Abstract

Bantuan Hukum dinyatakan tidak secara tegas sebagai tanggung jawab negara, tetapi Pasal 1 ayat (3) Undang­Undang Dasar menegaskan "Negara Indonesia adalah Negara Hukum" dalam negara hukum, negara mengakui dan melindungi hak asasi manusia bagi setiap orang termasuk hak atas Bantuan Hukum, termasuk kepada Prajurit TNI dan PNS TNI. Tujuan penelitian ini adalah untuk menganalisis menggunakan metode pendekatan yuridis dengan kajian secara komprehensif bersumber dari peraturan perundang-undangan dan juga penelitian yuridis empiris yaitu mengkaji atas dasar kebutuhan organisasi TNI terhadap hak hak dari Prajurit TNI dan PNS TNI. Hasil penelitian ini menunjukkan bahwa sesuai hukum acara yang berlaku di lingkungan Peradilan Militer bahwa bagi Prajurit TNI Bantuan Hukum juga sebagai salah satu rawatan kedinasan sebagaimana dinyatakan dalam Pasal 50 Undang­undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia dan Keputusan Panglima TNI Nomor Kep/1089/XII/2017 tanggal 27 Desember 2017 mengatur tentang Petunjuk Penyelenggaraan Bantuan Hukum di Lingkungan Tentara Nasional Indonesia.

Abstract

Masyarakat yang berada didaerah konflik akan merasa ketakutan, terancam dan mengungsi ke hutan-hutan. Pengerahan personel Kodam XVIII Kasuari bukanlah operasi militer melainkan mencari para pelaku tindak pidana terorisme karena telah menyebabkan ketakutan luar biasa pada masyarakat setempat hingga mengungsi ke dalam hutan sehingga Kodam XVIII Kasuari mendapatkan tugas tambahan untuk menormalisasi psikologis masyarakat Papua ganh terkena konflik tersebut dengan pendekatan antropologi wilayah. Tujuan dari penelitian ini adalah untuk mempelajari subjek menggunakan pendekatan yuridis normatif sesuai ruang lingkup dan definisi masalah yang disebutkan di atas. Berdasarkan ruang lingkup dan identifikasi masalah, peneliti juga akan melengkapi secara yuridis politis dan historis. Penelitian ini secara bersamaan menggunakan metode penelitian hukum empiris dan hukum normatif. Namun, dalam penelitian ini, peneliti fokus terhadap penyelidikan hukum normatif, dan penyelidikan hukum empiris berfungsi sebagai informasi tambahan. Kodam XVIII Kasuari selalu berusaha menghilangkan kebudayaan masyarakat pegunungan Arfak yang menjadikan kegiatan sehari hari berbenturan dengan tindakan kriminal atau kejahatan seperti senjata api sebagai mas kawin dengan berbagai cara pendekatan antropology. Pendekatan tersebut membantu masyarakatPapua Barat untuk dilaksanakan sepenuhnya oleh para prajurit sebagai bagian dari operasi teritorial dalam hal penggalangan serta pembinaan, sehingga dapat menimbulkan kesadaran masyarakat, serta menegakkan hukum nasional dilingkungan masyarakat Papua Barat.

Abstract

AbstractIn the context of an emergency situation such as a social conflict or war, such respect and protection must also be extended to those who are on the opposite side of us. The concept of respecting and protecting human dignity is an idea that has existed for a long time and has become an integral part of human civilization to show that the concept of respecting and protecting human dignity is universal. local customs and wisdom.This research problemon how the development of respect and protection of human dignity in emergency situations in international law and how the efforts of the International Committee of the Red Cross (ICRC) in seeking international law affinity in the above context with customary values.Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate thatFirst, Over time, the concept of respecting and protecting human dignity has also become an inseparable part of international law, Second, that the concept of respecting and protecting human dignity is an idea that has existed for a long time and has become an integral part of human civilization, Third, each regulation, which is developed in a simple manner, will be complemented by relevant religious customs and norms that are present in various forms in Indonesia where there is a wealth of relevant local traditions, known as adat originating from a rich cultural heritage and diverse influences.

