Abstract

Tujuan tulisan ini untuk memberikan solusi terhadap upaya peningkatan pengurangan sampah plastik di Kota Banjarmasin. Penelitian ini dilakukan dengan metode pendekatan Yuridis Normatif. Keberhasilan Kota Banjarmasin dalam mengurangi penggunaan sampah plastik melalui Peraturan Walikota Banjarmasin Nomor 18 Tahun 2016 tentang Pengurangan Penggunaan Kantong Plastik telah terbukti memiliki hasil yang signifikan yang dapat dilihat dari data-data yang telah disajikan dalam penelitian ini. Penggunaan Instrumen Command and Control yang selama ini dianggap tradisional dan cenderung tidak berhasil justru malah berhasil diterapkan dalam melalui Peraturan Walikota Banjarmasin Nomor 18 Tahun 2016 tentang Pengurangan Penggunaan Kantong Plastik. Kedepan Perlu meningkatkan kebijakan pengurangan penggunaan kantong plastik di dalam peraturan perundang-undangan yang lebih tinggi seperti peraturan daerah atau peraturan menteri serta perlu kiranya pengambil kebijakan baik pemerintah daerah maupun pemerintah pusat agar dapat merumuskan kebijakan pengurangan kantong plastik yang dapat memuat sanksi yang lebih tegas. Kata Kunci : Instrumen Penataan, Hukum Lingkungan, Pengurangan Kantong Plastik

Abstract

This research aimed to know how the community participated in household wastemanagement in Antasan Besar urban village, Central Banjarmasin Subdistrict. The type of researchmethod used is descriptive research with a qualitative approach, while data collection wasperformed through observation, documentation, questionnaires, and interviews.The results showed that people's participation in household waste management was quite goodgiven how they disposed of their waste. Most people have thrown garbage in temporary landfills(TPS), although there is still a small percentage of residents who throw garbage carelessly in theneighborhood and the river, or even burn it even though there have been some regulations. Theirparticipation is quite good in gotong royong activities to clean the environment, but their initiativeto invite other residents to clean is still low. Participation in sorting organic and non-organic wasteand recycling waste is still low. They do not recycle because they do not know and understand howto recycle. In contrast, their participation in reusing goods for another use is quite high.Participation in giving suggestions and opinions to local governments regarding waste managementis still very low. The main obstacle for the community in Antasan Besar sub-district in overcomingthe problem of household waste is the infrastructure, namely the absence of public trash cans, thedistance from the temporary waste disposal site from the residence, and the short schedule forwaste disposal.The best step to take is to start waste management from each household, and to facilitate it, itis recommended to the authorized agency or community group to carry out activities: 1).Counseling on the negative impact of burning household garbage and disposing of waste carelesslyin residential areas or rivers; 2). counseling on the need for waste recycling, reusing/upcyclingtrash, and sorting organic and non-organic waste 3). carrying out learning skills of recycling andcomposting waste for the community; 4). assisting in the fulfillment of infrastructure facilities,especially organic and non-organic waste bins, 5) socialization of Banjarmasin City RegionalRegulation No. 21 of 2011 on The Management of Land / Cleanliness and Sanitation, including theprohibitions and sanctions in the regulation.

Abstract

The right to a good and healthy environment is a human right guaranteed by the 1945 Constitution. Human rights in the field of the environment are very important, therefore the government should be present in ensuring that citizens get a good and healthy environment. The fulfillment of the right to a good and healthy environment is strongly influenced by variables outside the law such as economic variables, poverty, unemployment, and the Human Development Index (HDI).Because of that, This study aims was to exploring the relationship of sectoaral regional income (SRI), poverty, unemployment and Human Development Index (HDI) in spesific region to the environment quality.  Indicators used in this research are SRI of the industrial sector, mining sector, agricultural/plantation /forestry/fishery/livestock sectors, poverty, unemployment and HDI.  The type data used is secondary data from the Department of Environment, the Department of Energy and Mineral Resources,  and also the Central Bureau of Statistics of South Kalimantan Province for the period 2006 – 2020.Because of that, This research using secondary data from Central Bureau of Statistics for period 2006 – 2020. The method used in this study is descriptive quantitative using structural equation model.   Our results from this study were (1) SRI of the industrial sector, mining sector, agricultural/plantation /forestry/fishery/livestock sectors, poverty, and human development index (HDI) were give significant effect to environment quality because all value of CR ≥ 1.96 and probability < 0.05 (2) The unemployment indicator was not give a significant effect to environment quality because from the effect test, the value of CR ≥ 1.96 and probability < 0.05.

