Abstract

Humans must go through life events, including babies, children, teenagers, adults, the elderly and death. Death itself is a process that is greatly feared by humans. However, in the development of technology and science in the medical world, death does not come suddenly, death itself can occur with a plan, this action, namely killing in a predictable place and time, is called euthanasia, which is a killing process that is still controversial today. and has not been resolved properly by several parties. The aim of this research is: 1) To identify regulations for implementing euthanasia from a human rights perspective. 2). To identify the application of euthanasia in positive law in Indonesia. This research methodology uses normative juridical which includes primary, secondary and tertiary legal materials. The results of the research state that euthanasia regulations from a human rights perspective in Indonesian society believe that euthanasia is a practice that ignores a person's right to life and is not permitted, but the implementation of euthanasia already exists, which is called passive euthanasia, one of which is the act of doctors sending their patients home on the grounds that there is no treatment or desire. to recover still deserves to be punished if Indonesian law still prohibits euthanasia. However, this behavior does not violate the law, and often occurs in our society

Abstract

Covid-19 rocked Indonesia in early 2020. In the course of time, Covid-19 has spread to 34 provinces in Indonesia. The member of these cases is increasing every day. Cries of confusion from the people sounded fromall directions. In dealing with this, the Government of Indonesia issued a program that cannot be separated from the pro and con attitudes of the community, namely the vaccination program. Behind this program it turns out that it also gave birth to several “rogue” parties who became the issues of the Covid-19 Vaccine Certificates without going through the vaccination proces either in the form of letters of electronic documents. Some experts have dismissed the issue of this. Things like this are the Government’s homeworks to be throughly investigated and no longer appear in the community.

Abstract

The crime of detention can be resolved using the principles of Restorative Justice. Looking at the discussions above, it is clear that according to the legal rules restorative justice can be applied in criminal acts of detention as in Article 480 and Article 482 of the Criminal Code.

Abstract

This research aims to uncover the basis of judges' considerations in deciding divorce cases due to physical disability or illness in one of the married couples and to understand the classification of physical disability or illness according to Law No. 1 of 1974 and Islamic law. The research method used is juridical-normative. The research findings indicate that in deciding divorce cases related to physical disability or illness, specifically in cases numbered 115/PDT.G/2005/PA.SMN and 209/PDT.G/2005/PA.SMN, the panel of judges at the Religious Court of Sumenep has followed the procedures stipulated in Articles 65 to 91 of Law No. 7 of 1989 and considered the provisions of Marriage Law and applicable regulations in Indonesia. The decisions are also supported by evidence presented by the litigants, in accordance with both Positive Law and Islamic Law. Moreover, the emphasis on applying Article 19 letter (e) of Government Regulation No. 9 of 1975 and Islamic Law is not solely on the criteria of physical disability or illness but is more focused on the inability to fulfill the obligations as a husband or wife. Therefore, divorce decisions must be supported by facts demonstrating the spouse's actual incapacity to fulfill their marital obligations. This is crucial to prevent the Judiciary from granting divorce too easily, in accordance with the principle stated in Article 39 of Law No. 1 of 1974, which aims to make divorce more challenging to obtain. Additionally, the saying of the Prophet Muhammad is mentioned, emphasizing that although divorce is permissible, it is highly disliked by Allah SWT.

Abstract

The aim of this legal research is to discuss the application of the omnibus law method in structuring regional regulations regarding levies. The research technique used in this exploration is a normative research method using primary legal materials, secondary legal materials and tertiary legal materials. research resulted that the application of the omnibus law method to taxes and levies includes East Java Province Regional Regulation Number 9 of 2011 concerning Regional Levy which revokes several levy provisions from other regional regulations, and Sleman Regency Regional Regulation Number 13 of 2007 which amends several regional regulations become a regional regulation. The implementation of the omnibus law in the Sleman Regency Regional Regulations regarding levies has become a legal umbrella for efforts to manage budgets and resources effectively and efficiently. Although there are still several challenges and criticisms regarding the regulation of levy rates, in general the use of the omnibus law method is recognized as an effective tool in drafting regional regulations. Abstract

