Abstract

Abstrak, Penelitian ini dilatarbelakangi oleh adanya praktik sanda gawian yang dilakukan oleh pekerja penimbang karet di PT Darma Kalimantan Jaya dimana di dalam praktik tersebut terdapat perbedaan dengan teori yang telah ada.Penelitian ini bertujuan mengetahui gambaran praktik sanda gawian dan faktor yang melatarbelakangi sanda gawian di kalangan pekerja penimbang karet di PT Darma Kalimantan Jaya.Jenis penelitian ini adalah penelitian lapangan dengan tujuan hukum empiris yaitu mencakup penelitian terhadap penerapan hukum di masyarakat mengenai permasalahan praktik sanda gawian dikalangan pekerja penimbang karet. Teknik pengumpulan data: wawancara, observasi dan studi dokumentasi.Hasil penelitian ini menunjukkan bahwa pekerjaan boleh dijadikan objek gadai berdasarkan pendapat Imam Malik yaitu sesuatu yang wujudnya belum bisa dipastikan boleh digadaikan. Analisis Kasus I, II, III, dan IVhukumnya boleh karena termasuk ‘ūrf shahih yang berdasarkan pendapat Imam Hanafi bahwa pemanfaatan al-marhūn diperbolehkan asalkan ada izin dari penggadai dan penerima gadai, serta terdapat kemaslahatan dan menghilangkan kemudharatan di dalamnya. Kasus V, hukumnya haram karena terdapat pengambilan harta orang lain secara bathil, membawa lari uang ar-rāhin, penipuan dan melakukan kezaliman. Faktor yang melatarbelakangi pekerja penimbang karet melakukan sanda gawian adalah karena keperluan hidup yang mendesak seperti, membayar utang, modal usaha, merawat perkebunan, biaya anak sekolah. Adapun signifikansi dari penelitian ini bagi masyarakat yang menjalankan praktik sanda gawian yaitu, memperkuat praktik sanda gawian  yang sudah menjadi kebiasaan dan banyak mendatangkan kemaslahatan.

Abstract

Multatuli Museum has been established for several years and is visited by many tourists. However, in practice the Multatuli Museum often lacks museum guides when there is an increase in visits, so that visitors who are not accompanied by a tour guide do not get complete information. In addition, the lack of interest of the younger generation in visiting museum attractions so that by applying Augmented Reality technology to the Multatuli Museum is expected to attract visitors, especially the younger generation. Augmented Reality (AR) is a technology that is able to insert 3D and 2D objects into a real environment in real-time to display a Virtual Guide at the Multatuli Museum. The author creates an animation in the form of a virtual guide for the Multatuli Museum using Blender software to create 3D animations and using Unity software to build the application as well as the Vuforia extension for Unity with C# programming language. The author uses the prototyping method as the application development method and uses the Unified Modeling Language (UML) as the system design. This research produces an Augmented Reality Application that can be used on Android smartphones. This application is capable of displaying 3D animations that provide information about the showrooms in the Multatuli Museum. Based on black box testing all features in the application are 100% running well. with this application visitors feel helped when the tour guide is limited and feel happy because there is still a Virtual tour guide who helps in the museum.

Abstract

This research is motivated by the many violationscommitted by electricity service users or electricity customerswhich are often referred to as unlawful use of electric current.Consumers who object if their rights are not fulfilled submit alawsuit to BPSK (Consumer Dispute Resolution Agency).Consumers always have their complaints rejected regardingviolations of P2TL (Issuance of Electrical Inspections) because PLNalways makes excuses and takes refuge in PT Directors'Regulations. PLN and as long as the resolution method chosen ismediation, which is essentially an agreement between the parties,the BPSK panel cannot impose sanctions on PLN or grant consumercomplaints. Consumer protection is any effort that ensures legalcertainty to provide protection to consumers. There are 8 (Eight)cases related to consumer and PT problems. PLN (Persero) BPSKBanjarmasin City, one of the authors took a case regardingconsumer problems and PT. BPSK PLN (Persero) Case Number:18/PN BPSK.BJM/VIII/2022. This research aims to find out howthe dispute resolution process works and how legal protection is forconsumers in resolving disputes between consumers and PT. PLN(Persero) at BPSK Banjarmasin City. This type of research usesempirical law and uses a case study approach. The data obtainedwas collected using interview and documentation techniques. Thecollected data was then processed and analyzed using qualitativedescriptive methods. Based on the results of this research, in theprocess of resolving BPSK case Number: 18/PNBPSK.BJM/VIII/2022, the parties agreed to choose disputeresolution through mediation. According to the author's analysis,the resolution of mediation according to BPSK and according toIslam based on explanations is in harmony in its resolution. bothuse a peace agreement between the parties without forcing orpressuring the parties. According to the author's analysis, theprotection carried out by BPSK has implemented the theory of legalprotection as appropriate for consumers, starting from their rightsin receiving complaints to determining the results of disputeresolution.

Abstract

This research aims to analyze the relationship between business actors and consumers in electronic transactions according to a review of electronic transaction law in Indonesia. This research uses normative legal research methods with a doctrinal type of research. Primary data is obtained from primary legal materials such as laws, government regulations, and court decisions. Meanwhile, secondary data is obtained from secondary legal materials such as books, scientific journals and legal articles. The data analysis technique used is qualitative analysis. The research results show that the relationship between business actors and consumers in electronic transactions is regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE), Law Number 8 of 1999 concerning Consumer Protection (UUPK), and statutory regulations. other related. Business actors have an obligation to provide correct and clear information about the products or services offered, as well as guarantee the security of electronic transactions. Consumers have the right to obtain correct and clear information about products or services, as well as the right to resolve disputes fairly.

Abstract

Penelitian ini menganalisis mekanisme pipikatan—proses mediasi adat Dayak Maanyan yang wajib ditempuh pasangan sebelum perceraian—serta dampaknya bagi ketahanan rumah tangga. Pendekatan hukum empiris dengan perspektif sosiologi hukum digunakan untuk memetakan tahapan mediasi, aktor adat yang terlibat, dan hasil akhir proses tersebut. Data dikumpulkan melalui observasi partisipatif, wawancara mendalam dengan wali/asbah, Damang, dan pasangan terlibat, serta telaah dokumen keputusan adat. Temuan utama menunjukkan bahwa pipikatan berlangsung bertingkat: dimulai di lingkup keluarga inti, dilanjutkan ke wali/asbah, dan berujung pada putusan Damang. Hasil mediasi berupa perdamaian—yang merevitalisasi relasi suami-istri—atau perceraian yang sah secara adat. Perceraian adat belum berkekuatan hukum negara, sehingga pasangan masih wajib mengajukan gugatan ke pengadilan agama untuk memperoleh legalitas formal. Kajian ini menegaskan peran strategis hukum adat sebagai mekanisme penyelesaian sengketa rumah tangga sekaligus menyoroti relasi dialektis antara norma adat dan sistem hukum nasional Indonesia.
