Abstract

The Village Funds are utilized to finance the administration of government, development, community empowerment, and societal activities, with the primary focus during this pandemic being on financing community development, empowerment, and Covid-19 response for rural areas. This practice is regulated by the Indonesian Minister of Finance Regulation Number 222/PMK.07/2020 and implemented with the principles of Good Governance. The research employs a juridical-normative research method to examine two legal issues: whether the reallocation of Village Funds (DD) for Covid-19 response complies with Good Governance principles, and the legal implications of relocating Village Funds (DD) for Covid-19 response if not in line with Good Governance principles. The research aims to analyze the compliance of the Village Funds' reallocation for Covid-19 response with Good Governance principles and evaluate the legal consequences if not adhered to. The findings indicate that the reallocation of Village Funds (DD) for Covid-19 response aligns with Good Governance principles. The usage of these funds for Covid-19 handling is regulated by Permendes No. 11/2019 concerning the Utilization of Village Funds 2020, along with various other regulations, including Perppu No. 1 of 2020, Perpres No. 54 of 2020, and PMK No. 40/PMK.07/2020. However, if the reallocation of Village Funds (DD) does not adhere to Good Governance principles, it may lead to serious legal consequences. In accordance with Permendagri No. 113 of 2014 concerning village financial management, misuse of Village Funds during the Covid-19 pandemic is prohibited and may result in administrative sanctions, such as verbal or written warnings, or even dismissal, in accordance with Law No. 31 of 1999.

Abstract

Authentic agreements are executed in the presence of a notary, what if the agreement is executed by a person with a disability who is illiterate, the provisions of Article 1320 of the civil law book contain requirements for agreement skills, in addition to the provisions of Article 9 of law number 8 of 2016 explaining that persons with disabilities have the right for equal treatment before the law. This research is normative by using a statutory approach, a conceptual approach, and an analytical approach. Persons with disabilities who are illiterate can carry out authentic agreements themselves in accordance with Article 9 of the disability law. If this is not possible, then: first, ask for help from a notary, second, give power of attorney to someone who is capable and third; ask for pardon from the district court for family assistance. As for legal remedies that can be implemented, namely by Negotiation and filing civil and criminal lawsuits. Keywords: Illiterate; Agreement; Authentic.

Abstract

Regulations regarding interfaith marriage and registration in Indonesia have developed dynamically over time. It was found that there were court decisions rejecting interfaith marriages and their registration, but it was also found that there were court decisions granting permission. This is considered to cause legal uncertainty, because inter-religious marriages still continue to occur, while Law Number 1 of 1974 concerning Marriage and its amendments do not yet strictly and clearly regulate inter-religious marriages. This research focuses on examining the meaning of interfaith marriage and its registration over time in Indonesia as well as the direction of legal reconstruction in the future. This research is normative legal research that uses a statutory approach, a historical approach and a case approach. The legal hermeneutics research method is used to analyze the collected legal material. The research results found that the meaning of interfaith marriage and its registration experienced dynamics in its historical development in Indonesia from time to time, giving rise to legal uncertainty. Interfaith marriages and their registration can be given legal certainty by using a Court Decision or carried out abroad (in a country that permits interfaith marriages) and then reporting the registration administratively to the Civil Registry Office or Dukcapil Office to obtain legal certainty based on the provisions of the Marriage Law, Regulations Government Number 9 of 1975 concerning Implementation of UUP, and Law Number 23 of 2006 concerning Population Administration, as amended by Law Number 24 of 2013

Abstract

This article examines black campaigning on social media during the general election and its legal liability. Using legislative and conceptual approaches, normative legal research is done. Primary, secondary, and tertiary legal materials are used. Legal materials are analysed descriptive-qualitatively. Black political campaigns routinely abuse social media to attain their goals. The Law on General Elections and the General Election Commission Regulation on General Election Campaigns in Indonesia govern social media use in campaigns to combat this. The Law on General Elections and the Law on Information and Electronic Transactions penalise social media black campaigning with fines and jail time. Such actions are election crimes and cybercrimes since they involve technology

Abstract

This study analyzes Law Number 8 of 1999 concerning Consumer Protection related to dispute resolution methods and responsibilities that can be carried out by illegal online investment business actors. This normative research was conducted using a legislative approach, a conceptual approach, and a historical/historical approach. Settlement of illegal online investment disputes can be carried out using consumer protection mechanisms as regulated in Law Number 8 of 1999. In this case, investors are positioned as consumers who have the right to security and clarity of information. Victims can take criminal legal action by reporting to the police, or through non-litigation channels such as mediation at BPSK. However, settlement is often hampered because the perpetrators use fake identities and do not have official permission from the OJK. Therefore, synergy between consumer protection, criminal law enforcement, and supervision of financial institutions is very important to ensure justice for victims of illegal investment. The perpetrator's responsibility can be imposed through: Civil: replacing losses based on Article 1365 of the Criminal Code, Criminal: charged with fraud (Article 378 of the Criminal Code) and the ITE Law, Restitutive: returning the victim's assets through confiscation and auction mechanisms according to the TPPU Law

