Abstract

The purpose of this study is to determine the role of the Village Government in Empowering Farming Community and to find out how the factors that encourage and hinder the village government in empowering the community in Pakondang Village, Rubaru District, Sumenep Regency. This study uses a qualitative approach that emphasizes the human element as a research instrument. Based on the results of the research that has been done, the authors can draw the conclusion that the role of the village government in empowering farming communities can be seen from several indicators, namely: The role of the village government in fostering. The development of the life of the village community is carried out by the village head using the concept of awareness and willingness of the community itself. The role of the village government in providing services and development to the community such as in the activities of the agricultural sector, the very large contribution in agriculture is farming activities. Based on the results of interviews in the field, it shows that the government plays a very important role in providing empowerment to the community, especially in the field of agriculture, as well as the village government has provided training for the farming community on the manufacture of manure from cow dung who brought in trainers from the agricultural service with the driving factor of power as a village head who is responsible for the welfare of his village and the community is very responsive to the farmers community's creativity training on making their own fertilizer and the inhibiting factor is that many people still lack knowledge.

Abstract

Di Indonesia ini, ada banyak norma hukum yang sudah mengatur tindak pidana pembunuhan, termasuk mutilasi. Tindak pidana mutilasi telah diatur dalam berbagai peraturan perundang-undangan di Indonesia.  Perspektif kriminologi menyebutkan atau menggariskan pada pembahasan masalah faktor-faktor penyebab terjadinya tindak pidana mutilasi dan modus operandi kejahatan atau tindak pidana mutilasi, khususnya yang terjadi di Indonesia. Perspektif viktimologi menekankan pada aspek korban, yakni ketika seseorang menjadi korban tindak pidana mutilasi, mengapa sampai seseorang bisa menjadi korban mutilasi. Karena tindak pidana ini termasuk jarang terjadi atau hanya pada pelaku tertentu, sehingga kajiannya tidak mudah, apalagi yang berkaitan dengan  posisi korban.Kata kunci: korban, mutilasi, HAM, hukum, viktimologiIn Indonesia, there are many legal norms that already regulate murder, including mutilation. Abstract

Criminology perspective mentions or outlines in the discussion of the problems of the factors causing the occurrence of criminal acts of mutilation and modus operandi of crimes or criminal acts of mutilation, especially those that occur in Indonesia. The victimology perspective emphasizes the aspect of the victim, that is, when a person becomes a victim of a criminal act of mutilation, why can someone become a victim of mutilation. Because these crimes are rare or only occur in certain perpetrators, so the study is not easy, especially related to the position of the victim.

Abstract

Pandemi COVID-19 merupakan kejadian luar biasa yang harus segera ditanggapi oleh negara/pemerintah. Hal itu karena COVID-19 berdampak terhadap kesehatan masyarakat. Dalam Pasal 25 UDHR menyebutkan bahwa setiap individu berhak atas derajat kehidupan yang layak akan kesehatan. Disamping itu, kesehatan merupakan bagian dari hak asasi manusia. UUD 1945 juga mengatur pemenuhan kesehatan dengan menciptakan kehidupan yang sehat bagi masyarakatnya sebagaimana dalam Pasal 28 H Ayat 1. Penelitian ini bertujuan untuk mengkaji tanggung jawab negara terhadap pemenuhan hak kesehatan masyarakat di masa pandemi sesuai dengan yang diamanatkan Undang-undang Dasar 1945 Pasal 28 H Ayat 1. Metode yang digunakan adalah metode penelitian yuridis normatif (legal research) yaitu melakukan telaah bahan pustaka terhadap peraturan dan literatur yang berkaitan dengan permasalahan yang diteliti. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) dengan menggunakan analisis preskriptif. Hasil yang didapatkan dari penelitian ini ialah negara/pemerintah telah memenuhi tanggung jawabnya terhadap kesehatan masyarakat dengan melakukan berbagai upaya yang terimplementasikan dalam berbagai kebijakan di masa pandemi.

