Abstract

Pengakuan terhadap keberadaan masyarakat hukum adat telah tercantum dengan jelas di dalam Konstitusi di Indonesia pasca di amandemen, tepatnya ketentuan tersebut ada di dalam Pasal 18B ayat 2 UUD 1945. Pasal ini memberikan posisi strategis terhadap eksistensi masyarakat hukum adat di setiap wilayah Negara ini. Kehadiran masyarakat hukum adat merupakan suatu kenyataan sejarah yang tidak dapat dihindari atau disangkal oleh pemerintah. Berdasarkan konstitusi tersebut maka setiap Pemerintah Daerah diberi kewenangan membuat regulasi dalam rangka melindungi keberadaan suatu masyarakat hukum adat yang masih hidup di wilayahnya tidak terkecuali di Kalimantan Tengah. Namun, pada tataran implementatif berbagai regulasi yang dibuat oleh Pemerintah Daerah ternyata tidak berbanding lurus dengan perlindungan terhadap eksistensi masyarakat hukum adat tersebut, banyak persoalan, konflik antara masyarakat hukum adat dengan berbagai pihak baik pemerintah daerah maupun investor. Perlu upaya yang baik agar norma-norma yang dibentuk tidak hanya dijadikan sebagai simbol perlindungan terhadap masyarakat hukum adat semata namun hendaknya benar-benar dapat terimplementasi dengan baik dan memberikan jaminan perlindungan terhadap eksistensi masyarakat hukum adat khususnya di Kalimantan Tengah.

Abstract

Corruption never seems to disappear in Indonesia, because almost every day there is news in various print and electronic media regarding public officials, legislative members and even law enforcers who are caught in corrupt practices. Therefore, more massive efforts are needed to prevent and eradicate corruption. This writing uses the Normative Juridical Research method which examines legal rules and principles in answering legal problems that occur using a Conceptual Approach to draw conclusions about the problems studied. We should all be aware that the moment of the General Election (Pemilu) is a very important moment considering the fact that 78 years of Indonesian independence is certainly a moment that must be interpreted deeply, the moment of forming an effective and efficient Cabinet is one of the determining factors for the success of the entire 5 Year government agenda. future and realizing the ideals of the Indonesian nation that have always been echoed, including realizing a government that is clean and free from corruption. Because the disease of corruption that has grown and taken root in this country is caused by many factors, one of which can be caused by the relationship between various systems that are related to corrupt cultural patterns in various functions of power in this country, for example co-optation and strong political intervention. This writing concludes that one of the important points in fixing various corruption problems is by repairing damage to the function and structure of government in this country. Abstract

Decision Number 17/Pid.Sus-TPK/2023/PN Plk, handed down by the Palangka Raya Corruption Court against defendants Ben Brahim S. Bahat, former Regent of Kapuas, and Ary Egahni, member of the Indonesian House of Representatives, is an example of the application of additional penalties in corruption cases. The judge not only imposed the principal penalty of imprisonment and a fine, but also additional penalties in the form of a replacement payment of Rp8.8 billion and revocation of political rights to be elected to public office for five years after completing the sentence. This study aims to analyze the judge's considerations in imposing these additional penalties using normative, philosophical, and sociological approaches, and in relation to applicable criminal theories in Indonesia. The results of the analysis indicate that the additional penalty of replacement money was imposed based on Article 18 of the Corruption Law and Supreme Court Regulation Number 5 of 2014, with the consideration of returning state losses proportionally. Meanwhile, the revocation of political rights is based on Article 35 of the Criminal Code and the Constitutional Court Decision which confirms the constitutionality of the revocation of political rights of corruption perpetrators. From a sentencing theory perspective, the judge balanced the objectives of retributive, deterrence, and corrective justice. This decision demonstrates that the court not only upholds the law but also safeguards the integrity of democracy and rebuilds public trust in anti-corruption efforts.

Abstract

Penelitian ini bertujuan untuk menganalisis keterwakilan perempuan dalam Kelembagaan Adat Dayak di Kota Palangka Raya dalam perspektif hak sipil dan politik serta prinsip non-diskriminasi. Latar belakang penelitian didasarkan pada fakta empiris bahwa seluruh Damang Kepala Adat di Kalimantan Tengah berjenis kelamin laki-laki, meskipun Peraturan Daerah Nomor 16 Tahun 2008 tidak secara eksplisit membatasi berdasarkan jenis kelamin. Penelitian ini menggunakan pendekatan yuridis empiris dengan teknik wawancara mendalam terhadap 12 informan (Damang, mantir adat, tokoh perempuan adat, dan akademisi), observasi partisipatif, serta analisis dokumen normatif. Data dianalisis melalui analisis tematik dengan triangulasi sumber. Hasil penelitian menunjukkan bahwa norma patriarki struktural membatasi representasi perempuan secara substantif. Dalam perspektif teori representasi politik Pitkin, keterlibatan perempuan masih bersifat deskriptif dan belum mencapai representasi substantif. Secara normatif, praktik tersebut berpotensi bertentangan dengan Pasal 28I UUD 1945 dan prinsip CEDAW mengenai penghapusan diskriminasi terhadap perempuan. Kontribusi penelitian ini terletak pada integrasi analisis pluralisme hukum dan teori patriarki dalam konteks kelembagaan adat Dayak serta rekomendasi ius constituendum untuk reformasi regulasi daerah.
