Abstract

Penelitian ini merupakan penelitian files research (penelitian lapangan), yang dilaksanakan di Dinas Sosial Kabupaten Waykanan Provinsi Lampung. Penelitian ini merupakan penelitian kualitatif dengan menggunakan teori mashlahah. Hasil penelitian ini menunjukan bahwa Pengangkatan anak di Dinas Sosial Kabupaten Way Kanan sesuai dengan prinsip-prinsip hukum Islam dengan mengutamakan kemaslahatan anak angkat tersebut dalam hal tumbuh kembangnya. Berpijak pada permasalahan maslahah ad-daruriyyah, disusunlah kategorinya dalam lima hal, yaitu menjaga kemaslahatan agama (ad-din), jiwa (an-nafs), keturunan (an-nasl), kekayaan (al-mal) dan intelektual (al-‘aql) yang semuanya terpenuhi. Untuk memenuhi kepentingan terbaik bagi anak tanpa memutus nasab asli antara anak dan orang tua kandung. Namun dalam proses penetapan pengadilan tidak sesuai dengan Undang-Undang Nomor 3 Tahun 2006 Pasal 49 Ayat 20 tentang kewenangan absolut Pengadilan Agama, dimana Dinas Sosial Kabupaten Way Kanan merekomendasikan untuk untuk mengajukan penetapan pengangkatan anak di Pengadilan Negeri walaupun anak angkat dan orang tua angkat beragama Islam. Apabila hal ini terus berlanjut dikhawatirkan akan berimplikasi pada penetapan tentang hak waris dan sebagainya yang tidak sesuai dengan hukum Islam.

Abstract

Di era kemajuan tekhnologi dan informasi banyak sekali manfaat yang bisa digunakan khususnya untuk berkomunikasi dengan sesame manusia baik dengan jarak dekat maupun jarak jauh hanya menggunakan satu alat komunikasi yang dinamakan handphone/telephone genggam yang didalam nya banyak fitur-fitur yang bisa digunakan untuk memudahkan aktivitas untuk mengakses dan menjelajahi dunia maya atau lebih sering dikenal jejaring media sosial , seperti Whatapps, Instagram, Facebook, Line, Telegram, dan aplikasi dating seperti Tinder, Michat, Nearby, Tantan, Bumble dan lain sebagainya, Kemudahan-kemudahan yang ditawarkan didalam nya sering kali memberikan dampak positif dan dampak negatif bagi pengguna nya, terlebih pada jejaring sosial media, yang terkadang membuat penggunanya berlebih-lebihan dalam mengekspresikan diri dan mencari perhatian didunia maya, Didalam kehidupan keluarga karena pengaruh kemajuan tehknologi dan informasi inilah pasangan suami istri lebih banyak berkomunikasi menggunakan handphone baik untuk jarak dekat maupun jarak jauh yang terkadang sering kali menimbulkan konflik kesalah pahaman dan lepas dari tanggung jawab sebagai suami dan istri, Islam tidak melarang secara mutlak akan adanya kemajuan tekhnologi dan informasi ini terlebih jika manfaat nya digunakan dengan baik dan positif dalam kehidupan sehari-hari, Jika dilihat pada era sekarang ini sudah banyak pengguna aplikasi dating sebagai alat untuk sekedar mencari teman maupun relasi tetapi seringkali disalah gunakan, seperti terjadinya pornografi, penipuan, pemerasan bahkan perselingkuhan. Penulis menggunakan metode penelitian kualitatif dengan menggunakan Teori Fenomenologi realistik oleh Max Scheler dan teori Saddud Al –Dzari’ah sebagai pisau analisis dan rujukan serta memperkuat argument dalam menganalisis data, Adapun tekhnik pengumpulan data dengan melakukan observasi, wawancara dan dokumentasi pada beberapa pengguna aplikasi dating dilingkungan kerja aparatur sipil negera Disdukcapil Kota Bandar Lampung.

Abstract

Family law has an essential role in ensuring the stability and well-being of society. Conceptually and praxis show that family law has excellent complexity in responding to family problems that continue to develop along with the massive cultural transformation in society. This study aims to identify and evaluate two decades of family law research in Southeast Asia. This study not only uses bibliometric analysis but also utilizes VOSviewers software to visualize the network, trends, and characteristics of family law research in Southeast Asian countries in two decades based on the publication of articles in the Scopus database. Of the 427 published family law research documents in Southeast Asian countries over two decades, Indonesia, Malaysia, and Singapore contributed the most research based on the subject areas of social sciences and arts humanities. However, these studies have been unable to intervene and overcome the problems that arise in marriage, divorce, child custody, and inheritance, which still have the potential to raise various kinds of misconceptions ideologically and praxis. This study also recommends the importance of future studies to analyze the factors and implications of ideological and practical family law misconceptions for family welfare in the future.

