Abstract

Hadirnya tradisi martahi marpege-pege di kalangan masyarakat Batak Angkola sebagai solusi bagi keluarga yang akan menikahkan anaknya, karena dalam menikahkan anak dalam adat Batak Angkola membutuhkan biaya yang besar, tentunya tidak semua keluarga mempunyai kondisi ekonomi yang stabil Ketika anak laki-lakinya ingin menikah dan apabila tidak di nikahkan di kawatirkan terjadi perzinahan. Dengan kondisi ini maka lahirlah sebuah tradisi mengumpulkan uang dengan tujuan saling membantu. Penelitian ini adalah peneltian lapangan (field research) dengan pendekatan quantitative Deskriftif untuk mengungkap persepsi masyarakat terhadap tradisi martahi marpege-pege dan tinjauan hukumnya dalam Islam. Populasi penelitiannya adalah masyarakat Kabupaten Tapanuli Selatan yang berada pada 6 kecamatan dengan model ramdom sampling. Teknik pengambilan data yang dilakukan dengan Teknik angket tertutup dan wawancara serta Teknik Analisa data adalah kuantitatif deskriftif. Hasil peneltian ini menunjukkan bahwa persepsi masyarakat terhadap tradisi Martahi Marpegepege yaitu 69,93%: 30,06% dimana tradisi ini adalah tradisi yang baik dan perlu dilestarikan. Konsepsi hukum Islam tentang tradisi ini dianggap sebagai ‘urf sohih dengan berlandaskan pada al-adatu muhakkamah artinya bahwa kebiasaan yang baik menjadi dasar pengambilan hukum Islam. Dan status tradisi ini menjadi tradisi yang boleh dilakukan dalam tinjaun hukum syara‟.

Abstract

ملخصمرتاحي مرفغي-فغي هو تقليد راسخ في مختمع بتفانولى جنوبية أو سمي به باتك انكولا غالبًا.  هذا التقليد هو تقليد يهدف إلى المساعدة من االمقربين لأولئك الذين سيتزوجون أبنائهم في مسألة مال الذى التي سيعطها لعائلة البنات سيجوجه في العروس أو ما يسمى بولي أو طوخر. ولمساعدته فقام به التعاون المتبادل على شكل إعطاء من النقود لأولئك الذين يتزوجون من أبنائه بشرط أن يتم إعادتهم عندما يقوم بالحاجة الموساويا أيضًا أو سمي هذا بالدين في العرفي. فلذلك ليس هناك الضمان في استرداد هذا الدين. ومن هذا هناك موقف غير واضح لحسابات الدين. واما الغرض من هذا البحث هو شرح كيفية تطبيق مفاهيم  مرتاحي مرفغي-فغي وموقعه في الشريعة الإسلامية. هذا البحث هو بحث نوعي ، حيث يتم أخذ البيانات عن طريق إجراء مقابلات مع القادة والملاحظات التقليدية حول تنفيذ مرتاحي مرفغي-فغي في فادنغ لواس سمالية. وبعد إجراء هذا البحث ، وجد فيه أن تقليد مرتاحي مرفغي-فغي في أوله لمساعدة الرجل في أداء النكاح يحتاج فيه كثير من المال في تكلفة حفل النكاح الذي يشمل على تنفيذ حدث مرتاحي مرفغي-فغي نفسه ، مهر ، لباس خاص في النكاح، كتاب النكاح، الدرج في العادة. وليمة العرش ، وسائل النقل لالتقاط العروس ، أموال فاغولات بورو، والآن حتى الفتيات المتزوجات قاموا بتنفذها. من هذه الدراسة أن تقاليد مرتاحي مرفغي-فغي في الشرعية الإسلامية تشمل على أورف صحيح لان ليست في عبادة المحضة وتساعد بشكل متبادل بين الناس ، وخاصة أولئك الضعفاء اقتصاديًا.كلمة المفاتيح : التقليد ، السريعة الإسلامية

Abstract

The phenomenon of the veil in the community remains an interesting study because there are still many people who feel foreign to seeing women using it. Negative stigma is often directed at women who wear the veil by considering them as adherents of radicalism, terrorism, and followers of deviant studies. However, this development cannot be dammed and stopped so there are still many female students who wear the veil. The purpose of this study was to determine the motivation to use the veil among female students of IAIN Padangsidimpuan. This research is qualitative descriptive research that is revealing the phenomenon of the veil which is then reviewed from the point of view of Islamic law. Data collection techniques in this study use observation techniques, interviews, and documentation. The data analysis technique used the Miles and Huberman model data triangulation technique, namely data collection, data presentation, and conclusion drawing/verification. The results of this study indicate that the motivation to wear the veil among IAIN Padangsidimpuan students is intrinsic motivation, namely encouragement that comes from within. Extrinsic motivation is classified as little because having experience has a special relationship with "dating" status. The purpose of using the veil, in general, can be concluded to protect oneself, view, strengthen worship, be a shield not to do things that are forbidden by Allah, and become a pious person. Then the challenges they face come from themselves, their families, and the community environment in the form of negative stigma so that they are said to be adherents of radicalism, terrorism, extremism, and followers of deviant studies. Seeing the results of the study that female students used the veil without any element of coercion so legally Islamic Shari'a is a sunnah thing for the reason of wanting to protect themselves