Abstract

The rivers and canals in Banjarmasin need to be reorganized to restore the rivers and canals to be able to function. Various legal policies have been taken by Banjarmasin Government, from issuing regulations on rivers to making policies to establish a River Normalization Task Force. This research is aimed to analyze the Banjarmasin government's regional regulations that regulate the rivers and rivers layout, as well as the effectiveness of the legal policy taken by the government as mitigation of the flood problems Banjarmasin faces.This study uses an interdisciplinary legal research method (socio-legal methodology); where the law (in this case the statutory text) is not only interpreted as an object of value-free study but the law is interpreted as an object that is rich in values (including non-legal values).Based on the geographical condition ofBanjarmasin, rivers and canals should be very important for Banjarmasin as a way to avoid flooding. Therefore, it is necessary to arrange rivers and canals in Banjarmasin comprehensively and this arrangement cannot be done only partially. The river arrangement includes regulatory, institutional, and community development aspects in the vicinity. The development of the city of Banjarmasin from the point of view of city development must start from the rivers.

Abstract

Regional representation in the composition of the cabinet has not become an important part in the state administration tradition in Indonesia. Whereas regional representation is part of the way to bring together the values ​​of unity and integrity in the Unitary State of the Republic of Indonesia. The president's authority to appoint and dismiss ministers is a prerogative right granted by the 1945 Constitution to a president. With the condition of Indonesia which has a multi-party party system, the president's consideration is often in determining cabinet officials with only two considerations, namely political considerations and professional considerations or often called zaken cabinet. Meanwhile, the aspect of regional representation is not an important part in the president's consideration. This study wants to answer the urgency of regional representation in the composition of the cabinet and how the design of ministerial recruitment that represents cabinet representation. The results of this study indicate that regional representation in the composition of the cabinet is very important in terms of the aspect of orginal intent in the formulation of the 1945 Constitution. Abstract

Tujuan dilaksanakannya kegiatan pengabdian ini adalah untuk meningkatkan pemahaman pemilih pemula tentang pemilihan umum di kota Banjarmasin dan untuk meningkatkan partisipasi pemilih pemula pada pemilihan umum di Kota Banjarmasin khususnya yang tergabung dalam Kesatuan Aksi Mahasiswa Muslim Indonesia. Metode yang digunakan dalam kegiatan ini adalah dengan rangkaian tahapan yang disusun secara sistematis yaitu pertama dengan melakukan obeservasi lapangan dan pendataan peserta, pembuatan materi dan bahan lainnya, pembuatan konsep sosialisasi dan pelatihan, pelaksanaan sosialisasi dan pelatihan, membentuk gerakan pemuda sadar pemilu, dan terakhir adalah membuat laporan akhir dan artikel. Dari kegiatan ini hasil atau kesimpulannya adalah dari semua rancangan kegiatan yang tercantum dalam proposal kegiatan telah dapat dilaksanakan, meskipun terdapat beberapa kendala namun telah dapat diatasi. Antusiasme mahasiswa yang tergabung dalam Kesatuan Mahasiswa Muslim Indonesia sangat bagus terutama dalam komitmennya mengawal pelaksanaan pemilu 2019 dan turut berpartisipasi dalam menggunakan hak pilihnya. KAMMI terdaftar resmi sebagai pemantau pemilu di Badan Pengawas Pemilihan Umum (Bawaslu) sehingga dapat secara langsung berkontribusi mengawal pelaksanaan pemilu.

