Abstract

The determination of a public policy is of course always faced with the problem of budget constraints which often puts the government in a trade-off situation which is defined as a dilemma condition that makes it difficult to make choices in determining priorities. This is what makes many policies that are not effectively implemented. The neglect of community expectations has resulted in negative reactions ranging from acts of violation even to anarchy that leads to crime. For this reason, it is deemed very important for the government to have a strategy in setting a priority scale so that a policy is more beneficial to people's lives, not just focusing on legal certainty. For this reason, the main problem is related to the efforts of the Regional Government in determining the priority scale so that an implementation of public policy is truly on target. Keywords: Budget Constraint, Trade off, priority scale

Abstract

Abstract

The different legal systems of countries in the world make many international conventions available, such as UNIDROIT, UNCITRAL, CISG, COMECON, and so forth. Despite this, the conventions have not been able to fully accommodate the interests of the parties in conducting international relations. The intended international relations can be in the form of political relations and also commercial business. Many conventions at the UN, but do not necessarily require all members to follow and submit to the contents of these conventions. One of the requirements to legitimize a convention in the national domain is to ratify the convention. Then practice it in his national legal culture. Lex Mercatoria exists as a flexible international law both for adherents of the Civil Law System, Anglo Saxon and the Socialist legal system. One organization that specifically regulates world trade is the WTO or World Trade Organization, which also regulates ways of international dispute resolution. The methods practiced by the WTO were later gradually used as international customs for various countries in the world, moreover for Indonesia which officially became a member of this organization. Indonesia also hereby issues national regulations in order to adapt to international customs in the world, one of which is the issue of transnational dispute resolution. So that in this case will be further studied and analyzed regarding: a). How is the implementation of the lex mercatoria principle in carrying out international business contracts implemented in cross-country relations between UN member states? and b). What is the mechanism for resolving business disputes in the event of default or unlawful conduct across the United Nations member states

Abstract

Looking at the times and society's need for a modern form of technology-based business, it is interesting to discuss the topic of startup companies. Moreover, this form of business is now considered part of the trend of digitizing trade. In addition, e-commerce is a form of trend in the digital sector and today's economic sector. This research aims to examine the role of big data and the protection of personal data in startup companies and the legal relationship in it, and to examine the regulations regarding consumer protection for startup company users in Indonesia. This research was conducted using a normative research method, with a statutory approach and a case approach with descriptive and evaluative techniques. The results of this research revealed that the role of big data in the startup company business, among others, is to support business competition by using big data through innovation. Not only for startup companies, but for all current and future business ventures as well as for the government in relation to public services. The parties in the startup business other than the company itself, including consumers and the government as legal authorities. All of them have their respective important roles. Consumer protection is now the responsibility of OJK, in addition to the legal umbrella in the form of regulations issued by the OJK, regulations set by Bank Indonesia can also be used as the only central bank that has the capacity to determine monetary policy. In addition, it is also regulated in the ITE Law, which even though it is not sufficient to protect consumers, it can at least provide legitimacy for the protection of consumer data.

Abstract

Perdagangan global telah melahirkan keberadaan pasar global yang bersifat crossborderless. Maka, aktifitas di dalamnya akan sangat sulit dijangkau oleh hukum nasional yang dibatasi oleh wilayah yurisdiksi pemberlakuannya. Melalui teknologi Blockchain, diharapkan lebih mampu mengoptimalisasi perlindungan data bagi investor Indonesia yang melakukan aktifitas perdagangan di Pasar Global. Apalagi teknologi ini bukan merupakan hal baru diantara negara-negara pelaku perdagangan dunia, khususnya di Bursa Berjangka yang merupakan salah satu bentuk Pasar Global yang ada. Melihat pada sulitnya pembuktian dalam kasus-kasus di Bursa Berjangka dan pemblokiran situs Pialang yang dirasa kurang memberikan perlindungan hukum bagi investor Indonesia yang telah terlanjut melakukan deposit dana, maka diharapkan pengembangan teknologi Blockchain akan menjadi solusi bagi situasi ini. Hal tersebut sangat menarik untuk diteliti dan dianalisis lebih lanjut melalui rumusan permasalahan yaitu Bagaimana teknologi blockchain dikatakan mampu memberikan perlindungan hukum yg lebih optimal bagi investor di bursa berjangka komoditi atau bagi pihak manapun sekaligus pemerintah? Abstract