Abstract

The issue of domestic violence is not a small issue that only occurs in families who do not have education but also occurs in educated families. The existence of an order to beat the wife when she is against her husband (nusyuz) is the entrance to violence against women in a household. This research is a literature study with a qualitative descriptive type, namely describing domestic violence according to the Qur'an and Hadith. Data were collected using document study techniques on related literature and analyzed using content analysis techniques. The results of this study indicate that the husband's violence against his wife in the household in a review of the Qur'an and hadith is the potential of the husband's ability to beat his wife for educational purposes after advising and separating beds. In fact, this stage is rarely carried out. There are various forms of sexual violence, namely physical, psychological, sexual and economic neglect. Al-Qur'an and hadith there is no verse that allows violence in a household even though there is an order to beat the wife when nusyuz except for educational purposes. Based on the analysis above, it can be concluded that Allah SWT and the Prophet did not allow violence to occur in the household.

Abstract

Tradisi Mangupa Boru merupakan salah satu upacara adat yang dilakukan oleh masyarakat Batak Angkola untuk memberkati dan memberikan doa restu kepada pasangan pengantin. Upacara ini biasanya dilakukan oleh keluarga pengantin perempuan dan melibatkan berbagai ritual yang penuh simbolisme. Mangupa Boru bertujuan untuk mendoakan pasangan pengantin mendapatkan kehidupan yang harmonis, sejahtera, dan bahagia. Penelitian ini adalah penelitian kualitatif dengan pendekatan fenomenolgi untuk menjelaskan bagaimana posisi hukum Islam melihat tradisi mangupa dalam batak angkola. Teknik pengumpulan data menggunakan wawancara terstruktur dan tidak terstruktur dengan responden. Responden dalam penelitian ini adalah tokoh adat yang terdapat dalam adat batak angkola yang terdiri dari harajaon, orang tua, alim ulama, dan pemerintahan. Data yang dikumpulkan menggunakan Teknik analisis tematik dan analisis konten. Hasil penelitian ini menunjukkan bahwa mangupa pada tradisi batak Angkola mempunyai tujuan untuk menunjukkan rasa kasih sayang, dasarnya bahwa anak yang diupa selain anak biologis juga merupakan anak Masyarakat adat. Prosesi adat mangupa dilaksanakan memberikan nasehat kepada kedua mempelai. Unsur adat yang terdapat dalam prosesi adat adalah orang tua, hatobangon, harajaon, kahanggi, mora dan anak boru yang terhimpun dalam dalihan natolu. Mangupa perspektif hukum Islam merupakan urf dan tidak mengandung unsur kesyirikan dan tidak menyalahi hukum Islam. Mangupa adalah adat tradisi yang boleh dilestarikan selama prosesi tersebut tidak keluar dari nilai-nilai moral.

Abstract

The development of children in orphanages is greatly influenced by the parenting pattern provided by the caregiver as a substitute for the role of the biological father and mother. Divorce as a factor that causes children's development to be hampered both mentally, physically and cognitively. Reconstruction of gender roles is very necessary to produce healthy children, full of potential and self-confident children of divorce victims in orphanages. This study aims to determine the gender reconstruction of parenting at the Hayat Sabungan Jae orphanage in Padangsidimpuan City. This study is a qualitative study, namely looking at gender reconstruction in the care of children who are victims of divorce. Data were collected through observation, interviews, and document studies. The results of this study indicate that parenting practices are carried out by placing caregivers as fathers and mothers who replace their biological parents in three aspects, namely care, education and child self-development. Reconstruction of gender roles in the parenting process is carried out by considering the age of the child by engineering the role of the father and mother as befits the biological mother. The process is carried out by placing the father and mother specifically during the transition from the biological mother and father. Then self-development after adolescence by paying attention to the interests and talents of boys and girls. From the results of this study, it can be concluded that caregiving with gender reconstruction runs full of limitations of caregivers in Hayat orphanages. This means that there needs to be a balanced relationship between foster children and caregivers to create maximum care based on gender.

