Abstract

Hak Kekayaan Intelektual yang merupakan harta benda bergerak yang dapat diwakafkan jika dilaksanakan sesuai dengan ketentuan hukum Islam dan dilaksanakan sesuai dengan unsur-unsur wakat yaitu adanya wakif pemberi wakaf,  nazhir penerima wakaf, harta benda wakaf, ikrar wakaf, peruntukan harta benda wakaf sesuai dengan hukum Islam dan jangka waktu wakaf. Pelaksanaan wakaf hak kekayaan intelektual apabila pewakifnya meninggal dunia adalah pelaksanaan wakaf HKI berjalan terus sesuai dengan akta ikrar wakaf karena wakaf merupakan perbuatan wakif untuk memisahkan atau menyerahkan sebagian hak kekayaannya untuk dimanfaatkan sesuai dengan kepentingan dan merupakan nilai ibadah baik pewakif masih hidup maupun sudah meninggal dunia dan pahalanya terus didapatkan oleh pewakif. Akibat hukum keberlanjutan wakaf hak kekayaan intelektual apabila pewakifnya meninggal dunia adalah wakaf tersebut tetap berjalan sampai dengan habis masa berlakunya HKI tersebut. Wakaf HKI tersebut merupakan sedekah jariyah yang pahalanya berlaku secara terus-menerus. Harta wakaf berupa hak cipta terlepas dari harta milik pencipta atau pemegang hak cipta (wakif), dan tidak pula pindah menjadi milik orang-orang atau badan-badan sejak wakaf diikrarkan, hak cipta tersebut menjadi amanat Allah SWT kepada orang atau badan hukum untuk mengurus dan mengelolanya yang bertugas mengelola dan mengembangkan harta benda wakaf, kemanfaatannya hanya berupa hak ekonomi dan dinikmati oleh penerima manfaat wakaf

Abstract

During the Covid-19 pandemic and the new normal era, it became a separate challenge in resolving land cases by the National Land Agency (BPN). This condition is an opportunity as well as a challenge for the Ministry of ATR/BPN in carrying out its duties as an authorized official in its field. This writing uses legal research methods according to normative law. This type of research used in this writing is library research. Based on the results of the research, it is known that the settlement of land cases by the BPN is currently carried out based on Regulation Number 11 of 2016 as an effort to guarantee legal certainty and justice related to control, ownership, and use of land. One of the steps taken was mediation to reach an agreement, a peace agreement based on current events made mediation mandatory for the parties. That the opportunities and challenges for the BPNin resolving land disputes in accordance with the objectives of the new standard will be changed by the BPN. For this reason, it is necessary to conduct an assessment of opportunities and challenges for them. The Ministry of ATR/ BPN in solving and handling land cases in the new normal era like now.

Abstract

Placement of boundaries is necessary to avoid boundary disputes between landowners. The installation of land boundary markings by the owner with the approval of the boundary neighbors witnessed by village officials or authorized officials is called the delimitation contradiction principle. This principle is evidenced by an affidavit of approval which is signed directly by the land owner and adjacent land owner and witnesses who are present in the form of village officials. The principle of contradictory delimitation is a very basic thing that must be done by the owners, this is the main and very important condition for the land to be registered at the land office. Although land registration and the principles in land registration have been regulated in such a way and there is a legal basis governing these provisions, there are still many people who do not care, causing a problem, one of which often occurs in the field, namely the lost land boundary because the owner does not care. maintain and maintain these boundaries properly so that at the time of measurement by the land surveying officer, new land boundaries are installed and do not present bordering neighbors so that errors can occur in determining land boundaries. The problem that often arises is that neighboring neighbors underestimate their presence, consider measurements to be unimportant for certain reasons and because this can lead to disputes with other owners seizing land boundaries and there is no agreement between the parties in determining land boundaries. This indicates that the delimitation contradiction principle is not fulfilled. The procedure used to collect data in this study is in the form of documentation, namely the guidelines used in the form of notes or quotes, searching for legal literature, books and others related to the identification of problems in this study both offline and online. Analysis of legal materials is carried out using the content analysis method which is carried out by describing the material of legal events or legal products in detail in order to facilitate interpretation in the discussion. Basically the application of the delimitation contradiction principle is the presence of the parties concerned, namely the land registration applicant and the parties directly adjacent to the land boundary measurement and mapping carried out by the Land Office. has not been carried out, it is also possible that all of the parties concerned came but at the time of the measurement there was a dispute of opinion regarding the results of the measurement and mapping of land boundaries that was carried out, the application of the Delimitation Contradictory principle had also not been implemented.

