Abstract

Pengelolaan Barang Milik Negara/Daerah berdasarkan Peraturan Pemerintah No. 6 tahun 2006 menuntut adanya pertanggungjawaban, akuntabilitas, serta transparansi dalam pengelolaan barang milik Negara/daerah. Inti perubahan yang akan dilakukan antara lain meningkatkan esensi pengelolaan barang milik Negara pada Kantor Komisi Pemilihan Umum Kabupaten Siak yang meliputi mekanisme penggunaan, Sistem pelaporan, pengamanan dan pemeliharaan dan pengawasan serta pengendalian barang. Pasal 3 ayat (1) Peraturan Pemerintah No. 6 Tahun 2006, mengamanatkan bahwa pengelolaan barang milik Negara/daerah dilaksanakan berdasarkan asas fungsional, kepastian hukum, transparansi dan keterbukaan, efisiensi, akuntabilitas, dan kepastian nilai. Permasalahan dalam penelitian ini adalah sejauh mana implementasi dari Peraturan Pemerintah Republik Indonesia Nomor 6 Tahun 2006 tentang Pengelolaan Barang Milik Negara/Daerah pada Kantor Komisi Pemilihan Umum Kabupaten Siak dan apa saja yang menjadi hambatan dalam pengimplementasian Peraturan tersebut pada Kantor Komisi Pemilihan Umum Kabupaten Siak. Hasil penelitian ini diketahui bahwa implementasi Peraturan Pemerintah Republik Indonesia Nomor 6 tahun 2006 tentang Pengelolaan Barang Milik/Negara pada Kantor Komisi Pemilihan Umum Kabupaten Siak kurang terimplementasi dengan baik, hambatan ini disebabkan kurangnya sosialisasi tentang Peraturan Pemerintah Republik Indonesia Nomor 6 tahun 2006 tentang Pengelolaan Barang Milik/Negara, dan ketersediaan sumberdaya aparatur pelaksana baik dari segi kuantitas maupun kualitas dalam pelaksanaan pengelolaan barang milik Negara.

Abstract

Abstract The problem of land ownership in Indonesia in general and in the Kesumbo Ampai Village area has complex problems. Among them, the government takes over land from the people, to be developed in accordance with the plans that have been set to continue economic modernization or the creation of oil palm fields for investors, both inside and outside the State. This land problem shows a conflict of interest between the government, which sees land as capital for national development, and local residents who see land as a source of income. Based on the above problems, the formulation of the problem is how is the legal review of the existence of customary land in the Sakai Tribe Village based on the UUPA. The research method uses observation research. The result of the research is that the existence of the Sakai tribe community has been based on the conditions of existence determined by law so that the Sakai tribe is still truly a customary law community, as well as the land or land on which they live is land belonging to their ancestors for generations which is still jointly owned, which in terms of management and control and use of the land still follows the rules of customary law that apply in their environment, supervised by the customary leader they have.

Abstract

Dewasa ini gerakan Lesbian, Gay, Biseksual dan transgender (LGBT) merupakan hal yang dikhawatirkan oleh masyarakat. LGBT sendiri adalah gerakan untuk menormalisasi perilaku seksual menyimpang dengan mengatasnamakan hak asasi manusia. Paham ini sangat dilarang dalam hukum islam, yakni melalui al-quran surat al-a’raf ayat 80-81 dan surat Hud ayat 82-83. Pada tahun 2023 silam di kota pekanbaru pernah ditemukan grup pesan whatsup LGBT yang anggotanya adalah para siswa. Temuan hingga saat ini menjadi hal yang mengkawatirkan bagi SMP YLPI P Marpoyan, mengingat akses informasi melalui sosial media tidak bisa lagi dihalangi dari siswa-siswi. Tujuan kegiatan ini adalah untuk melakukan pencegahan masuknya paham LGBT di smp ylpi dengan pendekatan pendidikan hukum islam yang ditanamkan oleh para guru melalui budaya literasi. Metode yang digunakan dalam kegiatan ini meliputi dari tahap persiapan yakni penyusunan materi dan poster, tahapan pengadaan sudut bacaan dan tahapan diskusi. Program ini memberikan hasil yakni di inisiasinya budaya literasi pendidikan islam di kalangan guru. Sehingga wawasan keislaman ini bisa menjadi mencegah masuknya paham LGBT dikalangan murid.

Abstract

The elimination of the presidential threshold system on the one hand has had a positive impact on the development of Indonesian democracy. This system can restore the basic rights of citizens in the constitution (remedy of constitutional rights) that were once injured by the existence of the presidential threshold. There are many benefits that will be obtained by non-majority parties so that they can propose their respective presidential candidates, and also make the choice of president more diverse. With the PT, it will be easier for the president to carry out government duties, because there is no intervention from other dominant parties in parliament. However, the weaknesses of the elimination of the PT are also worth considering, such as the vulnerability of individual interests that can be obtained through presidential nominations. From a national security aspect, it will result in an expansion of conflict escalation and election crimes due to the large number of candidates. In terms of efficiency, the allocation of the election budget will increase (high cost election). At least the allocation of election funds can be channeled to areas that can improve the welfare of other people. However, this assumption needs to be further proven with in-depth research on the efficiency of campaign funds.

Abstract

Background. The existence of Article 28 of Law Number 11 of 2020 in conjunction with Government Regulation in Lieu of Law Number 2 of 2022 and Law Number 6 of 2023 Paragraph 3 on Job Creation, Government Regulation Number 26 of 2021 on the Implementation of the Agricultural Sector. Purpose. Minister of Agriculture Regulation Number 18 of 2021 on the Facilitation of Community Plantation Development, Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 18 of 2021 on the Procedures for Determining Management Rights and Land Rights, and Circular Letter of the Minister of Agrarian and Spatial Planning/Head of the National Land Agency Number 11/Se-Hk.02.02/Viii/2020. Method. the Implementation of Company Obligations in Facilitating Community Plantation Development collectively render the imperative of land redistribution for community plantations, constituting 20% of the aggregate land entitlements vested in plantation enterprises, not as an enforceable obligation but rather as an elective premise, wherein the ethos of facilitating community plantation development is underscored. This scholarly inquiry adopts a Normative Juridical methodology, employing both legislative scrutiny and a case study approach. Results. The findings assert, that the extant regulatory framework concerning land redistribution, as a commitment levied upon plantation entities for fostering community plantation initiatives, presently lacks parity, given that the apportionment of 20% (twenty percent) of land expanses granted under Business Use Rights or from the territories delineated in Plantation Conclusion. Business Licenses or Cultivation Business Licenses, earmarked for community beneficiaries, no longer carries the hallmark of an obligatory tenet but is relegated to the sphere of discretionary choice within the ambit of community plantation development facilitation programs.
