Abstract

The low motivation of students can be caused by the monotony of learning activities. Besides that, teachers are less varied in delivering material because they always use conventional methods, so that students play a less active role in learning. The involvement of students in learning will create a good impression and, of course, can make learning more meaningful, especially if students are directly involved in observations and practical activities. One of the learning strategies that can be used to attract students' attention is multi- intelligence-based learning. Learning activities based on multiple intelligences that are appropriate to the characteristics of the Fiqih material regarding the management of corpses are kinesthetic intelligence. The subjects in this study involved students in grades IX B and IX C MTs. As-Sa'adah Sukasari totaled 36 and 37 students, respectively. The instruments used in this study include observation sheets, motivation and multiple intelligence questionnaires, and learning outcomes tests. The results showed that students' motivation and learning outcomes increased after learning based on multiple intelligences. This can be seen from the average category of multiple intelligence questionnaire results on kinesthetic intelligence indicators of 80.77 with very good criteria. The results of the motivation questionnaire in the experimental class after learning multiple intelligences in the experimental class have a very high category (84.57), while in the control class it has a medium category (55.57). Student learning outcomes in the experimental class increased in the medium category (N-Gain 0.53) while the learning outcomes in the control class were in the low category (N-Gain 0.12).

Abstract

Information technology has changed the ways of transacting and opened up new opportunities in conducting business transactions. An online sale and purchase agreement via the internet is considered valid if it meets subjective and objective conditions. Trading business activities via the internet are known as electronic commerce (e-commerce). It has become a necessity that society always experiences changes which are often followed by changes in mindset and values. On the other hand, the legal anthropology approach in research on Islamic law, both the study of normative laws (in the Qur’an) and empirical ones (in the practice of Muslims), has not been fully used. This article describes the anthropological approach of Islamic law in viewing the phenomenon of online buying and selling practices in Indonesia. This article aims to highlight the practice of buying and selling online using an anthropological approach to Islamic law. This article is qualitative research with library research. This article uses a Normative-Anthropological approach. The data in this study were obtained from library materials such as books, journals, and others related to the problems studied, namely the anthropology of Islamic law and online buying and selling. Data analysis techniques used are data condensation, data presentation, and drawing conclusions. The analysis results show that economic activity, including buying and selling online, relies heavily on language as a symbol of interaction. In other words, humans and the economy always prioritize symbolic interactionism in negotiating the desires and expectations of sellers and buyers, that is where anthropology and economics meet.

Abstract

Aktivitas ekonomi dalam dunia Islam dikenal dengan sebutan muamalah, yang meliputi beberapa kegiatan jual beli, sewa menyewa, hutang piutang dan sebagainya. Seiring berjalannya waktu, masyarakat sudah semakin meningkatnya peminat yang beralih pada kegiatan ekonomi yang berprinsip syari’ah, hal ini dikarenakan terbukti lebih dirasa memihak pada keadilan. Dalam penulisan ini, penulis meneliti dengan menggunakan metode studi kepustakaan (library research), yaitu dengan cara mengumpulkan dan mempelajari literatur yang telah ada dari berbagai sumber. Dalam Fatwa Dewan Syariah Nasional No. 126/DSN-MUI/2019 menyebutkan pengertian definisi Wakalah adalah akad pemberian kuasa dari muwakil kepada wakil untuk melakukan perbuatan hukum tertentu. Dan wakalah juga dapat diartikan sebagai penjagaan/pelindung (al-hifzh) (Q.S.Ali-Imran 3/173), tanggungan (al-dhamah), penyerahan/pendelegasian (al- tafwidh) (Q.S An-Nisa 4/35) (Q.S. Al-An’am 7/89) (Q.S. Al- Sajdah 32/11), Pencukupan (al-kifayah). Kafalah berarti al- dhamm (genggaman atau pegangan), dan al-dhamm (tanggungan atau penjaminan). Ia disebut juga al-dhamanat (penjaminan), al hamalat (denda, tanggungan), dan al-za’amat (penjaminan, dan harta yang paling utama).

Abstract

Pesantren holds a significant position in Indonesia's educational system, functioning as key institutions for religious education and cultural preservation. This study aims to examine the implementation of religious moderation policies within pesantren to encourage interfaith understanding and collaboration among diverse religious groups in Indonesia. Using a mixed-methods approach, the research gathered data from interviews, surveys, and document analysis across a range of pesantren in Indonesia. Findings reveal multiple initiatives to foster religious moderation, including incorporating interfaith education into curricula, enhancing students' critical thinking skills, and promoting gender equality practices. These efforts have been met with successes and challenges; while students benefit from a broader perspective, obstacles such as resource limitations, cultural norms, and resistance to change were notable. This study underscores the vital role of pesantren in promoting religious moderation, which is crucial for nurturing understanding and peace among Indonesia’s religious communities. These findings offer meaningful insights for policymakers, educators, and community leaders on advancing religious tolerance and empathy within Islamic education, supporting the development of a more inclusive and cohesive society.

