Abstract

Kajian ini dilator belakangi perjalanan panjang hukum Islam untuk menjadi hukum formal di Indonesia tidak sepi dari polemik, khususnya pergumulan hukum Islam dengan hukum Barat dan hukum Adat, banyak menuai dilema dalam kebijakan. Perseteruan antara politik dan hukum sangat kuat dalam supremasinya. Oleh karena itu kajian ini berupaya mendiskripsikan konsep tualisasi politik hukum Islam dan pemberlakuannya di Indonesia. Kajian ini menemukan bahwa konfigurasi politik senantiasa akan berpengaruh terhadap sifat /karakter produk hukum Islam yang dihasilkan. Posisi dan fungsi hukum Islam di Indonesia sangat terpengaruh atas politik hukum. Dan berlakunya hukum Islam di Indonesia sebagai refleksi kajian politik hukum Islam.

Abstract

Abstract: This study argues that scientific findings play a role in encouraging changes in the fatwas of the Indonesian Ulema Council (MUI). This research is library research that takes the fatwas of the Indonesian Ulema Council (MUI) as its primary source. Those fatwas are Fatwa on Vasectomy/Tubectomy, Fatwa on Meningitis Vaccine for Hajj and Umrah Jama'ah, Fatwa on Determination of the Beginning of Ramadan, Shawwal and Dhulhijjah, and Fatwa on Qibla Direction. Data collection was conducted using document study techniques. The data analysis is done with the content analysis method. The results of this study show that scientific findings play an important role in encouraging changes in MUI fatwas into three patterns of change, namely: First, rukhsah, which is the change of fatwa in the form of giving leeway to the legal provisions of the previous fatwa, as the change of MUI fatwa on vasectomy/tubectomy. Second, nasakh is the change of fatwa in the form of eliminating/canceling the legal provisions in the previous fatwa, such as the change of MUI fatwa on Meningitis Vaccine for Hajj and Umrah Jama'ah. Third, takmîl is the change of fatwa in the form of perfecting/completing the legal provisions in the previous fatwa, as the change of MUI fatwa on the determination of the beginning of Ramadan, Shawwal and Dhulhijjah, and fatwa on Qibla direction. Methodologically, in addition to considering the latest scientific studies, MUI fatwas are also equipped with shara' arguments including adequate verses of the Qur'an, Hadith, scholarly opinions, and ushul fiqh studies. Abstract

The advancement of digital technology has transformed student consumption patterns, particularly through e-commerce platforms like Shopee and Tokopedia. This article analyzes student consumption behavior using Max Weber's social action theory and an Islamic economic perspective. Employing a qualitative, descriptive-analytical method, data were gathered through in-depth interviews with students who actively use e-commerce. The study reveals that student consumption is influenced not only by instrumental rationality but also by social, cultural, and religious values. From an Islamic economic viewpoint, some behaviors—such as excessive consumption, use of paylater services, and neglect of halal product considerations—do not align with ethical consumption principles. The findings highlight the need for increased Islamic economic literacy that extends beyond fiqh muamalah to encompass social ethics and awareness in digital transactions. Abstract

This article analyzes the implementation of the Job Creation Law as a tool to achieve public welfare through Karl Marx’s conflict theory, focusing on historical materialism and class struggle. Intended to boost investment, employment, and ease of doing business, the law has sparked controversy and widespread protests. Although enacted, it was declared unconstitutional by the Constitutional Court in November 2021. Using a descriptive qualitative method and library research, this study draws on articles, books, and online sources, analyzed through Marxist theory. Findings suggest that while the law aimed to support economic recovery post-pandemic, several of its regulations still require collective attention to truly realize its goal of public welfare.
