Abstract

Cryptocurrency has become a key focus in the evolving landscape of virtual finance, sparking a divide among Islamic scholars. The debate centres on whether cryptocurrency should be considered permissible for transactions under Islamic law. This study explores the polarisation among scholars, some of whom permit cryptocurrency use while others prohibit it. Using normative legal research methods with statutory and conceptual approaches from an Islamic law perspective, the study draws on secondary data, including primary, secondary and tertiary legal materials. The findings reveal that some scholars oppose cryptocurrency due to its lack of intrinsic value and high volatility, which leads to gharar (uncertainty). Conversely, others argue that cryptocurrency can be permitted if limited to monetary functions and not for other purposes. The study concludes by recommending that, as cryptocurrency becomes increasingly prevalent, Islamic scholars should work to establish ijma’ (consensus) and qiyas (analogical reasoning) to form a clear basis for determining its permissibility according to Islamic principles.

Abstract

Zakat is primarily an economic instrument used to achieve socio-economic justice. This goal can be accomplished if management is done properly and correctly. The purpose of this article is to analyze the legal policy of zakat management with the model of the voluntary system and its implications for the realization of social and economic justice in the community. This research is normative legal research with primary legal sources in the form of laws and regulations related to zakat management legal policies, which are then analyzed descriptively and qualitatively. According to the findings of the study, the legal policy of zakat management with a voluntary system model is based on the principle of community volunteerism in zakat payment. This voluntary system model is heavily reliant on public legal awareness regarding zakat payment. The use of the voluntary system model has consequences for the community's non-optimal fulfillment of social and economic justice, which is caused by a lack of state involvement through legal policies. The state's role is required to enforce the zakat law by compelling zakat obligors to fulfill their obligations. On the other hand, the potential for zakat remains enormous, and it must be managed optimally.

Abstract

Penelitian ini bertujuan untuk menganalisis dampak ekspansi ritel waralaba terhadap keberlangsungan pasar tradisional di Kabupaten Polewali Mandar dan menganalisis efektivitas Peraturan Bupati (Perbup) Kabupaten Polewali Mandar Nomor 47 Tahun 2022 tentang Pedoman Teknis Pengembangan, Penataan dan Pembinaan Toko Swalayan. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan sosiologi hukum (socio-legal approach) dan pendekatan perundang-undangan (statutory approach). Data primer diperoleh melalui wawancara mendalam dengan pelaku usaha ritel modern, pedagang pasar tradisional, dan observasi lapangan terkait kepatuhan zonasi serta jam operasional. Hasil penelitian menunjukkan bahwa 1) Dampak ekspansi ritel modern di Kabupaten Polewali Mandar di satu sisi memicu penurunan omzet pedagang tradisional akibat pergeseran preferensi konsumen terhadap kenyamanan, kepastian harga, dan legalitas administratif; namun di sisi lain, pasar tradisional tetap menunjukkan resiliensi melalui keunggulan komparatif pada komoditas pangan segar dan fleksibilitas tawar menawar yang ada. Penelitian ini merekomendasikan agar pemerintah daerah dapat melakukan sinkronisasi perizinan yang ketat, pengawasan lapangan yang konsisten, serta pendampingan teknis bagi produk lokal agar regulasi dapat berfungsi sebagai instrumen proteksi ekonomi yang baik.
