Abstract

The universal protection of human rights rests on a set of basic concepts known as human rights. This research aims to analyze (1) How does the low level of constitutional awareness among Indonesian society affect the implementation of human rights (HAM) and constitutional sovereignty in real practice? and (2) What is the impact of the lack of citizenship education on understanding constitutional rights and responsibilities as citizens towards realizing the goals of social justice mandated by the Indonesian constitution?. The research method used in this research is normative legal research with a descriptive analytical approach. The research results show that low constitutional awareness has a serious impact on the implementation of Human Rights and the sovereignty of a country's constitution. Citizenship education is likened to a rail or means that guides citizens to become good citizens. Increasing constitutional awareness and citizenship education are expected to support the struggle for legal justice in Indonesia. It is hoped that a society that is more aware of the constitution can play an active role in protecting and fighting for human rights (HAM), as well as supporting constitutional sovereignty to achieve the goals of social justice.

Abstract

This study seeks to analyse the constitutional provisions on political neutrality within the framework of Indonesia's democratic process, particularly as it pertains to the establishment and upkeep of a democratic society founded on social fairness and the preeminence of legal principles. This study examines applicable laws, legal theories, and police procedures via a normative-philosophical and descriptive analytical lens. Findings highlight the need of political neutrality in state administration and bureaucracy for maintaining a just and fair democracy. Government impartiality and honesty can only be restored by overhauls to political ethics and the inner workings of bureaucratic politics. In light of Pancasila and the Constitution of the Unitary State of the Republic of Indonesia (1945), this conclusion stresses the need of cooperation across different parts of the country in order to establish a national legal system that upholds democracy and social justice.

Abstract

Abstrak: Kehidupan perekonomian masyarakat hukum adat sangat bergantung pada kekayaan sumber daya alam, dan hutan adat adalah salah satu dari sekian banyak kekayaan alam yang dapat dikelola. Namun tidak semua masyarakat hukum adat dapat mengelola hutan yang ada dalam wilayah adat untuk memenuhi kebutuhan hidupnya, hal ini disebabkan karena kepemilikan negara atas hutan begitu kuat, untuk itu pengetahuan dan kesadaran hukum masyarakat hukum adat harus ditingkatkan. Adapun kegiatan in di di Negeri Sohuwe dan Negeri Waraloin dengan tujuan untuk memberikan pemahaman dan meningkatkan pengetahuan tentang implikasi hukum penetapan hutan adat bagi peningkatan perekonomiannya. Metode yang digunakan yaitu sosialisasi atau penyuluhan dan diskusi. Hasil dan kesimpulan yang didapatkan adalah ada anggota masyarakat yang telah mengetahui dan ada juga yang belum mengetahui tentang penetapan hutan adat dan implikasinya, selain itu lewat diskusi yang dibangun, ditemukan bahwa ada upaya menghalang-halangi masyarakat dalam mengelola hutan adat dengan alasan bahwa hutan tersebut merupakan hutan lindung. Strengthening the Legal Implications of Customary Forest Designation for Economic Improvement of Customary Law PeoplesAbstract: The economic life of indigenous peoples depends heavily on the wealth of natural resources, and customary forests are one of the many natural resources that can be managed. However, not all customary law communities can manage forests in customary territories to meet their needs; this is because state ownership of forests is so strong that knowledge and legal awareness of indigenous peoples must be improved. The activities in Sohuwe State and Waraloin Country aim to provide understanding and increase knowledge about the legal implications of establishing customary forests for economic improvement. The methods used are socialization, counselling, and discussion. The results and conclusions obtained are that community members already know, and some need to learn about customary forests' designation and implications. Besides that, through discussions that were built, it was found that there are efforts to hinder the community in managing customary forests because the forest is a protected forest.

Abstract

ABSTRACT: One of the important instruments in environmental management is permits. Licensing in an environmental context is referred to as an environmental permit. Environmental permits are understood as an important element in efforts to control activities and/or businesses so that the environment does not suffer a detrimental impact. In order to fulfill administrative activities to obtain environmental approval, there are documents that must be fulfilled, namely, AMDAL or UKL -UPL. After fulfilling one of these conditions, an environmental permit will be issued by the Minister, Governor, or Regent/Mayor in accordance with their authority by including the requirements contained in the environmental feasibility decision document or UKL-UPL recommendation. The research method used in this writing uses normative juridical research, where this type of research is analytical. The sources of legal materials used are primary and secondary legal materials. The collection technique is through literature study and then analyzed through descriptive methods. To obtain environmental approval, there are several conditions that must be met, one of which is through the ANDAL and RKL-RPL addendum. ANDAL is used as a careful assessment of the impact of an activity. ANDAL aims to analyze an activity that has the potential to have an impact on the environment, which will also become an important point in making decisions regarding permits for an activity. So it can be concluded that ANDAL is also the most important part of granting environmental approval.

Abstract

ABSTRACT: In carrying out or issuing decisions or actions, the government must determine based on authority, in Article 8 paragraph (2) of Law Number 30 of 2014 concerning Government Administration states that: "Government bodies and/or officials in using authority must be based on: a. Legislation. b. General principles of good government.” The dismissal and appointment of interim replacements for State Saniri members is regulated in Ambon City Regional Regulation Number 8 of 2017 concerning the State, in this case in Article 67, namely: "The interim membership of State Saniri is determined by the Mayor's Decree on the recommendation of the State Saniri Leadership through the Head of State Government" and Article 68 paragraph (1): "Members of Saniri Negeri resign because: a. Died. b. Own request; and c. dismissed." As well as paragraph (3) which states that: "Replacement of members of the Saniri Negeri who quit as referred to in paragraph (1) is proposed by the chairman of the Saniri Negeri to the Soa concerned no later than 14 (fourteen) days." However, in fact, the Mayor of Ambon issued Ambon Mayor Decree Number 447 of 2022 which in the Consideration considering letters a and b of the object of the decision is a letter from the Acting Head of the Batu Merah State Government regarding the follow-up to the interim replacement proposal. Meanwhile, the leadership of Saniri Negeri Batu Merah never made a proposal to the Acting Batu Merah, Head of Sirimau District, and Mayor of Ambon to dismiss and/or replace members of Saniri Negeri Batu Merah. The type of research carried out is a normative juridical research type carried out through literature review or secondary materials.

