Abstract

Abstract. The act of persecution is an act that is included in one of the criminal acts that commonly occur in the social community environment. This study aims to determine the basis for the consideration of the Bandung District Court judge in sentencing perpetrators of criminal acts of persecution carried out together using the empirical legal approach method and presenting it in the form of a description that explains and describes appropriately the problems that are interrelated with this research. Based on the results of the research and discussion, it will be known what the basis for the judge's considerations are in sentencing perpetrators of criminal acts of persecution together based on decision no. 864 / Pid.B / 2020 / Pn.Bdg. Seeing from the facts and valid evidence in the trial, the defendant has fulfilled the elements of the article charged so that the judge found the defendant guilty and the decision handed down by the panel of judges has fulfilled justice based on the values ​​​​arising from responsive legal sources. Abstrak. Tindakan penganiayaan adalah suatu perbuatan yang termasuk dalam salah satu tindak pidana yang biasa terjadi pada lingkungan masyarakat sosial. Dalam penelitian ini bertujuan untuk mengetahui dasar pertimbangan hakim pengadilan negeri bandung dalam menjatuhkan pidana terhadap pelaku tindak pidana penganiayaan yang dilakukan secara bersama-sama dengan menggunakan metode pendekatan hukum yuridis empiris serta menyajikannya dalam bentuk deskripsi yang menjelaskan hingga menggambarkan dengan sesuai akan permasalahan yang saling berkaitan dengan penelitian ini. Berdasarkan hasil penelitian dan pembahasan nantinya akan diketahui apa dasar pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana penganiayaan secara bersama-sama berdasarkan pada putusan no 864/Pid.B/2020/Pn.Bdg. Melihat dari fakta serta bukti yang sah di persidangan terdakwa telah memenuhi unsur-unsur dari pasal yang didakwakan sehingga hakim memutuskan terdakwa bersalah dan putusan yang dijatuhkan oleh majelis hakim telah memenuhi keadilan yang didasarkann pada nilai-nilai yang lahir dari sumber hukum responsif.

Abstract

The Public Prosecutor's Office's authority to investigate economic crimes in Indonesia remains limited, both normatively and institutionally. Yet the complexity and magnitude of losses resulting from economic offenses demand an institution with adequate juridical and technical capabilities. To address issues concerning the legal basis for these limitations, their impact on law enforcement, and an ideal legal‐policy model for the Public Prosecutor's Office, a normative legal approach was employed, incorporating statutory, case‐law, historical, comparative, and conceptual analyses. The discussion examines the grounds for such limitations under positive law, the prevailing legal‐policy direction, and the design of criminal institutions, according to which the Public Prosecutor's Office may exercise investigative functions only where governed by a lex specialis provision. Moreover, the normative and practical effects of these limitations on enforcement effectiveness are analyzed, particularly in relation to inter-agency coordination, legal certainty, and public confidence. In light of the Public Prosecutor's Office's success in handling major corruption cases, which are part of the broader category of economic crimes, there is a pressing need to formulate a legal‐policy model to expand and strengthen the institution's role. As a solution, a criminal‐law reform model is proposed that positions the Public Prosecutor's Office as the principal investigative body through centralized authority, accountable procedures, and integrated cross‐agency governance. This model is intended to establish a more centralized, efficient, and credible system for enforcing economic criminal law while reinforcing the direction of national criminal-law reform.

Abstract

This research explores the legal protection of domestic doctors in Indonesia in response to the increasing utilization of foreign doctors (FDs) within the framework of knowledge transfer aimed at improving healthcare services. With the enactment of Law No. 17 of 2023 on Health, the Indonesian government provides space for foreign doctors to practice with simplified licensing procedures, raising legal concerns regarding legal certainty, professional equality, and the rights of patients to clear and honest communication. This study uses normative juridical methods with statutory and conceptual approaches to analyze the legal framework surrounding this issue. The findings show that the implementation of simplified requirements for foreign doctors potentially threatens the professional standing of local doctors and risks violating patient rights. Recommendations include strengthening legal instruments and monitoring mechanisms to ensure that knowledge transfer objectives are met without compromising legal protection and healthcare quality. The legal framework provided by Law No. 17 of 2023 allows foreign doctors to practice with more straightforward licensing processes, but it raises concerns regarding the adequacy of regulatory oversight. Local doctors fear that the simplified procedures for foreign doctors may not guarantee the same level of competency, accountability, and ethical standards. Furthermore, the presence of foreign doctors could lead to a disparity in professional treatment and recognition, undermining the integrity of the medical profession in Indonesia. This study explores how these legal issues intersect with the broader goals of patient protection, ensuring that all medical practitioners, regardless of nationality, adhere to the highest standards of care and ethical conduct. The role of patient rights in this context is critical, as patients must receive clear and honest communication about the qualifications of the doctors treating them, ensuring their right to informed consent is upheld.
