Abstract

Kampanye merupakan salah satu tahapan pemilihan kepala daerah (selanjutnya disebut pilkada) langsung yang harus dijalani. Kegiatan kampanye sangat berperan untuk mendongrak perolehan suara. Pilkada menjadi perhatian publik karena mereka dijanjikan oleh pasangan calon yang berkampanye tentang banyak hal sehingga mereka terpesona dengan janji-janjinya. Rumusan masalah yang dibahas, Pertama, bagaimana implementasi pengunaan bahan kampanye dalam kampanye pemilihan kepala daerah di Kabupaten Pelalawan tahun 2015? Kedua, bagaimana menyelesaikan permasalahan hukum akibat terjadinya sengketa penggunaan bahan kampanye dalam pemilihan kepala daerah di Kabupaten Pelalawan tahun 2015? Metode Penelitian berupa penelitian yuridis sosiologis, melaksanakan penelitian di wilayah Kabupaten Pelalawan dalam Pelaksanaan Pilkada tahun 2015. Hasil Penelitian; Pertama, Pelaksanaan kampanye dengan metode penyebaran bahan kampanye kepada masyarakat umum menimbulkan permasalahan, Peraturan KPU Nomor 7 Tahun 2015 tentang Kampanye tidak mampu mengantisipasi potensi masalah  yang akan timbul dalam masa kampanye, tidak adanya meknisme review (verifikasi) terhadap materi dan desain oleh KPU, sehingga celah kekosongan hukum tersebut dimanfaatkan yang pada akhir nya menimbulkan konflik. Dalam kasus Pilkada Kabupaten Pelalawan, bahwa bahan kampanye tersebut tidak menyebut pasangan calon tersurat namun makna tersirat mengarah kepada pasangan calon tertentu. Kedua, Penyelesaian sengketa berkaitan bahan kampanye diselesaikan dengan penarikan bahan kampanye yang sudah beredar, hal ini berdasarkan rekomendasi dari Panwas Kabupaten Pelalawan, dan dari sisi KPU Kabupaten Pelalawan hal ini telah sesuai arahan dari KPU Provinsi Riau. Namun bahan kampanye yang terlanjur beredar akan sangat sulit kembali untuk ditarik.

Abstract

Indonesia as one of the countries that adhere to a democratic system continues to carry out direct regional head elections even though national health is a threat. The face-to-face campaign stage in the regional head election is one of the negative highlights of the Covid-19 incident because it is feared that it will cause a new cluster of Covid-19 cases. Therefore, this study will find and explore the problem of violating health protocols at the campaign stage carried out by candidates for regional heads. This study uses an approach with content analysis and phenomenology as methods. Data collection begins with the problem of violating health protocols at the campaign stage through news in 14 selected media. The results of the mapping in the form of trends and various polemics of violations are elaborated on cases of violations that occurred in the regions. The results of the study showed that violations of the health protocol were very high during the campaign period to violations of alleged criminal acts. Political contestation that occurred at the campaign stage during the pandemic did not become an obstacle for regional head candidates who took part in the election. So, it can be seen that the elections that took place during the pandemic were not in favor of the people because the political interests of regional head candidates were more important than public health as actors of democracy itself. Putting aside people's health is a bad record in the implementation of democracy.

Abstract

This study tries to examine the findings of the election supervisory body (Bawaslu) regarding 32,556 anomaly voters ahead of the 2019 general election in Riau. This trend occurs because of the unsynchronization of data from the Regional General Election Commission (KPUD), the Central Statistics Agency (BPS) and the Population and Civil Registration Office (Disdukcapil) of Riau Province. Findings in the form of poor accuracy in determining the voter list by the KPUD of Riau Province have caused dynamics and polemics in the community. By using the concepts of Election theory and Democracy and Community Political Rights with a single case qualitative approach, this study finds that the potential for people whose data is not recorded by the Disdukcapil will not only lose their right to vote in elections but can also lead to potential violations of Human Rights. Therefore, this study tries to provide an early warning about the potential negative consequences of inaccurate voter data.

Abstract

Studies about the politization of academic senate at higher education institutions in corruption control and prevention system are scarce. Framed by collective action, power balance, and bureaucratic transparency theories, this research aims to examine the effect of power imbalance due to double position of structural and academic senate leaders, and the dominance of ex-officio elements regarding to conflict of interests and corruptive behavior. The result reveals, the conflict of interests elicited by the power imbalance generated corruptive behavior in HEIs, especially in terms of policy corruption. In practical terms, nepotism and transactional patterns were the most common acts of corruption.   Abstrak Studi terkait politisasi senat akademik dalam sistem pengawasan dan pencegahan korupsi di perguruan tinggi masih sangat jarang dilakukan. Sehingga, penelitian ini bertujuan menguji dampak ketidakseimbangan kekuasaan akibat praktik rangkap jabatan pimpinan struktural dengan pimpinan senat akademik, dan dominasi unsur ex-officio dalam komposisi senat akademik terhadap konflik kepentingan dan perilaku korupsi di perguruan tinggi. Teori yang digunakan adalah teori tindakan kolektif, keseimbangan kekuasaan dan transparansi biro-krasi, Pengumpulan data dilakukan secara daring dan dianalisis menggunakan teknik des-kriptif, t-test, ANOVA, mediasi dan moderasi Hayes PROCESS. Hasil penelitian menyimpulkan, konflik kepentingan akibat ketidakseimbangan kekuasaan menyebabkan munculnya perilaku koruptif di perguruan tinggi, khususnya di ranah kebijakan. Sedangkan di ranah praktis, nepotisme dan pola transaksional menjadi dua perbuatan korupsi yang paling sering terjadi di perguruan tinggi.
