Abstract

This study discusses the existence of marriage guardians from the perspective of Islamic family law by comparing the regulations in force in Indonesia and Lebanon. These two countries, although both adhere to Islamic law as the basis for regulating marriage, have fundamental differences in placing the role and position of marriage guardians. In Indonesia, the existence of a guardian is an absolute requirement in the implementation of a marriage contract as regulated in the Compilation of Islamic Law (KHI), while in Lebanon, which has a plural legal system and is segmented based on sects, there are variations in the application of guardian requirements depending on the school of thought adopted. This study uses a normative legal approach with a comparative analysis method to examine the similarities and differences in the concept of marriage guardians in the two countries. The results of the study show that these differences are influenced by the social, political background, and diversity of schools of thought recognized in their respective legal systems. This study is expected to contribute to the development of discourse on the harmonization of Islamic family law in a pluralistic global context.

Abstract

Women's reproductive rights are an inseparable part of human rights, firmly guaranteed within Islamic teachings. This article aims to examine the normative foundations of women’s reproductive rights in Islam and to analyze the psychological consequences of neglecting these rights within marital life. This study employs a normative and descriptive-qualitative approach based on library research, drawing from classical and contemporary Islamic legal sources as well as relevant psychological literature. The findings show that Islam offers comprehensive protection for women's reproductive roles. Four fundamental rights are emphasized: the right to choose a life partner, the right to enjoy dignified and healthy sexual relations, the right to make conscious and responsible decisions regarding pregnancy, and the right to raise and care for children in a supportive environment. When these rights are denied—either by the spouse or societal structures—women become vulnerable to serious psychological pressures, including chronic stress, depression, loss of self-worth, and in many cases, divorce as a form of resistance against injustice. Promoting awareness and respect for women’s reproductive rights is essential as part of safeguarding the objectives of Islamic law (maqāṣid al-sharī‘ah), especially the protection of life (ḥifẓ al-nafs) and lineage (ḥifẓ al-nasl). This article recommends gender-based education and spiritual approaches to foster mentally healthy, just, and harmonious family life.

Abstract

Sebagaimana kehidupan di dalam keluarga akan ada perubahan dinamika sosial keluarga dalam masyarakat modern telah membuka ruang bagi perempuan, khususnya istri untuk mengambil peran sebagai kepala rumah tangga. Penelitian ini bertujuan 1) Untuk menganalisis peran istri sebagai kepala rumah tangga dalam perspektif sosiologi keluarga, dengan fokus pada faktor-faktor yang mendorong terjadinya perubahan peran, serta implikasi sosial dan kultural yang muncul. 2) Untuk memahami dan menganalisis tantangan yang dihadapi oleh istri yang berperan sebagai kepala rumah tangga. 3) Untuk memahami dan menganalisis dampak peran istri sebagai kepala rumah tangga terhadap kesejahteraan keluarga.Tesis ini merupakan penelitian kualitatif dengan menggunakan sumber data primer yang diperoleh dari beberapa informasi seperti istri yang menjalankan fungsi sebagai kepala rumah tangga ditinjau dari perspektif sosiologi keluarga Studi Kasus di Kelurahan Mayura Kecamatan Cakranegara Kota Mataram. Hasil penelitian menunjukkan bahwa 1) Peran istri sebagai kepala rumah tangga dalam perspektif sosiologi keluarga. tidak hanya terkait dengan aspek ekonomi, tetapi juga mencakup pengambilan keputusan, pengasuhan anak, dan norma dalam keluarga. Dalam perspektif sosiologi keluarga, masih menjadi hambatan yang signifikan. 2) Tantangan yang dihadapi oleh istri yang berperan sebagai kepala rumah tangga dihadapkan pada tekanan ekonomi yang berat. Sementara pada saat yang sama juga harus mengatur pengeluaran rumah tangga. 3) Dampak peran istri sebagai kepala rumah tangga terhadap kesejahteraan keluarga. Peran ini memperkuat ekonomi dan posisi perempuan dalam keluarga. Namun di sisi lain, terdapat tantangan serius dalam aspek psikologis, pengasuhan, dan kestabilan sosial-ekonomi.