Abstract

Wakaf uang telah ada sejak dahulu, walaupun pada peraktinya yang disebut akhirnya adalah wakaf benda tidak bergerak berupa tanah dan bangunan atau lainnya, sebab masyarakat banyak yang berwakaf dengan bentuk uang kemudian uang dari hasil wakaf tersebut di kumpulkan lalu dijadikan seperti tempat ibadah, sekolah, rumah sakit dan lainnya. Sehingga tidak terlalu kelihatan bahwa sebenarnya yang diwakafkan adalah berupa uang. Selanjutnya misalkan ingin membangun masjid dengan luas 1000 meter persegi yang kemudian dibagi menjadi 100 kapling dengan masing-masing kapling 10 meter dan per meternya dihargai Rp. 100.000, sehingga pewakif hanya perlu membayar sesuai kemampuannya denga harga permeternya Rp. 100.000,-. Bahkan sekarang ini wakaf uang semakin berkembang dari pada wakaf lainnya dan tentunya sangat produktif sebab dengan gampangnya akan mendapatkan hasil, hanya menginvestasikan uang yang ingin kita wakafkan saja kepada lembaga keuangan syariah penerima wakaf uang (LKS-PWU) sudah mendapatkan hasil dari investasi wakaf uang yang kita berikan dan langsung dapat dirasakan manfaatnya oleh masyarakat banyak, sehingga perlu adanya implementasi hukum wakaf uang ini agar lebih jelas dan aturannya lebih khusus

Abstract

Violence against women is very disturbing and causes injustice to the victims. Women are often victims of violence, because they are seen as weak and unable to fight the perpetrators. One of the causes of violence against women is gender inequality which creates unequal power relations between men and women. Unfortunately, this condition is often not realized by women because of the wrong understanding of what is considered as nature, which is gender. For this reason, it is necessary to educate the public, so that women no longer experience subordination which makes them vulnerable to becoming victims. Thus, violence against women can be minimized. Through the Muhammadiyah Development Partnership Program (PKPM), training is packaged that can educate MHH 'Aisyiyah administrators’ representatives from branches throughout the city of Medan to better understand gender and violence against women. The method used in this community service activity is training which begins with orientation and pre-test to the participants. The activity ended with a post-test. The post-test results showed an increase in participants' understanding of gender, forms of gender inequality, as well as knowledge about violence against women and efforts to prevent and deal with it.

Abstract

The role of youth is very important in building a spirit of tolerance in society. This research aims to examine the role of youth in building a spirit of tolerance in society. The research was conducted in Matanari hamlet, Ujung Teran Village, Dairi. This research uses a qualitative case study type approach. The subjects in this research were community leaders (JM), representatives of youth leaders (BM and TSM). Data was collected using semi-structured interviews, observation and documentation, and enriched through literature review. The data was then analyzed using the Miles and Huberman model (1994). The results of this research conclude that Matanari young people play an active role in building religious tolerance in Matanari hamlet. Matanari youth have routine activities that contribute to building religious tolerance, such as merkebbas activities during village parties/events and Halal Bil Halal activities for Eid al-Fitr and New Year celebrations. This activity is carried out regularly and has been passed down from generation to generation. Every Eid al-Fitr and New Year event is held every year. In each event, religious figures from both Islam and Christianity were given the opportunity to give speeches. Apart from that, this is a form of tolerance education for teenagers (primary and junior high school age children) through involvement in these activities. The role of support from parents/community figures is very important in these activities. This research is still very limited in terms of time, depth of material, and coverage of the area and research respondents. Therefore, more in-depth study and research is needed in the future.

Abstract

This research aims to find a model for securing land assets of the Muhammadiyah Association in Prov. North Sumatera that has not yet been certified, especially for land that is controlled without a legal basis or whose legal basis has been lost, in an effort to prevent ownership disputes so that legal certainty can be secured, protected, and guaranteed. The research method used uses a type of normative legal research. Norms, rules, and legal principles related to the objectives of this research will be obtained from secondary data sources, including primary, secondary, and tertiary legal materials, which will be collected by means of library research and then processed and analyzed qualitatively using a qualitative approach. legislation (statute approach). The results of the research show that the factors inhibiting the security of Muhammadiyah Persyarikatan land assets in the North Sumatra Province area that do not have legal rights include technical and non-technical factors. Technical factors include lack of rights, historical actors who have died, land control by individuals, and funding factors. Meanwhile, non-technical factors include low public legal awareness, physical land plots not controlled or utilized optimally, and physical control of land plots located in protected areas to which rights cannot be attached. There are 3 asset security models that can be used to secure Muhammadiyah Persyarikatan land assets in the North Sumatra Province area that do not have a legal basis, namely the juridical data security model, the physical security model of land parcels, and the model of securing the status of land rights through land registration activities based on land law. which applies in Indonesia

Abstract

Indonesia as a country with a majority Muslim population, takes advantage of great opportunities to further develop its potential in the halal tourism sector. Halal tourism began to develop because of the lifestyle needs of people who like to travel but still maintain sharia rules such as halal food and drinks, as well as sharia concept lodging. Islamic scholars agree that the main sources of Islamic law are the Qur'an and hadith. Other sources (theorems) such as ijma', qiyas, istihsan, mashlahah mursalah are still in dispute, both their existence and their intensity as legal arguments. For this reason, it will be seen how halal tourism is in Maslahah Mursalah's view. This research is a normative research with secondary data sources to be analyzed by descriptive analysis. In Maslahah Mursalah's view, a halal tourism concept can certainly provide the benefit of the world and the hereafter to humans. the concept of halal tourism is something that fulfills some of these principles, halal tourism can help humans to relieve fatigue because of activities that are the benefit of basic human needs, this is included in the Maslahah Dhorurriyah printip with the aim of maintaining religion, soul, mind, offspring and property . In addition, halal tourism in the form of mosques can also be managed so that tourist visitors can still worship while traveling with family
