Abstract

As a stage in the implementation of elections, verification of political parties is important. Aside from being an effort to create a simple multi-party system, the implementation of verification og political party is also an effort to ensure that the Political Parties are indeed eligible to contest in general elections. However, the verification should be carried out only once as stipulated in the legislation. However, in practice, new political parties must undergo verification twice with similar requirements, namely verification to obtain a legal entity status as stipulated in Law Number 2 of 2011 concerning Political Parties and verification to become an election participant regulated in Law Number 7 of 2017 concerning general elections. This raises the potential for reduplication of verification by the state of new political parties which then has implications for ineffectiveness, inefficiency and violations of the principle of justice. The research method in this article is normative juridical. The conclusion in this study is the implementation of political party verification which is currently happening inefficiently because it led to reduplication so that it needs to be reorganized.

Abstract

Semakin tingginya angka penyebaran Corona Virus Disease 2019 (Covid-19) di Indonesia ditindaklanjuti oleh Pemerintah dengan mengeluarkan kebijakan baru yakni Pemberlakuan Pembatasan Kegiatan Masyarakat. Seperti halnya kebijakan-kebijakan lain, pemberlakuan kebijakan ini sekali pun dinilai efektif oleh Pemerintah selayaknya harus tetap sesuai dengan peraturan perundang-undangan yang berlaku di Indonesia. Kebijakan PPKM merupakan salah satu kebijakan dalam upaya penanggulangan pandemi Covid-19 yang tidak mempunyai kedudukan hukum yang jelas, karena frase Pemberlakukan Pembatasan Kegiatan Untuk Pengendalian Penyebaran Wabah tidak terdapat dalam UU No. 6 Tahun 2018 tentang Kekarantinaan Kesehatan. Rumusan masalah yang hendak dijawab dalam artikel ini adalah bagaimana kedudukan hukum Pemberlakuan Pembatasan Kegiatan Masyarakat ini di dalam sistem ketatanegaraan Indonesia?. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan. Hasil penelitian menyimpulkan bahwa terdapat sejumlah peraturan berkaitan dengan PPKM tersebut yang cacat secara formil.

Abstract

This study aims to analyze the reform of criminal provisions in the Job Creation Law concerning labor. The amendments, which eliminate and modify criminal provisions, raise concerns about the potential erosion of legal enforcement regarding labor rights violations. This research employs a normative legal approach, focusing on conceptual frameworks and legislative regulations. Data were collected through literature review from primary legal sources, including relevant labor laws, and secondary sources such as legal books and journals. The findings indicate that while the reform of criminal provisions has positive impacts, it also presents negative consequences due to the regulation of these provisions outside the labor law framework. This duality underscores the need for careful consideration in balancing legal protections for workers with the objectives of efficient law enforcement in the evolving labor landscape.
