Abstract

Abstract

As a scientific discipline, morality with ethics orients its study on human behavior in the perspective of how it should not be. So not a few among Muslims who translate morals with ethics. In fact, the two depart from a different study and from a different source. Morals are developed from standard Islamic sources, namely the Qur'an and Sunnah. While ethics is developed from the thinking of the human brain, namely philosophy, so that one is sacred and the other is profane, one is from heaven and the other is from earth, one is kholiq, while the other is from creatures. This thought feels unfair if moral behavior that is what it should be is based on ugliness, so that it becomes akhlakul qobiha or al akhlakul madmumah. Moreover, if morality is then believed to be an Islamic science, then of course the other Islamic sciences are fiqh, aqidah, and tasawwuf.

The curriculum changes along with the times in the world, and according to the laws in force in Indonesia, the Islamic Education Curriculum is one of the parts that must be taught to students. Considering that Al-Ghazali is a very legendary figure in Islam because through his thoughts he played many roles in the development of the Islamic Education Curriculum, even his thoughts can still be studied to this day and are still able to be applied by certain groups of people. To prove this statement, research was conducted on Al-Ghazali's thoughts on the concept of Islamic education. So that it can be seen that his thoughts are still linked to the existing curriculum, this can be seen through an analysis of the curriculum in schools and Madrasah in Indonesia.

Abstract

This study aims to analyze the definition and concept map of Islamic Education (IPI) within the philosophical framework of Prof. Dr. Hasan Langgulung. IPI is strategically positioned as a discipline that bridges theoretical studies and educational practices in responding to contemporary challenges, while also serving as a foundation for character formation. The method used is library research with a qualitative approach, analyzing primary and secondary documents to synthesize a complete IPI concept map. The results of the study show that Langgulung defines IPI comprehensively as a normative field of science, exploring the process of multi-dimensional human growth (physical, soul, mind, spirit), and utilizing integrative sources of knowledge (revelation, reason, experience). This approach is based on three solid philosophical pillars: Ontology (human nature and fitrah), Epistemology (integration of revelation, reason, and experience), and Axiology (utility values to form a perfect human being). Langgulung's thinking elevates the discussion of IPI from the operational level (Tarbiyah, Ta'lim, Ta'dib) to the philosophical level, providing a solid foundation for IPI as a complete discipline. The ultimate goal is to produce a perfect human being capable of fulfilling the balanced roles of 'Abdullah (servant of God) and Khalifatullah fil Ardh (leader on earth), by optimizing the full potential of human nature. This educational model is considered relevant in contemporary discourse to integrate religious and general knowledge and address the moral crisis.

Abstract

This research analyzes the behavior of underage unregistered marriages (nikah siri) conducted by couples from the perspective of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 on Marriage. The main focus of this study lies in Article 7 paragraph (1), which stipulates that the minimum legal age for marriage for both men and women is 19 years. The research method used is library research with a statutory approach. The results show that underage unregistered marriages occur due to several factors, including economic conditions, low levels of education, and attempts to avoid adultery (zina). However, from the perspective of positive law, this practice has no legal validity because the marriage is not registered with the Marriage Registrar (Pegawai Pencatat Nikah/PPN), thereby violating the administrative requirements set by the state. The absence of legal recognition results in the loss of legal protection for the wife and children, including difficulties in obtaining civil rights such as birth certificates and inheritance rights. Although Law Number 16 of 2019 provides a legal mechanism through Marriage Dispensation in the Religious Court, unregistered underage marriages are still considered a form of legal circumvention, as they disregard the protection of children's rights and undermine the long-term objective of family stability mandated by the law.

Abstract

This study aims to analyze the implementation of parental responsibility towards children after divorce, the legal basis for child protection, and the impact of divorce on child welfare. The research method used is a normative juridical approach with a literature study technique through the assessment of laws and regulations, the Compilation of Islamic Law, court decisions, as well as relevant literature and previous research results. The results of the research show that the obligations of parents after divorce include the fulfillment of financial support, custody (hadhanah), education, and the physical and psychological protection of children. However, in practice, the implementation of these obligations still faces various obstacles, such as low legal awareness among parents, prolonged conflicts, and weak enforcement of court decisions. The suboptimal implementation of parental responsibilities has an impact on the psychological, social, educational, and economic conditions of children. This study concludes that the welfare of children after divorce is more determined by the consistency of the implementation of parental responsibilities than by the marital status of the parents. Therefore, synergy between parents, judicial institutions, the state, and society is needed to ensure the protection and fulfillment of children's rights after divorce.