Abstract

This research discusses the responsibilities of the police as debt collectors, where legally, in carrying out their duties, the police must comply with the disciplinary rules for police officers, one of which is that they are prohibited from being debt collectors or protecting people who have debts, as stated in Article 5 letter (h) of the Regulations. Government Number 2 of 2003 concerning Disciplinary Regulations for Members of the National Police of the Republic of Indonesia states that police are prohibited from being debt collectors or protecting people who have debts. However, in one example of the case in South Buru, namely the cooperative case, Lisa Fano, in her interview, once used police services as a source of threats. in collecting debts and one of the Palamaria families also often uses the services of the police as collectors and protectors. In this case the borrower does not use the services of a collector but uses the services of the police so that they feel that with the police, it will be easy to carry out the collection. The problem taken in this research is whether the police are responsible as debt collectors and what are the legal consequences if the police become debt collectors. The research method used in researching and discussing this problem is normative juridical. The legal materials used are primary, secondary and tertiary legal materials. Research results Based on the duties of the police as contained in Law number 2 of 2002, the police are not authorized to collect debts then the legal consequences for police who become debt collectors based on police regulation number 2 of 2003 can be subject to sanctions in the form of dishonorable dismissal, through The procedure is based on Regulation Number 2 of 2003, the legal consequences for the police are that they can be given heavy sanctions, namely dishonorable dismissal.

Abstract

Pulau Seram memiliki komunitas masyarakat hukum adat yang tergabung dalam suatu persekutuan hidup secara berkelompok dalam bentuk tertentu yang sering disebut Patai dalam bahasa Wemale. Persekutuan ini sebagai sarana untuk menghimpun masyarakat hukum adat sekaligus sebagai bentuk persekutuan pemerintahan adat yang secara hukum belum diatur secara jelas dalam sistem pemerintahan negeri saat ini terutama berdasarkan peraturan perundang-undangan. Tujuan dari pengabdian ini untuk memberikan penyuluhan hukum atau sosialisasi terkait kedudukan sistem pemerintahan adat Yapio Patai dalam persekutuan masyarakat hukum adat di Pulau Seram dan untuk memberikan pemahaman tentang pentingnya pengaturan Yapio Patai dalam pengaturan hukum. Pengabdian ini dilakukan dengan menggunakan metode penyuluhan hukum atau sosialisasi. Dengan hasil memberikan rekomendasi kepada masyarakat adat tentang kedudukan Yapio Patai dapat diterima oleh masyarakat persekutuan Yapio Patai sebagai bentuk pemerintahan adat yang tetap hidup dan berfungsi di tengah-tengah persekutuan tersebut, dan untuk menjaga eksistensi keberadaan persekutuan Yapio Patai dalam kaitan dengan hukum adat dan penyelesaian masalah-masalah adat antara marga-marga yang ada di dalamnya, maka direkomendasikan untuk membentuk Dewan Saniri Yapio Patai dengan Peraturan Bersama Kepala Pemerintah Negeri.

Abstract

The Validity of the Regent's Decree which was annulled by the Acting Regent, which of course is motivated by regulations and/or laws, especially law Number 30 of 2014 concerning Government Administration, which in scope also regulates the requirements for the validity of decisions which contain the elements the authority of administrative officials or state administration officials of reviewed in terms of authority. Procedures and also the subtance of the objeckt of the decisions, as well as looking at the legal consequences of canceling decisions made by the acting Regent. This writing discusses two issues, namely: 1). Can the acting regent be able to cancel the Regent's Decree. 2). What are the legal consequences of the cancellation of the Regent's Decree by the Acting Regent.

Abstract

Law Enforcement supervision of violators of official vehicle users by government officials is carried out based on the principle of decentralization where the Central Government fully delegates to Regional Governments to follow up or manage their respective regions. Any State/regional losses due to negligence, misuse or violation of law on the management of State/regional property are resolved through claims for compensation in accordance with laws and regulations. In responding to and avoiding the misuse of official vehicle facilities by government officials, it is necessary to supervise the use of official vehicle facilities. Supervision carried out on official vehicle facilities is intended so that government officials are aware of their responsibilities as servants of the state and society and do not attach importance to personal interests. The legal issues in writing are, first; What is the function of Government supervision of official vehicles ?. second; How are sanctions applied to violators of the use of official vehicles by government officials? The type of research used is Normative juridical research using a problem approach, namely a statutory approach and a concept approach. While the legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The technique of collecting legal materials through literature research with legal material analysis techniques is qualitative. Based on the results of research that violations of the use of official vehicle functions are still often encountered, due to the use of official vehicles are often used outside official interests. Violation of regulations and abuse of authority because it is not in accordance with the use and function of the official vehicle itself based on Government Regulation Number 28 of 2020 on Amendments to Government Regulation Number 27 of 2014 concerning Management of State/Regional Property and in accordance with Government Regulation Number 94 of 2021 concerning Civil Servant discipline. Government officials who misuse official vehicles may be penalized. Any party that causes losses to the State/Region for personal interests or for interests outside the functions of the position and service that can result in state/regional losses, may be given administrative sanctions and criminal sanctions.
