Abstract

Consumer protection should receive more attention, because foreign investment has become part of Indonesia's economic development, where the Indonesian economy is also related to the world economy which can have negative implications for consumers. This study aims to determine the adoption of the ultimum remedium principle in consumer protection law and to determine the ultimum remedium principle of business actors in consumer protection law. The research method used is a normative juridical research method with secondary data source and analyzed deductively. The research desire to be achieved in consumer protection is to create a sense of security for consumers in meeting the needs of life. It is proven that all consumer protection norms in the Consumer Protection Law have criminal sanctions. The presence of criminal sanctions in consumer protection regulations is a form of ultimum remedium (the last alternative) when resolving consumer protection disputes through other legal channels is not sufficient.

Abstract

The problem of traffic accidents that cause death due to road damage is a problem that is always prominent from time to time. Of course, it needs to be studied in the aspect of criminal liability to resolve if there is a legal event in question occurs. The research method used in this research is normative juridical. The results showed that awave of traffic accidents that occurred due to road damage here found there were 2 (two) pihak which will basically receive the consequences ofroad users(community)  both victims and perpetrators,for  road organizers (whodeal withroad repairs / road repairs, namely the Public Works Office in each region),  Criminalliability for the occurrence of traffic accidents that result in death caused by road damage,can be charged to different parties because of their nature is kasuistis. Rembang District Court Decision No. 129 / Pid.Sus / 2019 / PN Rbg  basically the judge's decision can be said to be appropriate to say the defendant has been negligent because he was not careful and vigilant when driving on damaged roads / potholes

Abstract

Salah satu modus kejahatan penggelapan adalah penggelapan dalam jabatan. Penelitian ini fokus menganalisis putusan perkara penggelapan dalam jabatan pada koperasi kredit di Kabupaten Karo, dengan tujuan menganalisis penerapan hukum dalam putusan pengadilan terhadap tindak pidana penggelapan dalam jabatan dalam koperasi kredit dan upaya penanggulangan tindak pidana penggelapan dalam jabatan pada koperasi kredit di Kabupaten Karo. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan (statute aprroach) dan pendekatan kasus (case aprroach). Data yang digunakan adalah data sekunder terdiri dari bahan hukum primer, sekunder dan tersier yang dikumpulkan dengan teknik studi pustaka (library research). Seluruh data dianalisis dengan metode analisis data kualitatif. Berdasarkan penelitian ini disimpulkan bahwa penerapan hukum terhadap tindak pidana dalam Putusan Nomor 354/Pid.B/2013/PN.Kbj yaitu Jaksa Penuntut Umum menjerat terdakwa dengan Pasal 374 KUHP yaitu Penggelapan Dalam Jabatan. Penjatuhan sanksi pidana yang dilakukan hakim terhadap terdakwa atas tuntutan penuntut umum terhadap pasal 374 KUHP sudah tepat karena unsur yang terdapat dalam ketentuan yuridis mengenai penggelapan yang terdapat sudah terpenuhi baik dari unsur objektif maupun subyektifnya. Adapun upaya penanggulangan tindak pidana penggelapan dalam jabatan pada koperasi kredit di Kabupaten Karo dapat dilakukan secara non penal mengoptimalisasikan aplikasi Sikundo yang ada dalam koperasi kredit, dimana dalam sistem tersebut akan terpantau transaksi apa saja yang akan dilakukan oleh para anggota koperasi dan bisa diakses oleh semua anggota koperasi, mensejahterakan para para anggota koperasi yang ada di dalam koperasi tersebut. Sedangkan upaya penanggulangan secara penal atau represif dalam tindak pidana penggelapan dalam jabatan pada koperasi kredit yaitu dapat dilakukan dengan cara menyerahkan kasus tindak pidana yang terjadi kepada pihak penegak hukum.

Abstract

Penelitian ini terkait dengan adanya kasus perusakan lingkungan hidup oleh PT. Gorga Duma Sari (PT. GDS) yang terbukti secara sah dan meyakinkan bersalah telah melakukan tindak pidana perusakan lingkungan hidup berdasarkan Pasal 98 ayat (1) UU Pengelolaan dan Perlindungan Lingkungan Hidup berdasarkan Putusan Mahkamah Agung RI No. 1203K/Pid.Sus/2016. Putusan tersebut mengadili Terdakwa “JH” selaku Direktur Utama PT GDS atas perbuatannya yang mengakibatkan dilampauinya baku mutu udara ambien, buku mutu air, baku mutu air laut atau baku mutu kerusakan lingkungan hidup yang diatur dalam Pasal 98 ayat (1) jo. Pasal 116 ayat (1) UU PPLH. Dalam amar putusan tersebut ada hal yang menarik terkait pidana tambahan perbaikan kerusakan lingkungan yang dilakukan dengan cara menanam tanaman keras di lokasi bekas tebangan pohon dari membangun dinding penahan tebing terhadap tebing yang telah dipotong oleh PT GDS. Penjatuhan pidana tambahan dalam putusan ini terdapat makna “tanaman keras” yang tidak dijelaskan oleh majelis hakim. Istilah tanaman keras ini tidak diatur sama sekali mengenai definisi tanaman keras yang sesungguhnya. Permasalahan penelitian ini, yaitu: pengaturan pelaksanaan putusan pengadilan (eksekusi) pidana tambahan terhadap putusan tindak pidana lingkungan hidup; kekuatan eksekutorial jaksa dalam pelaksanaan eksekusi pidana tambahan dalam Putusan Mahkamah Agung RI No. 1203K/Pid.Sus.LH/2016. Penelitian ini adalah penelitian hukum normatif, dengan sifat penelitian deskriptif analisis. Pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach). Putusan pengadilan sebagai data sekunder didapat dari Kepaniteraan Pengadilan Negeri Balige. Dengan menggunakan analisis kualitatif, maka hasil penelitian, bahwasanya masih terdapat kekosongan hukum dalam eksekusi putusan tindak pidana lingkungan hidup; dan tidak adanya upaya paksa dari Kejaksaan Negeri Pangururan dalam melaksanakan eksekusi Putusan MA.RI No. 1203K/Pid.Sus.LH/2016. Sebab, tidak ada sanksi tindakan tata tertib yang dikenakan kepada PT. GDS apabila tidak melaksanakan pidana tambahan tersebut.

