Abstract

The means of law harmonization is a very popular topic discussed by law scholars and business practitioners. The means of law harmonization through the substantive rules of the law of international trading is regarded efficient to prevent conflicts among systems of law which are subscribed by each country. The main goal of law harmonization is to look for homogeneity from fundamental principles through all of systems of law available (which will be harmonized). CISG in arranging the contract is viewed from the principle of consensus so that the absence of the things will not affect the validity of the contract. CISG does not arrange the relationship of law between the validity of a covenant and its implications. The contract of selling and buying in CISG, instead of requiring an agreement between two sides, requires real actions. The things being sold and bought must be free of rights and demand of the third side, expect the buyer who agrees to receive the things and complies to the rights and demands.

Abstract

This research departs from the development of religious tourism in Banjar Regency which has its own charm and is often visited by local, national and international tourists is the Tomb of Sheikh Muhammad Arysad Al-Banjari or known for his book essay, namely Sabilal Muhtadin and the Tomb of Guru Sekumpul who is a charismatic cleric his era so that the purpose of this study is to analyze the multiplier effecet of religious tourism on the income of the people in the Regency Banjar. The research method used is a quantitative approach, then sampling using cluster sampling and quota sampling. In relation to the quota sampling technique, a sample of 40 respondents consisting of business actors, workers and the community was determined, while the sampling cluster was at Datu Kalampayan Tomb and Guru Sekumpul Cemetery. Data collection techniques using structured interviews and analyzed using descriptive statistics by adopting a formula from the multiplier effect known as Keynes' theory. The results showed that the value of Keynesian Local Income Multiplier, Ratio Income Multiplier has a value of 1 both Type I and II so that it has an impact on the economic development of the community.

Abstract

The purpose of this study is to analyze the potential of halal tourism for the regional economy and its impact on community income in South Kalimantan. This study employs a combination of qualitative and quantitative approaches. The sampling technique employed was cluster sampling in three districts/cities, with a sample size of 100 respondents determined through quota sampling. The data collection technique used was structured interviews, followed by triangulation to validate the interview results. Data analysis was conducted using the Miles and Huberman approach to identify the potential for halal tourism, while quantitative analysis employed the multiplier effect approach to measure the economic impact. The study's results demonstrate the potential of halal tourism in South Kalimantan, highlighting its appeal through river destinations, floating markets, religious sites, natural attractions, marine activities, culture, and cuisine. The Keynesian Local Income Multiplier value is 1.09. Meanwhile, the Type I Income Multiplier Ratio is 3.63 and Type II is 4.15, indicating a significant increase in the income of business owners, workers, and local consumption. This study contributes to the Islamic economic literature by providing halal tourism development that not only supports regional economic growth but also aligns with Sharia principles to create mutual benefits.

Abstract

Alternative crowdfunding has emerged as a vital financing solution for Small and Medium Enterprises (SMEs) in Indonesia, offering funding opportunities beyond traditional financial institutions and fostering economic growth. However, the Indonesian government must address risks such as fraud, personal data misuse, and investor losses by ensuring strong legal protection and regulatory oversight. This study examines the legal framework for equity-based crowdfunding and SME empowerment in Indonesia, drawing comparative insights from Austria’s well-established regulations. The novelty of this research lies in its comparative approach, which highlights regulatory asymmetries affecting investor confidence and SME access to funding. The urgency is underscored by Indonesia’s rapidly expanding digital finance sector, where weak governance could undermine crowdfunding’s potential. This normative legal study employs a descriptive-analytic approach, integrating legislative and conceptual perspectives from both jurisdictions. Findings indicate that Austria enforces investment limits, stringent platform accountability, and robust law enforcement, ensuring market stability while supporting SMEs. Conversely, Indonesia should ease SME access to crowdfunding while implementing investment caps to mitigate investor risks. Moreover, Austria’s strong judicial oversight and auditing mechanisms serve as a model for Indonesia, which requires enhanced regulatory enforcement and institutional capacity. This study contributes to legal scholarship by proposing a balanced regulatory model that fosters SME participation while ensuring investor protection, transparency, and sustainable market growth. By adopting best practices from Austria and Europe, Indonesia can refine its crowdfunding regulations to drive economic development while maintaining a secure financial ecosystem.

Abstract

This research is motivated by the release of Presidential Regulation No. 16 of 2018 concerning the Procurement of Goods/Services, which has three important stages: preparation, selection, and implementation. The issuance of this presidential rule aims to enhance the utilization of products from local Micro, Small, and Medium Enterprises (MSMEs). In the age of digitization, the Indonesian government has developed an electronic-based system known as e-procurement for the acquisition of products and services. This enhances the efficiency, effectiveness, competitiveness, transparency, fairness, accountability, and integrity of the procurement process, while also ensuring it is free from corrupt practices. This study aims to examine the e-procurement system in Indonesia through the lens of the fiqh principle of saddu al-dhariah, with the goal of mitigating corrupt practices in the procurement of products and services. The main data in this study revolves around Presidential Regulation No. 16 of 2018. Secondary data is derived from multiple sources including case studies on the procurement of goods and services, as well as publications and reports published by the Government Goods/Services Procurement Policy Institute (LKPP). The study findings suggest that e-procurement adheres to the principle of saddu al-dhariah by effectively mitigating state losses and enhancing government operational efficiency. The general public reaps advantages from this approach as it leads to a surge in the sales of domestic MSME products. Nevertheless, LKPP must persist in monitoring this mechanism to prevent any discussions conducted by parties with personal or collective interests.

Abstract

Productive Zakat or known as an Islamic philanthropic instrument that is capable of empowering and improving community welfare, such as through the Z-Mart Program by National Amil Zakat Agency (BAZNAS). However, the implications of the Z-Mart Program for Mustahik's welfare remain unknown. This study aims to reveal the implications of the Z-Mart Program in Barito Kuala Regency on mustahik welfare. Using field research method with qualitative approach. Data collection techniques include interviews, observations, and documentation. The data analysis technique uses descriptive analysis consisting of data reduction, presentation, and conclusion. This study finds that empowerment through the Z-Mart Program has a positive impact on the increase of business scale, income, skills, and welfare of mustahik. Based on these findings, it is recommended that BAZNAS continue and optimize mustahik empowerment through the Z-Mart Program.
