Abstract

Penelitian ini bertujuan untuk mengetahui, menganalisis dan menjelaskan penerapan hukum terhadap para pihak dengan dicantumkannya klausula asuransi jiwa dalam perjanjian kredit.Berdasarkan penelitian dan Pembahasan, maka penulis menyimpulkan Dalam asuransi jiwa kita mengenal 3 (tiga) pihak yaitu penanggung, tertanggung (debitur yang menanggungkan jiwanya), penikmat (ahli wari atau yang diperjanjikan). Ketiga pihak bila disederhanakan lagi menjadi, debitur, kreditur, dan perusahaan asuransi. Asuransi jiwa yang merupakan salah satu contoh asuransi dengan biaya tertentu yang mana penggantian risiko tidak akan sesuai dengan risiko yang dialaminya.Kematian merupakan evenemen dalam asuransi jiwa, yang menimbulkan hak dan kewajiban bagi para pihak. Pada umumnya ketika tertanggung meninggal dunia maka penanggung mempunyai kewajiban untuk memberikan ganti rugi kepada penikmat (ahli waris) kecuali diperjanjikan lain. Misalnya pihak debitur menyetujui klausula yang diberikan oleh pihak bank, berisikan kerja sama dengan pihak asuransi jiwa untuk menanggulangi risiko yang terjadi. Jadi dalam hal ini pihak bank bertindak sebagai pemegang polis (penerima) ganti kerugian.

Abstract

This study aims to analyze the application of chemical castration as a punishment for child rapists from a human rights perspective, focusing on Court Decision No. 859/Pid.Sus/2023/PN.Bjm as the subject of the study, as well as its compliance with the principle of humanity. The method used in this study is a descriptive-analytical normative legal method employing both a statutory approach and a case-based approach, involving a qualitative analysis of primary, secondary, and tertiary legal sources. The novelty of this study lies in its specific examination of the judge’s reasoning in imposing chemical castration on the perpetrator in Judgment No. 859/Pid.Sus/2023/PN.Bjm, as well as the relationship between regulations and judicial practice, which has not been extensively studied. The results of the study indicate that the imposition of chemical castration as an additional penalty for the perpetrator of child rape in the aforementioned judgment is normatively intended to protect the victim, in this case the child, and to prevent the recurrence of similar criminal acts. However, this has become controversial from a human rights perspective because it pertains to the perpetrator’s right to bodily integrity, as stipulated in Law No. 39 of 1999 and Articles 28G through 28J of the 1945 Constitution of the Republic of Indonesia. Furthermore, in this ruling, the imposition of chemical castration on the perpetrator was also based on the judge’s subjective considerations without regard to the cumulative requirements for restricting rights under Law No. 17 of 2016, Article 81, paragraph (7), resulting in inconsistencies that potentially violate the principle of proportionality between statutory regulations and judicial practice. The conclusion of this study is that chemical castration sentences not based on clear legal provisions and human rights standards have the potential to create inconsistencies in the application of the law and violate the principle of proportionality regarding the offender’s right to bodily integrity.

Abstract

The right to information and access to medical records constitutes a fundamental component of patients' civil law rights as guaranteed under Law Number 17 of 2023 on Health in Indonesia. However, information asymmetry between healthcare providers and patients and their families in alleged medical disputes continues to limit public understanding of legal rights and appropriate dispute resolution mechanisms. This Community Service Program aimed to enhance the legal literacy of patients' families regarding their right to information and access to medical records while strengthening their bargaining position through a non-litigation advocacy approach. The program involved six family members of a patient facing an alleged medical dispute in Sorong City. The implementation consisted of three stages: preparation, advocacy, and evaluation. The preparation stage involved identifying legal facts through in-depth interviews and document analysis. The advocacy stage included legal counseling, communication assistance, and facilitation of requests for information and access to medical records from healthcare providers. The evaluation stage assessed improvements in participants' legal understanding and the progress of the advocacy process. The results showed that the advocacy assistance improved the legal understanding of all six participants regarding patients' civil law rights, strengthened their ability to exercise their rights to information and medical records in accordance with applicable laws and regulations, and promoted more constructive communication with healthcare providers. This community service program demonstrates that civil law rights-based advocacy assistance is an effective community empowerment strategy for supporting more transparent, equitable, and patient-centered resolution of alleged medical disputes.
