Abstract

This research aimed at analysing how copyrights could bring about economic rights for innovators and authors. In addition of generating economic rights, copyrights also protecting intellectual property rights. As we know, intellectual property rights is rights obtained from one’s thoughts or ideas, and it has economical values for the innovator and/or author. As it consequence, people required to get license from and grant royalty to the innovator and/or author when they need to gain further these economic values. This condition also valid to the copyrights as contained in law no. 28 of 2014 on Copyrights. Abstract

Hukum Waris yang berlaku di Indonesia bersifat Pluralisme, artinyanya adalah bahwa hukum waris yang ada di Indonesia beranekaragam, ada Hukum Waris Perdata Barat (BW), Hukum Waris Islam dan Hukum Waris Adat. Hukum Waris Perdata Barat (BW) diperuntukkan bagi orang non muslim atau orang-orang yang tunduk pada ketentuan Hukum Waris Perdata Barat, Hukum Waris Islam diperuntukkan bagi orang  Muslim dan Hukum Waris Adat diperuntukkan bagi masyarakat adat. Pada Hukum Waris Perdata Barat dikenal dua cara pembagian warisan untuk ahli waris yaitu: secara ab intestato (ahli waris mempunyai hubungan darah dan hubungan perkawinan dengan si pewaris) dan secara testamentair/surat wasiat (ahli waris ditentukan oleh si pewaris dalam surat wasiat. Kedua cara pembagian ini pada prinsipnya menekankan bahwa yang berhak mewaris adalah orang yang terdekat dengan si pewaris

Abstract

ABSTRAKTulisan ini membahas tentang kejahatan perang (war crime) dan menghubungkannya dengan Hukum Perang (Humaniter) Internasional ditinjau dari sudut pandang yuridis khususnya Hukum Pidana Internsional. Kejahatan perang diartikan sebagai salah satu pelanggaran Hak Asasi Manusia (HAM) Berat yang terjadi pada masa konflik bersenjata yang merupakan perbuatan yang bertentangan dengan prinsip kesimbangan antara asas kepentingan militer dengan asas kemanusiaan yang diakui sebagai hukum perang. Hukum Perang (Humaniter)  tidak bertujuan untuk melarang perang, atau untuk mengadakan undang-undang yang menentukan aturan permainan dalam perang, tetapi demi alasan kemanusian untuk mengurangi atau membatasi penderitaan individu-individu dan untuk membatasi wilayah dimana kekuasaan konflik bersenjata diperbolehkan. Dengan alasan-alasan ini hukum humaniter disebut sebagai “peraturan tentang perang berperikemanusiaan”. Jadi Hukum Humaniter mencoba untuk mengatur agar suatu perang dapat dilakukan dengan lebih memperhatikan prinsip-prinsip kemanusiaan. Adapun dasar hukum yang dipakai dalam penulisan ini adalah Konvensi Den Haag 1907, Konvensi Jenewa 1949 dan Pasal 8 Statuta Roma 1998. Kata Kunci: Perang, Kejahatan Perang, Hukum Humaniter Internasional, Pelanggaran  Hak Asasi  Manusia Berat, Konvensi Jenewa 1949 Abstract This journal discusses about war crime and its relationship with International Humanitarian Law which reviewed from juridical perspective mainly in International Criminal Law. War Crime means as one of grave breaching happened in armed-conflict periods and it is opposite with balance principles between military interest principle and humanity principle that recognized as humanitarian law. Humanitarian law does not aim to prohibit war or make laws which determine role of the game on war, but for the humanity reason in decreasing or restricting people’s suffering and restricting territory where the power of armed-conflict is legal. By these reasons, humanitarian law is mentioned as “Rule of Humanitarian War”. Therefore, humanitarian law tries to conduct war by regarding humanity principles. Some basic laws used for reference in this journal are Den Haag Convention 1907, Geneva Convention 1949, and Statutes of Rome 1998 Article 8.Keywords: War, War Crime, International Humanitarian Law, Grave Breachers. Abstract

International criminal law is “the law which determines what national criminal law will apply to offences actually committed if they contain an international element”. Beside that, the definition of international criminal law in the meaning of the territorial scope of municipal criminal law, the meaning of internationally prescribed municipal criminal law, in the meaning of municipal criminal law common to civilized nations, in the meaning of international co-operation in the administration of municipal criminal justice An international crimes is such an act universally recognized as a criminal which is    considered a grave matter of international concern and for some valid reason cannot be left within the exclusive jurisdiction of the state, that would have control over it under normal circumstances. In the context of international criminal law, the International Criminal Court is a permanent court formed by the United Nations based on Statute of Rome 1998. The Court designated as an instrument to prosecute people who commit any international crimes.