Abstract

This study aims to analyze the strength of Maqashidu al-Syari'ah (MS) in mediation regulations and their application in the process of mediation for inheritance disputes in the Religious Courts. This research applies descriptive analytical method; data were collected by doing observation, indepth interview with mediators, documentation and literature study, then data analysis techniques were used to analyze it. The findings of this study show that MS's spirit in the Perma of Mediation Procedure in Court is very strong. However, However, the MS spirit contained in the Perma has not been successfully implemented in mediation in Religious Courts. The results of this research imply the necessity for mediators to master the MS and its spirit contained in the Perma on Mediation Procedures in Court well and apply it in mediation.Penelitian ini bertujuan menganalisis kekuatan semangat Maqashidu al-Syari'ah (MS) dalam Perma No. 1 Tahun 2016 tentang Mediasi dan penerapannya dalam upaya perdamaian sengketa waris di Pengadilan Agama (PA). Metode deskriptif analisis diterapkan dalam penelitian ini; data dikumpulkan dengan observasi, wawancara mendalam dengan mediator, studi dokumentasi dan studi literatur, lalu data dianalisis dengan mengaplikasikan teknik kualitatif. Penelitian menunjukkan ruh MS dalam Perma tentang Mediasi di Pengadilan sangat kuat. Namun semangat MS yang terdapat dalam Perma itu belum berhasil diterapkan dengan baik dalam mediasi di PA. Hasil penelitian ini mengimplikasikan keharusan bagi para mediator untuk menguasai MS dan semangatnya yang ada dalam Perma tentang Mediasi di Pengadilan dengan baik dan menerapkannya dalam proses mediasi.

Abstract

There has been a lot of research on Maqashid al-Syari'ah, but none of these studies have focused on disclosing the existence of Maqashid al-Syari'ah in the Regulation of mediation in court. This study aims to analyse the strength of Maqashid al-Syari'ah in mediation regulations and their application in the mediation process for inheritance disputes in the Religious Courts. No previous research has specifically explored the spirit of Maqashid al-Syari'ah in Perma regarding mediation in court. However, the Maqashid al-Syari’ah spirit contained in the Supreme Court Regulation has not been successfully implemented in mediation in Religious Courts. The results of this research imply the necessity for mediators to master the Maqashid al-Syari'ah and its spirit contained in the Perma on Mediation Procedures in Court well and apply it in mediation. Sampai saat ini telah banyak penelitian tentang Maqashid al-Syari’ah, namun belum ada satupun dari penelitian-penelitian itu yang memfokuskan kepada pengungkapan eksistensi Maqashid al-Syari’ah dalam Perma tentang mediasi di Pengadilan. Penelitian ini bertujuan menganalisis kekuatan semangat Maqashid al-Syari’ah dalam Perma No. 1 Tahun 2016 tentang Mediasi dan penerapannya dalam upaya perdamaian sengketa waris di Pengadilan Agama. Abstract

Sengketa waris di Kabupaten Sumedang masih cukup tinggi, dengan 13 kasus yang diajukan ke Pengadilan Agama Sumedang. Hal ini menunjukkan bahwa penyelesaian sengketa waris di tingkat masyarakat masih belum optimal. Salah satu penyebabnya adalah kurangnya pemahaman masyarakat terhadap Hukum Waris Islam, yang sering memicu perselisihan antar ahli waris. Kegiatan Pengabdian Kepada Masyarakat (PKM) ini bertujuan untuk meningkatkan literasi Hukum Waris Islam melalui kegiatan penyuluhan dan edukasi kepada masyarakat. Metode yang digunakan meliputi penyuluhan hukum, diskusi interaktif, dan studi kasus yang diambil dari kasus-kasus waris yang terjadi di wilayah Sumedang. Hasil kegiatan menunjukkan bahwa penyuluhan dan edukasi Hukum Waris Islam secara signifikan meningkatkan pemahaman masyarakat terkait pembagian waris menurut hukum Islam. Peningkatan literasi hukum ini diharapkan dapat mengurangi potensi sengketa waris di kemudian hari karena masyarakat memahami hak dan kewajibannya secara individu maupun kolektif.
