Abstract

Authentic agreements are executed in the presence of a notary, what if the agreement is executed by a person with a disability who is illiterate, the provisions of Article 1320 of the civil law book contain requirements for agreement skills, in addition to the provisions of Article 9 of law number 8 of 2016 explaining that persons with disabilities have the right for equal treatment before the law. This research is normative by using a statutory approach, a conceptual approach, and an analytical approach. Persons with disabilities who are illiterate can carry out authentic agreements themselves in accordance with Article 9 of the disability law. If this is not possible, then: first, ask for help from a notary, second, give power of attorney to someone who is capable and third; ask for pardon from the district court for family assistance. As for legal remedies that can be implemented, namely by Negotiation and filing civil and criminal lawsuits. Keywords: Illiterate; Agreement; Authentic.

Abstract

Perkembangan teknologi dan informasi membawa berbagai macam dampak terhadap seluruh aspek kehidupan masyarakat di seluruh dunia. Perkembangan ini tidak hanya memberikan good impact bahkan juga memberikan adverse effects. Apapun yang diinginkan, melalui teknologi dan informasi ini akan menjadikan lebih mudah dan membantu aktivitas dan kegiatan manusia. Aktivitas manusia yang awalnya dilakukan secara konvensional, saat ini berubah menjadi cara-cara non konvensional. Salah satunya adalah dalam menyampaikan berkomunikasi dengan orang lain yang dilakukan dengan cara menyampaikan pendapat. Dengan teknologi informasi yang berkembang saat ini, maka akan memudahkan orang untuk dapat mengetahui ataupun berkomunikasi dalam jarak jauh pada berbagai belahan bumi secara seketika dalam hitungan detik sekalipun. Sarana yang dapat digunakan mulai dari radio, televisi, telepon, telepon genggam, telegram, faximile, dan yang terakhir internet. Penyampaian pendapat melalui teknologi informasi yang semakin pesat dan sangat canggih ini, telah berfusi menjadi gaya hidup ( lifestyle ) bagi masyarakat diseluruh dunia tidak terkecuali di Indonesia.Hal ini merupakan imbas perkembangan teknologi informasi di era globalisasi ini.Metode penelitian yang digunakan adalah penelitian hukum normative (normative law research). Hasil yang diperoleh berdasarkan penelitian yaitu  konsekuensi yuridis tindak pidana pada pelaku ujaran kebencian (hate speech) melalui media sosial. Kehadiran teknologi informasi   yang demikian canggih telah memberikan berbagai nuansa yang baru serta menyentuh berbagai aspek kehidupan dan memberikan dampak   positif yang relatif besar.

Abstract

This research is normative legal research that uses a normative judicial approach. The research results show that: (1) There are differences of opinion between judges, e-commers and notaries. regarding the strength of proof of a signature on an electronic document in proving civil procedural law in Indonesia. Judges and e-commers are of the opinion that electronic documents that have been signed with an electronic signature have the same evidentiary power as authentic deeds made by authorized officials, after the issuance of Law Number 11 of 2008 concerning Electronic Information and Transactions. Meanwhile, the notary is of the opinion that an electronic document signed with an electronic signature only has the power of proof under the hand, because it does not meet the requirements as an authentic deed, that is, it does not appear before an authorized official; and (2) Settlement of disputes resulting from non-fulfillment of the agreement can be resolved using a court or an institution outside the court, but e-comers generally use institutions outside the court because it is considered easier and faster to resolve and the costs are cheaper.The use of an electronic signature on an electronic document can guarantee the security of an electronic information message, which uses a public network, because electronic signatures are created based on asymmetric cryptography technology. From this research, there are differences of opinion regarding the evidentiary power of electronic documents signed with electronic signatures that are used as evidence in trials. Abstract

Hubungan perkawinan dapat menimbulkan akibat hukum. Terdapat juga perkawinan beda agama yang menjadi perbincangan mengenai keabsahan perkawinan serta terhadap hak waris anak yang berbasis Hak Asasi Manusia. Apabila salah satu pasangan meninggal menjadi pewaris yang akan di wariskan kepada ahli waris. Waris berupa harta kekayaan yang dimiliki oleh pewaris dilakukan peralihan harta kekayaan tersebut dilakukan secara adil berbasis pada Hak Asasi Manusia. Berdasarkan pada hal tersebut mengenai waris anak hasil perkawinan beda agama penulis merumuskan beberapa permasalahan sebagai berikut : 1. Bagaimana hak waris anak hasil perkawinan beda agama berbasis Hak Asasi Manusia ? 2. Bagaimana penyelesaian waris anak hasil pernkawinan beda agama berbasis Hak Asasi Manusia. Adapun mengenai metode penelitian yang dugunakan penulis adalah jenis penelitian normatif, dilakukan dengan dua pendekatan yaitu pendekatan perundang-undangan serta norma hukum dan juga melalui pendekatan konseptual mengenai waris anak hasil dari perkawinan beda agama. Hasil dari penelitian penulis ditemukan bahwa, waris terhadap anak hasil perkawinan beda agama harus mendapatkan hak yang adil dan sesuai ketentuan dengan tidak adanya diskriminasi terhadap hak anak tersebut serta ada beberapa hal untuk penyelesaian mengenai waris anak dari perkawinan beda agama yang dimana penulis dalam menulis berbasiskan Hak Asasi Manusia. Hak waris anak hasil perkawinan beda agama diberikan secara adil sesuai ketentuan yang berlaku dan penyelesaian waris anak hasil perkawinan beda agama menurut komplikasi hukum islam dapat dilakukan dengan cara wasiat wajibah

Abstract

Humans must go through life events, including babies, children, teenagers, adults, the elderly and death. Death itself is a process that is greatly feared by humans. However, in the development of technology and science in the medical world, death does not come suddenly, death itself can occur with a plan, this action, namely killing in a predictable place and time, is called euthanasia, which is a killing process that is still controversial today. and has not been resolved properly by several parties. The aim of this research is: 1) To identify regulations for implementing euthanasia from a human rights perspective. 2). To identify the application of euthanasia in positive law in Indonesia. This research methodology uses normative juridical which includes primary, secondary and tertiary legal materials. The results of the research state that euthanasia regulations from a human rights perspective in Indonesian society believe that euthanasia is a practice that ignores a person's right to life and is not permitted, but the implementation of euthanasia already exists, which is called passive euthanasia, one of which is the act of doctors sending their patients home on the grounds that there is no treatment or desire. to recover still deserves to be punished if Indonesian law still prohibits euthanasia.