Abstract

The semanda lekok marriage tradition among the Lampung Sai Batin people results in the wife dominating the husband, particularly in terms of control over marital property. This dominance is a consequence of the semanda marriage, in which wedding expenses and living costs are borne by the wife’s family, and after which the husband lives with the wife’s family. This study aims to analyze the forms of wife’s dominance over the husband in the semanda marriage, the reasons why the Lampung Sai Batin indigenous people maintain the semanda lekok marriage, and the contribution of this tradition to the development of Islamic family law. The study used a qualitative method with an empirical approach. Data came from the primary and secondary data sources. The data were collected by means of interview. The respondents consisted of the husbands in semanda lekok marriages, customary leaders, and religious leaders in Pekon Bakhu, Batu Ketulis Subdistrict, West Lampung. The data analysis involved the theories of Maqāṣid al-Sharī’ah and gender justice. The findings reveal that the forms of wife’s dominance include the husband being severed from his nasab (lineage) and inheritance rights from his parents, the husband not being entitled to joint earnings, and inherited property being granted to the eldest son. However, there has been a shift in values in the practice of semanda inheritance law; when the wife dies and the couple has no children, the husband receives a share of the inheritance. The reason for maintaining this marriage system is to continue the lineage of the wife’s family as her parents do not have a son and the wife is the only child, as well as the wife’s family has the economic ability and is a solution for prospective husbands who cannot afford the marriage. Nevertheless, the tradition of denying joint property distribution is contrary to the Maqāṣid al-Sharī’ah and gender justice. Therefore, it is important to adapt and negotiate in implementing the semanda lekok marriage to maintain the objectives of sharia and the values of gender justice.

Abstract

This research aims to analyze Yusuf Al-Qardhawi's views on ihdad and the implementation of career women's leave rights due to the death of their husbands and their relevance to contemporary Islamic family law. This research is a field research study. The informant consisted of the General Manager of the Chandra Supertore Bandar Lampung company, qualitative analysis. Research findings show that Yusuf al Qardhawi is of the view that women who are in ihdad may carry out their professions outside the home, limited to professions permitted by religion, maintaining religious ethics, whether in clothing, walking, talking, avoiding making up, wearing perfume, interacting with the opposite sex. This ability protects the benefit and survival of the family, as is the concept of Maqashid al Syari'ah to protect the soul, religion, mind, lineage, and property. Career women's leave rights due to the death of their husbands are only two days in employment law. However, in its implementation at the Chandra Superstore company, career women generally take one week off. They consist of the right to 2 days of leave plus permission from the company for two days, plus exchanging work schedules with colleagues in the profession. The company still requires its employees to look attractive according to the Company's SOP. Implementing this left-right is still very far from being different from the head criteria in Islamic family law.

Abstract

Kebijakan batas usia perkawinan menjadi isu penting dalam hukum keluarga Islam di banyak negara Muslim. Pernikahan dianggap sebagai institusi sosial dan agama untuk membangun rumah tangga dan menjaga nilai-nilai moral Islam. Namun, batas usia perkawinan sering menjadi perdebatan karena setiap negara Muslim memiliki regulasi yang berbeda, dipengaruhi oleh tradisi lokal, interpretasi hukum Islam, dan hukum internasional. Penelitian ini bertujuan untuk: (1) Mengetahui regulasi batas usia perkawinan di negara-negara Muslim beserta dasar hukum yang mendasarinya; (2) Mengidentifikasi faktor-faktor yang mempengaruhi perbedaan implementasi regulasi tersebut. Metode penelitian yang digunakan adalah penelitian pustaka dengan pendekatan kualitatif deskriptif, dan teknik pengumpulan data melalui dokumentasi. Sumber data yang digunakan adalah berbagai literatur yang membahas topik penelitian, dengan analisis deskriptif dan analisis konten teori Klaus Krippendorff. Hasil penelitian menunjukkan bahwa regulasi batas usia perkawinan di negara-negara Muslim seperti Indonesia, Malaysia, dan Mesir memiliki ketentuan yang berbeda. Di Indonesia, usia minimal untuk menikah adalah 19 tahun berdasarkan UU No. 16 Tahun 2019. Di Malaysia, usia minimal untuk perempuan adalah 16 tahun dan laki-laki 18 tahun berdasarkan Hukum Keluarga Islam Malaysia. Sementara di Mesir, batas usia pernikahan adalah 18 tahun menurut Undang-Undang Keluarga Mesir No. 1 Tahun 2000. Implementasi regulasi ini dipengaruhi oleh faktor budaya, agama, sistem hukum, ekonomi, dan pendidikan. Meskipun regulasi menetapkan batas usia minimal yang lebih tinggi, budaya dan tradisi lokal sering mendorong pernikahan dini, terutama di beberapa wilayah.