Abstract

Threats faced by the Indonesian people come from non-traditional threats, Indonesia's strategic defense policies are directed to face and overcome non-traditional threats. driven compared to other institutions. The absence of a legal umbrella that regulates the involvement of the TNI in the implementation of  MOOTW duties can also be used by groups or organizations who are not happy with the TNI institution so that the slightest mistake made by TNI members in the field can be used as a powerful weapon to discredit the TNI and bring down the TNI by specific group goals and missions. This study was conducted with the aim of providing an overview and analyzing the juridical and non-juridical impacts of TNI involvement in MOOTW duties and to provide an overview and analysis of efforts to overcome the juridical and non-juridical impacts of TNI involvement in MOOTW duties. This research was conducted using a normative juridical research method by conducting a comprehensive study based on legislation and empirical juridical research, namely conducting an assessment based on observations of threats involving the TNI. This study will use the Theory of Rule of Law and Theory of Authority as the theoretical basis in analyzing the main problems in research on the authority of the TNI to overcome threats that must be equipped with juridical aspects. The government, the DPR, the leadership of the TNI, the Ministry of Defense, the Police and other relevant agencies in an effort to anticipate the juridical and non-juridical impacts of the TNI's involvement in MOOTW duties.Keyword: Regulation; The involvement of the TNI; Military Operations Other Than War (MOOTW) AbstrakAncaman yang dihadapi bangsa Indonesia berasal dari ancaman non-tradisional, kebijakan strategis pertahanan Indonesia diarahkan untuk menghadapi dan mengatasi ancaman non-tradisional. Belum adanya payung hukum yang mengatur tentang pelibatan TNI dalam pelaksanaan tugas OMSP dapat dimanfaatkan juga oleh kelompok atau organisasi yang tidak senang dengan institusi TNI sehingga kesalahan sekecil apa pun yang dilakukan oleh anggota TNI di lapangan dapat dijadikan sebagai senjata yang ampuh untuk mendiskreditkan TNI dan menjatuhkan TNI dengan tujuan dan misi-misi kelompok tertentu. Penelitian ini dilakukan dengan tujuan untuk memberikan gambaran dan menganalisis dampak yuridis dan non yuridis pelibatan TNI dalam tugas OMSP dan memberikan gambaran dan menganalisis upaya mengatasi dampak yuridis dan non yuridis pelibatan TNI dalam tugas OMSP. Penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan melakukan kajian yang komprehensif bersumber pada peraturan perundang-undangan dan juga penelitian yuridis empiris yaitu melakukan pengkajian berdasarkan pada pengamatan terhadap ancaman yang melibatkan TNI. Penelitian ini akan menggunakan Teori Negara Hukum dan Teori Kewenangan sebagai landasan teori dalam menganalisis pokok permasalahan dalam penelitian tentang kewenangan TNI mengatasi ancaman yang harus dilengkapi dengan aspek yuridis. Oleh karena itu ada beberapa hal yang perlu dilakukan oleh Pemerintah, DPR, Pimpinan TNI, Depan, Kepolisian dan instansi terkait lainnya dalam upaya mengantisipasi dampak yuridis dan non yuridis pelibatan TNI dalam tugas OMSP.Kata Kunci: Yuridis; Pelibatan TNI; OMSP.

Abstract

The involvement of the Indonesian National Armed Forces (TNI) in countering terrorism is in article 7 paragraph (1) of Law Number 34 of 2004 concerning the TNI which states that the main task of the TNI is to uphold state sovereignty, maintain the territorial integrity of the unitary state of the Republic of Indonesia based on Pancasila, the 1945 Constitution and protect the entire nation and the homeland of Indonesia from threats and disturbances to the integrity of the nation and state. It is known that acts of terrorism are based on ideologies that wish to change the basis of the state, so that the TNI's involvement in counterterrorism is very relevant. The TNI's authority in combating terrorism is a matter that is still being debated. This study uses a qualitative research method with a legal approach and a literature approach. The results of the study state that the TNI's authority in dealing with terrorism is given on the grounds that terrorism is an act that threatens the integrity and unity of the Unitary State of the Republic of Indonesia.Keywords: Authority; Indonesian national army; Counter Terrorism; The sovereignty of the Republic of Indonesia.  AbstrakKeterlibatan Tentara Nasional Indonesia (TNI) dalam penanggulangan terorisme yaitu pada pasal 7 ayat (1) Undang-undang Nomor 34 tahun 2004 tentang TNI yang berbunyi bahwa tugas pokok TNI adalah untuk menegakkan kedaulatan negara, mempertahankan keutuhan wilayah negara kesatuan Republik Indonesia yang berdasarkan Pancasila, UUD tahun 1945 serta melindungi segenap bangsa dan tumpah darah Indonesia dari ancaman dan gangguan terhadap keutuhan bangsa dan negara. Diketahui bahwa aksi terorisme berbasis pada ideologi yang berkeinginan merubah dasar negara, sehingga sangat relevan keterlibatan TNI dalam penanggulangan terorisme. Kewenangan TNI dalam pemberantasan terorisme merupakan sebuah hal yang masih menjadi perdebatan. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan hukum dan pendekatan pustaka. Hasil penelitian menyatakan bahwa kewenangan TNI dalam mengati terorisme diberikan dengan alasan bahwa terorisme sebagai tindakan yang mengancam keutuhan dan persatuan Negara kesatuan Republik Indonesia.Kata Kunci : Kewenangan; Tentara Nasional Indonesia; Penanggulangan Terorisme; Kedaulatan NKRI.