Abstract

Sexual violence can happen to anyone regardless of gender. The perpetrator of violence also allows the person closest to the victim. Sexual violence is increasing from year to year. In 2021 there were 1,902 and 2022 3.442 cases of sexual violence that occurred. Sexual violence can be physical and psychological. The state of Indonesia is experiencing serious violence and sexual harassment because the victims of sexual violence are mostly women, while the age of the victims of sexual violence is that most are children compared to adults. And the perpetrators are mostly adults. The government has made efforts to reduce this action by making existing regulations. As is the case in the Criminal Code regarding the concept of sexual violence contained in Articles 285 and 289. Article 285 regarding the maximum sentence for perpetrators of rape, namely 12 years in prison, while Article 289 regarding imprisonment for nine years for those who commit, threaten with violence, force or allow acts obscene The government has made efforts to reduce acts of sexual violence, by making statutory regulations that regulate sexual violence, the Law on Sexual Violence No. 12 of 2022 which was ratified on April 12, 2022, the legal basis for the protection of sexual violence against children in the Criminal Code, laws that regulate sexual violence in Indonesia. However, in reality it is still not effective, it is hoped that the government will make policies regarding actions taken for this sexual violence.

Abstract

Preventing criminal acts of money politics in general elections is an important effort to maintain election integrity and the sustainability of democracy. The practice of money politics can threaten democratic principles, such as justice, participation and accountability. To overcome this problem, public education, information campaigns and community involvement play a crucial role in building public awareness of the dangers of money politics. This article discusses several key issues related to money politics, including factors that influence people to become involved in money politics, the negative impact of money politics on the integrity of elections and democracy, as well as effective strategies for building public awareness. Apart from that, this article also highlights the important role of public education, information campaigns and community involvement in preventing money politics in the 2024 elections. Through this collaborative effort, it is hoped that the public can be actively involved in honest, fair and transparent elections and avoid the rise of politics. Money.

Abstract

Abstract

In the 1945 Constitution of Indonesia, the government of the Republic of Indonesia acknowledges the existence of villages, customary rights, and commits to respecting diversity while providing constitutional protection to all village communities. Village governments are entrusted with the responsibility of managing village finances in accordance with the provisions set forth in Law Nomor 6 of 2014 concerning Villages. This responsibility encompasses financial management, assets, and village income, all aimed at improving the quality of life for the village population. Despite the potential for issues such as fraud and corruption committed by village officials or village governments, this research primarily focuses on the position of village finances within the framework of national financial oversight and the implementation of supervision over village financial management in accordance with village financial regulations in Indonesia. To establish the position of village finances as an integral part of national finances, there is a need for new legal provisions and incentives that unequivocally state that village finances are indeed a component of national finances. The implementation of oversight over national financial management is governed by Regulation of the Minister of Home Affairs Nomor 73 of 2020, whicinvolves various stages including planning, execution, reporting, and follow-up supervision.

Abstract

It is hoped that the formation of regional regulations can be a solution in forming aspirational legal products in the region by involving community components. In addition, through the preparation of a program for the formation of regional regulations regarding the Program for the Formation of Regional Regulations which involves the community as definite, standard, standard, systematic and planned guidelines, it is possible to create aspirational regional legal products that can be accepted and implemented among the community. By involving the community in the formation of regional legal products, it will have a positive impact in creating a peaceful, orderly and prosperous society in the context of regional autonomy. Based on this, the problem identification that can be formulated is how the community plays a role in the formation of regional legal products. So that it can create regional legal products that are aspirational and in line with community development.

Abstract

One of the development efforts within the national development framework, the government/government agencies/institutions at every level carry out development authority for the Public Interest. Based on the concept of the State's Right to Control, the Government, on behalf of the Land State, has the absolute right to regulate, determine and determine land rights for the sake of realizing the welfare of the people. On the other hand, the government has an interest in acquiring land for the public interest. In this research, a juridical study was carried out on what is the state's right to control land in land acquisition for public purposes? And what is the government's authority to acquire land for public purposes? The aim of this research is to determine the state's right to control land for the public interest and to find out what the government's authority is in acquiring land for the public interest. The method used in this research is the Normative Juridical method, namely comprehensively reviewing the legal aspects of statutory provisions related to the settlement of compensation for land acquisition for the public interest. In this research, it was found that the State is only limited to regulating, determining and determining the allocation of land rights, and in procuring land for the public interest, the government or agencies using land as development objects are obliged to provide compensation in accordance with the value determined by the assessment team.