Latar belakang: Pembimbing Kemasyarakatan (PK) memiliki peran strategis dalam proses rehabilitasi dan reintegrasi klien pemasyarakatan ke dalam masyarakat. Mereka tidak hanya bertindak sebagai pengawas, tetapi juga sebagai pembimbing yang memberikan dukungan emosional dan sumber daya bagi klien agar dapat memperbaiki perilaku dan menyesuaikan diri setelah pembebasan. Namun, meskipun telah dilakukan pembimbingan, masih ditemukan kasus residivisme di Balai Pemasyarakatan (Bapas) Klas II Pamekasan. Hal ini menimbulkan pertanyaan mengenai efektivitas peran PK dalam menurunkan angka pengulangan tindak pidana. Metode penelitian: Penelitian ini menggunakan metode kualitatif dengan pendekatan sosiologi hukum. Pendekatan ini bertujuan untuk menganalisis bagaimana norma hukum berinteraksi dengan masyarakat, khususnya dalam konteks pembimbingan dan pengawasan klien pemasyarakatan di Bapas Klas II Pamekasan. Hasil penelitian: Hasil penelitian menunjukkan bahwa PK memiliki peran penting dalam menurunkan angka residivisme melalui pembimbingan dan pengawasan. Beberapa upaya yang dilakukan antara lain pendampingan secara berkelanjutan, pemberian penyuluhan hukum, serta fasilitasi akses terhadap pelatihan keterampilan. Meskipun demikian, efektivitas peran PK masih menghadapi beberapa kendala, seperti keterbatasan sumber daya, kurangnya kesadaran hukum klien, serta dukungan masyarakat yang belum optimal. Kesimpulan: Secara umum, peran PK dalam pembinaan klien pemasyarakatan di Bapas Klas II Pamekasan cukup baik, tetapi belum sepenuhnya efektif dalam menekan angka residivisme. Masih diperlukan penguatan dalam aspek pembimbingan, peningkatan koordinasi dengan pihak terkait, serta pendekatan yang lebih komprehensif agar klien lebih sadar akan kepatuhan hukum dan dapat beradaptasi dengan baik di masyarakat.

Abstract

Refugees are individuals or more who are forced to leave their home country due to circumstances that may lead to torture and so on. Indonesia did not participate in ratifying the 1951 convention and the 1967 Protocol. The Indonesian government cooperates with international institutions and international organizations UNHCR (United Nations High Commissioner for Refugees) is a global organization under the United Nations High Commissioner for Refugees, with its headquarters located in Geneva, Switzerland. On December 14, 1950, this organization was established with the aim of protecting and assisting refugees at the request of the government or the UN, and then assisting the refugees in the process of relocating to a new location.

Abstract

In Indonesia, the government has made facilities easier for pedestrians by installing sidewalks. Sidewalks are pedestrian facilities that are parallel to car traffic lanes but are elevated above the surface of the sidewalk due to the layer on the road. The aims of this research are: 1) To determine the legal protection of pedestrians' rights against misuse of sidewalks. 2) To determine the application of sanctions to misuse of sidewalk functions. This research methodology uses normative juridical which includes primary, secondary and tertiary legal materials. The results of the research show that The sidewalk is the right of road users. This is regulated in Article 131 paragraph (1) UULAJ. and there are rules for the use of sidewalks and road user facilities that must be taken into account include Zebra crossings, pedestrian bridges, tunnel crossings and Pelican crossings. Sanctions that can be imposed for misuse of sidewalks are regulated in article 274 paragraph (2) and article 275 paragraph (1 ) UULAJ.

Abstract

This study discusses the legal reconstruction of the authority of the Ombudsman of the Republic of Indonesia (ORI) after the Constitutional Court (MK) Decision Number 62/PUU-VIII/2010, with a focus on advocacy based on pseudo/quasi principles. The Ombudsman, as an independent state institution, plays a role in supervising the implementation of public services to prevent and deal with maladministration. However, the existence of Article 43 of Law Number 37 of 2008 concerning the Ombudsman and the Constitutional Court's decision creates the potential for norm inharmonization that has an impact on the implementation of the Ombudsman's duties. This study analyzes two main things: legal certainty on the authority of the Ombudsman after the Constitutional Court's decision and legal reconstruction to strengthen the supervisory function of public services. The results show that the pseudo/quasi principle allows the Ombudsman to carry out an advocacy function similar to the judiciary, but without full executive power such as the judiciary. Legal certainty is needed to ensure that the Ombudsman's actions remain within the limits of the authority regulated by law. Legal reconstruction is suggested to provide stronger legitimacy to the Ombudsman's authority, including strengthening the recommendation aspect to be more binding and implementive. This reconstruction also includes increasing institutional capacity, coordination between agencies, and strengthening regulations that support supervisory functions that are more responsive to the needs of the community. Thus, this research contributes to the development of public service law, especially related to the role of the Ombudsman in realizing transparent, accountable, and fair services.
