Abstract

This research is a literature study that aims to analyze the development of Islamic banks in Indonesia from a sociological perspective. Islamic banks, operating based on Islamic sharia principles, have played an important role in the transformation of the financial sector in Indonesia. However, the role of Islamic banks does not only reflect financial aspects, but also reflects the broader social and cultural dynamics in Indonesian society. This research methodology is based on a literature study involving searching, selecting, and analyzing relevant literature related to the development of Islamic banks in Indonesia. Data is obtained through literature search in various sources, including academic databases, scientific journals, books, and research reports. The results of this literature analysis will include an in-depth understanding of the sociological aspects that influence the development of Islamic banks in Indonesia. This includes the role of culture, social factors, as well as the social and economic impact of the development of Islamic banks. The main findings will be synthesized and presented in this study to provide a comprehensive picture of the dynamics of Islamic bank development in the social context of Indonesian society. This research is expected to provide valuable insights for stakeholders in the Islamic financial sector, as well as policy makers who seek to understand the role of Islamic banks in the social and economic transformation of Indonesian society. The study also provides the basis for further research focusing on the role of sociology in the context of Islamic banking in Indonesia

Abstract

Interfaith marriage in Islam and Article 16 of the Universal Declaration of Human Rights (UDHR) show significant differences in legal and ethical approaches. In Islamic law, interfaith marriage is strictly regulated, with permission for Muslim men to marry Ahl al-Kitab women (Jews and Christians), but prohibiting Muslim women from marrying non-Muslim men. This aims to maintain the sustainability of Islamic beliefs in the family. Meanwhile, the UDHR emphasizes the right of individuals to choose a life partner without discrimination of religion, race, or nationality. This study aims to find out how the law of interfaith marriage, according to Islamic Marriage law allows marriage between a Muslim man and a woman Ahl al-Kitab, there are certain conditions that must be met, including maintaining Islamic norms and respecting the rights of the couple Various opinions of scholars regarding interfaith marriage, especially related to the different views of madhhab, reflect the complexity and variation in the understanding of Islamic law on this topic. Article 16 of the UDHR, which affirms the freedom of individuals in marriage without discrimination, is contrary to the principles of Islamic law that further restrict interfaith marriage, describing the tension between human rights and religious teachings in the context of interfaith marriage.

Abstract

Child marriage remains a persistent global issue, including in Indonesia and Australia. Despite legal frameworks that set a minimum age for marriage, the practice persists due to loopholes, socio-cultural factors, and weak enforcement. This study adopts a comparative legal approach by analysing statutory regulations, court decisions, and relevant academic literature within the contexts of Islamic law, Indonesian law, and Australian law. Findings reveal that the challenges in regulating child marriage are not purely juridical but are significantly influenced by psychosocial conditions. In Indonesia, the prevalence of marriage dispensations and cultural norms that tolerate early marriage creates a tension between legal norms and social realities. In contrast, Australia, while having a stronger legal framework and a relatively low prevalence, still allows dispensations for those aged 16–17 and faces cases of forced marriage within migrant communities, compounded by limited national data. The study’s contribution lies in demonstrating the importance of a legal-psychosocial perspective for understanding and addressing child marriage regulation. Protecting children’s rights, therefore, requires not only normative reforms but also comprehensive social interventions that address underlying cultural and structural drivers.

Abstract

Penelitian ini mengkaji pengaruh struktur kabilah dalam masyarakat Arab terhadap transmisi hadis pada masa sahabat dengan menggunakan pendekatan analitis sosiohistoris. Struktur kabilah yang berbasis pada hubungan genealogis dan solidaritas kelompok (ʿashabiyyah) berfungsi sebagai jaringan sosial utama yang membentuk jalur transmisi hadis sekaligus memfasilitasi penyebarannya secara luas dan berpotensi menimbulkan preferensi sosial dalam periwayatan. Dengan metode studi kepustakaan (library research), penelitian ini menganalisis pola empiris sanad para perawi besar berdasarkan afiliasi kabilah utama, yaitu Quraisy, Anshar, dan mawali non-Arab. Temuan penelitian menunjukkan bahwa jaringan kabilah menjadi sarana efektif distribusi hadis lintas wilayah, tetapi pada saat yang sama juga menciptakan tekanan selektif yang direspons oleh ulama hadis melalui kritik sanad dan penilaian perawi (jarh wa-taʿdīl). Secara kritis, penelitian ini mendialogkan temuan tersebut dengan kajian hadis kontemporer, termasuk karya Joseph Schacht, G. H. A. Juynboll, Mustafa al-Aʿzami, dan Jonathan A. C. Brown. Penelitian ini berargumen bahwa konteks kabilah tidak melemahkan autentisitas hadis, melainkan merupakan variabel sosiohistoris yang justru diakomodasi dalam disiplin ilmu hadis. Pendekatan interdisipliner ini berkontribusi terhadap pengembangan metodologi yang menjembatani ilmu hadis dan sejarah sosial.

Abstract

This article examines whether murābaḥah regulation and practice in Indonesia embody Islamic justice as a substantive ethical principle or remain confined to procedural sharia compliance. Existing studies on murābaḥah largely emphasize contractual validity, regulatory structure, and institutional compliance, but pay limited attention to justice as an ethical standard for evaluating how Islamic consumer finance operates in practice. Using a normative-conceptual method, this study analyzes primary legal and regulatory materials, including OJK regulations, statutory instruments, DSN–MUI fatwas, and internal supervisory guidelines, complemented by an interview conducted in November 2025 with an Assistant Manager at the OJK Regional Office in Cirebon. The analysis employs Sayyid Qutb’s framework of Islamic justice—mīzān, ḥurriyyah, and takāful ijtimāʿī—to assess the legal construction, regulatory objectives, and operational logic of murābaḥah within Indonesia’s Islamic financial system. The study finds that although murābaḥah has been regulated in a systematic and comprehensive manner to ensure legal certainty, prudential governance, and formal sharia compliance, such regulatory coherence does not automatically realize substantive Islamic justice. Market-oriented margin structures, debt-like operational features, and limited social orientation reveal a normative gap between procedural conformity and ethical justice. This article contributes to Islamic governance scholarship by offering a justice-centered evaluative framework for murābaḥah and by providing normative insights for strengthening Islamic consumer finance regulation beyond technical compliance toward a model that better integrates legal certainty, social justice, balanced risk allocation, and collective welfare.

Abstract

The demand for Sharia-based legal services in Indonesia is steadily increasing, highlighting the urgency of establishing the position of Sharia Notary as a bridge between Islamic law and positive law. This study employs a normative juridical approach with qualitative methods. Data were collected through literature review, regulatory analysis, and in-depth interviews with notaries, academics, and practitioners of Sharia law. The main findings indicate that despite significant opportunities for developing the Sharia Notary—particularly in supporting the national Sharia economic system—substantial challenges continue to hinder its implementation. These challenges include the absence of specific regulations, limited educational infrastructure and professional certification, and the lack of harmonious integration between Sharia law and the national legal system. This study presents a novelty in the form of a conceptual framework proposal for the legalization and institutionalization of the Sharia Notary position in Indonesia, through three strategic recommendations: establishing specific regulations, integrating Sharia legal curriculum into notarial education, and strengthening the supervisory role of Sharia oversight bodies. The Sharia Notary plays a strategic role in ensuring legal certainty in Sharia transactions and strengthening trust in a fair, inclusive legal system.Keywords: Sharia Notary; Islamic law; positive law; regulation; Sharia economy.
