Abstract

The Ciboleger Barokah Valley Community, comprising 115 individuals, represents a marginalized Baduy community in Bojong Menteng Village, Leuwidamar District, Lebak Regency. The Baduy tribe adheres to the Sundanese Wiwitan religion, and those who convert to other faiths can no longer live in Kanekes Village, their ancestral home. Most Baduy individuals in Ciboleger Valley lack formal education and employment, often experiencing social isolation and separation from their extended families. These conditions elevate the risk of social issues, including domestic violence, due to economic fragility, as they struggle to meet daily needs. To address these challenges, a program offers financial literacy and legal education. This initiative aims to reduce domestic violence and enhance economic resilience. Financial literacy is delivered through counselling and entrepreneurship training, with a focus on kinca serabi and mustofa potato production by the Dapur Mimih Serang culinary brand. Interactive training engages the local community through discussions, question-and-answer sessions, practical exercises, and business exploration, fostering Self-Help Groups within the community. The program's holistic approach seeks to empower this marginalized community academically, economically, and legally.

Abstract

ABSTRACT: Prior to colonization of Dutch, most of Indonesian solve legal problem by making an agreement. A court is a modern legal representation for Indonesian that is the last way taken if fail to reach an agreement. The settling of criminal case through a court is often leaving social problem. The enforcement of juvenile case is a dominant problem that can be seen. Raju case and AAL are juvenile cases causing social tension. In the context of modern law, a crime is a crime, law must be enforced. Despite the fact that most Indonesian believe that two cases are insignificant for being tried before the court that may bring negative impact on the future of the children. Abstract

Di Indonesia, cabang olahraga yang sangat popular yaitu sepakbola. Dalam dunia persepakbolaan, kenyataannya masih banyak sekali penyimpangan yang terjadi, saat ini telah berkembang perilaku curang dengan menjual pertandingan, melakukan pengaturan skor (match fixing), atau suapmenyuap. Sepak bola Indonesia pernah beberapa kali diterjang skandal pengaturan skor, yang terbaru skandal match fixing di babak penyisihan grup Liga 2 2021 di Klub Perserang. Kriminalisasi pengaturan skor dalam persepakbolaan Indonesia diatur dalam UU No. 11 Tahun 1980 tentang Tindak Pidana Suap, diancam dengan sanksi pidana. Namun dalam prakteknya, pelaku pengaturan skor hanya dihukum administrasi saja. Tujuan penulisan ini memahami dan mengetahui bagaimana seharusnya penegakan hukum pidana terhadap tindak pidana suap dalam kasus suap pengaturan skor pemain Perserang. Metode yang digunakan Peneliti di dalam penulisan ini adalah metode penelitian hukum Yuridis Normatif. Dari hasil penelitian yang dilakukan oleh Peneliti dengan metode tersebut, Peneliti memperoleh jawaban bahwa, dalam kasus pertandingan Perserang, para pemain terlibat suap pengaturan skor dengan kategori aktif dan pasif, sehingga dapat dimintai atau dipertanggungjawabkan atas perbuatan pidana yang dilakukannya. Pembahasan penelitian ini adalah Penegakan hukum terhadap suap pengaturan skor dalam pertandingan sepakbola, perlu dilakukan karena kenyataannya Indonesia memiliki UU No. 11 Tahun 1980 yang masih eksis dan berlaku sebagai hukum positif. Dalam kasus pertandingan Perserang, para pelaku terbukti memenuhi unsur delik pidana dalam Pasal 2 dan 3 UU No. 11 tahun 1980. Para aparat penegak hukum diharapkan dapat meminta pertanggungjawaban pidana dan melakukan penegakan hukum pidana secara konkret, terhadap para pelaku tindak pidana suap pengaturan skor.

