Abstract

Penelitian ini membahas mengenai prinsip hifzh al-maal (menjaga harta) dalam konteks penetapan uang jasa sebesar 25% pada program pembiayaan PNM Mekaar Syari’ah di Aceh Besar. Program ini merupakan bentuk pembiayaan usaha mikro yang ditujukan khusus bagi perempuan prasejahtera tanpa agunan, dengan tujuan untuk meningkatkan kesejahteraan keluarga melalui pemberdayaan ekonomi. Namun, adanya penetapan uang jasa sebesar 25% secara flat (tetap) setiap tahun menimbulkan persoalan tersendiri, terutama bagi pelaku UMKM yang memiliki pendapatan tidak tetap. Kondisi ini menimbulkan pertanyaan apa yang dimaksud dengan maqashid syari’ah dan prinsipnya dalam kehidupan Masyarakat, bagaimana praktik pembiayaan modal dan pandangan pelaku UMKM terhadap penetapan uang jasa 25% oleh PNM Mekaar Syari’ah Aceh Besar, serta bagaimana ketentuan tersebut ditinjau dari prinsip hifzh al-maal. Penelitian ini menggunakan metode yuridis sosiologis dengan pendekatan kualitatif, mengumpulkan data melalui wawancara langsung kepada nasabah dan pegawai PNM Mekaar Syari’ah Aceh Besar. Hasil penelitian menunjukkan bahwa meskipun program ini membantu akses modal usaha, penetapan uang jasa yang tetap tanpa mempertimbangkan fluktuasi pendapatan dinilai memberatkan sebagian nasabah dan berpotensi bertentangan dengan prinsip hifzh al-maal. Prinsip ini menekankan pentingnya menjaga dan mengelola harta secara proporsional dan menghindari beban yang merugikan. Oleh karena itu, penyesuaian sistem pembiayaan yang lebih adaptif terhadap kondisi ekonomi nasabah sangat diperlukan agar pelaksanaan program tetap sesuai dengan nilai-nilai maqashid syari’ah dan benar-benar menghadirkan kemaslahatan.

Abstract

Marriage in Islam is a sacred bond (mitsaqan ghalidzan) that requires the husband to provide financial support to his wife, as regulated by Islamic law and Indonesian legislation. However, problems arise when the husband, despite being financially capable, is stingy in fulfilling this obligation, resulting in household disharmony and divorce. This study examines the legal implications of this attitude through a normative legal analysis of the Banda Aceh Sharia Court Decision Number 350/Pdt.G/2024/MS.Bna. The purpose of the study is to analyze the legal basis for providing support, the husband's stinginess as a reason for divorce, and the judge's considerations in deciding the case. Using a normative legal approach, the study uses primary data from court decisions and secondary data from existing theories and research. The results show that providing support is a husband's obligation based on Islamic law (the Qur'an, Hadith) and national law (Law No. 1/1974, KHI). Stinginess in providing support, even if the husband is in a sufficient economic condition, is considered a neglect of obligations and is a valid reason for divorce. The study's conclusion suggests that an Islamic legal perspective aligns with this issue, emphasizing justice and responsibility. It is recommended that future researchers conduct more in-depth comparative studies on the implementation of livelihood provisions in various regions with varying socioeconomic characteristics.

Abstract

The postponement of the distribution of joint property after divorce is still an ongoing socio-juridical problem and has an impact on weak legal certainty and the fulfillment of economic rights after divorce, especially for women. Although Indonesian positive law and Islamic law normatively regulate the division of common property, there is still a gap between legal norms and the practice of their implementation in a society based on customary law. This research fills the research gap in the form of a lack of empirical juridical studies on the postponement of the distribution of common property in the interaction between customary law, Islamic law, and state law in traditional societies. The purpose of this study is to analyze the causal factors, patterns, and legal implications of post-divorce joint property distribution, with an emphasis on the protection of economic rights. The method used is empirical juridical with a socio-legal approach, which is carried out through field research in Katimaju Village, Ketambe District, Southeast Aceh Regency, with in-depth interview techniques and document analysis. The results of the study show that the delay in the distribution of joint property is influenced by the strong customary norms, the dominance of the role of extended families and traditional leaders, and the prevalence of unregistered marriages, which has implications for legal uncertainty and weak economic protection for women. The novelty of this research lies in an integrative analysis between normative legal frameworks and local social practices that reveal structural injustices in customary dispute resolution mechanisms. Based on these findings, this study recommends that the settlement of the distribution of joint property after divorce be required through a legal mechanism that has binding power by involving the Religious Court as the main authority, accompanied by the reformulation of customary dispute resolution mechanisms to be in harmony with Islamic law and state law, increasing the legalization of marriage through marriage registration, and strengthening community-based legal education to ensure legal certainty.  protect women's economic rights, and realize substantive justice in indigenous peoples.

Abstract

The construction of the Wastewater Treatment Plant (WWTP) in Aceh Tengah Regency is a strategic government project implemented through a construction service contract between the P2P Work Unit as the project owner and PT Meudang Pirak as the service provider. During its implementation, the project encountered various technical and non-technical constraints that resulted in contract changes through three addendum contracts. This condition raised legal issues regarding the validity of the addendum contracts under both positive law and the perspective of Islamic jurisprudence (fiqh muamalah), particularly within the framework of the ijārah 'ala al-'amāl contract. Therefore, the research problems of this study focus on the validity of the main contract and its addendums in the Aceh Tengah WWTP project and their conformity with the principles of ijārah 'ala al-'amāl. This study employs a qualitative method with a descriptive-analytical approach through library research by examining contract documents, statutory regulations, and relevant fiqh muamalah literature. The findings indicate that all addendum contracts implemented constitute legally valid contractual adjustments from administrative, juridical, and sharia perspectives, as they do not eliminate the pillars and conditions of the ijārah contract. Instead, the addendums function to maintain contractual continuity, ensure clarity of the work object, guarantee certainty of ujrah (wages), and realize the principles of justice and public benefit (maṣlaḥah). Accordingly, the main contract and its addendums in the Aceh Tengah WWTP project are deemed valid and consistent with both positive law and Islamic jurisprudence

Abstract

This study examines the effectiveness of the Johor Islamic Family Law Enactment 2003 in protecting child custody (hadhanah) rights after divorce, employing a qualitative approach that combines normative legal analysis and interviews with officers of the Johor Syariah High Court. The enactment comprehensively regulates custodial hierarchy, eligibility requirements, maintenance, visitation rights, and protective mechanisms such as interim custody orders and restrictions on removing a child from Malaysia. Findings reveal that while the enactment is structurally robust and grounded in the principle of Jabl al-Masalih, its implementation requires alignment with the Child Act 2001 to fulfil the objective of Daf‘ al-Mafasid, particularly in cases involving abuse, neglect, violence, or attempted child abduction. Despite the sufficiency of the enactment from a legal standpoint, challenges emerge from individual non-compliance with court orders, such as failure to pay maintenance or refusal to surrender the child. The involvement of enforcement agencies, including the Royal Malaysia Police and the Social Welfare Department, is crucial in ensuring effective execution of custody decisions. Ultimately, maximizing child protection after divorce necessitates a holistic harmonisation of Islamic family law with national child-protection frameworks to ensure the child’s safety, welfare, and long-term well-being.