Abstract

Perkembangan teknologi dan informasi membawa berbagai macam dampak terhadap seluruh aspek kehidupan masyarakat di seluruh dunia. Perkembangan ini tidak hanya memberikan good impact bahkan juga memberikan adverse effects. Apapun yang diinginkan, melalui teknologi dan informasi ini akan menjadikan lebih mudah dan membantu aktivitas dan kegiatan manusia. Aktivitas manusia yang awalnya dilakukan secara konvensional, saat ini berubah menjadi cara-cara non konvensional. Salah satunya adalah dalam menyampaikan berkomunikasi dengan orang lain yang dilakukan dengan cara menyampaikan pendapat. Dengan teknologi informasi yang berkembang saat ini, maka akan memudahkan orang untuk dapat mengetahui ataupun berkomunikasi dalam jarak jauh pada berbagai belahan bumi secara seketika dalam hitungan detik sekalipun. Sarana yang dapat digunakan mulai dari radio, televisi, telepon, telepon genggam, telegram, faximile, dan yang terakhir internet. Penyampaian pendapat melalui teknologi informasi yang semakin pesat dan sangat canggih ini, telah berfusi menjadi gaya hidup ( lifestyle ) bagi masyarakat diseluruh dunia tidak terkecuali di Indonesia.Hal ini merupakan imbas perkembangan teknologi informasi di era globalisasi ini.Metode penelitian yang digunakan adalah penelitian hukum normative (normative law research). Hasil yang diperoleh berdasarkan penelitian yaitu  konsekuensi yuridis tindak pidana pada pelaku ujaran kebencian (hate speech) melalui media sosial. Kehadiran teknologi informasi   yang demikian canggih telah memberikan berbagai nuansa yang baru serta menyentuh berbagai aspek kehidupan dan memberikan dampak   positif yang relatif besar.

Abstract

This research is normative legal research that uses a normative judicial approach. The research results show that: (1) There are differences of opinion between judges, e-commers and notaries. regarding the strength of proof of a signature on an electronic document in proving civil procedural law in Indonesia. Judges and e-commers are of the opinion that electronic documents that have been signed with an electronic signature have the same evidentiary power as authentic deeds made by authorized officials, after the issuance of Law Number 11 of 2008 concerning Electronic Information and Transactions. Meanwhile, the notary is of the opinion that an electronic document signed with an electronic signature only has the power of proof under the hand, because it does not meet the requirements as an authentic deed, that is, it does not appear before an authorized official; and (2) Settlement of disputes resulting from non-fulfillment of the agreement can be resolved using a court or an institution outside the court, but e-comers generally use institutions outside the court because it is considered easier and faster to resolve and the costs are cheaper.The use of an electronic signature on an electronic document can guarantee the security of an electronic information message, which uses a public network, because electronic signatures are created based on asymmetric cryptography technology. From this research, there are differences of opinion regarding the evidentiary power of electronic documents signed with electronic signatures that are used as evidence in trials. Abstract

Hubungan perkawinan dapat menimbulkan akibat hukum. Terdapat juga perkawinan beda agama yang menjadi perbincangan mengenai keabsahan perkawinan serta terhadap hak waris anak yang berbasis Hak Asasi Manusia. Apabila salah satu pasangan meninggal menjadi pewaris yang akan di wariskan kepada ahli waris. Waris berupa harta kekayaan yang dimiliki oleh pewaris dilakukan peralihan harta kekayaan tersebut dilakukan secara adil berbasis pada Hak Asasi Manusia. Berdasarkan pada hal tersebut mengenai waris anak hasil perkawinan beda agama penulis merumuskan beberapa permasalahan sebagai berikut : 1. Bagaimana hak waris anak hasil perkawinan beda agama berbasis Hak Asasi Manusia ? 2. Bagaimana penyelesaian waris anak hasil pernkawinan beda agama berbasis Hak Asasi Manusia. Adapun mengenai metode penelitian yang dugunakan penulis adalah jenis penelitian normatif, dilakukan dengan dua pendekatan yaitu pendekatan perundang-undangan serta norma hukum dan juga melalui pendekatan konseptual mengenai waris anak hasil dari perkawinan beda agama. Hasil dari penelitian penulis ditemukan bahwa, waris terhadap anak hasil perkawinan beda agama harus mendapatkan hak yang adil dan sesuai ketentuan dengan tidak adanya diskriminasi terhadap hak anak tersebut serta ada beberapa hal untuk penyelesaian mengenai waris anak dari perkawinan beda agama yang dimana penulis dalam menulis berbasiskan Hak Asasi Manusia. Hak waris anak hasil perkawinan beda agama diberikan secara adil sesuai ketentuan yang berlaku dan penyelesaian waris anak hasil perkawinan beda agama menurut komplikasi hukum islam dapat dilakukan dengan cara wasiat wajibah
