Abstract

Abstrak Kecerdasan buatan adalah hasil dari perkembangan teknologi yang demikian pesat di era revolusi industri 4.0. Kehadiran kecerdasan buatan memberikan banyak manfaat dan memudahkan pekerjaan manusia sehingga lebih efektif dan efisien. Selain dampak positif dari kecerdasan buatan, ternyata terdapat potensi permasalahan dari kehadiran kecerdasan buatan yakni jika kecerdasan buatan melakukan tindak pidana dan menimbulkan korban. Hukum positif Indonesia belum mengatur mengenai pengaturan pertanggungjawaban perbuatan yang dilakukan oleh kecerdasan buatan ketika melakukan tindak pidana. Artikel ini bertujuan untuk mengetahui prospek pengaturan pertanggungjawaban pidana terhadap perbuatan yang dilakukan oleh kecerdasan buatan. Metode yang digunakan dalam penulisan artikel ini adalah metode penelitian hukum normatif dengan pendekatan konseptual. Hasil dari penelitian ini adalah kecerdasan buatan bukanlah subjek hukum dalam hukum pidana, dan pertanggungjawaban pidana terhadap tindak pidana yang dilakukan oleh kecerdasan buatan dibebankan kepada pembuat kecerdasan buatan, dan pengguna kecerdasan buatan. Kata Kunci: kecerdasan buatan; pertanggungjawaban pidana; subjek hukum. Abstract Artificial intelligence is the result of such rapid technological developments in the era of the industrial revolution 4.0. The presence of artificial intelligence provides many benefits and facilitates human work so that it is more effective and efficient. Apart from the positive impact of artificial intelligence, it turns out that there are potential problems with the presence of artificial intelligence, namely if artificial intelligence commits crimes and causes victims. Indonesia's positive law does not yet regulate the regulation of accountability for actions committed by artificial intelligence when committing a crime. This article aims to find out the prospects for setting criminal liability for acts committed by artificial intelligence. The method used in writing this article is a normative legal research method with a conceptual approach. The results of this study are that artificial intelligence is not a legal subject in criminal law, and criminal responsibility for crimes committed by artificial intelligence is borne by artificial intelligence makers and artificial intelligence users. Abstract

Abstract Legal philosophy in Indonesia has the biggest role in the formation of law in Indonesia. Pancasila as a source of law contains the meaning of all regulations and laws, starting from our constitution and all regulations apart from our constitution, of course, Pancasila is the basis and foundation of the law. Pancasila is the Indonesian legal system. Therefore, Pancasila is not only known as a philosophy but also known as written law in Indonesia which contains living laws. The problem is how big is the role of Legal Philosophy in influencing the formation of the legal system in Indonesia. This question must be very important to answer. The author tries to examine this problem with normative law in the legal method. The approach taken by the author is taken from several books that contain related problems. Abstract

Abstrak Fenomena pelaksanaan perkawinan secara paksa sebagai suatu fenomena sosial telah bergulir menjadi suatu fenomena hukum. Pemaksaan perkawinan dalam perkembangannya menjadi salah satu bentuk dari tindak pidana kekerasan seksual sebagaimana diatur di dalam Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual. Artikel ini akan menganalisis tentang pemaksaan perkawinan sebagai jenis dari tindak pidana kekerasan seksual. Fokus kajiannya adalah berkaitan dengan pengertian tindak pidana pemaksaan perkawinan dan bentuk pertanggungjawaban pidana bagi pelaku tindak pidana pemaksaan perkawinan. Hasil dari penelitian ini adalah tindak pidana pemaksaan perkawinan merupakan pelanggaran dari hak asasi manusia dan sebagai salah satu bentuk tindak pidana kekerasan seksual. Kata Kunci: Pemaksaan Perkawinan; Kekerasan Seksual; Pertanggungjawaban Pidana. Abstract The phenomenon of forced marriage as a social phenomenon has turned into a legal phenomenon. In its development, forced marriage has become a form of criminal sexual violence as regulated in Law Number 12 of 2022 concerning Criminal Sexual Violence. This article will analyze forced marriage as a type of criminal act of sexual violence. The focus of the study is related to the definition of the criminal act of forced marriage and the form of criminal responsibility for perpetrators of the criminal act of forced marriage. The results of this research are that the criminal act of forced marriage is a violation of human rights and is a form of criminal sexual violence. Abstract

Abstract Indonesia has a strategic geographical location, namely located between 2 (two) continents and 2 (two) oceans. The implication of Indonesia's strategic location geographically is that Indonesia has natural riches that are characterized by unique biodiversity, which is not found in any other country in the world. The advantages of Indonesia's natural wealth must be protected, in order to provide benefits, especially for the welfare of society. This article will discuss the protection of geographical indications as part of intellectual property rights to natural resources which should be utilized as much as possible for the welfare of society. This article was written using a type of normative legal research with a conceptual approach. The results of this research are that protection of geographical indications is protection of the economic rights of local communities in order to achieve community welfare. Abstract

This study aims to identify and analyze the phenomenon of “No Viral No Justice” and its implications for victim protection within the criminal justice system. It also seeks to examine the extent to which viral exposure on social media influences law enforcement responsiveness in handling cases involving victims. This research employs an empirical legal research method with a descriptive approach. The research was conducted within the jurisdiction of relevant law enforcement institutions and supported by data from media reports and victim-related cases. The types and sources of data consist of primary data and secondary data. Data collection techniques include observation, interviews, and literature study. The data were analyzed using qualitative analysis techniques. The results of this study indicate that the main factors contributing to the emergence of the “No Viral No Justice” phenomenon include lack of institutional responsiveness, limited access to justice for victims, public distrust of law enforcement, and the growing influence of social media as a tool of public pressure. Furthermore, the implications for victim protection reveal both positive and negative dimensions. On the one hand, viral exposure can accelerate case handling and strengthen institutional accountability. On the other hand, it may lead to revictimization, violations of victim privacy, and unequal protection, as only high-profile cases tend to receive serious attention. Therefore, strengthening a victim-oriented justice system that ensures equal protection without reliance on viral pressure is essential.

Abstract

Despite the increasing prosecution of environmental crimes, environmental criminal law scholarship has yet to systematically address how the presumption of innocence, embodied in the maxim in dubio pro reo, operates in cases characterized by scientific uncertainty and diffuse ecological harm, creating a doctrinal gap in balancing procedural safeguards with ecological protection. While this principle safeguards the rights of the accused, its rigid application often conflicts with the need for ecological justice in environmental crime cases, where the victims are not individuals but ecosystems themselves. The emerging principle in dubio pro natura, which promotes environmental protection as a legal priority in ambiguous situations, offers a counterbalance but remains underdeveloped in doctrinal formulation, theoretical grounding, and consistent judicial application. This study argues for a context-sensitive interpretative framework that reconciles in dubio pro reo and in dubio pro natura in the adjudication of environmental crimes. Adopting a normative juridical method grounded in doctrinal legal analysis, this study examines statutory provisions, judicial decisions, and scholarly interpretations at both national and international levels. The findings identify a doctrinal inconsistency affecting evidentiary standards, burden of proof, and preventive enforcement mechanisms In several cases, the application of in dubio pro reo has undermined preventive environmental enforcement, while the potential of in dubio pro natura remains largely rhetorical. The study concludes that a balanced and context-sensitive integration of both principles is necessary to optimize justice, not only for human defendants but also for nature as a legal subject, particularly in prosecuting complex environmental crimes.
