KAJIAN EPISTIMOLOGIS ILMU USHUL FIQH - Studi terhadap Pemikiran Abū Isḥāq Ibrāhīm al-Shīrazī al-Al-Fayrūz Abādī Tajrid, Amir

Abstract

Artikel ini bermaksud melakukan kritik epistimologis terhadap Kitab al-Luma’ yang ditulis oleh Abū Isḥāq Ibrāhīm al-Shīrazī al-Al-Fayrūz Abādī (al-Shīrazī). Tulisan ini, secara deskriptif berusaha menggali dan mengkritisi karakteristik dan pengetahuan mengenai ilmu ushul fiqh yang terkandung di dalamnya. Beberapa catatan penting terhadap kitab ini adalah: pertama, pemikiran ushul fiqh al-Shīrazī dalam Kitab al-Luma’ ditulis pada era keemasan karya-karya ushul fiqh, sehingga metode dan pokok-pokok pemikiran ushul fiqh al-Shīrazī menjadi inspirator generasi berikutnya. Kajian materi ushul fiqh didasarkan pada metode para tokoh pendahulunya, terbukti pada dominasi metode komparatif yang digunakan ketika mengetengahkan materi ushul fiqh dari beberapa tokoh ushul fiqh yang berbeda pandangan. Kedua, al-Shīrazī termasuk dalam barisan ahli ushul mutakallimin yang mempunyai pemikiran orisinil dan merdeka. Kritik tajam yang dilancarkan mengajak para pihak untuk tidak condong terhadap madzhab fiqh tertentu. Oleh karena itu penyajian pemikiran ushul fiqh al-Shīrazī dalam al-Luma’ lebih bersifat kalamī, karena bangunan argumentasi yang melibatkan unsur-unsur kalam dan mengedepankan logika menjadi alat dalam menilai dan mengukur kebenaran ilmu ushul fiqh. Ketiga, al-Luma’ telah memenuhi dasar-dasar ilmu pengetahuan baik secara ontologi, epistemologi, maupun aksiologi.***This article intends to conduct epistemological critique of the Book “al-Luma” that  written by Abū Ibrāhīm al-Shirazi Ishaq al-Al-Fayruz Abadi (al-Shirazi). Therefore the presentation of ideas al-Shirazi on ushul fiqh is in the sense of Kalami, because the arguments are built from elements of kalam and prioritize the logic as a tool in assessing and measuring the truth  of ushul fiqh. Abstract

This paper aims to explore the emergence, continuity and shifting of the meaning of maqāṣid al-sharī’ah. Initially, maqāṣid al-sharī’ah entered into the study of uṣūl al-fiqh and later became an independent scientific discipline. Historically, the journey of maqāṣid al-sharī’ah has four periods, namely, the pre-codification era, the first development era, the second development era, and the maturation era as a scientific discipline. This paper is qualitative with a descriptive-analytic method, namely exploring the concept of maqāṣid al-sharī’ah in various literature. The findings in this paper are, first, the history of the emergence and development of maqāṣid al-sharī’ah is closely related to the enforcement of Islamic law. Second, the continuity of maqāṣid al-sharī'ah is an ideological concept because it is based on the prevailing paradigm
