, Algeria represents a substantive maqāṣid-oriented model in which expanded judicial authority, mandatory reconciliation, and compensation for harm effectively constrain unilateral divorce and promote financial justice and child welfare. The study concludes that effective regulation of arbitrary divorce depends not on procedural formality alone but on the institutional capacity to translate ethical objectives into enforceable outcomes. This maqāṣid-based typology contributes to Islamic family law scholarship by offering a comparative framework for evaluating justice-oriented legal reform.

Abstract

This study aims to examine the relationship between women's religious organizations and the 2024 election contest from the perspective of fiqh democracy. This is because women's politics in the contemporary context is a necessity to realize justice for women. This study uses qualitative methods to explore the acceleration of women's religious organizations in Tulungagung and Trenggalek Regencies. The collected data is then presented descriptively and analyzed using content analysis through fiqh civilization (civilization jurisprudence). This study finds that (1) Women's religious organizations in Tulungagung and Trenggalek Regencies have demonstrated their strong existence in various aspects of women's participation in the 2024 political arena. (2) The position of women's religious organizations in Tulungagung and Trenggalek Regencies in the 2024 political contest is influenced by various supporting and inhibiting factors. (3) The contribution of women's religious organizations in Tulungagung and Trenggalek Regencies in facing the 2024 political contest can be seen through the fiqh democracy approach, which is the foundation of the women's religious organization movement. [Penelitian ini bertujuan untuk melihat hubungan politik organisasi keagamaan perempuan dalam kontestasi pemilu 2024 perspektif fiqih demokrasi. Hal ini dikarenakan politik perempuan dalam konteks kontemporer menjadi sebuah keniscayaan untuk mewujudkan eksistensi keadilan bagi perempuan. Penelitian ini menggunakan metode kualitatif untuk untuk menggali akselerasi gerakan organisasi keagamaan perempuan di Kabupaten Tulungagung dan Trenggalek. Data yang telah dikumpulkan kemudian dipaparkan secara deskriptif untuk kemudian dianalisis menggunakan metode content analysis melalui fiqih peradaban. Penelitian ini menemukan bahwa (1) Organisasi keagamaan perempuan di Kabupaten Tulungagung dan Trenggalek telah menunjukkan eksistensinya yang kuat dalam berbagai aspek partisipasi perempuan di ranah politik 2024. (2) Posisi organisasi keagamaan perempuan di Kabupaten Tulungagung dan Trenggalek dalam kontestasi politik 2024 dipengaruhi oleh berbagai faktor pendukung dan penghambat. (3) Kontribusi organisasi keagamaan perempuan di Kabupaten Tulungagung dan Trenggalek dalam menghadapi kontestasi politik 2024 dapat dilihat melalui pendekatan fiqih demokrasi yang menjadi landasan gerakan organisasi keagamaan perempuan].

Abstract

This research is motivated by the importance of preserving the authenticity of the Qur’an as the primary source of Islamic teachings and law, which serves as the foundation for legal certainty within the Islamic Family Law system. Historical records show that the codification process of the Qur’an carried out by Zaid bin Tsabit during the caliphates of Abu Bakr and Uthman bin Affan played a crucial role in ensuring the integrity and uniformity of the revealed text, thereby having significant implications for the validity of Islamic legal arguments. This study aims to critically analyze the role of Zaid bin Tsabit in the Qur’anic codification process and its implications for the certainty of the textual basis (nash) in Islamic family law. Using a qualitative method with a historical-normative approach, this research combines chronological and normative analyses of primary sources such as the works of as-Suyuthi and az-Zarkasyi, as well as secondary sources in relevant academic literature. The findings indicate that the codification process of the Qur’an holds not only historical value but also juridical significance, as it ensures the authenticity of the text as the foundation of Islamic law. Therefore, integrating historical and normative aspects is essential to maintaining the authority of Islamic legal sources in the contemporary era.