Abstract

Masyarakat sekitar merasa ketakutan, terancam dan mengungsi ke hutan-hutan. Bupati Maybrat menyerukan kepada masyarakat yang masih mengungsi agar kembali ke rumah atau kampungnya masing-masing. Penambahan personel Kodam XVIII Kasuari di sana bukanlah operasi militer melainkan mencari para pelaku tindak pidana teorisme karena telah menyebabkan ketakutan luar biasa pada masyarakat setempat hingga mengungsi kedalam hutan. Tujuan penelitian ini mengkaji pokok permasalahan sesuai dengan ruang lingkup dan identifikasi masalah sebagaimana yang telah disebutkan di atas melalui pendekatan yuridisnormatif. Selain itu, peneliti juga akan melengkapinya dengan yuridis-historis dan yuridis-politis berdasarkan ruang lingkup dan identifikasi masalah yang ada. Penelitian mempergunakan metode penelitian hukum normatif dan metode penelitian hukum empiris sekaligus. Akan tetapi, peneliti akan lebih menitikberatkan penelitian ini pada penelitian hukum normatif, sedangkan penelitian hukum empiris berfungsi sebagai informasi pendukung. Kodam XVIII Kasuari selalu berusaha menghilangkan kebudayaan masyarakat pegunungan Arfak yang menjadikan kegiatan sehari hari berbenturan dengan tindakan kriminal atau kejahatan seperti senjata api sebagai mas kawin dengan berbagai cara pendekatan antropology. Pendekatan tersebut membantu masyarakat Papua Barat dijalankan sepenuhnya oleh para prajurit di lapangan dalam kerangka operasi teritorial dalam aspek pembinaan dan penggalangan sehingga dapat menimbulkan kesadaran masyarakat, serta menegakkan hukum nasional dilingkungan masyarakat Papua Barat.

Abstract

On the one side, there is the authority to use armed force, but on the other side, there is an obligation to protect objects by the regime of Human Rights Law and International Humanitarian Law which has created a need for certainty of restrictions. In the Human Rights Law regime, the use of force is limited to a situation which is an absolute necessity. The purpose of this research is to know that the first protection aspect of Human Rights Law and International Humanitarian Law is in the context of providing a legal framework to move according to their needs. This research was conducted using a normative juridical research method by conducting a comprehensive study based on laws and regulations as well as empirical juridical research, namely conducting a study based on observations of the handling of national security and defence threats in Indonesia involving the TNI. The conclusion of this research is that International Humanitarian Law, especially in International Armed Conflict ("KBI"), does give the right to combatants to participate directly in hostilities (direct participation in hostilities). The consequence is that it is possible for parties to armed conflicts to directly use lethal force against their adversaries. Nevertheless, International Humanitarian Law still provides various limitations both through its main principles (among others, distinction and proportionality) as well as special rules regarding the methods and means of fighting.Keyword: Human Rights Law; International Humanitarian Law; Armed Forces; TNI AbstrakDisatu sisi ada kewenangan penggunaan kekuatan bersenjata, namun disisi lain ada kewajiban perlindungan obyek oleh rezim Hukum HAM dan Hukum Humaniter Internasional telah menimbulkan suatu kebutuhan akan kepastian pembatasan. Dalam rezim Hukum HAM, penggunaan kekuatan dibatasi untuk suatu situasi merupakan keharusan mutlak (absolute necessity). Tujuan penelitian ini agar diketahui bahwa aspek pelindungan pertama dari Hukum HAM dan Hukum Humaniter Internasional dalam konteks sebagai penyediaan kerangka hukum untuk bergerak sesuai kebutuhannya. Penelitian ini dilakukan dengan metode penelitian yuridis normatif dengan melakukan kajian yang komprehensif  bersumber pada peraturan perundang-undangan dan juga penelitian yuridis empiris yaitu melakukan pengkajian berdasarkan pada pengamatan terhadap penanganan ancaman keamanan dan pertahanan negara di Indonesia yang melibatkan TNI. Kesimpulan penelitian ini adalah Hukum Humaniter Internasional, khususnya dalam Konflik Bersenjata Internasional (“KBI”), memang memberikan hak kepada kombatan untuk turut serta secara langsung dalam permusuhan (direct participation in hostilities). Konsekuensinya adalah dimungkinkannya bagi para pihak dalam konflik bersenjata untuk langsung menggunakan kekuatan mematikan terhadap musuhnya.  Meskipun demikian, Hukum Humaniter Internasional tetap memberikan berbagai pembatasan baik melalui prinsip­prinsip utamanya (antara lain, pembedaan dan pro porsionalitas) serta aturan­aturan khusus terkait cara dan alat berperang.Kata Kunci: Hukum Hak Asasi Manusia; Hukum Humaniter Internasional; Angkatan Bersenjata; TNI

