Abstract

Saat ini Indonesia telah memiliki aturan hukum yang jelas tentang perlindungan hukum bagi Pekerja Migran Indonesia (PMI). Aturan tersebut tertuang dalam Undang-Undang Nomor 18 Tahun 2017 yang kemudian di konkritkan dengan Peraturan Pemerintah Nomor 59 Tahun 2021. Adanya aturan hukum yang bagus belum menjamin bahwa aturan tersebut akan berjalan dengan baik jika para-PMI sendiri kurang memahami aturan itu. Tujuan dari Pengabdian kepada Masyarakat (PkM) ini adalah untuk memberikan akses informasi dan mengedukasi tentang perlindungan hukum terhadap hak-hak PMI kepada para PMI yang ada di Hong Kong. Dampak yang diharapkan yakni para PMI di Hong Kong memiliki pengetahuan tentang macam-macam hak yang dimiliki beserta mekanisme pelaporan/pengaduan apabila pelanggaran hak itu terjadi, sehingga mereka dapat bekerja di luar negeri dengan aman dan nyaman. PkM ini dilakukan dengan metode blended yakni secara luring yang dilakukan dalam bentuk penyuluhan hukum dan pendampingan hukum dan secara daring yang dilakukan dengan membentuk Whatsapps group dan menyelenggarakan webinar berkala. Target yang diharapkan dari PkM ini yaitu para PMI memiliki pengetahuan tentang macam-macam hak yang dimiliki sesuai peraturan perundang-undangan di Indonesia, mengetahui peran KJRI Hong Kong dalam memberikan perlindungan hukum terhadap PMI, serta Kebijakan Pemerintah Hong Kong tentang PMI. Setelah mengikuti kegiatan ini peserta diharapkan mampu secara mandiri memperjuangkan hak-haknya ketika suatu saat mereka mengalami pelanggaran hak.

Abstract

Placement fees cannot be charged to Indonesian migrant workers. Therefore, BP2MI established BP2MI Regulation No. 09/2020 regarding the waiver of the placement fee for Indonesian migrant workers. One of the contents of the regulation only stipulates 10 types of positions for Indonesian migrant workers whose placement fees are waived. By using normative legal research that is descriptive in nature, the results obtained are that the BP2MI policy which only stipulates 10 types of positions for Indonesian migrant workers whose placement fees are freed is not in accordance with the concept of the welfare state adopted by the Indonesian state. Besides, when related to several principles of protection for Indonesian migrant workers, the criteria for the position of Indonesian migrant workers who should also receive exemption from placement fees include being vulnerable to discrimination, exploitation, violence, human trafficking practices, as well as threats of opinion and restrictions on access to movement.

Abstract

This research aims to analyse the role of Constitutional Law (HTN) in regulating higher education in Indonesia, especially in maintaining the balance between academic freedom and state supervision. The method used in this research is the normative juridical method, which focuses on the study of legislation related to higher education as well as legal practices applied in Indonesia. The analysis is conducted on Law No. 12/2012 on Higher Education and Law No. 20/2003 on the National Education System, as well as other implementing regulations. The results show that HTN has two main roles in higher education in Indonesia. First, HTN acts as an instrument that regulates and supervises higher education institutions to ensure education remains in accordance with national goals and the basic principles of the state. Second, HTN also serves to protect academic freedom, which is a fundamental right guaranteed by the constitution. However, tensions often arise between the academic freedom that must be protected and state supervision aimed at maintaining the quality of education. In the discussion, it was found that while state supervision is essential to maintain the relevance and quality of higher education, overly restricted academic freedom can stifle innovation and creativity in education. Therefore, wise policies are needed to create a healthy balance between state oversight and academic freedom. Thus, higher education in Indonesia can serve as a means for the nation's progress without sacrificing the freedom of thought that is essential for the development of science.

Abstract

In cases of judicial review, the extension of the Constitutional Court's authority from negative to positive legislators contests the potential conflicts with democratic institutions, particularly parliament and the government. This study aims to analyze four key aspects: the legitimacy of the Constitutional Court in making Positive Legislature decisions, the conflicts that emerge between democratic institutions and the Constitutional Court due to the issuance of positive legislature decisions, Constitutional Courts as positive legislators in a comparative study, and the efforts undertaken to resolve conflicts. The research utilized a doctrinal legal research method, relying on secondary data gathered across literature pieces and analyzed qualitatively. The findings reveal that the Constitutional Court's decision to take on a positive legislator role has sparked conflicts between the courts and democratic institutions in Indonesia. This conflict was exemplified when parliament and the government withstand Constitutional Court Decision No. 91/PPUU-XVIII/2020, which declared certain provisions of Law No. 11 of 2020 on Job Creation somehow conditionally unconstitutional. Viewed from a global perspective, the Constitutional Court's role as a positive legislator also challenges democracy issues in many countries. To mitigate such conflicts, it is crucial to establish a mutual understanding among the Constitutional Court, parliament, and the government regarding the guidelines that the Constitutional Court should follow while making positive legislature decisions and the implementation by parliament and the President.

