Abstract

The Indonesian criminal justice system is undergoing a fundamental transformation from a retributive approach to restorative justice. This study aims to analyze the implications of this paradigm shift on the dominus litis principle upheld by the Prosecutor's Office, and evaluate its implementation in ensuring legal certainty and justice for victims. The research method used is socio-legal, combining normative analysis of laws and regulations (Criminal Procedure Code, Prosecutor's Office Law, New Criminal Code, Perja 15/2020) with empirical analysis related to the reality of law enforcement. The results of the study indicate that restorative justice does not weaken the dominus litis principle, but rather functionalizes it into a more humane discretionary authority, changing the role of prosecutors from mere prosecutors to peace facilitators. However, empirically, weaknesses were found in the legal product of the Decree on Termination of Prosecution (SKPP), which is purely administrative in nature, making it vulnerable to pretrial and weak in the execution of compensation for victims. This study concludes that to ensure complete legal certainty without compromising victims' rights, the implementation of restorative justice must be synchronized with Article 132 of Law No. 1 of 2023 (New Criminal Code) and adopt a judicial scrutiny mechanism to ensure that peace agreements have binding enforcement power.

Abstract

Abstract

This article examines the legal compatibility of granting Mining Business Licenses (Izin Usaha Pertambangan, IUP) directly to universities under Indonesian positive law. Using a normative juridical method with statute and conceptual approaches, the article analyses four intersecting regulatory regimes: the Mineral and Coal Mining Law, the Higher Education Law, the State Finance Law, and the Environmental Protection and Management Law. The study finds that universities are not a permissible legal subject to hold IUP under the current mining regime, a position explicitly confirmed by the 2025 amendment to the Mineral and Coal Mining Law, which removed universities from priority access to mining permits. Beyond this statutory exclusion, the proposed policy generates structural incompatibilities with higher-education law, which mandates a non-profit academic mission protected by academic freedom and institutional autonomy; with state finance law, which imposes strict public accountability obligations on university budgets; and with environmental law, which assigns full strict liability for mining damage to the licence holder. The cumulative effect is a normative configuration that Indonesian positive law does not accommodate. The article recommends that university involvement in the mining sector be channelled exclusively through research partnerships, capacity-building agreements, and consultancy arrangements that preserve academic independence and respect the Tri Dharma mandate.

Abstract

Restorative justice, as a manifestation of the Prosecutor's authority and discretion in controlling criminal cases, is vulnerable to abuse of authority if it is not supported by the principle of accountability and a robust supervision system. This research aims to strengthen the authority of prosecutors in applying restorative justice by strengthening regulations at the legal level and proposing stricter criteria for crimes that fall into this category. The research method used is normative legal research, which aims to find coherence between the Prosecutor's authority and legal norms, legal concepts, and legal principles through a legislative and conceptual approach. This study finds that implementing restorative justice by prosecutors requires strengthening regulations and a more muscular supervision system to prevent abuse of authority and ensure legal certainty and justice for all parties. This study implies the need for more transparent regulations and a strict monitoring system to avoid abuse of authority in the application of restorative justice by prosecutors, ensure an accountable law enforcement system, and protect human rights.

Abstract

The meaning of judicial power as a discourse in every discussion is always linked to the natural law theory pioneered by Thomas Aquinas. However, this natural law theory, which emphasizes the discourse of judges as representatives of God from a practical perspective, needs to be elaborated to foster understanding in legal practice. The appreciation of carrying out this task is very important, because the word judge (hakim, Indonesian) is taken from the word Al Hakiim (Arabic), one of the 99 names of Allah in Asmaul Husna which means the Most Wise. This study, therefore, presents the idea of Maqashid Syariah which contains the meaning of wisdom as a methodology in implementing the concept of judicial power. This research uses normative legal research methods with a hermeneutical approach. This research resulted in the conclusion that the responsibility of implementing the concept of judicial power for a judge in order to produce just laws requires the participation of conscience as a fatwa provider regarding what is right and wrong, in addition to reason. The Maqasid Syariah approach in the context of interpreting judicial power in this research recommends that it is important for policy makers to take steps that are in line with efforts to maintain the mind, religion, soul, lineage and assets of judges in order to maintain their independence in carrying out their duties.

Abstract

Land disputes remain a persistent legal problem in Indonesia because land holds significant social, economic, and legal value and frequently generates competing claims among individuals and institutions. Unresolved disputes may escalate beyond civil disagreements and contribute to criminal offenses, including unlawful occupation, document falsification, and other unlawful conduct concerning land rights. This study examines the role and effectiveness of mediation in resolving land disputes and preventing related criminal offenses at the Surakarta City Land Office. The research applies an empirical legal method with a qualitative approach by examining the implementation of mediation, institutional practices, and obstacles encountered during dispute resolution. The findings demonstrate that mediation provides an important nonlitigation mechanism for facilitating dialogue, reducing conflict, and encouraging mutually acceptable settlements. However, its effectiveness remains limited by the unwillingness of disputing parties to participate constructively, emotional tensions between the parties, insufficient numbers of competent and certified mediators, inadequate supporting facilities, and limited legal awareness. When mediation fails to produce an agreement, disputing parties generally pursue litigation, which may prolong conflict and increase the possibility of unlawful conduct. The study concludes that strengthening mediator competence, improving institutional capacity, increasing public legal awareness, and encouraging meaningful participation can enhance mediation as a preventive legal mechanism against criminal offenses arising from land disputes.

Abstract

This study aims to analyze the application of psychoanalytic and empiricist learning theories in human resource (HR) development and to examine the function of law in fostering compliance through the Integrity Zone at the Trenggalek District Attorney's Office. The urgency of this study lies in the importance of the integrity and professionalism of prosecution officials as a foundation for ensuring just legal certainty. This research employs a normative legal method with a statutory and conceptual approach. The findings indicate that effective HR management reflects a psychoanalytic aspect (internal mentality) influenced by empirical factors (work environment and infrastructure) as a driving force. This driving factor is then engineered through law to shape behavior. The novelty of this research is positioning the Integrity Zone not merely as an administrative program, but as an instrument of legal engineering that consciously applies learning theories to control and prevent behavioral deviations. In conclusion, administrative law, through the declaration of an Integrity Zone, serves as a strategic tool for building a culture of compliance and accountability within law enforcement institutions.
