Abstract

A decade after the enactment of Law Number 24 Year 2009 on the Flag, Language and Coat of Arms and Anthem which introduces mandatory use of Indonesian language in memorandums of understanding or agreements involving state institutions, government agencies, Indonesian private institutions or Indonesian citizens, there are still many questions arised about the extent of which these norms should apply in the private commercial sphere.  Various litigations filed before the court to declare the agreement null and void for failure to meet the language provisions. While some lawsuit has been successful, but more recent court decisions have been consistently rejecting petition to declare an agreement as null and void for failure to comply with article 31 Law Number 24 Year 2009.This paper will conduct a normative study to determine the extent of which the mandatory use of the Indonesian language in the agreement has affect the private commercial sphere. In what instance violation of the provision has been fully regarded as violation of an Objective Condition for a valid agreement as regulated in Article 1320 of the Civil Code which makes the agreement null and void by law and what does not.This paper will study the laws and regulations related to the mandatory use of the Indonesian language in private commercial contracts to find out about situation and study its implementation in selected court decisions to understand the situation and provide possible recommendation for improvements

Abstract

One of the digital economy transactions is the transaction on YouTube monetization received by video creators based on viewers in a source country. Overseas video creators do not pay Income Tax (PPh) in Indonesia on income from Youtube videos sourced in Indonesia because there is no physical presence of the video creator in Indonesia and no identified income as a tax object on which the Indonesian tax authorities impose PPh on the overseas video creator. This condition creates legal uncertainty, injustice, and loss of benefit for Indonesia as a source country due to the loss of potential PPh revenue from the digital market. Currently, Article 32A of the General Provisions and Tax Procedures (KUP) Law has provided a formal tax law to be able to appoint other parties as PPh withholders. However, the implementation is not yet possible because the material tax law is not yet sufficient to designate other parties, such as Google, which are not domiciled and have no permanent establishment in Indonesia as PPh withholders. To achieve legal objectives, the PPh Law as material tax law needs to be strengthened to provide legal certainty in the PPh withholding on foreign video creators and create justice and benefits for Indonesia as one of the source countries for video creators' income. Strengthening the PPh Law is conducted by amending the provisions of Article 26, Article 2 paragraph (4), and Article 4. The amendment to the PPh Law does not result in revisions of the P3B Indonesia and other countries since the allocation of taxation rights for royalty income from the source country has been regulated in the P3B. Furthermore, the government could make implementing regulations regarding the PPh withholding by other parties on income from the utilization of content copyrights received by YouTube video creators.

Abstract

Indonesia is a developing country with an expanding healthcare market, which faces the enduring challenge of fostering a pharmaceutical patent system that incentivizes research and development while ensuring broad access to affordable medicines. This study aims to offer policy recommendations that balance the need for pharmaceutical innovation with the imperative of maintaining an accessible and competitive healthcare landscape. The study includes a review of pharmaceutical patent regulations in India, Brazil, the United States, and the European Union. It integrates empirical data analysis to assess patent application trends and market dynamics, utilizing a difference-in-differences econometric model to establish causality between policy reforms and sector changes. It highlights the necessity of public health safeguards, proposing mechanisms like conditional compulsory licensing as critical elements in the patent reform framework. The study emphasizes actionable policy recommendations while incorporating stakeholder perspectives from regulatory authorities, pharmaceutical firms, and public health organizations to understand the implications for investment, competition, and medicine accessibility. By implementing these strategic policy adjustments, Indonesia can maximize the benefits of Law No. 65 of 2024 while safeguarding public health and promoting domestic pharmaceutical innovation in a rapidly evolving global landscape.

Abstract

Introduction: The fulfillment of the right to housing is a national problem that must be resolved. Jakarta is the capital city of Indonesia which faces problems in fulfilling the right to housing. The apartment area has been built to respond to these problems.Purposes of the Research: The purpose of this study is to analyze the management and licensing of apartments in Jakarta City.Methods of the Research: This research is a normative juridical research. It uses several approaches, namely the statute approach, the conceptual approach, and the comparative approach. The type of data used consists of primary legal materials, namely the 1945 Constitution of the Republic of Indonesia, Law Number 1 of 2011 concerning Housing and Settlement Areas, Law Number 20 of 2011 concerning Apartments.Results of the Research: Based on the results of the study, it was found that there were many cases, for example the case in Decision concerning the Privatization of SPAM and the unilateral determination of BPPL between the Sentul City against PT Sentul City. Based on this case, there was a legal uncertainty regarding the management and licensing of the apartment area in Jakarta