Abstract

This research aims to discuss the background to the policy on the obligation to change Village-Owned Enterprises (BUMDes) from business entities to legal entities and the development of BUMDes legal entity status in Banyudono District, Boyolali Regency. Law Number 11 of 2020 concerning Job Creation in Article 117 amends Article 1 (6) of Law Number 6 of 2014 concerning Villages. Before the changes to the Village Law, BUMDes were described as business entities, whereas in the Job Creation Law BUMDes were described as legal entities. The research method used is empirical juridical, located in Banyudono District, Boyolali Regency, Central Java. The results of the discussion showed that 1) The aim of the promulgation of Article 117 of the Job Creation Law is to be able to absorb the widest possible Indonesian workforce amidst increasingly competitive competition and the demands of economic globalization, including at the village level by optimizing BUMDes. 2) In Banyudono District, Boyolali Regency, there are 15 (fifteen) villages and only 5 (five) BUMDes, but there are 2 (two) BUMDes that have not yet been incorporated, namely BUMDes Banyudono and BUMDes Hamlet.

Abstract

ABSTRACT Purpose of the study: The objective of this research is to investigate the positive legislature decision of the Constitutional Court, whose hierarchy is ambiguous in the order of Indonesian legal norms. Methodology: This study utilized a doctrinal legal research method with a legal realism approach. The data were sourced from primary, secondary, and tertiary legal materials. The authors employed the literature study as the method to collect data that were then qualitatively analysed. Results: The results of this study indicate that from a formal perspective, the positive legislature decision is a court verdict that falls under the jurisdiction of the judicial branch of power. However, from a material perspective, it encompasses elements such as regulations (regeling) that are genuinely located within the executive and legislative branches of power. Considering the presence of norms (regeling) in the Positive Legislature Decision, it is necessary to evaluate its position within the hierarchy of legal norms in Indonesia. Applications of this study: Constitutional judges can use this research as a reference in making positive legislative decisions. It can also be used as a reference in forming laws as a follow-up to the Constitutional Court's decision. Novelty/Originality of this study: This research revealed that the Constitutional Court's positive legislature decision includes elements of legal norms, also known as regeling, such as statutory regulations. Consequently, it is imperative to evaluate the position of courtly decisions within the hierarchical structure of legal norms in Indonesia. It is also crucial to find the legal reasoning for the Constitutional Court's positive legislature decision. Keywords: Constitutional Court Decisions, Positive Legislature, Legal Norms, Legal Hierarchy   ABSTRAK  Tujuan Penelitian: Penelitian ini bertujuan untuk mengkaji putusan perundang-undangan positif Mahkamah Konstitusi yang hierarkinya masih rancu dalam tatanan norma hukum Indonesia. Metodologi: Penelitian ini menggunakan metode penelitian hukum doktrinal dengan pendekatan realisme hukum. Data yang digunakan bersumber dari bahan hukum primer, sekunder, dan tersier. Metode pengumpulan data dilakukan dengan studi kepustakaan yang kemudian dianalisis secara kualitatif. Hasil Penelitian: Hasil penelitian ini menunjukkan bahwa dari segi formil, putusan perundang-undangan positif merupakan putusan pengadilan yang berada di bawah yurisdiksi cabang kekuasaan yudikatif. Namun, dari segi materiil, putusan perundang-undangan positif mengandung unsur-unsur seperti peraturan perundang-undangan (regeling) yang secara hakiki berada di bawah cabang kekuasaan eksekutif dan legislatif. Melihat keberadaan norma (regeling) dalam Putusan Perundang-Undangan Positif, maka perlu dikaji kedudukannya dalam hierarki norma hukum di Indonesia. Aplikasi Penelitian: Hasil penelitian ini dapat dijadikan acuan bagi hakim konstitusi dalam mengambil keputusan perundang-undangan positif. Dapat pula dijadikan sebagai acuan dalam pembentukan peraturan perundang-undangan sebagai tindak lanjut putusan Mahkamah Konstitusi. Kebaruan/Keaslian penelitian ini: Penelitian ini mengungkap bahwa putusan MK yang bersifat positif mengandung unsur norma hukum, yang juga dikenal dengan istilah regeling, seperti peraturan perundang-undangan. Oleh karena itu, penting untuk mengevaluasi kedudukan putusan pengadilan dalam struktur hierarki norma hukum di Indonesia. Abstract

This paper was written to describe maritime sovereignty disputes under the United Nations Convention on the Law of the Sea 1982 (UNCLOS). UNCLOS' 1982 role was enormous in resolving the South China Sea dispute, Indonesia's Malaysian dispute, and the Natuna islands dispute. The theoretical framework used in this paper to analyze case studies is the international regime and the theory of compliance with maritime dispute resolution. The results of this paper show that the jurisdiction of UNCLOS 1982 offers several paths in dispute resolution and prevents the occurrence of perpetual sea disputes.

Abstract

Background: Freedom of expression is still a problem in the implementation of democracy in Indonesia. Amnesty noted that throughout 2020 there were 132 cases of alleged violations of the right to freedom of expression using the ITE Law with a total of 156 victims, among them 18 activists and four journalists. In 2021, there have been 56 similar cases with a total of 62 victims. Aim: This research aims to discuss Indonesia’s reformation along with its obstacle throughout the years. Method: This study used a qualitative approach and a case study. The data was gathered from a number of different places. The sources explore the challenges that Indonesia has faced in its reformation over the years. Findings: The ITE Act is still needed to prevent and punish crime in the digital world. However, there are several articles in this Law that need to be revised because there are multi-interpretation articles, rubber articles, and semantic improvements of several articles to be better. If it is not immediately revised, then the public will be afraid to convey criticism for fear of making the critic's party entangled in the punishment of libel and defamation charges.
