Abstract

Expressing opinions in demonstration is a right that has been guaranteed in the constitution and law. The arrangement is written in the 1945 Constitution of the Republic of Indonesia Article 28E paragraph (3) and Law Number 9 of 1998 concerning the freedom to express opinion in public. A democratic country has a great respect for differences of opinion manifested in the form of demonstration. However, the freedom of demonstration is in the form of responsible freedom regulated in Article 6 of Law No. 9 of 1998. In this demonstration, the actions must respect the rights of others, so that no one is harmed by the demonstration. If someone is harmed, they must prioritize the principles of justice in accordance with applicable law. This study was conducted with a qualitative method approach, namely by using the type of normative research, by conducting a study of legislation (Statute approach). This study resulted that the demonstration arrangements regulated in the law must be respected by all parties, where the principle of legal protection is attached to demonstration participants and security forces to respect each other's democratic values in Indonesia. Furthermore, on the principle of right to freedom of expression in a democratic country, all citizens must have the same rights in any form of expression. If there is a party who is harmed, it must be resolved according to the applicable law, so that the Indonesian guarantee legal certainty from irresponsible parties to uphold democratic values, as well as freedom of opinion.

Abstract

Penelitian ini bertujuan untuk menentukan efektivitas penggunaan ambang batas presiden atau presidential threshold dalam pemilihan umum presiden di Indonesia. Setiap negara yang berdaulat dipimpin oleh seorang pemimpin negara untuk menjalankan segala bentuk tugas kenegaraannya. Sebagaimana termaktub dalam pasal 1 ayat (2) Undang-Undang Dasar 1945 menyebutkan bahwa kedadulatan ada di tangan rakyat dan dilaksanakan berdasarkan undang-undang. Indonesia mengimplementasikan sistem presidensial dalam pemerintahannya dimana pemerintahan dipimpin oleh seorang presiden terpilih dan bertindak atas nama rakyat sebagaimana bagian dari negara demokrasi. Presiden di Indonesia dipilih oleh rakyat melalui sebuah proses pemilihan umum. Penelitian ini menggunakan jenis metode Hukum Normatif melalui data kepustakaan dari berbagai sumber seperti buku, jurnal, undang-undang, dan peraturan terkait judul penelitian yang membahas tentang Presidential Threshold. Hasil Penelitian pertama, Dalam proses pencalonan Presiden di Indonesia di usung oleh partai politik menggunakan sistem presidential threshold dimana hanya partai yang memenuhi ambang batas yang boleh mengajukan calon presiden, Presidential threshold yang telah ditetapkan yaitu sebesar 20% dari perolehan kursi di parlemen bagi setiap partai politik. Hasil Penelitian kedua, Ambang batas ini telah membatasi hak berpolitik warga negara Indonesia dan interpretasi dari presidential threshold seharusnya adalah ambang batas untuk keterpilihan presiden bukan untuk pencalonannya, maka dengan demikian telah melanggar konstitusi yang diatur dalam pasal 28D ayat 3.

Abstract

Pemilihan Umum di Indonesia tergolong memiliki sistem yang berubah-ubah berdasarkan dinamika politik yang sedang terjadi di masyarakat. Pengaturan mengenai besaran parliamentary threshold adalah salah satu yang tidak pernah usai menjadi topik hangat di masyarakat. Dalam dinamikanya Mahkamah Konstitusi telah melakukan judicial review terhadap pasal tersebut sebanyak 7x (tujuh kali). Lalu, bagaimanakah proporsionalitas parliamentary threshold ini dapat diterapkan sehingga dapat dirasakan keadilan yang bernafaskan nilai-nilai demokrasi bagi para kontestan pemilihan umum mendatang? Dan bagaimana dampak yuridis dari Putusan Mahkamah Konstitusi nomor 116/PUU-XXI/2023 terhadap pasal 414 ayat (1) Undang-Undang Pemilihan Umum yang dinyatakan konstitusional bersyarat ini kedepannya dapat menjadi penguat sistem multipartai di Indonesia? Penulis menggunakan metode normatif yuridis dalam menguraikan permasalahan putusan presidential threshold dan mengimplementasikannya berdasarkan teori demokrasi. Dari hasil penelitian ini dapat penulis simpulkan bahwa demi mewujudkan proporsionalitas pemilihan umum dan meminimalisir terbuangnya suara rakyat guna memperkuat sistem multipartai yang berlandaskan nilai-nilai demokrasi, maka pengaturan parliamentary threshold perlu untuk dilakukan penghitungan ulang melalui penentuan rumus baku dan penghitungan yang konkret agar dapat merepresentasikan apa yang dikehendaki oleh rakyat pada pemilihan umum yang akan datang.

Abstract

This research aims to analyze the reconciliation between executive and legislative powers within Indonesia's presidential system. By examining the dynamic relationship between these two branches of power, the study focuses on the challenges and solutions for creating effective synergy. A qualitative research method was employed, utilizing document analysis and interviews with experts. The findings highlight the critical importance of dialogue and collaboration in strengthening political stability and national development. This study concludes that constructive dialogue and collaborative policies are essential to overcome existing challenges and foster a more stable and effective governance in Indonesia.

Abstract

Defamation is one of the criminal acts that fall into the qualification of insult. Defamation is regulated in Article 310 of the Criminal Code and in Article 27 Paragraph (3) of the Electronic Information and Transaction Law. The purpose of the existence of this legal rule on defamation is to protect the dignity and dignity of every person, especially regarding the honorable self-esteem (eer) and good name (goeden naam) of a person due to the use of social media that has a negative impact. The formulation of the problem discussed in this paper is to analyze (1) The regulation of the crime of defamation in the Criminal Code and Article 27 Paragraph (3) of the Law on Information and Electronic Transactions due to the use of social media that has a negative impact. The writing method used is normative research, which is research that relies on secondary data sources as the main reference data. The results obtained from the research were concluded (1) Regulations regarding the crime of defamation are regulated in Article 27 paragraph (3) of the Law on Information and Electronic Transactions. To determine whether the defamation element in the ITE Law has been fulfilled, it must refer to Article 310 of the Criminal Code. The negative impact caused is that the use of social media itself makes adolescents lazy and rarely socializes face-to-face with others so that it has the potential to make adolescents become anti-social individuals, addiction which leads to reduced time efficiency, consumption, mental health of adolescents, affects the decline of moral values and ethics of the younger generation, decreases the quality of critical thinking of adolescents, and the ease of being influenced by information that is not yet known to be true as seen from the ITE Law issued by the government to be a guideline in the implementation of Article 27 paragraph (3) of the ITE Law which aims to create legal certainty with solutions such as setting a healthy time limit; Build awareness of the emotional impact; Develop critical skills; Provide an understanding of online privacy; Focus on offline social interactions; Implementation of the ITE Law.