Abstract

The culture of “reciprocity” remains preserved and continues to serve as the foundation for the implementation of customary/Adat marriages among the indigenous Sea Tribe community in Lingga Regency. This study aims to strengthen cultural norms and regulatory frameworks, while also addressing the enforcement of such cultural practices. Employing an empirical legal approach, the study found that the practice of reciprocity conflicts with the prevailing national marriage law. Specifically, due to imbalances in social obligations, the Sea Tribe community often carries out child marriages based on custom without obtaining a court-issued marriage dispensation, as legally required. Furthermore, the Sea Tribe can no longer be classified as an Adat law community, as it no longer meets the criteria; instead, it should be regarded as a customary community that remains subject to national law. Drawing on Satjipto Rahardjo’s Theory of Legal Compliance, the study identifies three key factors contributing to the community’s non-compliance with marriage law: the lack of proper legal indoctrination, entrenched collective habits, and a limited understanding of the benefits of legal obedience. Consequently, the continued application of the reciprocity culture results in violations of children’s rights to health and education within the community. In light of Mochtar Kusumaatmadja’s Theory of Development Law, this study underscores the need for marriage law to more effectively govern the practices of the Sea Tribe community.

Abstract

Intellectual property (IP) is a key component of the global economy, and it is also a critical component of ensuring global competitiveness. It is essential for organizations and inventors seeking robust global intellectual property protection to maintain competitive advantage. This study examines the role of structured innovation in enhancing patent approval rates, mitigating legal risks, and accelerating market entry for technological innovations. The study employs a mixed-methods approach, integrating legal analysis, case study evaluations, empirical data collection, and AI-based predictive modeling to provide an in-depth understanding of the factors contributing to successful patent filings and long-term intellectual property sustainability. The research also examines emerging trends in artificial intelligence and predictive analytics that are reshaping the landscape of IP management. The findings derived from this study serve as a valuable resource for policymakers, legal practitioners, and industry stakeholders seeking to enhance their innovation strategies in an increasingly competitive and complex intellectual property landscape. Specifically, this study aims to provide a strategic roadmap for optimizing patent filing and securing global protection by evaluating real-world applications and examining cross-jurisdictional intellectual property frameworks. A comparative study of patent laws across key jurisdictions, including the United States, the European Union, and China, highlights critical differences in examination procedures, enforceability, and litigation risks, providing comparative insights essential for businesses operating in global markets. The empirical findings underscore that structured innovation methodologies contribute to higher patent success rates and reduce legal uncertainties, enforcement complexities, and post-grant challenges.

Abstract

The integration of Artificial Intelligence (AI) into scientific advancements has become a crucial part of daily life for many people. In the creative industry, AI has the potential to not only enhance the level of creativity, but also productivity. The legal implications of this development must be carefully analyzed for the development of the creative industry, to establish a legal position on where AI stands in the increasingly competitive market, especially when Intellectual Property Right (IPR) as a key factor is taken into account. This research examines the need for a legal framework for AI. It was conducted through the lens of intellectual property law, to determine its place within existing IPR regimes using the comparative legal method. The results conceptually justify the urgency to regulate AI, and highlights the taxonomy dilemma of AI-generated works within the current dynamics of the creative industry, indicating a taxonomy dilemma. Further analysis also indicates that while there’s a decent urgency to address all of the normative issues that exist within Indonesia’s IPR legal framework, it’s imperative that Indonesia prioritizes the development of the copyright and patent regimes, which are closely related to the nature of AI-generated works.