Abstract

The practice of boro (pawning agricultural land) has been a long-standing tradition in Si bio-bio village which is detrimental to one of the parties, namely the pawnbroker, but it is still being carried out. Seeing this phenomenon requires an in-depth study of the legal aspects of muamalah fiqh. This article is a qualitative descriptive study to reveal the practice of pawning agricultural land (boroh) in the village of Sibio-bio which is then studied in Sharia law. Data collection techniques using observation techniques, interviews, and document studies. While the data analysis technique uses data triangulation, namely data collection, classification, and verification (drawing conclusions). The results of this study indicate that the pawning of agricultural land (boroh) was carried out by the people of Sibio-bio village due to the lack of a strong desire to save. The money obtained from pawning agricultural land is used for several needs such as building a house, children's education costs, child marriage costs, business capital, and buying vehicles. Regarding the legal status of pawning agricultural land (boroh) in the village of Sibio-bio, the clerics differed on the use of pawned goods (marhun), the Syafi'iyah explained that murtahin could use them, Malikiyah said murtahin could not control them, hanbilah clerics and Hanafiyah allowed it with Rahin's permission. The conclusion of this study is that pawning agricultural land is an act that is permitted, and the use of this land may be controlled by murtahin with permission from Rahin, and of course, it must be stated when the pawn agreement takes place

Abstract

Marriage should not cause one of the partners to lose happiness due to wanting to cover up the sexual identity of one of the partners. Contemporary Islamic jurisprudence opens up space in studying the legal status of lavender marriage to avoid marriages that are not in accordance with the maqosid An-nikah. This study is a literature study to reveal the legal status of lavender marriage in the context of contemporary Islamic jurisprudence. Data were obtained by looking in depth at various literatures to get a more specific explanation. The results of this study indicate that lavender marriage is a marriage that is prohibited in Islam because it deviates from the true purpose of marriage. Islamic law does not provide opportunities for marriages that do not respect human nature as men or women in obtaining happiness in marriage. Islam prohibits marriages that violate human nature. Contemporary scholars are not in accordance with the purpose of marriage and violate the rights and obligations of one of the partners.

Abstract

Arabic language learning in modern Islamic boarding schools focuses on memorization and repetition, while the communicative and linguistic dimensions have not been optimally integrated. Therefore, it is necessary to design a development model that combines academic learning activities in the classroom with communicative and contextual language practices. This study aims to describe and analyze the method of developing Arabic language learning activities through the All in One System approach at Ar-Raudhatul Hasanah Islamic Boarding School. This study uses a qualitative descriptive approach, using data collection techniques such as observation, interviews, and document analysis. Data analysis was carried out through the interactive model of Miles, Huberman, and Saldaña, including data reduction, display, and conclusion drawing. Data validity was ensured through source triangulation, technical triangulation, and member checking. The findings of this study revealed three models of Arabic language learning development: Mufradāt learning developed using the ADDIE model, emphasizing systematic planning and continuous evaluation; grammar learning developed through the ASSURE model, which focuses on learner characteristics and active participation; and and language skills learning (istimā‘, muḥādathah, qirā’ah, and kitābah) are developed through the CTL (Contextual Teaching and Learning) model, which emphasizes experience-based learning. This study concludes that the All in One System has created a dynamic and participatory Arabic language learning ecosystem, positioning language as a living practice shaped by social and cultural interactions.

Abstract

Kesetaraan antara suami dan istri dalam pernikahan menjadi sebab keutuhan dalam menjalankan bahtera rumah tangga. Setelah menikah terjadi tidak kafa’ah antara suami dan istri teruma dalam hal Al-hirfah (penghasilan) dan Al-mal (kemampuan finalsial). Penelitian ini ditujukan untuk menjelaskan kafa’ah antara suami dan istri setelah menikah generasi millenial muslim kekinian yang sering kali menyebabkan perpecahan bahkan perceraian antara keduanya. Penelitian ini adalah penelitian kualitatif analitik deskriptif untuk menggambarkan secara jelas tentang kafa’ah suami dan istri setelah menikah yang terfokus pada kafa’ah Al-Hirfah dan Al-mal sebagai sebab kebutuhan kehidupan yang acapkali membuat ketidakharmonisan keduanya. Teknik pengumpulan data menggunakan wawancara mendalam kepada informan sebanyak delapan keluarga yang merupakan pengajar pada perguruan tinggi. Setelah data dikumpulkan kemudian dianalisis menggunakan triangulasi data yang terdiri dari reduksi data, penyajian data, dan analisa. Hasil penelitian menunjukkan bahwa kafa’ah dalam pernikahan generasi millenial muslim dalam dua kategori ­kafa’ah yaitu ­kafa’ah Al-Hirfah dan Al-mal. Kafa’ah Al-hirfah (penghasilan) dalam bentuk pendidikan istri lebih tinggi dari pada suami, karir (pekerjaan) istri lebih maju dari suami, dan pengetahuan istri lebih luas dari suami. Kemudian pada aspek kafa’ah Al-mal (penghasilan), penghasilan istri lebih besar dari suami, istri bekerja menjadi pencari nafkah utama keluarga, dan suami tidak memiliki penghasilan tetap. Kedua kafa’ah ini tidak menjadi sebab perpecahan dalam keluarga mereka karena secara syari’ah tidak menjadi sebab batalnya pernikahan karena sudah menjadi kesepakatan keduanya sebelum menikah dan sesudah menikah. Dari hasil penelitian ini dapat disimpulkan bahwa kafa’ah setelah menikah ditujukan untuk menjaga keharmonisan keluarga.
