Abstract

This study analyzes and discusses the role of legal philosophy in Indonesia. Legal philosophy changes the statutory regulations based on TAP XX/MPRS 1966, then the order of statutory regulations based on TAP III/MPR/2000, until finally is the order of laws and regulations based on article 7 of law No. 12 of 2011 in lieu of law no. 10 of 2004, this change is based on legal philosophy in Indonesia based on legal theory, this is that legal philosophy plays a very important role in forming law in a democratic direction, leading to the true needs of society, the change is based on renewal based on the principle of utility and fairness of function. national law is for protection, so the change or formation of law in Indonesia must go through a process of legal philosophy in which it is able to direct and accommodate legal needs in accordance with the level of progress of development in all fields, which is also able to meet the needs of a diverse society at large, which The laws formed are the rules for the game of life. Law is formed as a fulfillment of a sense of justice for the wider community, without distinguishing race, class, ethnicity, party, religion or other distinctions within the framework of Bhinneka Tunggal Ika. Abstrak           Penelitian ini menganalisa dan membahas tentang peran filsafat hukum yang ada di Indonesia filsafat hukum mengubah tata aturan peraturan perundang-undangan yang didasari TAP XX/MPRS Tahun 1966, kemudian tata urutan Peraturan perundang-undangan yang di dasari TAP III/MPR/2000, sampai terakhir adalah tata urutan peraturan perundang-undangan yang didasari pasal 7 undang-undang No, 12 tahun 2011 sebagai pengganti undang-undang No. 10 tahun 2004, pengubahan itu atas dasar filsafat hukum di Indonesia ada pada teori hukumnya hal ini bahwa filsafat hukum sangat berperan dalam pembentukan hukum ke arah yang demokratis, mengarah kepada kebutuhan masyarakat yang hakiki pengubahan itu atas dasar pembaharuan yang didasari pada asas kemanfaatan dan keadilan fungsi hukum nasional adalah untuk pengayoman, maka perubahan atau pembentukan hukum di Indonesia harus melalaui proses filsafat hukum yang di dalamnya mampu mengarahkan dan menampung kebutuhan-kebutuhan hukum sesuai dengan tingkat kemajuan pembangunan di segala bidang, yang juga mampu memenuhi kebutuhan masyarakat luas yang majemuk, yang mana hukum yang dibentuk merupakan rules for the game of life. Hukum di bentuk sebagai pemenuhan rasa keadilan bagi masyarakat luas, tanpa membedakan ras, golongan, suku, partai, agama, atau pembedaan lain dalam kerangka bhinneka tunggal ika.

Abstract

This journal discusses the role of legal philosophy in building a sense of justice. Philosophy of law is a branch of science that studies the basics, objectives, and principles of law. Legal philosophy also considers abstract questions related to human rights, justice, and moral obligations. A sense of justice is a concept that refers to the feeling that all people get equal rights before the law and are given justice according to their deeds. Building a sense of justice is provided through the judge's ruling process. However, judges are often easily intervened by certain parties, resulting in a legal mafia in the judiciary. For example, the practice of the judicial mafia in Indonesia can be seen from cases where judges are intervened by lawyers or other parties to give unfair verdicts. To deal with this problem, the theory of fair law enforcement proposes a research method that focuses on how to enforce laws that are fair and equitable for everyone. This research was conducted by collecting data related to the judicial process, analyzing existing legal policies, and evaluating how legal practice in the field. This research method aims to find solutions to the problems of the legal mafia that occur in the judiciary and build a stronger sense of justice in society. Abstrak           Jurnal ini membahas peran filsafat hukum dalam membangun rasa keadilan. Filsafat hukum merupakan suatu cabang ilmu yang mempelajari dasar-dasar, tujuan, dan prinsip-prinsip dari hukum. Filsafat hukum juga mempertimbangkan pertanyaan-pertanyaan abstrak yang terkait dengan hak asasi manusia, keadilan, dan kewajiban moral. Rasa keadilan merupakan suatu konsep yang mengacu pada perasaan bahwa semua orang mendapatkan hak yang sama di hadapan hukum dan diberi keadilan sesuai dengan perbuatan mereka. Membangun rasa keadilan diberikan melalui proses putusan hakim. Namun, hakim seringkali mudah diintervensi oleh pihak-pihak tertentu, sehingga terjadi mafia hukum di peradilan. Contohnya, praktek mafia peradilan di Indonesia terlihat dari adanya kasus-kasus dimana hakim diintervensi oleh pengacara atau pihak lain untuk memberikan putusan yang tidak adil. Untuk menghadapi permasalahan ini, teori penegakan hukum berkeadilan mengajukan metode penelitian yang memfokuskan pada bagaimana cara menegakkan hukum yang adil dan merata bagi semua orang. Penelitian ini dilakukan dengan mengumpulkan data-data terkait proses peradilan, menganalisis kebijakan-kebijakan hukum yang ada, serta mengevaluasi bagaimana praktek hukum di lapangan. Metode penelitian ini bertujuan untuk mencari solusi atas permasalahan mafia hukum yang terjadi di peradilan dan membangun rasa keadilan yang lebih kuat di masyarakat.

Abstract

At the end of 2020, to be precise in November 2020, the government passed Law Number 11 of 2020 concerning Job Creation. Several months later, namely in February 2021, the government stipulated implementing regulations for Law Number 11 of 2020, namely Government Regulation Number 35 of 2020 concerning Specific Time Work Agreements, Outsourcing, Working Time and Rest Time, as well as Termination of Employment Relations. People infected by the COVID-19 outbreak continue to increase every day, and the number of deaths due to the COVID-19 outbreak continues to increase. The Central Government and Regional Governments have issued policies to prevent and overcome the spread of the COVID-19 outbreak, namely by implementing Large-Scale Social Restrictions (PSBB) and Implementing Community Activity Restrictions (PPKM). With the implementation of PSBB and PPKM by the government, several sectors, especially the accommodation provision sector, tourism businesses, food and beverage businesses, real estate, and construction experienced direct impacts as a result of the COVID-19 pandemic and the existence of PSBB and PPKM. The tourism sector, especially hotels, experienced a decline in income due to the lack of overnight guests, forcing entrepreneurs to lay off workers without providing wages to reduce expenses and save company finances. This thesis research analyzes the impact caused by laying off workers/laborers without being paid wages and legal considerations regarding the decision of the Industrial Relations Court at the Central Jakarta District Court with case number: 398/Pdt. Sus PHI/2021/PN. JKT. PST. The purpose of this decision analysis is to find out requests for termination of employment (PHK) by workers or employees due to being laid off for more than three months without wages based on Law Number 11 of 2020 concerning Job Creation.

Abstract

Narcotics abuse against children or students is a criminal act or is in a very dangerous category so that handling in law enforcement must be more careful and thorough so that preventive efforts and prosecutions are effective. Law and enforcement against narcotics crime in Indonesia according to the law number 35 of 2009 concerning narcotics, how top protect children the misuse of drugs seen from the social aspect and the positive legal functioning of the state brings very good effects for the protection of the threat of development and growth of the nation’s generation. Narcotics are not pests that are harmful to the human body but are capable of killing human civilization together. So that in law enforcement against narcotics crimes, according to the narcotics law, criminal sanctions will be imposed, fines, life imprisonment and other sanctions. The system of association and the level of understanding and awareness of the substance of narcotics.