Abstract

In carrying out a land sale and purchase agreement, a Notaryis required. Notaries are public officials who have the authority to make authentic deeds relating to land. In a land sale and purchase agreement made before a Notary, the Sale and Purchase Agreement must be executed first by the parties before it is made into a Deed of Sale by the Land Deed Official. An agreement is the most important thing in a land sale and purchase agreement, and each party has the freedom to determine what conditions they wish to agree upon. However, in some occasion, making an agreement in an authentic deed would allow legal problems to arise. Legal problems can arise if a Sale and Purchase Agreement is executed on a plot of land with former eigendom rights which has not yet been converted. Furthermore, because the plot of land with former eigendom rights is a land that has not been converted yet, its status is a land controlled by the state. State land cannot be the object of land sale and purchase, therefore, the land cannot be traded.The aim of this research is to analyze the Notary's responsibilities regarding sales and purchase agreements for state land with former eigendom rights. The legal research method used is normative-empirical, the type of approach used is the Approach to Legal Cases (Case Study) and the Approach to Legal Systematics. The type of data used is by using secondary data sources supported by primary data, and the method of obtaining data is by literature study and interview techniques.Bahasa Indonesia Abstrak: Dalam melakukan perjanjian jual beli tanah diperlukan profesi Notaris. Notaris sebagai pejabat umum yang berwenang untuk membuat akta autentik peralihan hak atas tanah atau membuat akta yang berkaitan dengan pertanahan. Dalam perjanjian jual beli tanah, Perjanjian Pengikatan Jual Beli harus dibuat di hadapan Notaris dan dilaksanakan terlebih dahulu oleh para pihak karena adanya syarat-syarat atau keadaan yang harus dipenuhi sebelum dibuat menjadi Akta Jual Beli oleh PPAT. Suatu kesepakatan menjadi hal yang terpenting dalam Perjanjian Pengikatan Jual Beli tanah di hadapan Notaris, dan setiap pihak mempunyai kebebasan untuk menentukan syarat-syarat yang ingin diperjanjikan. Namun pada kenyataannya, dalam pembuatan perjanjian dalam akta autentik memungkinkan terjadinya permasalahan hukum. Permasalahan hukum dapat terjadi apabila dilakukannya Perjanjian Pengikatan Jual Beli atas sebidang tanah bekas hak eigendom yang hingga saat ini belum dikonversi dan dilakukan pendaftaran di Badan Pertanahan Nasional. Lebih lanjut, karena objek tanah bekas hak eigendom yang menjadi objek jual beli adalah tanah yang belum dikonversi, maka tanah tersebut merupakan tanah yang dikuasai oleh negara. Oleh karena itu, tanah tersebut tidak bisa diperjualbelikan karena tanah negara tidak bisa menjadi objek jual beli tanah. Tujuan dari penelitian ini adalah untuk menganalisa tanggung jawab Notaris terhadap perjanjian jual beli tanah negara bekas hak eigendom. Metode penelitian hukum yang digunakan adalah normatif empiris, jenis pendekatan yang digunakan adalah pendekatan terhadap kasus hukum (case study) dan pendekatan terhadap sistematika hukum. Jenis data yang digunakan adalah menggunakan sumber data sekunder yang dikuatkan dengan data primer, dan cara perolehan data dengan studi kepustakaan dan teknik wawancara.

Through a comparative analysis of legal frameworks, case studies, and empirical data, this study presents insights for inventors and organizations seeking to optimize their patent portfolios. The findings underscore the importance of integrating structured methodologies with legal foresight to enhance global competitiveness and innovation sustainability. Future research directions include the application of structured patent filing to emerging fields such as AI-driven biotechnology and blockchain-based intellectual property management.

Abstract

he integration of artificial intelligence (AI) into various sectors, including banking, has grown increasingly prevalent. AI holds significant potential in the banking system, particularly in financial risk analysis. However, its utilization requires a robust legal framework to ensure ethical and accountable application. This study aims to analyze the direction of Indonesia's legal policy and develop a legal framework model that supports the ethical use of AI for financial risk analysis in the banking sector. The research employs a normative legal research method. Through this method, the study identifies several normative issues that may negatively impact the use of AI for financial risk analysis. These issues range from fundamental legal norms, such as accountability for AI utilization, to more technical concerns, including transparency, cybersecurity, and data privacy. The findings highlight gaps in the current regulatory framework, necessitating an urgent response to accommodate the complexities introduced by AI technologies in financial systems. This research proposes a legal framework development model to provide a normative construction for relevant regulations. The proposed model emphasizes the pivotal role of the Financial Services Authority (OJK) in implementing and monitoring regulations based on the framework. By addressing these regulatory challenges, the model seeks to facilitate the ethical and responsible deployment of AI in financial risk analysis while safeguarding stakeholder interests and ensuring compliance with prevailing legal principles. Pemanfaatan artificial intelligence (AI) dewasa ini semakin terintegrasi ke dalam berbagai sektor, seperti salah satunya sektor perbankan. AI memiliki potensi yang signifikan dalam sistem perbankan, khususnya untuk digunakan dalam analisis risiko finansial. Namun pemanfaatan ini perlu diakomodasi dengan kerangka hukum yang memadai, untuk memastikan pemanfaatan sistem AI yang etis dan bertanggung jawab. Tujuan penelitian ini adalah untuk menganalisis arah politik hukum Indonesia serta mengembangkan model pengembangan hukum yang dapat diterapkan untuk mendukung pemanfaatan AI yang etis untuk tujuan analisis risiko finansial dalam sistem perbankan. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Dengan menggunakan metode penelitian hukum normatif, hasil penelitian ini menemukan beberapa permasalahan normatif yang dapat berdampak negatif terhadap pemanfaatan AI untuk analisis risiko finansial, mulai dari norma hukum yang mendasar seperti pertanggungjawaban mengenai pemanfaatan AI, hingga yang bersifat lebih teknis seperti transparansi, keamanan siber, dan privasi data. Penelitian ini mengusulkan model pengembangan hukum yang dapat dimanfaatkan untuk memberikan gambaran konstruksi normatif bagi beberapa peraturan perundang-undangan relevan, dengan mendukung OJK sebagai bagian sentral dari penerapan dan pengawalan regulasi berdasarkan model tersebut.