Abstract

The COVID-19 pandemic is very risky and requires quick action and policy-making for the safety of all. For this reason, the government has taken a policy related to using specific budget allocations by facilitating the procurement process of goods and services to prevent and handle COVID-19. Still, in the process, many acts have occurred that are detrimental to state finances. The method used in this thesis is the normative legal research method, which refers to legal norms with data sources obtained by examining library materials to obtain secondary data in the form of primary, secondary, and tertiary materials. The study results found that in the two decisions studied, the judges had carefully considered the legal facts in the trial but still had different interpretations regarding the element of "Unlawfully" in the Corruption Law. Several factors cause the provisions of Article 2 paragraph 2 of the Corruption Law not to be applied to perpetrators of corruption during the pandemic, namely from the Public Prosecutor, Panel of Examining Judges, and the applicable regulations. Criminal policy in overcoming corruption in the relationship between business actors and procurement officials is carried out in two ways: non-penal policy by increasing supervision. In contrast, penal policy has been carried out by making changes to the Corruption Crime Law. It is hoped that the Examining Judge can have uniformity in interpreting Article 2 and Article 3 of the Corruption Crime Law so that there is no disparity in punishment for corruption convicts so that no parties feel disappointed by the decisions made.

Abstract

This study examines the role of the Prosecutor's Office in the pre-prosecution stage of corruption cases involving corporate legal entities and analyzes the mechanism for assessing formal and material completeness as a basis for prosecution feasibility. The increasing involvement of corporations in corruption cases poses challenges in proving corporate criminal liability and linking individual actions to corporate responsibility. This research uses normative legal methods with a statutory and conceptual approach through the analysis of the Criminal Procedure Code, the Law on the Eradication of Corruption, Supreme Court Regulation Number 13 of 2016, prosecutorial guidelines, and the doctrine of corporate criminal liability. The results of the study show that the Public Prosecutor plays a role as dominus litis in ensuring the completeness of the formal and material case files, including verification of corporate legality, fulfillment of criminal elements, attribution of liability, and sufficiency of legal evidence. The procedural law orientation that still focuses on individual actors is the main challenge. Therefore, the effectiveness of the pre-prosecution stage greatly determines the success of prosecution and legal certainty in corporate corruption cases.

Abstract

The rapid development of social media in the digital era has given rise to the phenomenon of trial by social media, which refers to public judgment of an individual before a final and legally binding court decision is rendered. This phenomenon has the potential to undermine the principle of the presumption of innocence and the concept of due process of law, as public opinion is often formed more quickly than the legal process itself. Consequently, the reputation of individuals involved in legal proceedings may be adversely affected, while the objectivity and independence of law enforcement institutions may be compromised by public pressure. This study aims to analyze the impact of trial by social media on law enforcement in Indonesia, examine its implications for the protection of the presumption of innocence from the perspective of due process of law, and formulate an ideal legal framework to mitigate its negative effects on the criminal justice process. This research employs a normative legal research method supported by empirical data obtained through interviews. The study is descriptive-analytical in nature and utilizes primary, secondary, and tertiary legal materials collected through library research and document analysis. The data were analyzed qualitatively using a statutory approach. The findings indicate that trial by social media significantly affects law enforcement in Indonesia by shaping public opinion prior to judicial decisions, thereby potentially violating the presumption of innocence and disrupting the implementation of due process of law. Furthermore, public judgment on social media may influence the objectivity of judicial proceedings and create social stigma against suspects or defendants. Therefore, a more comprehensive legal framework is required, including the establishment of specific regulations governing the publication of criminal cases, stronger personal data protection mechanisms, reforms of the Criminal Procedure Code that accommodate digital rights, and the enhancement of public digital literacy as well as the professionalism of law enforcement officials. These measures are essential to ensure a fair, objective, and just judicial process in the digital age.
