Abstract

This study aims to explain the role of the Indonesian Public Prosecutor's Office and the Malaysian Prosecutor's Office in corruption crimes as well as the similarities and differences between the authorities of the Republic of Indonesia Prosecutors and the Malaysian Prosecutors in handling corruption cases. This research uses qualitative research research. In this research, the data collection method is carried out by using the library research technique, namely by studying the literature, legislation, books, official documents, and the writings of scholars related to this thesis. and analyzed using descriptive-qualitative methods. The approach used in this research is a statutory approach and a conceptual approach. The results of this study indicate that what becomes the similarity between the authority of the Republic of Indonesia Prosecutor's Office with the Malaysian Attorney is the role of the permanent prosecutor as public prosecutor, while what distinguishes the authority of the Republic of Indonesia Prosecutor's Office with the Malaysian Attorney is the authority in the field of prosecution.Keywords: Comparison, Authority, Attorney, Corruption Crime

Abstract

AbstractThis study aims to explain the role of the Attorney General of the Republic of Indonesia and the Malaysian Attorney in corruption, as well as the similarities and differences between the authority of the Attorney General of the Republic of Indonesia and the Attorney General of Malaysia in handling corruption cases. Abstract

The more technology develops, the more complaints from the public against illegal online loan applications on the Google Play Store.  Online loans that carry out illegal actions such as debt collector behavior, disbursement without the applicant's approval, threats to spread personal data and terrorize cellphone contacts are increasingly being carried out. The research method used is a juridical-empirical type of legal research using a case approach and a statutory approach. The results of this study are the government that has the authority to online loans on the Google Play Store is the Financial Services Authority, the Investment Alert Task Force and the Ministry of Communication and Information of the Republic of Indonesia by providing administrative sanctions and blocking online loan applications that perform illegal acts.Keyword: Authority; Governement; Online Loans; Google Play Store AbstrakSemakin berkembangnya teknologi semakin banyak juga pengaduan dari masyarakat terhadap aplikasi pinjaman online ilegal yang ada di Google Play Store. Pinjaman online yang melakukan tindakan ilegal seperti perilaku debcolletor, pencairan tanpa persetujuan pemohon ancaman penyebaran data pribadi dan melakukan terror kepada kontak handphone semakin banyak dilakukan. Metode penelitian yang digunakan adalah jenis penelitian hukum yuridis-empiris dengan menggunakan pendekatan kasus dan pendekatan perundang-undangan. Hasil dari penelitian ini adalah pemerintah yang memiliki kewenangan terhadap pinjaman online di Google Play Store ialah Otoritas Jasa Keuangan, Satgas Waspada Investasi dan Kementerian Komunikasi dan Informatika Repubik Indonesia dengan memberikan sanksi administratif dan pemblokiran aplikasi pinjaman online yang melakukan tindakan ilegal.Kata Kunci: Kewenangan; Pemerintah; Pinjaman Online; Google Play Store

Abstract

The rapid development of the platform economy has positioned data as a strategic asset that determines competitiveness. However, the massive data control by large-scale digital platforms raises concerns about data monopoly practices that may hinder innovation and create barriers to market entry. Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition was enacted before the digital economy era; thus, the relevance of its norms needs to be reassessed in addressing big data issues. This research aims to analyze the qualification of massive data control as a dominant position and formulate adaptive competition law policy recommendations in the digital era. The research methodology employed is normative juridical with a statute approach, conceptual approach, and comparative approach. The research findings indicate that normatively, massive data control can be qualified as a dominant position because it creates market dependency and network effects. Data monopoly in the platform economy requires a new legal approach that is not solely based on price indicators but also on data accessibility. Legal policies are needed to incorporate Digital Market Power clauses in the revision of the Competition Law. This includes dominant position criteria measured not only by market share but also by massive data control and user dependency on the platform.

Abstract

Based on Law Number 11 of 2008 concerning Electronic Information and Transactions, which was last amended by Law Number 1 of 2024, the Google Play Store is classified as a Private Electronic System Provider. As a global application distribution platform operating in Indonesian jurisdiction, Google is strictly bound by the positive laws applicable in the country. The purpose of this study is to examine the civil liability of Google Play Store as an Electronic System Provider for losses arising from the circulation of disguised gambling applications on its platform. Using a normative juridical approach with conceptual and statutory analysis methods, this study examines the gap between the regulatory obligations imposed by Indonesian cyber law and the reality on the ground that thousands of gambling applications disguised as online games have managed to escape the Google Play Store's content moderation system. The results of the study indicate that the five elements of Unlawful Acts as regulated in Article 1365 of the Indonesian Civil Code have been fulfilled, namely (1) unlawful acts in the form of negligence in moderation, (2) errors in the form of culpa, (3) actual losses suffered by users, (4) a proven causal relationship and (5) violation of legal obligations as an Electronic System Organizer based on the ITE Law and PP No. 71 of 2019. This study offers a comprehensive legal argument that Google Play Store can be held civilly liable as an Electronic System Organizer in Indonesia.

Abstract

This study examines personal data protection in the practice of an artificial intelligence–based photo marketplace on the FotoYu platform, which utilizes facial recognition technology for photo processing and commercialization. The research focuses on the extent to which the processing of facial biometric data by the photo marketplace platform provides adequate legal protection for data subjects in accordance with the Personal Data Protection Law. The study adopts a normative juridical method, employing a statutory approach and a conceptual approach through the analysis of legal norms, principles, and doctrines of personal data protection. The findings indicate that personal data processing in AI-based photo marketplaces has not fully complied with the principles of explicit consent, purpose limitation, transparency, and the fulfillment of data subject rights. Indirect consent mechanisms and the complexity of AI-driven processing may create a gap between legal norms and practical implementation. The study concludes that personal data protection in photo marketplace practices still requires strengthening, both in terms of regulation and implementation. Therefore, more specific implementing regulations and enhanced platform responsibility and accountability are necessary to ensure effective protection of data subject rights in the digital economy era.