Abstract

Abstract :This writing is generally about Environmental Criminal Law which consists of criminal aspects of environmental law. Enviromental Protection and Governance Act No. 32 Year 2009 article 97 to article 120 regulate about this environmental crime. It stated there that environmental crime is a forbidden deed considered as a deed against the law for it cause an enviromental damage by polluting and contaminating environment.  There are material and formal criminal act in this environmental criminal act; a material act consider the effect of those criminal deeds, while a formal act focus more on the illegal action. This paper analyze both material and formal criminal act as regulated in Enviromental Protection and Governance Act No. 32 Year 2009, specifically at articles 98, 99 and 112 for the material act, while for formal act covered by articles 100-111 and articles 113-115. Keywords: Environmental Criminal Law, Environmental Crime, Material Criminal Act, Formal Criminal Act, Enviromental Protection and Governance Act No.32 Year 2009

Abstract

This writing propose to explain some criterions of grave breaches, which is constituted of genocide, war crime, aggression and crime against humanity. Genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or group. War Crimes: Namely, violations of the laws or customs of war. Such violations shall include, but not be limited to, murder, illtreatment or deportation to slave labour or for any other purpose of civilian populations of or in occupied territority, murder or ill-treatment of prisoners of war or persons on the seas, killing of hostages, plunder of public of private property, wanton destruction of cities, town or villages, or devastation not justified by military necessity. Abstract

There are many Indonesian Muslims who do not know how to distribute their inheritance. Islamic doctrine told us to dispense immediately properties after someone died, and that is the moment when a person has the legal rights as a heir. Islamic Law Compilation Book II, that regulate procedure of inheritance for Muslims, prescribe who has the rights of inheritor and how to distribute the inheritance. It is also written there how to dissolve some dispute on inheritance things. This writing focused on the arrangement of inheritor rights as stated in Islamic Law Compilation based on Al-Qur’an and Hadith. It is finally expected that Indonesian Muslims understand of their rights and obligation on inheritance things as proposed in Islamic Law Compilation to bring about justice in our society. Abstract

Maraknya peredaran narkoba di lingkungan masyarakat sudah tidak dapat dihindarkan lagi. Banyaknya  korban narkoba dalam hal ini termasuk anak-anak diaman mereka sesunggunya masih dalam status anak sekolah. Secara normatif masalah  hukum memang sudah tidak bisa ditolerir, namun disatu sisi berdasarkan undang – undang perlindungan anak, maka negara diminta pertanggungjawabannya untuk melakukan kebijakan yang setidak-tidaknya harus berpihak pada kepentingan anak. Abstract

The growth of development and demands in people’s life have brought us problem of environmental disputes. While there are disputes or quarrels between individuals, corporations, and state or government; the scoop of the disputes include private law, public law, administrative law, and international law. This writing is focused on environmental disputes based on private law, and also on the mechanism of dispute solutions –both through litigational or non-litigational mechanism. In litigational mechanism, people could submit a lawsuit for an act against law comitted by others based on article 1365 KUH Perdata. In non-litigational mechanism, they need to find alternative dispute solution through processes of negotiation, mediation, consiliation, even arbitrage. Both mechanism, basically, try to make up for damage by compensation and also to recover environmental detriment for a better condition.

Abstract

There are two kinds of dispute settlement; a dispute could be resolved by a judicial decision (litigation) or by a non-litigation process. This non-litigation process also known as alternative dispute resolution and arbitration. This writing focused on dispute settlement by an arbitration process. This alternative resolution prefered mostly by business people to resolve their disputation for its positive characterization. Arbitration mechanism tend to be operated fastly, efficiently, and effectively, while the case handled by expertises with integrity. The objective of dispute resolution through arbitration is to bring about a win-win solution and justice for each part involved. Regulation about arbitration has been enacted by Arbitration Act No 30 Year 1999 about Arbitration and Alternative Dispute Resolution, while it has also been arrange internationally by New York Convention of 1958, Washington Convention of 1965, UNCITRAL Arbitration Rules 1976, and UNCITRAL Model Law on International Commercial 1985.  Keywords: Alternative Dispute Resolution, Arbitration, Arbiter, Arbitration Act No.30 Year 1999