Abstract

This paper examines the practice of intermarriage, between Indonesian Muslims and non-Indonesian converted Muslims living in Australia. Very little is known about this intermarriage phenomenon and its internal dynamics and patterns of social interaction. Building on Ibn Khaldun’s concept of asabiyyah (group solidarity) that intermarriage can be understood as an intimate link between social groups leading to social cohesion, the paper argues that intermarriage decreases the salience of cultural distinctions and couples and in-group members lose the negative attitudes they may have had toward the out-groups.  The research is an empirical study which was conducted through in-depth interviews with 12 married couples, focus group discussions, and observations and yields two key conclusions. First, varying levels of challenges specifically favourable, mildly demanding, moderately trying, and highly challenging establish family dynamics in which the dual-integrated approach to family resilience is enacted. Social circles strongly influence the religious commitment and faith of mixed marriage families, presenting the most problematic distinctions to address.  Second, the social cohesion they formed is diverse and strengthens across generations, which impacts  on the social and cultural identities of the future offspring who will end up with mixed or multi-ethnic origins. Thus, this article argues that the intermarried partners, although were from different social, cultural, and ethnic,  backgrounds,  demonstrably shared some common values and aspirations which acted as building-blocks for unity and contributed to in-group and out-group social cohesion.

Abstract

This article aims to draw on the lessons and experiences of female leaders for what approaches should be nurtured and adopted in breaking the ‘glass ceilings.’ This research examines pathways to female leadership and public acceptance of their roles. The article offers strategies for the next generation of emerging female leaders, drawing from narratives of five female leaders in five religiously affiliated universities in Indonesia and three in the United States. This article argues that an intense external discourse could expedite the internal institutional force of change for female university leaders. A collective solidarity among professional peers is pivotal for women to reach leadership positions, however the institutional force must be sustained with a conducive social and political support. The ‘stepping ladders’ illustrate how women’s tracking to the leadership roles and building up a path to advance the chances remained a critical challenge, as exercising an ultimate command under the shadow of patriarchal can complicate the question of who is the true leader? The research contributes to widen the vision of what female leadership in the universities have advanced, highlighting the external and internal influence that entrenched and nurtured such development. These influences should be adaptable and structured to response to the critical call to reach the quantity and quality of female leadership to advance authority and agency contexts.[Abstrak: Artikel ini bertujuan untuk mengambil pembelajaran dan pengalaman para pemimpin perempuan mengenai pendekatan apa yang harus dikembangkan dan diterapkan dalam mendobrak ‘langit-langit kaca’. Penelitian ini mengkaji jalur kepemimpinan perempuan dan penerimaan masyarakat terhadap peran mereka. Artikel ini menawarkan strategi untuk generasi pemimpin perempuan masa depan, yang diambil dari lima narasi pemimpin perempuan di lima universitas berafiliasi keagamaan di Indonesia dan tiga di Amerika Serikat. Artikel ini berargumentasi bahwa wacana eksternal yang intens dapat mempercepat perubahan kekuatan institusional internal bagi para pemimpin perempuan di universitas. Solidaritas kolektif di antara rekan-rekan profesional sangat penting bagi perempuan untuk mencapai posisi kepemimpinan. Kekuatan kelembagaan harus ditopang dengan dukungan sosial dan politik yang kondusif. ‘Tangga loncatan’ ini menggambarkan bagaimana upaya perempuan dalam mencapai peran kepemimpinan dan membangun jalur untuk meningkatkan peluang, masih menjadi tantangan, dimana menjalankan peran kepemimpinan tetapi berada di bawah bayang-bayang patriarki dapat mempersulit dalam menjawab pertanyaan tentang siapakah pemimpin yang sebenarnya? Penelitian ini berkontribusi untuk memperluas visi mengenai kemajuan yang dicapai oleh kepemimpinan perempuan di universitas, dengan menyoroti pengaruh eksternal dan internal yang memperkuat dan memupuk perkembangan tersebut. Pengaruh-pengaruh ini harus dapat disesuaikan dan lebih terstruktur demi menanggapi tuntutan penting untuk mencapai kepemimpinan perempuan baik secara jumlah dan kualitas guna memajukan konteks otoritas dan lembaga.]

Abstract

Marriage life will always experience changes and ups and downs. Reviewing early marriage from the perspective of Islamic family psychology provides important insights into the dynamics which occur. It helps identify challenges and opportunities to improve the welfare and success of marriage. The objectives of this research were to understand and analyse the dynamics of early marriage in terms of Islamic family psychology and to understand and analyse the efforts of early marriage actors in dealing with family problems. This thesis used qualitative research based on field research; it used primary data sources obtained from the perpetrators of early marriage, parents, officials at the Religious Affairs Office (KUA) and religious leaders in the sub-district of Bolo, Bima Regency and secondary data sources. The data were collected by doing observation, interview, and documentation. The results of this research showed that 1) The dynamics of early marriage in terms of Islamic Family Psychology that every couple would experience challenges and changes over time, the factors which influenced failure in dealing with the dynamics of early marriage were the couple's psychological factors, lack of understanding and communication, not understanding the roles and responsibilities, lack of family support, not being able to adjust in marriage. 2) The efforts of early marriage actors in dealing with family problems were a) there were problems, b) there was no communication to solve, and c) they silenced and ignored each other. While other couples tried to understand each other, communicated and the support of direction from parents.