Abstract

This study aims to analyze the implementation of the role of the Bandar Lampung City Election Commission (KPU) in conducting political education for first-time voters in accordance with the Regulation of the General Election Commission Article 10 Paragraph 1B during the 2024 Bandar Lampung Mayor Election. Using the perspective of Fiqh Siyasah, the study identifies various supporting factors, such as the support of educational institutions and the enthusiasm of young voters, as well as obstacles, including budget constraints and low political awareness. The results indicate that optimizing political education programs through adequate budget allocation, the use of digital technology, and strategic collaboration with various stakeholders are effective steps to enhance the political participation of the younger generation.

Abstract

BUMDes as a source of Village Original Income is a business entity managed by a group of people who are entrusted by the Village Council to improve the village economy and explore its potential systematically for mutual benefit. Village-Owned Business Entities aim to optimize the economy of village residents by building villages and business entities. The purpose of this research is to identify how Article 87 of the BUMDes Law can be utilized to optimize the village economy. The formulation of the problem in this research is the position of the Sadar Sriwijaya Village Government in implementing Article 87 of the BUMDes Law to optimize the village economy, and the use of Fiqh Siyasah analysis in this regard. This research uses a qualitative descriptive method in the field, with information collection through observation, interviews, and recording. Based on the results of the study, the economy of Sadar Sriwijaya Village has been running well, but has not been running optimally due to limited business capital and less than optimal dependence on PAD. In other words, there has been no business development cooperation between BUMDes and villagers.

Abstract

The implementation of the Ministerial Regulation plays a crucial role in enhancing the effectiveness of the Karang Taruna organization, in accordance with the Regulation of the Minister of Social Affairs Number 25 of 2019. This study aims to analyze the role of youth organization or Karang Taruna in Cempaka Barat Village, particularly in relation to Article 6 of Permensos 25/2019, from the perspective of Fiqh Siyasah Tanfidziyyah. The research employs a field study approach using a case study of the local Karang Taruna organization. The findings indicate that while Karang Taruna has made efforts to optimize its role, it continues to face challenges, including limited funding and the absence of many members due to work or study commitments outside the region. The principles of Fiqh Siyasah Tanfidziyyah have been found to be highly relevant in improving organizational effectiveness. This study underscores the importance of adaptive policies to support the role of Karang Taruna in promoting social development within village communities.

Abstract

This study aims to explore the form of the absence of reciprocal or mutuality values that lead wives to file for a divorce, the factors causing the non-implementation of reciprocal values in financial support, and strategies for family strengthening. This research is a qualitative descriptive study based on the increasing trend of divorce cases filed by wives. Data was gathered from online news about the trend of divorce lawsuits triggered by either the wife's or husband's failure to apply reciprocal values.   Interviews were conducted with maslahah family counselors, heads of religious affairs office, female scholars, academics, and judges of religious courts about the reasons wives file for divorce and efforts to strengthen families. Analysis was done qualitatively using the theories of mublà and social adaptation. The findings indicate that the absence of reciprocal values is triggered by gender-biased understanding dominating classical scholars' mindsets, which rely on patriarchal ethics and greatly favour men. This gender bias is implemented in Indonesian marriage regulations and becomes ingrained in the subconscious of society. Consequently, the obligation of financial support is seen as an absolute duty of the husband, without considering specific circumstances such as illness, disability or imprisonment, which may prevent the husband from fulfilling his obligations. On the other hand, when a husband cannot provide financial support, he is also unwilling to share domestic responsibilities, causing the wife to bear a double burden. As a result, conflicts and violence often occur. Therefore, there is a need to reinterpret the concept of financial support by following the messages of the Quran and the dynamics of modern society, implementing reciprocal values, and adapting roles. Socialising reciprocal values to all elements of society through relevant institutions and social media is essential for realising family strengthening.