Abstract

Directors often face dilemmas in making business decisions in buying and or selling assets, shares, investment, expansion because they have two sides of supervision. If they are always restrained by fear and fear in making decisions, the business movement will definitely be hampered. The approach method used in this research is a sociological juridical approach using secondary data and reinforced by primary data. Secondary data was obtained from laws and regulations and interviews with informants, and questionnaires who had served as Directors in BUMN, while secondary data was obtained from the statute approach and conceptual approach. The data obtained from this study were then analyzed qualitatively to answer the problems in this study. The results of this study indicate that the decision of the Board of Directors in business if it is based on good faith cannot be blamed, either civilly or criminally. However, if the Board of Directors is guilty (schuld) and/or negligent (culpoos), the members of the Board of Directors are fully responsible personally and jointly and severally (Article 97 paragraph (3), (4) and (5) of the Company Law). The Board of Directors personally can also be bankrupt so that it is not only PT that is obliged to pay its obligations, the Board of Directors must also be responsible for paying debts.

Abstract

Investigators of predicate crimes who are authorized to conduct ML investigations have determined in a limited manner, namely only appointing investigators from the State Police agency Republic of Indonesia, Attorney General's Office, Corruption Eradication Commission (KPK), National Narcotics Agency (BNN) and the Directorate General of Taxes and the Directorate of Customs and Excise of the Ministry of Finance Republic of Indonesia, meanwhile a TNI soldier, TNI Investigator is not on the list as an investigator for predicate crimes. The purpose of this study is to analyze the authority TNI investigators in conducting an investigation of money laundering offenses allegedly committed by Justisiabel Military Courts are still a problem, on the other hand there should be no omission of every act that violates the law in the pursuit of justice and legal certainty. Method The approach used in this research is a sociological juridical approach with using secondary data and reinforced by primary data. Secondary data obtained from interviews with resource persons, and questionnaires distributed to nurses in the District Sidoarjo, while secondary data were obtained from the statute approach and conceptual approach. The sampling method chosen is the purposive sampling method which is considered to be able to represent the population. The data obtained from this study were then analyzed qualitatively to answer the problems in this research. The results of this study indicate that according to the applicable procedural law within the Military Courts which are authorized to conduct an investigation into a criminal act allegedly committed by a Judicial Justicia he military is a TNI Investigator, it turns out that it can't be applied immediately in the process ML investigation because the Law (UU TPPU) has determined otherwise, in providing ML investigation authority.

Abstract

Determination of the status of evidence of crimes in military courts has the same legal implications as in general courts. Based on the provisions of Article 191 of Law 31 of 1997 concerning Military Courts, it is stated that "In the case of a sentencing decision or being free from all charges or acquittal from all legal charges, the Court stipulates that the confiscated evidence be handed over to the party most entitled to receive it back whose names are listed in the the decision, except if according to the provisions of the legislation, the evidence must be confiscated for the benefit of the state or destroyed or damaged so that it cannot be used anymore", but when the court decides that the evidence is returned to the rightful person, it often issues a decision that raises the question of who is entitled to it. . The purpose of this study is to analyze using the approach method used in this study is a juridical approach by conducting a comprehensive study based on laws and regulations and also empirical juridical research, namely conducting an assessment based on observations of several court decisions which until now have not been able to return of evidence to the rightful person. The results of this study indicate that according to the procedural law applicable in the Military Courts and general courts, it is necessary for the judge to confirm in the court's decision by stating who has the right so that there is legal certainty.