Abstract

Kekerasan seksual terhadap anak merupakan kejahatan serius yang semakinmeningkat dari waktu ke waktu dan apabila dibiarkan dampaknya dapat mengancamdan membahayakan jiwa anak, merusak kehidupan pribadi dan tumbuh kembang anak,juga mengganggu rasa kenyamanan, ketentraman, keamanan, dan ketertiban masyarakat. Maka dari itu pemerintah memberikan pemberatan hukuman kepada pelakukekerasan seksual pada delik persetubuhan dengan menambakan hukuman berupatindakan kebiri kimia. Identifikasi masalah pada penelitian ini adalah bagaimanapenerapan pidana kebiri kimia bagi pelaku kekerasan seksual terhadapap anak diIndonesia dan bagaimana penerapan pidana kebiri kimia bagi pelaku kekerasan seksualterhadap anak ditinjau dari teori pemidanaan.Teori yang digunakan dalam penelitian yaitu Teori Penegakan Hukum dan TeoriPemidanaan. Metode yang digunakan dalam penelitian ini yaitu yuridis normatif.Spesifikasi penelitian yang digunakan adalah jenis penelitian kualitatif denganpendekatan perundang-undangan dan pendekatan kasus. Sumber data yang digunakanadalah sumber dara sekunder yang di dalamnya dibagi lagi menjadi 3 (tiga) bagian,yaitu bahan hukum primer, sekunder, dan tersier, dengan teknik pengumpulan datamenggunakan penelitian pustaka.Hasil Penelitian yang didapat yaitu pada proses penerapan hukuman kebiri diIndonesia terdapat hambatan dari dua faktor yaitu dari faktor undang-undang dan faktorsarana prasarana. Ditinjau dari teori pemidanaan hukuman kebiri kimia sesuai denganteori gabungan hal tersebut dikarenakan karena hukuman kebiri kimia berisi suatutindakan pembalasan dari pemerintah untuk memberikan efek jera terhadap si pelakudan juga berisi upaya pemerintah memperbaiki si pelaku melalui rehabilitasi untukmembuat si pelaku kembali ke jalan yang benar serta mempersiapkannya untuk kembalihidup bermasyarakat. Kesimpulan bahwa hukuman kebiri kimia bagi pelaku kekerasanseksual terhadap anak sudah pantas guna melindungi keamanan dan ketentraman anakpada umumnya. Saran perlunya meningkatkan usaha-usaha dalam arti luas melaluisosialisasi kepada seluruh aparat penegak hukum yang terlibat dalam proses penegakanhukum untuk berani memutus atau manjatuhkan hukuman tersebut dan menjalankanputusan sesuai dengan undang-undang yang berlaku.

Abstract

Perkembangan digitalisasi teknologi bidang kesehatan bentuk pelayanan kesehatan secara online, dimana pasien tidak perlu bertatap muka langsung, jenis pelayanan baru pada bidang kesehatan ini disebut juga dengan telemedicine. Identifikasi masalah penelitian ini terdiri atas 2 masalah, pertama bagaimana perlindungan hukum terhadap dokter dalam hubungan teraupeutik pelayanan kesehatan melalui media elektronik telemedisin menurut Undang- Undang Nomor 17 Tahun 2023 Tentang Kesehatan, kedua bagaimana pertanggungjawaban Etik terhadap dokter dalam hubungan teraupeutik pelayanan kesehatan melalui media elektronik telemedisin jika terjadi kesalahan diagnosa. Metodologi yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan. Pertanggungjawaban etik dalam pelayanan telemedisin telah diatur dalam KODEKI dokter yang di duga melakukan kesalahan dalam pelayanan telemedisin dikarenakan oleh pemeriksaan yang tidak lengkap dan mengakibatkan kesalahan terhadap saran-saran dan pemberian obat termasuk dalam kategori resiko rendah yang meyebabkan cedera ringan dan dapat diatasi dengan pertolongan pertama, dan sanksinya diatur dalam Pasal 29 oleh MKEK dengan sanksi kategori 1 (satu). Kementrian Kesehatan Agar dilakukan sinkronisasi tentang peraturan perundang-undangan yang mengatur mengenai pelayanan kesehatan telemedisin di Indonesia, dimana peraturan yang ada hanya sebatas pada situasi pandemik COVID-19 dan perlu disesuaikan dengan perkembangan teknologi saat ini.

Abstract

This research reveals a hypothesis that there is vested interest on regulating law in the house of representative regarding Law No. 1/2015 article 73 in term of money politics which is conducted by regional head candidate and analyze legal efforts that can be done to cope such issue. Although the law has been revised for three times, lastly by Law No.6/2020, yet regulation record that the house of representative persists ‘to protect’ its interest on regional head election is traceable. This research shows an understanding to society and stakeholders especially in the field of general election regarding lawmaking which deviates from penal policy theory. This research focuses on how legislation design on formulating Article 73 of Law No.1/2015 so it becomes non-exectubale norm? Theory of Postmodern Criminology is utilized to divulge political agenda of Article 73 of Law No.1/2015. This research is a research regarding a norm which relies heavily on secondary data. The result of the research proves that there is a consistent effort from the parliament  ‘to secure’ legislation process so article 73 cannot be implemented. Parliament intentionally and systematically has made article 73, particularly that related to money politic which may lead to disqualification, hard to be enforced.