Kejahatan dalam masyarakat akan menimbulkan ketidakseimbangan. Terlebih untuk masyarakat adat, tidak hanya ketidakseimbangan secara sekala yang berubah, melainkan secara niskala pula. Menurut Sutherland, kejahatan dapat timbul dari bentuk pergaulan lingkungan sekitarnya dan berdasarkan diri sendiri. Sebagai bentuk pencegahan dan menciptakan keseimbangan, masyarakat adat Bali memiliki awig-awig yang berperan sebagai pedoman dalam berperilaku bagi masyarakat adat. Dalam penelitian ini menggunakan metode penelitian yuridis empiris dan studi kasus guna menggali lebih dalam serta menemukan informasi baru mengenai hukum pidana adat, mengetahui penerapan awig-awig di desa Penyaringan, serta mengetahui awig-awig berdasarkan perspektif hukum preventif. Hasil yang diperoleh dari penelitian ini yaitu kehadiran awig-awig dapat membantu pencegahan terjadinya tindak kejahatan pada lingkungan masyarakat Bali.

Abstract

Penyelenggaran Pemerintahan Desa akan tersusun dan terarah dengan baik bahkan lebih maju apabila di berbagai lapisan masyarakat desa memiliki kesadaran terhadap Pemerintahan Desa yang di dampingin Badan Pemusyawaratan Desa (BPD). Sehingga seluruh masyarakat akan terwakili kepentinganya untuk mencapai Pemerintahan Desa yang demokratis, jujur, bersih dan bebas dari KKN. Dengan demikian penyelenggaraan Pemerintahan Desa termasuk Desa Marga Dauh Puri haruslah mengacu pada peraturan pemerintah yang ditetapkan yakni sesuai dengan Undang-UndangNo23 Tahun 2014 TentangPemerintahan Daerah, Undang-UndangNomor 6 Tahun 2014 TentangDesa, Undang-Undang No 12 Tahun 2005 Tentang ICCPR  dan Permendagri Nomor 110 Tahun 2016, Pasal 32 Tentang Badan Pemusyawaratan Desamengingatkan adanya sistem pemerintahan agar lebih efektif dan efisien serta demokrasi. Penelitian ini menggunakan metode Penelitian Hukum Empiris yang akan mendeskripsikan Tugas dan Fungsi Badan PemrusyawaratanDesa dalam menjunjung tinggi nilai demokrasi di Desa Marga DauhPuri. Penelitian ini menggunakan metode penelitian hukum empiris. Setelah data terkumpul maka dilakukan analisis dengan menggunakan pendekatan perundang-undangan. Hasil dari penelitian ini menunjukan bahwa, dalam Undang-Undang Nomor 6 Tahun 2014 tentang desa pasal 55  dijabarkan tentang fungsi Badan Permusyawaratan Desa Sampai dengan saat ini BPD telah dapat menjalankan tugas dan fungsinya meskipun masih dalam taraf orientasi, terbukti sejak 2019-2022 BPD Bersama Pemerintah Desa Marga Dauh Puri telah berhasil membuat 28 Perdes , dan Pembangunan di Banjar Ole dan Banjar Kelaci. Dari hasil penelitian diatas peran BPD dalam menampung dan menyalurkan aspirasi masyarakat di Desa Marga Dauh Puri, semua jawaban menunjukkan kearah yang baik. BPD dituntut untuk melakukan perannya antara lain mengenalkan nilai-nilai demokrasi Pancasila kepada masyarakat desa pada umumnya dan pelaksanaan pemerintahan desa pada khususnya.

