Abstract

Muhammad Syahrur viewed the ulama’s understanding of testaments as being very raw and stagnant so that it did not provide room for movement in resolving later cases. Therefore he suggests new ideas related to the testament which would symbolize that the Koran was indeed “shâlihun lî kulli zamân wa makân”. Syahrur sees the position and application of the testament more than the inheritance. The istinbath method of the Shahrur law is only of two kinds, which are sourced from the Koran and the Sunnah. The difference in views of Shahrur is based on his views on the Koran and the Sunnah which are different from the majority of scholars. In studying the Koran he also relied on sever- al approaches namely: linguistic, philosophical and intra-textual. The thought brought by Syahrur was in contradiction with classical scholars. Therefore, Syahrur’s opinion cannot be freely adopted in responding to the reality of fiqh today and is not one of the forms of renewal of Islamic law. However, what Syahrur did in the testament issue must not all be rejected outright, but there are parts that can be adopted in applying the will law.

Abstract

Children are creatures created by God that must be protected and maintained with honor and dignity. The fulfillment of children's rights is an interesting issue to discuss. This study aims to analyze the fulfillment of children's rights in the family from the perspective of Fiqh and analyze effective ways that must be done so that the guarantee of the fulfillment of children's rights can be realized properly. This study uses a literature review. The data collection technique used is documentation, which examines scientific journals, books, and documents related to the research object. The analysis method used in this study is the Miles and Huberman analysis method. The data validation technique used is source triangulation, which compares one source with another source so that the data obtained is valid. An important finding in this study is the fulfillment of children's rights if narrowed down more deeply into five things: the fulfillment of rights related to religious affairs (Hifz al-din), the fulfillment of rights related to the soul (Hifz al-nafs), the fulfillment of rights related to honor and nasab (Hifz al-Nasl), the fulfillment of rights related to reason (hifz al-aql), and the fulfillment of rights related to property (Hifz al-mal). Children must be guaranteed their right to grow and develop following their nature; therefore, all forms of treatment that interfere with and damage children's rights in various forms of violence, discrimination, and exploitation that are not inclusive must be abolished without exception. The guarantee of the fulfillment of children's rights needs to be integrated with the applicable legal regulations in society to be more effective, namely Law Number 4 of 1979, Presidential Decree Number 36 of 1990, and Law Number 35 of 2014 concerning Child Protection as a form of amendment to Law Number 23 of 2002 concerning Child Protection. This study contributes to the academic discourse by offering a normative reconstruction of children's rights within the family through the lens of maqaṣid al-shari'ah, thereby integrating classical fiqh principles with contemporary child protection laws in Indonesia.

Abstract

Khitan perempuan adalah tindakan memotong atau mengurangi sedikit kulit pada bagian paling atas alat kelamin perempuan, umumnya pada preputium klitoris (kulit penutup klitoris. Penelitiannya adalah kualitatif deskriptif dengan teknik pengumpulan data memakai studi dokumentasi dengan analisis data induktif dan deduktif. Hasil penelitiannya: PP No. 28 Tahun 2024 adalah tonggak penting dalam perlindungan kesehatan reproduksi dan hak anak di Indonesia. Dengan pelarangan khitan perempuan secara eksplisit, pemerintah menegaskan bahwa praktik ini tidak lagi dapat dibenarkan dari sisi medis, agama, maupun budaya, dan seluruh upaya diarahkan pada edukasi serta perlindungan anak perempuan dari risiko dan bahaya. Secara umum, kebijakan penghapusan khitan perempuan mendapat sambutan positif dari berbagai pihak yang peduli pada kesehatan dan hak perempuan, namun masih menghadapi tantangan kuat dari tradisi dan pemahaman agama yang keliru di masyarakat. Oleh karena itu, sosialisasi, edukasi, dan pendekatan budaya yang melibatkan tokoh adat dan agama sangat krusial untuk keberhasilan implementasi kebijakan ini.  PP No. 28 Tahun 2024 tentang penghapusan khitan perempuan secara prinsip hukum Islam dapat diterima karena: 1) Tidak ada kewajiban syariat yang kuat untuk khitan perempuan. 2) Praktik tersebut berpotensi membahayakan dan merusak tubuh, yang dilarang dalam Islam. 3) Regulasi ini sejalan dengan maqasid syariah dalam menjaga kesehatan dan kemaslahatan umat. Namun, keberhasilan implementasi kebijakan ini membutuhkan pendekatan edukasi yang sensitif terhadap nilai-nilai agama dan budaya masyarakat agar penghapusan praktik sunat perempuan dapat diterima secara luas tanpa menimbulkan konflik sosial.

Abstract

This study aims to generate theoretical ideas about religious practices within the tradition of local wisdom. The fact that the Malay Batubara community continues to perform a healing ritual known as ubat-ubat serves as the foundation of this research. In addition to Islam, elements of Hinduism and Buddhism can also be found in these healing rituals, reflecting a form of religious syncretism. The purpose of this study is to explain why the community continues to practice this ritual from the perspective of Surah Al-Baqarah, Verse 165. A qualitative method involving observation and interviews was used to collect data. The findings indicate that the Malay Batubara community performs the ubat-ubat ritual to avoid misfortune and express gratitude to the Creator, who has provided sustenance to His servants through objects and nature. Whether conducted individually or collectively, this ritual reflects the love for Allah, as stated in Surah Al-Baqarah, Verse 165, which serves as the foundation for strengthening the devotion of believers. The author hopes that this religious tradition does not become mystical or negatively impact the community in the future, whether in terms of education, economy, or religion, despite this ceremony being held annually.

Abstract

In this tajhizul mayit training activity for the MDA GUPPI children of Pastap Julu Village, the community service provided guidance on important issues related to human relations with other humans, namely the problem of tajhizul mayit (corpse care). Islam pays very serious attention to this issue, so that this is one of the obligations that must be fulfilled by humanity, especially Muslims. This community service work aims to 1). Equip MDA children with tajhizul mayit skills. 2). Train MDA children to be able to implement and develop the religious knowledge they have obtained in society. Meanwhile, the benefits that will be generated from this training are 1). Improving the skills of MDA children in properly and correctly handling corpses in accordance with the teachings of Islamic law, so that if one day they are needed they are ready to use. 2). Increasing skilled personnel in handling corpses. 3). Increasing the skills of the modin in handling corpses. The result of this community service work is that the MDA GUPPI children of Pastap Julu Village have been able to implement and practice how to properly and correctly handle corpses in accordance with the provisions of Islamic law.

Abstract

This paper explains that Islamic courts have a central role in upholding the law based on the principles of justice and benefit in accordance with sharia teachings. This study aims to examine the application of Maqasid Syariah the main objectives of sharia, which include the protection of religion, life, intellect, descendants, and property in the judicial process, in order to achieve a balance between al-‘adl (justice) and al-maslahah (benefit). The research method used is a literature study with a normative-juridical approach, involving an analysis of classical and contemporary Islamic legal sources, as well as a review of relevant judicial decisions. The results of the study indicate that the integration of Maqasid Syariah in judicial practice can maintain the relevance of law to social dynamics, while ensuring that the principle of justice remains the primary foundation. Achieving this balance requires an active role of judges in interpreting sharia arguments comprehensively and contextually, so that legal decisions are not only normatively valid but also beneficial for the welfare of the community