Abstract

The implementation of restorative justice in the Indonesian Police Force is conducted by settling the case in the preliminary investigation and investigation stage. There are material requirements that should be fulfilled one of which is that the case is not a recidivism based on a verdict. In practice, this requirement remains unclear. For instance, an issue will arise when a perpetrator who committed a theft then settled with a restorative justice mechanism in a police station but then caught for committing another theft. The problem that emerges is whether the second offense can be still solved by restorative justice in police stations. Considering that one of the material requirements is that the case is not a recidivism according to the court’s verdict whilst restorative justice settlement is not counted as a verdict. This issue requires reinterpretation so that the implementation of restorative justice can provide justice for all parties. The purpose of this research is to re-interpret clearly material requirements in terms of not repeating criminal acts based on judicial decisions for the future implementation of restorative justice in the police station. The research method employs a normative juridical with cases approach whilst the data is analyzed descriptively to describe the material requirements in the form of not repeating a crime based on a court decision in the police stage. The results of the study reveal that in practice repetition of criminal acts must be based on court decisions. The police are still implementing restorative justice for the second criminal act with the condition that the victim and the perpetrator have reconciled. Therefore, it is necessary to deconstruct the meaning of not repeating a crime based on a court decision, so that it is not a repetition of a crime that has been resolved by means of restorative justice in the police. This is so that the recovery goals of restorative justice are achieved. Abstract

This paper examines the urgency of codifying the Election Law and Regional Election Law into one integrated regulation in the Indonesian legal system. Currently, the implementation of the General Election and Regional Election are still regulated separately through Law No. 7 of 2017 and Law No. 10 of 2016, which has given rise to a number of problems, such as the lack of synchronization of implementation times, overlapping authority, and differences in implementation standards. This lack of integration also has the potential to hamper the efficiency and stability of the central and regional governments, especially ahead of the implementation of the national simultaneous Regional Election in 2024. Through a normative approach and analysis of the Constitutional Court's decisions, especially the Constitutional Court Decisions No. 55/PUU-XVII/2019 and Constitutional Court Decisions No. 85/PUU-XX/2022, this paper shows that the Regional Election should be considered as part of the Election regime. Codification of the two regulations is important to simplify the electoral system, ensure legal certainty, and strengthen the principle of people's sovereignty in the 1945 Constitution of the Republic of Indonesia. The results of this study recommend that the integration of electoral regulations through codification is a strategic step in supporting effective, efficient, and inclusive democracy in Indonesia.

Abstract

This research is based on the hypothesis that online prostitution exists and is easily found in the Banten region. Two main issues are discussed in this study: first, what factors lead someone to become an online commercial sex worker in Banten? Second, how can criminal law address online commercial sex workers? This study combines empirical and normative research. Primary data collection was conducted through various dating applications. Primary data was obtained directly from online commercial sex workers spread across Banten through interviews conducted at restaurants, cafes, rented houses, and hotel lobbies. The research findings reveal that economic factors, divorce, religious understanding, and weak law enforcement contribute to the widespread occurrence of online sex worker transactions in Banten. Criminal law does not classify sex workers as offenders due to the role bias between perpetrator and victim. However, under Law Number 1 of 2023 concerning the Criminal Code and several other laws, sex workers can be subject to criminal legal norms, although some of these cases fall under the category of complaint-based offenses. The research concludes that online sex workers in Banten are very easy to find. The government has a role and responsibility in addressing the rise of online prostitution in Banten. All respondents who chose the path of online prostitution through dating applications are individuals who adapt through innovation—desiring success, money, and other benefits but using unlawful means. A specific legal norm is needed to regulate online sex workers without requiring interpretation.

Abstract

This study addresses the persistent challenges in Indonesian electoral dispute resolution and candidacy threshold regulations, a recurring issue in both general and regional elections, notably in 2024. The urgency lies in the need for robust legal frameworks to ensure fair and democratic processes. Employing a normative juridical method with legal, historical, comparative, and conceptual approaches, this research offers novel insights into optimizing dispute settlement mechanisms. It proposes empowering Bawaslu, KPU, and DKPP for proactive and reactive oversight, alongside advocating for candidacy threshold adjustments aligned with prevailing laws and Constitutional Court rulings on presidential thresholds. This research contributes by offering concrete policy recommendations for a more stable and just electoral system.