Abstract

The progress of technological innovation in the era of globalization was so quickly. The digital technologi gives special colour in the financial business sector. During the pandemic, a lot of people switch use online transactions because of the implementation of restrictions community activities system applicate by the government. Behind the high growth graph, it turns out that in practice financial tecnology (fintech) are reaping various polemics in the community. The lack of knowledge of digital financial literacy has resulted in many citizens being entangled in the dynamics of illegal fintech lending cases. The fintech requires Bank Indonesia and the Financial Services Authority carry out intensive supervision of the legality of digital financial innovation companies through the Regulatory Sandbox mechanism. This article uses normative legal research as a reference basis in determining legal procedures related to the polemic of Fintech-based innovation companies in Indonesia. The analytical method used is qualitative and described descriptively. The results of this study are to find out the harmonization of BI and OJK authorities through the implementation of the Regulatory Sandbox mechanism by establishing PBI No.19 /12 /PBI /2017 and POJK No. 13/ POJK.02/ 2018 as the legal basis for the legalization of fintech innovations before they are widely circulated in the community.

Abstract

The first generation of human rights basically spoke about freedom and political life, in other words, these rights were civil and political rights. In this case, it can be exemplified by the right to life, equality before the law, freedom of opinion, the right to a fair legal process, the right to freedom of religion and the right to vote and be elected in elections. The role of the village apparatus is very important in guaranteeing the implementation of freedom of human rights in society which is reflected in the system of government and protection of the rights of the community in the civil and political fields in accordance with the Law of the Republic of Indonesia Number 12 of 2005 concerning Ratification of the International Covenant On Civil And Political Rights Covenant (International Civil and Political Rights) which is accompanied by a Declaration against Article 1 concerning the ratification of the International Covenant on Civil and Political Rights. The obstacles faced in the fulfillment of civil and political rights in the community can be resolved by using a consensus approach bridged by the Village Consultative Body (BPD) and facilitated by the village apparatus. BPD plays an important role in ensuring the civil and political rights of the people of Marga Dauh Puri Village, Marga District, Tabanan Regency, Bali. Moreover, the UN Human Rights Council has opened up opportunities for complaints for individuals, activists and NGOs. So it is interesting to examine more deeply through two problems, namely regarding the selection mechanism and the absorption of understanding of human rights in the regulation and process of selecting village government apparatus, especially related to civil and political rights in the life of the nation and state of the Marga Village community in particular. With a research method that is somewhat different from human rights research in general, namely Juridical Empirical.

Abstract

The State of Indonesia is a legal state (rechtsstaat), this has received legitimacy through the provisions of Article 1 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia (1945 Constitution). The Attorney General's Office has issued several policies, including the First, the Attorney General's Regulation of the Republic of Indonesia Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. It is hoped that this provision as a form of prosecution discretion can be used by the Prosecutor to view and balance between the applicable rules and the principle of benefit to be achieved. Diversion and Restorative Justice are the basis for reforming the criminal justice system in the implementation of the juvenile justice system, which can be seen in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, which aims to prevent child offenders from being subjected to punishment or punishment. Both concepts are new things for Indonesian people. Law Number 3 of 1997 does not contain restorative juctice principles, and there are no strict provisions regarding diversion (settlement outside the process). Termination of Prosecution Based on Restorative Justice stipulated in the Attorney General Regulation Number 15 of 2020 guidelines for Public Prosecutors to stop prosecutions with due observance of fairness, public interest, proportionality, punishment as a last resort, and fast, simple and low cost. Socialization Perja 15 of 2020 and updating the role of the prosecutor's office in tackling crime in realizing restorative justice by means of, among other things, making peace efforts and having a peace process where the prosecutor plays an active role in handling cases so that cases can be resolved without having to go to court.
