Abstract

The practice of undisputed marriages is the same in the case of breaking up of marital relations and has implications for the process of dividing joint assets.So the purpose of this study is how the legal consequences and provisions for the distribution of assets for divorced wives from marriage are not recorded in the distribution of joint assets in civil law and how legal remedies for wives for the right to share joint assets for divorced wives in marriage are not recorded in Bima Regency.This study uses empirical legal research, with a Case Approach, a legal approach (approach status) and a conceptual approach (conceptual approach) using primary data, data analysis using qualitative descriptive with inductive thinking. The results of this study indicate that first a marriage is valid if it is carried out according to religious law and consecutive beliefs.Second, if the marriage is not registered, then it is not and the validity of the marriage, both in the distribution of joint property or gonorrhea property. Third, the legal consequences of unregistered marriages on the position of joint assets, marriages without official documents or commonly referred to as unregistered marriages,so that in the position of joint property the State is not entitled to regulate the distribution because it is not recorded in the marriage registration, but in the distribution of joint property it can still be carried out on condition that an agreement is made in the distribution of its assets.

Abstract

Latar Belakang: Masalah narkoba, ancaman covid-19 dan sampah merupakan problem yang sama-sama penting yang harus menjadi perhatian bagi semua pihak. Narkoba misalnya setiap tahunnya menelan korban tidak kurang dari 4 juta jiwa. Sedangkan korban covid 19 di Indonesia menelan jiwa 83.279, dan trendnya terus bertambah. Sementara masalaah sampah juga tidak sangat mengkhawatirkan. Dengan ragam masalah tersebut, maka semua pihak harus ambil bagian mengatasi ragam masalah tersebut. Salah satu upaya yang bisa dilakukan adalah kolaborasi berbagai pihak mengarusutamakan program kampung sehat. Tujuan, tujuan dari kegiatan ini adalah membangun kesadaran masyarakat mewujudkan kampung sehat, utamanya keasadaran atas bahaya narkoba, pencegahan penyebaran covid-19, dan kesadaran tentang lingkungan bersih. Metode, Metode Pelaksanaan dilaksanakan dengan melakkan penyuluhan, diskusi, menyeprot disivektan, dan semangat gotong royong. Hasil, hasil kegiatan: Pertama, penyuluhan narkoba-psikotropika, berupa, munculnya kesadaran masayakat desa Tonnggondoa Kabupaten Bima tentang bahaya narkoba dna psikotropika, pemerintah Desa meluncurkan program reward bagi korban narkoba yang mau melakukan rehabilitasi dengan program pemberdayaan pemberian sapi 1 ekor. Kedua, Kegiatan penyemrotan disinvektan pada fasilitass umum dan pemukiman warga, melibatkan komponen warga, mahasiswa, dan aparatur desa, hasilnya berupa lingkungan dan fasiltas umum steril dari penyebaran covid 19. Ketiga, kegiatan gotong royong menghasilkan lingkungan yang bersih, dan timbulnya kesadaran secara kontinyu kemolpok masyarakat tentang pentingnya kebersihan.

Abstract

Disclosure of Indonesia's campaign finance has been in the spotlight since the post-Suharto elections, with publications related to KPU campaign finance receipts, payments and reports. However, the applications revealed by campaign funds are never optimal. This article contributes to addressing two problems at once. First, conceptually money politics and in simultaneous local elections. This research is a normative legal research or doctrinal research which is explorative-analytic in nature. The data used is secondary data, in the form of primary legal materials and secondary legal materials. The findings show that the cause of money politics will still be influenced by cultural factors, poverty, education level, level of understanding of law, degree of understanding of religion, weak government institutions, weakness of oversight institutions and party apparatus as well as weak political cadres. Therefore, it is necessary to have effective participation and application of the Village model Anti-money politics in Pilkada. Maximization of social capital forms a village social movement that is anti-money politics.

Abstract

After Law Number 21 of 2008, the government attempted to increase the resilience of sharia banking to potential risks that could occur at any time. The systemic impact resulting from failure to control risk is the main reason for implementing strict regulations in the banking industry. the impact caused by the failure to control risks, and the implementation of strict regulations on the banking industry, and looking at the government's actions in forming regulatory rules regarding sharia banking. Considering this research, we look at the rules made by the government. Why is the main reason for implementing strict regulations in the banking industry. The aim of this research is to determine the impact of failure to control risk by sharia banking, and the implementation of strict regulations in the banking industry. This research uses a descriptive-qualitative approach, with a type of library research, namely a type of research by collecting scientific papers as research objects or collecting data in the nature of a library study. The research results show that the Government needs to improve the regulatory and supervisory function of sharia banking in Indonesia. To optimize the function of sharia banking, the government must be able to control the risks that always frame sharia banking business activities.

Abstract

Pasca revisi Undang-Undang Perkawinan, terjadi kenaikan angka yang signifikan terhadap jumlah permohonan dispensasi kawin. Hal ini disebabkan oleh batas usia kawin bagi wanita yang dinaikkan menjadi 19 tahun. Perubahan regulasi tersebut dilakukan untuk mengatasi kondisi darurat perkawinan anak yang terjadi di Indonesia. Sayangnya, kenaikan jumlah permohonan dispensasi tidak dibarengi dengan aturan yang ketat, sehingga mayoritas justru dikabulkan oleh hakim. Aturan yang telah ada, baik UU No. 16 Tahun 2019 maupun PERMA Nomor 5 Tahun 2019 memiliki celah hukum yang membuat izin dispensasi kawin masih terbuka lebar dengan menggunakan alasan apapun. Artinya, praktek perkawinan di bawah umur pasca revisi UU Perkawinan akan terus menerus terjadi jika aturan yang ada tidak melimitisasi alasan di balik pengajuan permohonan dispensasi kawin. Alasan pengajuan permohonan dispensasi harus dibatasi pada alasan yang sifatnya sangat mendesak untuk menghindari multitafsir. Oleh karena itu, perlu adanya aturan tentang dispensasi yang menyebutkan secara jelas mengenai alasan pokok yang dapat diajukan oleh para pihak dan juga yang dapat dikabulkan oleh hakim. Hal ini dimaksudkan untuk menciptakan kepastian hukum dan meminimalisir praktek perkawinan di bawah umur yang terjadi akibat adanya dispensasi kawin
