Abstract

Research aims to understand a style learning and study results style and influence in the learning student learning islamic education x a state sma palopo 4. Type this study quantitative with the design ex-post facto capital with a population of 51 students with the sample is covering sampling.Data drawn through the survey data processed by analysis descriptive statistics and statistics inferential.The research results show that study visual style, auditory, students and a kinesthetic having influence in the the highest student learning study visual style of 13,2 %.Religious education study results people in the 28 people and frequency the 55 % the percentage.And influence the style of student learning islamic education in the learning supported by r2 ( r square) of 0,360 or 36 % style learning in the learning student effect for  islamic education.

Abstract

In fact, there are still many people living in poverty where they cannot fulfil their basic needs, be it food or clothing, there are still many children who drop out of school which causes ignorance. Education is one of the things that can change a family to be prosperous, therefore the government is obliged to fulfil this right. The problem in this paper is what form of government responsibility to fulfil the basic rights of the unprosperous people in education? The writing method used is normative with more emphasis on positive legal norms in the form of statutory regulations. The result of the discussion of this writing is that education is the basic right of the unprosperous people fulfilled by the government. In carrying out its responsibilities, the government fulfils the basic rights of the unprosperous people in several programs. Education which is the basic right of the unprosperous people is provided by the social service through PKH, while the Education Office provides these rights through (PIP) As stated in Article 31 of the 1945 Constitution, the community is required to get an education and the government is responsible for this, with some Indonesian program has fulfilled the rights of the unprosperous people in education.

Abstract

The Board of Directors in carrying out the management of the company is subject to the principles of civil law. If the Board of Directors deviates from the principle, it is called conducting Ultra Vires. This action can certainly have positive and negative consequences for shareholders both majority and minority can test at the General Meeting of Shareholders. The ultra vires action by the directors is detrimental to the creditor, the legal mechanism that needs to be studied in more depth to get the answer. This study aims to analyze the legal protection of creditors for directors of limited companies conducting Ultra Vires and analyze legal remedies against restoring the creditor's rights to directors of limited companies conducting Ultra Vires. (1) Does the law regulate the protection of creditors for directors of limited companies conducting Ultra Vires ?; (2) How does the law restore creditor rights over the directors of the limited company to conduct Ultra Vires ?. With these legal issues, the basis for protecting third parties. These principles include the Goodwill Principle, the Pacta Sunt Servanda Principle and the Modern Ultra Vires Doctrine. By relying on these fundamentals, preventive legal protection and repressive legal protection can be given. Legal remedies for recovery are based on the first, actions containing aspects of repairing and preventing, and secondly, actions or efforts containing aspects aimed at recovering, including ratification and compensation.

Abstract

Data mengatakan Indonesia merupakan negara yang kaya akan sumber daya alam, bahkan menjadi negara dengan sumber daya alam paling melimpah di dunia. Perspektif kekayaan intelektual, potensi-potensi itu merupakan produk yang dapat dilindungi berdasarkan kepemilikan komunal indikasi geografis. Setelah meratifikasi beberapa perjanjian internasional, terutama Persetujuan TRIPs, Indonesia berkewajiban memiliki regulasi yang memberikan perlindungan kepada indikasi geografis. Pada beberapa regulasi yang pernah ada, pemerintah daerah diberikan kewenangan sebagai pemohon saat pendaftaran sebuah produk sebagai indikasi geografis di kementerian. Faktanya, peran pemerintah daerah kurang optimal, terutama bila dilihat dari potensi yang dimiliki, ditambah regulasi sifatnya tidak imperatif. Penelitian ini bersifat normative dengan pendekatan perundang-undangan. Dari hasil kajian yang sudah dilakukan, didapati hasil bahwa kedudukan pemerintah daerah dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis tidak imperatif mengatur secara spesifik kedudukan pemerintah daerah, sehingga dengan yang melimpah hanya sedikit yang didaftarkan akibat kurangnya kontribusi pemerintah daerah.

Abstract

Problematika muncul ketika partai politik memiliki kewenangan yang cukup besar dalam menentukan calon presiden dan calon wakil presiden berdasarkan adanya presidential threshold. Hal ini mendorong terbentuknya koalisi besar antar partai politik yang sering kali tanpa tandingan. Identifikasi masalah yang diangkat dalam artikel ini adalah: Apakah penguatan presidential threshold berdampak pada polarisasi partai politik di Indonesia? dan Bagaimana keberlanjutan sistem check and balances dalam konteks ketatanegaraan Indonesia?, Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian menunjukkan bahwa presidential threshold memiliki dua sisi kepentingan yang saling terkait, dengan kadar kepentingan yang sama bagi partai politik. Sistem check and balances memerlukan penegasan yang lebih nyata melalui aturan yang ada, karena hal ini memiliki konsekuensi yuridis terkait hubungan timbal balik antar kekuasaan dalam sistem pemerintahan presidensial.

Abstract

Legal protection is very important in credit agreements, especially for lenders/creditors (creditors). Legal protection is all forms of efforts to protect respect and recognition of human dignity and human rights in the field of law. Credit is generally used to facilitate business and plays a very important role in Indonesia's economic activities. Its position applies to both manufacturing companies and private companies which are developed independently because it aims to improve the people's standard of living. As a financial institution that provides financial services, banks play a role in economic activities by providing credit through bank loans and other means in the form of credit agreements between creditors who are lenders, or lines of credit with obligors who are debtors who have helped meet funding needs. The problem is about the form of legal protection for creditors if the debtor defaults and what sanctions are imposed by the creditor if the debtor defaults. The results obtained from this legal research are a form of legal protection given to creditors when the debtor defaults according to Law Number 4 of 1996, namely a credit agreement set forth in the form of a deed, either in the form of an underhand deed or an authentic deed in accordance with the Elucidation of Article 10 of the Law -Law No. 4 of 1996, that by issuing a Mortgage Letter by the Land Office as proof of the existence of a Mortgage which is irah-irah and has the same executor power as a judge's decision which has permanent legal force, then if the debtor defaults or defaults, he can ask for help directly to the Head of the local District Court to carry out the execution through a public auction in order to obtain payment of creditors' receivables. As well as the interpretation in Law Number 4 of 1996 which provides legal protection to creditors, namely the provisions of Article 1 number 1 concerning creditor preference rights; Article 6, Article 14 paragraphs (1), (2), and (3) and Article 20 paragraphs (2) and (3) concerning the implementation of Mortgage Rights; Article 11 paragraph (2) regarding promises that must be included in the Deed of Granting Mortgage Rights (APHT) to protect creditors if the debtor defaults, as well as the provisions of Article 7 concerning the principle of droit de suite which states that mortgage rights still guarantee objects even though they are transferred to third parties so that they remain guarantee the payment of creditors' receivables.
