Abstract

The three primary questions this research seeks to address are: How does criminal law approach environmental issues, such the PETI case, and what are the ethical philosophy of preventative initiatives' perspectives on solving environmental issues? as well as the measures taken by the government to address this issue. This paper uses a qualitative research methodology that is somewhat juridical-empirical in character. Written resources (books, journals, papers, etc.) are the source of data for this topic. This research study divides textual material into two categories: main and secondary. Criminal threats, such as jail time and fines, must exist for PETI offenders, as mentioned in the articles. Further criminal or disciplinary penalties under Article 119 Law Number 32 of 2009 concerning Environmental Protection and Management can be imposed on commercial companies. People need to understand their own roles, obligations, and responsibilities in life. in order for this moral idea to serve as a safeguard against human-caused environmental harm. Lastly, in regards to the government policies that also need to play a role in solving this PETI issue, these include: offering support to enable PETI to become a legal business; offering technical help; offering financial support for development; and offering access to prevent business actors from feeling pressured to legalize a business. the mining.

Abstract

This study aims to examine the authority of local governments and to identify an ideal regulatory model for community-based coastal area protection and management. This is crucial as most of these islands are small and rich in natural resources with high economic potential. Ironically, according to data from the World Bank and Statistics Indonesia (BPS), coastal communities remain largely impoverished. The study focuses on two main issues: (1) the extent of local government authority in regulating community-based coastal protection and management, and (2) the ideal regulatory model. Using normative legal research, the findings indicate that local governments hold such authority under laws including the 1945 Constitution, Law No. 1/2014, Law No. 23/2014, and relevant ministerial regulations. The ideal model is a regional legal policy (local regulation) specifically ensuring community participation in managing coastal resources to alleviate poverty and promote justice and welfare.

Abstract

This study aims to examine the halal certification application procedure for Korean cuisine products at LPPOM MUI East Java and assess its legality from the perspective of Islamic law. The research employs a qualitative method with a descriptive-analytical approach. The findings indicate that halal certification aligns with the 1945 Constitution and is supported by legal frameworks such as Law No. 8 of 1999, Law No. 18 of 2012, Law No. 33 of 2014, and Presidential Instruction No. 2 of 1991. Halal certification has become mandatory due to changes in the composition of food, medicine, and cosmetics. The application procedure includes HAS training, implementation of the halal assurance system, document preparation, registration, monitoring, field audits, and certificate issuance.

Abstract

Agreements found on online shopping websites, known as digital contracts, are binding for parties involved in electronic commerce. These include not only the business actors but also the platform providers acting as facilitators. Digital contracts often contain standard clauses unknowingly agreed upon by consumers. According to Article 1, point 17 of the ITE Law, electronic contracts are agreements made via electronic systems. Standard clauses are governed by Law No. 8 of 1999 on Consumer Protection. The rise of online commerce demands legal certainty to protect consumer rights. Consumer protection under the law ensures legal assurance for consumers in electronic transactions.

Abstract

Penelitian ini bertujuan untuk menjawab tiga hal utama: pandangan hukum pidana terhadap masalah lingkungan seperti penambangan emas tanpa izin (PETI), solusi preventif dari perspektif etika, serta peran pemerintah dalam penyelesaiannya. Pendekatan yang digunakan adalah kualitatif dengan pendekatan yuridis-empiris. Sumber data berasal dari bahan tertulis (buku, jurnal, artikel), baik data primer maupun sekunder. Sanksi pidana bagi pelaku PETI berupa pidana penjara dan denda, serta pidana tambahan atau tindakan administratif sebagaimana tercantum dalam Pasal 119 Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup. Manusia harus menyadari fungsi dan tanggung jawabnya dalam kehidupan, sehingga kesadaran moral menjadi langkah preventif terhadap kerusakan lingkungan. Pemerintah perlu berperan aktif melalui pendampingan, bantuan teknis, pembiayaan, serta kemudahan akses legalisasi agar pelaku PETI dapat beralih ke usaha yang sah.

Abstract

This research aims to analyse the role of Constitutional Law (HTN) in regulating higher education in Indonesia, especially in maintaining the balance between academic freedom and state supervision. The method used in this research is the normative juridical method, which focuses on the study of legislation related to higher education as well as legal practices applied in Indonesia. The analysis is conducted on Law No. 12/2012 on Higher Education and Law No. 20/2003 on the National Education System, as well as other implementing regulations. The results show that HTN has two main roles in higher education in Indonesia. First, HTN acts as an instrument that regulates and supervises higher education institutions to ensure education remains in accordance with national goals and the basic principles of the state. Second, HTN also serves to protect academic freedom, which is a fundamental right guaranteed by the constitution. However, tensions often arise between the academic freedom that must be protected and state supervision aimed at maintaining the quality of education. In the discussion, it was found that while state supervision is essential to maintain the relevance and quality of higher education, overly restricted academic freedom can stifle innovation and creativity in education. Therefore, wise policies are needed to create a healthy balance between state oversight and academic freedom. Thus, higher education in Indonesia can serve as a means for the nation's progress without sacrificing the freedom of thought that is essential for the development of science.
