Abstract

The Ciboleger Barokah Valley Community, comprising 115 individuals, represents a marginalized Baduy community in Bojong Menteng Village, Leuwidamar District, Lebak Regency. The Baduy tribe adheres to the Sundanese Wiwitan religion, and those who convert to other faiths can no longer live in Kanekes Village, their ancestral home. Most Baduy individuals in Ciboleger Valley lack formal education and employment, often experiencing social isolation and separation from their extended families. These conditions elevate the risk of social issues, including domestic violence, due to economic fragility, as they struggle to meet daily needs. To address these challenges, a program offers financial literacy and legal education. This initiative aims to reduce domestic violence and enhance economic resilience. Financial literacy is delivered through counselling and entrepreneurship training, with a focus on kinca serabi and mustofa potato production by the Dapur Mimih Serang culinary brand. Interactive training engages the local community through discussions, question-and-answer sessions, practical exercises, and business exploration, fostering Self-Help Groups within the community. The program's holistic approach seeks to empower this marginalized community academically, economically, and legally.

Abstract

Perkembangan digitalisasi teknologi bidang kesehatan bentuk pelayanan kesehatan secara online, dimana pasien tidak perlu bertatap muka langsung, jenis pelayanan baru pada bidang kesehatan ini disebut juga dengan telemedicine. Identifikasi masalah penelitian ini terdiri atas 2 masalah, pertama bagaimana perlindungan hukum terhadap dokter dalam hubungan teraupeutik pelayanan kesehatan melalui media elektronik telemedisin menurut Undang- Undang Nomor 17 Tahun 2023 Tentang Kesehatan, kedua bagaimana pertanggungjawaban Etik terhadap dokter dalam hubungan teraupeutik pelayanan kesehatan melalui media elektronik telemedisin jika terjadi kesalahan diagnosa. Metodologi yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan. Pertanggungjawaban etik dalam pelayanan telemedisin telah diatur dalam KODEKI dokter yang di duga melakukan kesalahan dalam pelayanan telemedisin dikarenakan oleh pemeriksaan yang tidak lengkap dan mengakibatkan kesalahan terhadap saran-saran dan pemberian obat termasuk dalam kategori resiko rendah yang meyebabkan cedera ringan dan dapat diatasi dengan pertolongan pertama, dan sanksinya diatur dalam Pasal 29 oleh MKEK dengan sanksi kategori 1 (satu). Kementrian Kesehatan Agar dilakukan sinkronisasi tentang peraturan perundang-undangan yang mengatur mengenai pelayanan kesehatan telemedisin di Indonesia, dimana peraturan yang ada hanya sebatas pada situasi pandemik COVID-19 dan perlu disesuaikan dengan perkembangan teknologi saat ini.

Abstract

This paper examines the urgency of codifying the Election Law and Regional Election Law into one integrated regulation in the Indonesian legal system. Currently, the implementation of the General Election and Regional Election are still regulated separately through Law No. 7 of 2017 and Law No. 10 of 2016, which has given rise to a number of problems, such as the lack of synchronization of implementation times, overlapping authority, and differences in implementation standards. This lack of integration also has the potential to hamper the efficiency and stability of the central and regional governments, especially ahead of the implementation of the national simultaneous Regional Election in 2024. Through a normative approach and analysis of the Constitutional Court's decisions, especially the Constitutional Court Decisions No. 55/PUU-XVII/2019 and Constitutional Court Decisions No. 85/PUU-XX/2022, this paper shows that the Regional Election should be considered as part of the Election regime. Codification of the two regulations is important to simplify the electoral system, ensure legal certainty, and strengthen the principle of people's sovereignty in the 1945 Constitution of the Republic of Indonesia. The results of this study recommend that the integration of electoral regulations through codification is a strategic step in supporting effective, efficient, and inclusive democracy in Indonesia.
