Abstract

This study aims to analyze the resolution of credit agreement breaches through the Small Claims Court mechanism and to examine the judge's legal reasoning in Decision of the Boyolali District Court Number 1/Pdt.G.S/2026/PN BYL. The research employed a normative juridical method using statutory and case approaches. Data were collected through library research on legislation, legal doctrines, and court decisions and were analyzed qualitatively. The findings indicate that the Small Claims Court mechanism fulfills the principles of simple, speedy, and low-cost justice for resolving credit agreement disputes that satisfy the requirements of Supreme Court Regulation Number 4 of 2019. The judge's considerations were based on the existence of a legal relationship, the debtor's failure to perform contractual obligations, and the fulfillment of the elements of breach of contract under Article 1243 of the Indonesian Civil Code. The study concludes that the effectiveness of the Small Claims Court depends on the proper application of legal norms and careful judicial assessment of evidence to ensure legal certainty, justice, and legal benefit in civil dispute resolution).

Abstract

This study investigates Artificial Intelligence (AI) applications in legal case analysis and court outcome prediction within Indonesia's judicial system. Using qualitative descriptive analysis through comprehensive literature review of journal articles, books, and legal documents, this research examines opportunities, challenges, and ethical implications of AI implementation in legal practice. Findings reveal AI's significant potential for enhancing judicial efficiency through task automation, improving accuracy via pattern recognition and data analysis, and increasing accessibility through digital legal services. However, critical challenges include algorithmic bias perpetuating systemic inequalities, transparency deficits in decision-making processes, accountability gaps in AI recommendations, and data protection concerns under Indonesia's Personal Data Protection Law. Ethical implications encompass fairness issues in justice delivery, potential reduction of human oversight, privacy risks from data collection, and social impacts on legal profession dynamics. This research provides original insights through comprehensive analysis tailored to Indonesian legal framework, integrating Justice Theory, Computational Ethics, Legal Subject Theory, and Regulatory Theory. The study concludes that responsible AI integration requires developing regulatory frameworks, enhancing transparency mechanisms, addressing algorithmic bias, protecting personal data, maintaining human oversight, and promoting stakeholder collaboration to ensure ethical AI deployment in Indonesia's judicial system.

Abstract

Rendahnya kesadaran dan pemahaman hukum masyarakat Desa Kenteng terhadap pengelolaan aset tanah permukiman, meliputi; hak, kewajiban, prosedur pendaftaran, serta risiko hukum menyebabkan lemahnya kepastian hukum dan tingginya potensi sengketa pertanahan di tingkat pedesaan. Tujuan Pengabdian kepada masyarakat ini adalah untuk menguatkan kesadaran hukum masyarakat melalui penyuluhan pengelolaan aset tanah permukiman di Desa Kenteng, Ponjong, Gunung Kidul, Yogyakarta. Metode Pengabdian masyarakat ini menerapkan pendekatan partisipatif berbasis community organizing dengan metode kualitatif deskriptif-partisipatoris yang melibatkan masyarakat Desa Kenteng secara aktif sejak identifikasi masalah hingga pelaksanaan penyuluhan hukum pengelolaan aset tanah permukiman agar hasilnya baik bagi masyarakat. Melalui diskusi tersebut diperoleh bahwa rendahnya pemahaman hukum atas status dan tata kelola aset tanah permukiman dapat diatasi melalui penyuluhan hukum partisipatif yang selaras dengan teori legal empowerment, budaya hukum Friedman, dan pembangunan berbasis aset, sehingga mendorong perubahan kesadaran, perilaku, dan keadilan sosial masyarakat secara bertahap dan berkelanjutan.