Abstract

Pendampingan Pencanangan Desa Wisata  Berbasis Lahan Basah di Desa Pulau Sewangi Kabupaten Barito Kuala ini bertujuan memberikan pemahaman dalam pencanangan desa wisata dan mengoptimalkan potensi desa wisata yang berbasis lahan basah di Desa Pulau Sewangi Kabupaten Barito Kuala. Tahapan Kegiatan ini diawali dengan Indektifikasi Masalah dan Survei Lapangan, Penyusunan Bahan Pelatihan, Pelaksanaan Penyuluhan Pengembangan Desa Wisata, Pendampingan dalam Penyusunan Peraturan Desa dan Evaluasi, Publikasi serta Penyusunan Laporan Akhir. Mitra yang terlibat dalam pengabdian ini adalah kepala desa, aparatur desa, BPD dan masyarakat desa sehingga dengan program ini mitra dapat memahami dalam pembentukan desa wisata serta terlaksananya pencangan desa wisata guna meningkatkan kesejahteraan masyarakat. Kegiatan ini  mampu meningkatnya kesadaran masyarakat dalam menggali dan membangun potensi desa dalam bidang pariwisata khususnya pariwisata di lahan basah.Kata Kunci : Desa Wisata, Lahan Basah, Pulau Sewangi

Abstract

The purpose of this study is to find out the reasons for the formation of the Indigenous Law Community which are stated to still exist in Indonesia and the reasons why customary law is not codified in Indonesian laws and regulations. Customary law is based on Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia. The research method used in this article is normative legal research or commonly referred to as doctrinal law research that focuses on written regulations. The findings in this article reveal that customary law is not one of the laws in the hierarchy of laws and regulations in Indonesia because customary law is not a written law. Customary law will continue to change according to the desired interests and will ensure a sense of justice for the community because of the problems that exist in the community. Therefore, the codification of customary law iscontrary to the existing law in Indonesia which was made to be valid forever. According to Satjipto Raharjo, there are 4 requirements in Article 18 B paragraph (2) of the 1945 Constitution of the Republic of Indonesia as a form of state power that determines the existence of a Customary Law Community, namely. as long as they are alive, in accordance with the development of society, according to the the principle of the unitary state of the republic of Indonesia and regulated by law.

Abstract

Salah satu isu strategis yang dihadapi desa pulau sewangi yang mempunyai pengaruh yang besar, luas dan signifikan terhadap perbaikan kondisi masyarakat pada masa mendatang adalah Aspek Lingkungan Hidup meliputi penggunaan lahan, pemukiman dan keanekaragaman hayati yang harus dijaga kelestariannya dan diselamatkan dari kerusakan lingkungan. Kurangnya pemahaman dalam pembentukan peraturan desa yang bernuasa hijau dan berwawasan lingkungan dalam upaya pelestarian lingkungan menjadi masalah tersendiri yang harus ditangani. Pendampingan Penyusunan Peraturan Desa sebagai Upaya Perlindungan dan Pengelolaan Lingkungan Lahan Basah di Desa Pulau Sewangi Kabupaten Barito Kuala ini bertujuan untuk memberikan pemahaman dan pelatihan dalam penyusunan peraturan desa dalam upaya melindungi lingkungan hidup khususnya lahan basah. Pelaksanaan kegiatan ini dilakukan dengan metode yang disusun secara sistematis mulai dari identifikasi masalah, survei lapangan, penyusunan bahan pelatihan, sosialisasi penyusunan peraturan desa, pendampingan serta evaluasi. Hasil pengabdian ini menunjukan bahwa : Pertama, Meningkatnya pemahaman dan kesadaran aparatur desa serta Badan Permusyawaratan Desa dalam mengelola desa. Kedua, Masyarakat dan aparatur desa memahami pentingnya peraturan desa secara khusus mengatur tentang perlindungan terhadap lahan basah.
