Abstract

Bantuan hukum merupakan keharusan yang wajib diwujudkan negara sebagai kehendak dari Indonesia sebagai negara hukum. Tujuan dari penelitian ini adalah kedudukan dan persamaan hak masyarakat dihadapan hukum sebagai cerminan keadilan dan bukti perwujudan pemberian bantuan hukum bagi masyarakat sebagai sarana untuk mencari keadilan. Metode penelitian yang digunakan penelitian ini yaitu jenis yuridis normatif yang bersumber dari data sekunder dengan menelaah bahan hukum pustaka dan undang-undang. Hasil penelitian konsep negara hukum tidak ada perbedaan bagi masyarakat karena ketidakmampuannya secara ekonomi lalu seseorang harus kehilangan haknya untuk memperoleh keadilan. Kehadiran dan pengaturan pemberian bantuan hukum yang telah ada bukan sekedar untuk meramaikan profesi hukum di tanah air, tetapi lebih dari itu salah satu langkah untuk mewujudkan keadilan khususnya bagi masarakat yang dikategorikan sebagai orang-orang yang tidak mampu secara ekonomi.

Abstract

Restorative justice is the settlement of criminal cases based on victims. If the punishment for the perpetrator is still considered inadequate for the loss of the victim, then through restorative justice the rights of the victim in the context of the victim's recovery can be immediately carried out by the perpetrator directly, not by the state. The main issues discussed include: how to implement restorative justice at the level of investigation, prosecution and at trial in court, and how to resolve victim-based criminal cases between retributive justice and restorative justice. The research was conducted through normative legal research, the material studied was library material and the method of conclusion by deduction. Restorative justice at the level of investigation, prosecution and at the time of trial in court aims to protect the victim directly by the perpetrator and stop the investigation, investigation and or prosecution. Retributive justice tends to punish the perpetrator without considering the recovery of the victim, meanwhile restorative justice is the resolution of criminal disputes by means of restoring the victim.

Abstract

Indonesian positive law with Islamic law is a step in realizing Indonesianness in the sense of having an Indonesian personality and sense of nationality, besides that, Indonesian positive law with Islamic law also has a noble goal, namely achieving justice. The purpose of this study is to find out the relationship between Indonesian positive law which is characterized by Islamic law in relation to justice. The research method used is a normative legal research method. The realization of Indonesia's positive law with Islamic law is in fact very much in line with the first principle of Pancasila, namely Belief in One God. Omnibus law is an opportunity in realizing positive Indonesian law with Islamic law, especially in improving the status and aligning KHI with various sectoral laws and regulations, these opportunities and challenges must be captured not only by experts in Islamic law in Indonesia but also by the Faculty of Sharia. 'ah in Indonesia, not only by the State Syari'ah Faculties but also by the Private Syari'ah Faculties.
